Fire crews are actively responding to two grass fires in Graham County. Both are mostly contained.

Mickie Helberg, Graham County EMS director and emergency manager, said the fires are south of the Hill City fairgrounds, and the other is further south of L road and U.S. Highway 283.

Helberg said both are about 80% to 85% contained. No structures have been burned, and no injuries have been reported.

Crews are continuing to secure fire lines amid windy conditions. About 18 Graham County trucks are currently deployed.

The public is advised to avoid the areas.

Local dispatch also called fire crews to Lincoln and Pioneer Roads to a large grass fire in Russell County at about 12:20 p.m. today. Further details are pending.&nbsp;

I-70 closed in both directions between Goodland, Colby

Hays is under both a high wind and red flag warning today, according to the National Weather Service.

The high wind warning is in effect until 6 p.m. today for&nbsp;Trego, Ellis, Scott, Lane, Ness, Rush, Hamilton, Kearny, Finney, Hodgeman, Pawnee, Stafford, Gray, Ford and Edwards counties.

Northwest winds are expected to be 30 to 40 mph with gusts up to 65 mph.

Damaging winds will blow down trees and power lines.
  Widespread power outages are expected. Travel will be difficult,
  especially for high-profile vehicles.&nbsp;

Remain in the lower levels of your home during the windstorm, and avoid windows. Watch for falling debris and tree limbs. Use caution if you must drive, the National Weather Service advises.

The red flag warning is also in effect until 6 p.m. today.

The combination of strong winds and low afternoon relative humidity will result in critical wildfire danger today across southwest and central Kansas, according to the National Weather Service.

Relative humidity may be as low as 15%.&nbsp;Any fire that develops will catch and spread
  quickly. Outdoor burning is not recommended, the National Weather Service said.

The high in Hays today is forecast at 49 degrees. The weekend forecast is for highs in the lower 50s and sunny. Winds should diminish.

Ellis County Fire Chief Darin Myers recalled leading firefighters during a wildfire that ultimately burned about 163,000 acres across northwestern Kansas.

"It was a long three days and very consuming for our resources throughout all of Ellis County. ... We were out there almost 12 to 15 hours for the most part every day," Myers said.

Dec. 15, 2021, was the start of the Four County Fire that destroyed dozens of homes and claimed two lives, including one in Ellis County, Myers said. <a href="https://hayspost.com/posts/244e646d-1963-4b42-bcf5-c85c78f9b5bb">The windstorm and wildfires caused more than $2.3 million in damage</a>.&nbsp;

Myers said 27 structures in Ellis County, including homes, barns and sheds, were damaged or destroyed. The fire left widespread destruction across Russell, Rooks and Osborne counties as well. 

Myers said more than 40,000 acres burned in Ellis County alone.

"It was very devastating. A lot of memories, one of those career-type events that you hope never happens again," Myers said.

<a href="https://hayspost.com/posts/24e11ab6-f29c-4355-91e5-47e7511a74ce">Ellis County faced dozens of fires, with three major blazes driving the response.</a> One burned about 100 hay bales northeast of Hays, another started south of Riga and moved toward the city of Ellis, and a third began near the Cedar Bluff feedlot in Trego County before moving toward the Grants Villa area.

Fires near Hays destroyed at least eight homes. Myers said that loss, along with the lives taken, was emotionally difficult for him to process in the immediate aftermath.

"People losing their homes was tough. Knowing that we couldn't do anything to help them was tough. One individual who was lost until he was found, it weighed heavily on me a lot. ... When his family and kids came in, that was tough," he said.

Fire crews began evacuating the western edge of the city of Ellis as the blaze advanced to within about a mile of the town. Despite 100 mph winds, zero visibility and flames reaching up to 50 feet, shifting weather conditions later allowed responders to gain the upper hand that day.

Cattle losses were widespread across affected counties, with some ranchers losing most of their herds. As fire chief, Myers focused on strategic coordination and ensuring exhausted crews were cared for.

The county fire department worked alongside other local agencies, with resources stretched thin. Wildland Task Force, the National Guard and state emergency management assisted in the following days, Myers said.

🎙 Ellis County Fire Chief reflects on Four County Fire four years later

The Hays USD 489 school board discussed the increasing responsibilities for the school resource officer at its meeting on Monday.

Hays Police Department resource officer Austin Spencer<a href="https://hayspost.com/posts/18ea67f1-ebbb-4724-8255-f5e086cfd7ae">&nbsp;was hired as the district school resource officer in 2023. He works under a memorandum of understanding between the school district and the Hays Police Department.</a>

<a href="https://hayspost.com/posts/4d8f0a7f-c22c-4d18-8223-e9589f05ad06">The school district and the city of Hays split the cost, with the school district paying 70 percent and the city paying 30 percent.</a>

Board members expressed concerns about the amount of work Spencer will have when the high school and middle school are both on the same campus on 13th Street starting in January.

Hays Middle School staff will begin moving into the renovated former high school this week, with classes beginning in their new home on Jan. 7.

Hays High School has about 1,100 students, and the middle school has about 650 students.&nbsp;

Spencer said he already covers both schools under his memorandum of understanding with the school district.&nbsp;

To date, he has spent part of one day per week at the middle school and has traveled to the school at the administration's request.

Spencer said he thought having both schools on one campus would make his job more manageable. He said he will be able to spend more time at the middle school because of its proximity to the high school.

He said even walking or running to respond to an incident will always be a quicker response compared to driving across town.

However, several board members expressed concern about Spencer's workload, given the sheer number of students and teachers who will be occupying the combined campus.

For budgeting purposes, board member Ruth Ruder asked whether Spencer thought he would need the assistance of an additional officer to cover the expanded campus.

Spencer said it's a big campus, but he thought he could get anywhere on campus in good time.

Ruder said, "At the end of this next semester, with the campus being full, I would like an updated report."

She said she wanted to know if Spencer ever felt overwhelmed.

"Your job is very, very important to the district," she said. "It is to me."

Board member Jayme Goetz said, "I am a little concerned number-wise because it looks like we are saying you only have to manage two schools. A ratio of 1 to 2 doesn't sound too intimidating, but to me it's really a ratio of 1 to 2,000."

She said she has not heard any concerns. She has only heard praises about Spencer's work thus far.

"My concern is when we have 2,000 students in a very tight area, is one SRO going to be enough?" she asked. "Do we need to be allocating money for that support?"

Hays Police Chief Don Scheibler also attended the meeting.

"I'm like you," he said. "I am a little concerned when we get that many people on that big of a campus."

He also thought a review of the campus's security at the end of the spring semester would be advisable.

"I could see the need. I think Mr. Albers [Hays Middle School principal] would take an SRO for his school," Scheibler said. "We would have to sit down and talk about that."

Spencer said he worked with staff and contractors during the first few weeks of the fall semester to ensure all entrances at the new high school were secure. They also observed and tweaked traffic flow for the new school.

"It went pretty smoothly from my perspective," he said. "I was able to get back fairly quickly into my regular security checks and presentations in classes."

Spencer said more fine-tuning of the traffic flow will be needed as the middle school moves into the former high school in January.

The middle school start and release times will be staggered by 10 minutes compared to the high school. Pick-up and drop-off for the middle school will be in the former Hays High student parking lot on the west side of the school.

The elementary schools participate in an Adopt-A-Cop program that assigns Hays Police officers to schools in the district. The officers stop at the schools randomly to interact with the children. Teachers can also call those officers to give class presentations.

Board member Allen Park asked if DARE was still offered in district schools. Scheibler said no.

He works under a memorandum of understanding between the school district and the Hays Police Department.</a><a href="https://hayspost.com/posts/4d8f0a7f-c22c-4d18-8223-e9589f05ad06">The school district and the city of Hays split the cost, with the school district paying 70 percent and the city paying 30 percent.</a>Board members expressed concerns about the amount of work Spencer will have when the high school and middle school are both on the same campus on 13th Street starting in January.Hays Middle School staff will begin moving into the renovated former high school this week, with classes beginning in their new home on Jan. 7.Hays High School has about 1,100 students, and the middle school has about 650 students.&nbsp;Spencer said he already covers both schools under his memorandum of understanding with the school district.&nbsp;To date, he has spent part of one day per week at the middle school and has traveled to the school at the administration's request.Spencer said he thought having both schools on one campus would make his job more manageable. He said he will be able to spend more time at the middle school because of its proximity to the high school.He said even walking or running to respond to an incident will always be a quicker response compared to driving across town.However, several board members expressed concern about Spencer's workload, given the sheer number of students and teachers who will be occupying the combined campus.For budgeting purposes, board member Ruth Ruder asked whether Spencer thought he would need the assistance of an additional officer to cover the expanded campus.Spencer said it's a big campus, but he thought he could get anywhere on campus in good time.Ruder said, "At the end of this next semester, with the campus being full, I would like an updated report."She said she wanted to know if Spencer ever felt overwhelmed."Your job is very, very important to the district," she said. "It is to me."Board member Jayme Goetz said, "I am a little concerned number-wise because it looks like we are saying you only have to manage two schools. A ratio of 1 to 2 doesn't sound too intimidating, but to me it's really a ratio of 1 to 2,000."She said she has not heard any concerns. She has only heard praises about Spencer's work thus far."My concern is when we have 2,000 students in a very tight area, is one SRO going to be enough?" she asked. "Do we need to be allocating money for that support?"Hays Police Chief Don Scheibler also attended the meeting."I'm like you," he said. "I am a little concerned when we get that many people on that big of a campus."He also thought a review of the campus's security at the end of the spring semester would be advisable."I could see the need. I think Mr. Albers [Hays Middle School principal] would take an SRO for his school," Scheibler said. "We would have to sit down and talk about that."Spencer said he worked with staff and contractors during the first few weeks of the fall semester to ensure all entrances at the new high school were secure. They also observed and tweaked traffic flow for the new school."It went pretty smoothly from my perspective," he said. "I was able to get back fairly quickly into my regular security checks and presentations in classes."Spencer said more fine-tuning of the traffic flow will be needed as the middle school moves into the former high school in January.The middle school start and release times will be staggered by 10 minutes compared to the high school. Pick-up and drop-off for the middle school will be in the former Hays High student parking lot on the west side of the school.The elementary schools participate in an Adopt-A-Cop program that assigns Hays Police officers to schools in the district. The officers stop at the schools randomly to interact with the children. Teachers can also call those officers to give class presentations.Board member Allen Park asked if DARE was still offered in district schools. Scheibler said no.

 For the past three years, Rooks County Historical Museum has invited the public to welcome regional singers and poets to celebrate an old-fashion Christmas.

This year Zerf, Betty Burlingham, and Museum Coordinator Rick Gianni performed. To enjoy stunning tree displays, homemade snacks, auction donations, and performances, folks need to make this a red-letter calendar day every year.

In small gatherings, audiences often know performers. It was almost old home week as these three recognized friends and supporters who welcomed their personal stories. 

Zerf shared how he became a cowboy singer. Like many western Kansans, he migrated to California for a spell. Playing in a band and seeking musical inspiration led him to the Burbank Public Library where he struck paydirt with WPA song collections from each state--oldies our great-greats sang during settlement years. Recognizing treasure, he copied them for his personal collection, initiating the question, “What will I do with these?”

The answer emerged as a singing cowboy persona allowing him to channel lyrics written by long dead musicians. Those folksy tunes present listeners with a peek at ancestors’ challenges. One ditty relayed they had “no corn, cabbage, potatoes, or tomatoes.” It makes you wonder if they ate anything that dry year besides dust.

In addition to singing other’s songs, Zerf writes original tunes that invite audiences to time travel to Wild West towns like Sheridan and Ellsworth where memorable characters often end up buried in Boot Hill. Another about the ladder of rivers and streams reminds listeners that some of those tales are “So lost, we’ve forgotten the cost.” 

Adding more sad sagas, he sang the traditional “Little Joe the Wrangler” and a caballero-inspired piece in Spanish about another young cowboy gone too soon. I could listen all day to learn Kansas history from this regional troubadour.

To lighten matters, Betty Burlingham confessed she started life as a science nerd turned molecular biologist before marrying a rancher/professor and recreating herself as an award-winning cowboy poet.

 While she may no longer study life under a microscope or in a test tube, her poetry reveals that humor drives her daily observations. Verses about her husband’s proposal warmed our chucklers up so we could outright guffaw when she energetically recited “Special Delivery” about the night her water broke before she and hubs picked up new bulls and ground feed for them before heading to the hospital for their own delivery. 

She kept the audience in stitches with stories of cursers and crooners in “Yelling at Cows” and a graphic “Cowgirl’s Revenge” recitation. Her insights about humans, animals, and nature make fine use of her scientific method training.

Museum coordinator Rick Gianni, an Italian descendent from Indiana who knows his pasta, is a rootin' tooti'n cowboy poet with quirky twists to regional humor. 

Keeping laughs rolling, he contributed rhymes about a cowboy sent to shop for his spouse’s lingerie. Who knew a fella could use his hat size to buy the correct support garment. He followed that with a clever poem about one-upping a cocky relative. 

Like every good cowboy poet, he makes folks laugh and cry. The audience headed home wiping tears, thinking about lessons Smitty and Badger shared.

Heads up! Put Rooks County Historical Society and Museum’s Cowboy Christmas on next year’s calendar. Those prairie troubadours and poets will have you laughing and crying 'til it’s hard to see the best Christmas tree display ever.

Three-day weather outlook

Development by Heart of America Development Corporation of the Tallgrass 4th Addition in east Hays is moving forward with the next step: awarding a bid for street, storm sewer, water, and sanitary sewer improvements to 101 lots in the area.&nbsp;

Hess Services, Hays, was the low bidder&nbsp;at $4 million.&nbsp;

Hays city commissioners will review the recommended bid award at their work session on Thursday afternoon, along with a construction inspection contract agreement with Sloan Engineering and Consulting, Hays, for $196,000.

Platting and zoning of the proposed development was completed in early 2025. The housing project is planned for one phase, beginning in March 2026.&nbsp;

Four other agenda items are related to development of city-owned property at Interstate 70, Exit 161, for commercial business and housing.

Jesse Rohr, public works director, will present requests to annex the 90-acres and rezone the property from agriculture to commercial general district.

A rezoning request and annexation for 2200 Commerce Parkway, the city's tree farm on the south side of the interstate, will also be presented.

 The city is proposing the requested zoning change to make it available for development. Installation of utilities is planned for 2026.

The property was originally a rest stop location for I-70. When the exit ramps for Commerce Parkway were installed in 1995, and the rest stop was removed, the land was deeded over to the city of Hays.

 Since then, it has been the Parks Department's tree farm. Assistant City Manager Jarrrod Kuckelman said the tree farm would be relocated if development occurs.

All items will be considered for a vote at next week's meeting on Tuesday, Dec. 23, due to the Christmas holiday.&nbsp;

Sen. Barb Wasinger on property taxes

Rep. Barb Wasinger, R-Hays, will speak with the commission about state and local property taxes at the beginning of the work session.&nbsp;

Hays City Commission to look at furthering Tallgrass 4th Addition, I-70 Exit 161

The Ellis County Commission reviewed documents to establish a community improvement district at Stonewood Estates North Addition during Tuesday's meeting.

Homeowners are seeking to establish an improvement district to fund road improvements within their subdivision and extend those improvements to 270th Avenue.

No vote was taken to approve a drafted petition as the commission works to establish consistent criteria for future improvement district projects.

"We need to have some kind of minimum standard regarding years of maintenance and more," Commissioner Michael Berges said.

Darin Myers, county administrator, recapped commission discussions on establishing minimum standards, including maintenance expectations over 10 years and how those standards may vary by road type, potentially requiring a higher signature threshold than the statutory minimum, and the county avoiding upfront costs that could divert resources from other projects.

Dominic Eck of Gillmore &amp; Bell said the county may set a higher signature requirement if it chooses, rather than the statutory minimum of 55%.

Commissioners also discussed with Eck the details of signatures for jointly owned properties and trusts, as well as which payments may be accepted and bond proceeds.

Larry Cleveland with Ransom Financial said there would be a 10-year bond for Stonewood Estates North Addition, with an assessment of about $80 per month, including interest and fees.&nbsp;

The commission approved a resolution authorizing the Public Building Commission to begin the bonding process to finance several major county building projects.

Throughout 2025, the commission reviewed proposed projects, their costs and financing options. Preliminary estimates total about $10.78 million. The commission set a $11 million bond cap to allow for flexibility and account for other fees.

The projects include a remodel of the law enforcement center, replacement of the courthouse and administrative building HVAC system, and a fire storage building at Public Works.&nbsp;

Ellis County Public Works was approved to purchase an 8-foot culvert to replace a county bridge on Saline River Road. Brendan Mackay, public works director, recommends accepting a bid of about $34,200 from Wellborn Sales, the lowest-cost option.

The commission accepted a donation of about $1,250 from Buckeye Wind Energy to the Ellis County Fire Department to reimburse project costs in Schoenchen, including radio installation and building modifications.

Ellis County’s Noxious Weed Department received approval to purchase a 2026 tractor and a mounted boom mower.&nbsp;&nbsp;

Affected counties include&nbsp;Trego, Ellis, Scott, Lane, Ness, Rush, Hamilton, Kearny, Finney, Hodgeman, Pawnee, Stafford, Gray, Ford and Edwards.

Northwest winds 30 to 40 mph with gusts up to 60 mph are possible.

Areas of blowing dust are likely. Please exercise caution when driving past open fields, as visibility could quickly fall to one-half mile or less over very short distances.

The National Weather Service advises that loose objects should be fastened or secured in a safe location before the onset of winds.

Winds today could gust to 33 mph with a high forecast of 61.

The forecast high for Hays on Thursday is 49.

High wind watch in effect for Hays on Thursday

A GoFundMe has been established for the family of the man killed in a semi-truck accident on Interstate 70 on Sunday.

Julio Caesar Villarreal, 37, WaKeeney, was killed when he was&nbsp;loading a disabled vehicle onto a trailer pulled by a 1996 Ford F250 on the north shoulder of Interstate 70 near the 183 Bypass. 

The pickup was legally parked and towing a 2014 Eagle trailer, which was hauling a 2009 Chevy Tahoe. One pedestrian was attempting to strap down the vehicle on the side of the trailer closest to the roadway.

A westbound 2026 Freightliner semi driven by Alejandro Fuentes-Castro, 53, Wilmington, Delaware, failed to maintain his lane and struck&nbsp;Villarreal, who was on the roadway side of the vehicle.

Villarreal's friend posted on the GoFundMe page, “As Casey’s boss and friend, I am starting a GoFundMe for Casey Villarreal!&nbsp;With heavy hearts, we share the tragic loss of Ceaser Villarreal, who was taken from us far too soon, leaving behind Casey. GoFundMe created for WaKeeney man struck, killed on I-70 Sunday

That's how Hays City Manager Toby Dougherty sums up Monday's complicated legal arguments before the Kansas Supreme Court&nbsp;about whether Hays and Russell can transfer their water rights in Edwards County. 

WaterPACK, a group of agricultural irrigators, objects to the 90-mile pipeline project.

The R9 Ranch southwest of Kinsley was purchased in 1995 by Hays. The city of Russell bought an 18% interest in the R9 in 1996.

"We were very happy with the proceedings," Dougherty said. "We had prepared extensively for the oral argument and potential questions from the judges.

"I think Dan Buller (attorney for Hays and Russell) and Stephanie Kramer (Kansas Department of Agriculture attorney) were very adept in illustrating the key points in a very simplistic manner and reminding the justices that not only does WaterPACK lose on the merits of the case, but because of that, they don't even have standings to be bringing thise case forward."

Now it's just a waiting game until the Supreme Court issues its ruling, which Dougherty expects to be in a few months.&nbsp;

About 10 years ago, Hays and Rusell filed application to change their 32 water rights from irrigation to municipal use. The request was approved by Kansas Department of Agriculture chief engineer Earl Lewis.

Legal wrangling between WaterPACK (Water Protection Association of Central Kansas), the Edwards County Commission and the Edwards County Planning Commission, which&nbsp;<a href="https://hayspost.com/posts/72cef8d3-79bf-4085-b070-bccbdc589f9d">oppose the pipeline</a>,&nbsp; and Hays and Russell, has been underway for almost 11 years.&nbsp;&nbsp;

"We see no reason why the Supreme Court would overturn what a&nbsp;<a href="https://hayspost.com/posts/8d8e87f6-e3c9-4950-bcea-9cac40e269bd">judge has already resoundingly upheld</a>," Dougherty said <a href="https://hayspost.com/posts/92c6bbf2-25be-47de-ad1c-a2e44e17e420">when the oral argument date was first announced</a>.&nbsp;

WaterPACK's attorney, Charles Lee, argued Monday the cities would take too much water from Edwards County, ultimately lowering the aquifer level.

But, said Dougherty, "what they conveniently forget to bring up in their briefs...is they're causing way more lowering of the aquifer than we are."

The southwest corner of the R9 Ranch abuts some WaterPACK members.

"When WaterPack's own members looked at what would happen if we pumped every drop of available water from our property for 51 years, ... we would contribute 2.4 feet of decline in a 140-foot of saturated thickness,"&nbsp;Dougherty said.

"But their expert conveniently forgot to include that WaterPACK's members and the irrigators around us, would drop that aquifer by about 20 feet because of their utilization."

To protect the declining aquifer, Hays and Russell's regulatory consumptive use of their water rights in Edwards County is 83.7%, and the towns voluntarily agreed to drop their use another 30%.

"We cannot pump every drop of water available from the property from day one," Dougherty said. "It's not physically possible. We don't have the legal right to do it, and we're only building seven wells to start with."&nbsp;

Even taking all of WaterPACK's claims at face value, it does not demonstrate harm, Dougherty says, and he believes that's what the Supreme Court justices came away with.

"There is no harm that would result in impairment in the future. It just boils down to they don't like the project," he said.

Ellis County is the only county in Kansas with a population of more than 15,000 without an adequate local water supply.&nbsp;
