OSBORNE COUNTY —Investigators are working to determine the cause of train derailment in Downs, Kansas.

Early Thursday, a Kyle Railroad train passing through Downs derailed seven railcars carrying corn, according to Kyle Railroad spokesman Tom Ciuba.&nbsp;There were no injuries, and no hazardous materials were involved.&nbsp;

All railroad crossings that were blocked in town are now open.

TREGO COUNTY —One person died in an accident just after 8:30a.m. Thursday in Trego County.

The Kansas Highway Patrol reported 2011 Toyota 4-Runner driven by Deborah K&nbsp;Nagorka, 63, Glendale, Arizona, was westbound on Interstate 70 ten miles west of WaKeeney.

The driver lost control of the SUV when it struck a patch of ice. The vehicle enter the median, rolled across eastbound lanes of the Interstate and came to rest on its top in the south ditch.

Nagorka was pronounced dead at the scene. Eagle Med transported a passenger Anthony R&nbsp; Nagorka, 63, Glendale, Arizona, to Hays Medical Center. Both were properly restrained, according to the KHP.

The Kansas Highway Patrol reported a 2019 Isuzu passenger vehicle driven by Luz Camargo Garcia, 50, Denver, Colorado, was westbound traveling 50 mph on Interstate 70 two miles west of Kansas 212.

Woman hospitalized in Hays after rollover accident

Hays experienced a blizzard Wednesday, which led the Hays Police Department to respond to 36 disabled vehicles.

Hays Police Lt. Tim Greenwood reported officers also responded to three accidents. No injuries were reported.

Greenwood said most incidents happened on the town’s outskirts, including Commerce Parkway and 48th Street, due to poor visibility and slick roads.

According to the <a href="https://hayspost.com/posts/b82b4e2c-c40d-4afc-999f-fbbaa5fcf51b">K-State Agricultural Research Center</a>, the official measurement was a little more than 3 inches of snow.

Greenwood advises the public to avoid driving during severe weather or take precautions, as even emergency vehicles can get stuck.

"Have the proper vehicle, go extremely slow and have the lights on. We were even having emergency response vehicles and snow plows getting stuck," he said.

Police officers also worked alongside the Hays Fire Department, Ellis County EMS, Hays Public Works and the Ellis County Sheriff's Department.

A little more than three inches of snow was the official measurement from Wednesday's blizzard in Hays.

The report from the K-State Agricultural Research Center south of town noted it was a little difficult to measure the snow due to blowing and drifting.

Precipitation from the sleet and melted snow was 0.40 inches.

The 158 year cumulative average amount of precipitation by the end of March is 2.46 inches. Hays currently sits at 2.11 inches.

According to the weekly U.S. Drought Monitor for Kansas, Ellis County continues to remain in moderate drought. The extreme western portion of the county is slightly better with a rating of abnormally dry.&nbsp;

The measurements were made Tuesday morning, prior to Wednesday's blizzard.&nbsp;

HOUSE PASSES LEGISLATION TO CONTROL PROPERTY TAX INCREASES

TOPEKA — Even though it was passed out of the House chamber last week, by a final action vote of 115 to 6 and I voted yes, I would be remiss to not dedicate considerable space to House Bill (HB) 2396 to you, the constituents of House District 109. In response to growing concerns of rising property tax costs from across Kansas the House Committee on Taxation developed HB 2396, after considerable work and thought.

HB 2396 answers those concerns through several means. First is that it establishes a protest petition for voters in the event that property tax revenues, within the governing jurisdiction and current year, exceed past property tax revenues adjusted by the Consumer Price Index (CPI), for the Midwest Region as published by the Bureau of Labor Statistics. The protest petition would require signatures from 10 percent of the qualified voters in the governing jurisdiction and need to be filed within 30 days of the certification of the property tax revenue increase taking effect.

If those requirements were met the property tax in the jurisdiction would be reduced by the corresponding difference between the previous year and the current year, adusted by the forementioned CPI. Second is that the legislation creates the Acknowledging Stewardship of Tax Revenue and Appropriations (ASTRA) Fund. The fund would receive an initial transfer of $60 million from the State General Fund in Fiscal Year 2026 and then an ongoing transfer of the same amount compounded by two percent for future fiscal years.

The fund would be administered by the State Treasurer and its monies distributable to any county or city whose property tax revenues did not exceed the prior mentioned annual CPI adjusted increase. Apportionment of the distributable fund would be calculated by the State Treasurer, with 65 percent based on population and 35 percent on assessed property valuations; said apportionment would also be certified by the Director of Property Tax Valuation within the Department of Revenue. Funds would be administered to recipients by January 15 of each new calendar year.

School districts and the State of Kansas would be the only governing districts exempt under the bill. 

Lastly the bill would eliminate property tax neutral rate requirements and the Taxpayer Notification Costs Fund.

House Appropriations (HAPP) was busy again this week, as the session nears first adjournment. The committee held two informational hearings on important topics in the state and acted on several bills in committee.

On Tuesday, the committee first held a hearing on House Bill (HB) 2398, which would appropriate state general funds to create a master plan for renovating the Quindaro ruins into an archaeological park. Testimony, ranging from proponent to neutral, was provided by several individuals regarding the site’s history and the best means to renovate it. After that the committee received an informational briefing from the Department of Commerce regarding the STAR Bonds program and then an informational briefing from Kansas State University, Wichita State University, and the University of Kansas on projects in need of bonding, within the respective university campuses.

Wednesday saw HAPP hold both an informational hearing on HB 2402 and work Senate Bill (SB) 125. 

The informational hearing for HB 2402, creating a blue-ribbon commission on higher education and requiring new reports, had proponent and neutral testimony received testimony from both the Kansas Association of Community Colleges and the Kansas Board of Regents.

SB 125, Claims against the State, was amended into a trailer appropriations bill, in order to address recent agency concerns, and was passed out of committee after lengthy discussion.

The committee on Thursday worked HB 2237 and HB 2402. 

HB 2237, which increases the maximum limit on recruitment and retention bonuses for state agencies and requires new annual reporting, was passed out of committee with no changes.

HB 2402 was likewise passed out of committee.

Last week the Kansas House of Representatives worked 28 pieces of legislation. Below is a selection of four from that list of bills. 

First is House Bill (HB) 2111. This piece of legislation would increase the aggregate acreage enrollment limit in Kansas from 40,000 to 60,000 for Conservation Reservation Enhancement Programs (CREP), set the county enrollment limit for CREP at 25 percent of the state acreage cap and establish new CREP classifications for water conservation.

Second is Senate Bill (SB) 88. This bill would add new requirements in training for state long-term care ombudsmen, specifically towards memory care.

Third is HB 2329. This legislation would amend the Kansas Juvenile Justice Code’s sentencing alternatives, detention length limit, and placement matrix.

Fourth, and last, is Substitute for HB 2149; the bill would add new disclosure requirements for distributed energy retailers offering installation, require the Attorney General to revise disclosure standards, and establish standards and limitations for distributed energy systems connected to utility grids.

All of these bills passed, and I voted yes on each.

Second is that the legislation creates the Acknowledging Stewardship of Tax Revenue and Appropriations (ASTRA) Fund. The fund would receive an initial transfer of $60 million from the State General Fund in Fiscal Year 2026 and then an ongoing transfer of the same amount compounded by two percent for future fiscal years.The fund would be administered by the State Treasurer and its monies distributable to any county or city whose property tax revenues did not exceed the prior mentioned annual CPI adjusted increase. Apportionment of the distributable fund would be calculated by the State Treasurer, with 65 percent based on population and 35 percent on assessed property valuations; said apportionment would also be certified by the Director of Property Tax Valuation within the Department of Revenue. Funds would be administered to recipients by January 15 of each new calendar year.School districts and the State of Kansas would be the only governing districts exempt under the bill. Lastly the bill would eliminate property tax neutral rate requirements and the Taxpayer Notification Costs Fund.COMMITTEE HAPPENINGSHouse Appropriations (HAPP) was busy again this week, as the session nears first adjournment. The committee held two informational hearings on important topics in the state and acted on several bills in committee.On Tuesday, the committee first held a hearing on House Bill (HB) 2398, which would appropriate state general funds to create a master plan for renovating the Quindaro ruins into an archaeological park. Testimony, ranging from proponent to neutral, was provided by several individuals regarding the site’s history and the best means to renovate it. After that the committee received an informational briefing from the Department of Commerce regarding the STAR Bonds program and then an informational briefing from Kansas State University, Wichita State University, and the University of Kansas on projects in need of bonding, within the respective university campuses.Wednesday saw HAPP hold both an informational hearing on HB 2402 and work Senate Bill (SB) 125. The informational hearing for HB 2402, creating a blue-ribbon commission on higher education and requiring new reports, had proponent and neutral testimony received testimony from both the Kansas Association of Community Colleges and the Kansas Board of Regents. SB 125, Claims against the State, was amended into a trailer appropriations bill, in order to address recent agency concerns, and was passed out of committee after lengthy discussion.The committee on Thursday worked HB 2237 and HB 2402. HB 2237, which increases the maximum limit on recruitment and retention bonuses for state agencies and requires new annual reporting, was passed out of committee with no changes. HB 2402 was likewise passed out of committee.HOUSE DELIBERATIONS Last week the Kansas House of Representatives worked 28 pieces of legislation. Below is a selection of four from that list of bills. First is House Bill (HB) 2111. This piece of legislation would increase the aggregate acreage enrollment limit in Kansas from 40,000 to 60,000 for Conservation Reservation Enhancement Programs (CREP), set the county enrollment limit for CREP at 25 percent of the state acreage cap and establish new CREP classifications for water conservation. Second is Senate Bill (SB) 88. This bill would add new requirements in training for state long-term care ombudsmen, specifically towards memory care. Third is HB 2329. This legislation would amend the Kansas Juvenile Justice Code’s sentencing alternatives, detention length limit, and placement matrix. Fourth, and last, is Substitute for HB 2149; the bill would add new disclosure requirements for distributed energy retailers offering installation, require the Attorney General to revise disclosure standards, and establish standards and limitations for distributed energy systems connected to utility grids. A new organization is forming in Hays to amplify members' giving power.

100 Who Care is a giving circle that asks 100 local residents to donate $100 each. The members of the group gather to hear from three local nonprofits and then vote on their preferred cause.

The cause that earns the most votes receives a collective $10,000 donation from the group.

"We use the tagline of 'The Power of 100,'" Brandy Ridgway, local organizer, said. 

"If I were to give $100 to First Call for Help, they might be able to fill up a gas tank for their transient assistance program or maybe use that for a month of their loads of laundry program. But if me and 99 of my other friends give $100, that's $10,000," she said.

Members of the group then nominate three nonprofits to present at the next quarterly meeting of the 100 Who Care group.

Nonprofits that don't win a donation round can be nominated to present again for future donation rounds.

To qualify for donations, organizations have to be 501(c)3s or affiliated with a 501(c)3 non-profit.

"These are nonbudgeted dollars in the programs, which can make a big difference becuase this will be money that will not be used to just keep the lights on," Ridgway said. "This is money that can be used to advance a program or make a much bigger difference."

There are no qualifications to be a member of the group. You just have to agree to give $100 to the organization the group votes to support that quarter.

Payments are made directly to the selected nonprofit.

100 Who Care has about 350 chapters nationwide. The groups are 100% volunteer run. The chapters don't collect any money themselves. All the funds go directly to the nonprofits. Donations are tax deductible.

Most chapters meet and donate quarterly. Ridgway hopes to get the initial group to sign on for at least a year of giving.

She said she hopes to keep the meetings short—an hour or less.

Ridgway encountered a similar group in Great Bend.

"I said, 'I think this is fascitatic. I wish we could bring this to Hays,'" she said.

Barton County has 114 members and has given more than $250,000 since that group started seven years ago.

"Me, as an individual, I can give $100, but it doesn't stretch very far," she said. "It can have much more impact if me and 99 of my friends each give $100."

The organization started as 100 Women Who Care. It started with a woman who wanted to buy cribs for impoverished moms, but she could only give one crib. She didn't think that would make much of a difference.

There also now groups of 100 Men Who Care and 100 Teens Who Care.

The Ellis County group will be open to anyone. The nonprofits must provide services in Ellis County.

Ridgway is working with a Fort Hays State University Leadership 310 group to organize the group's first meeting. The group will eventually need a nominating committee of three or four people to help set up meetings.

The time commitment for volunteers is minimal, typically about an additional hour outside of the voting meetings every three months.

An informational meeting for the group will be at 6 p.m. April 15 in the meeting space at the Sternberg Museum in Hays.

Ridgway said she hopes to have the group's first voting meeting to award donations in July.

Youngsters showcase skills at Kiwanis Tri-Star Basketball Contest 

 As spring approaches and temperatures rise, the City of Hays Parks Department is taking a proactive approach to ready local parks for increased public use.

While some preparations are already underway, city officials note certain tasks cannot be completed until later in the season due to fluctuating temperatures.

“We strive to open as many facilities as possible as early as we can,” said Jeff Boyle, director of parks. “However, overnight freezes still pose a risk to our plumbing systems, and we want to ensure everything is in proper working order when our residents are ready to enjoy the outdoors.”

All park restrooms remain closed, with the exception of the heated restrooms at U.P. Park (located at 10th and Main).

According to Boyle, draining and disassembling restroom plumbing for winter is a meticulous process.

Reassembling the fixtures requires similarly intensive work, making it impractical to open and close facilities repeatedly each time there is a temperature drop.

Restrooms are typically opened by mid- to late April when the threat of freezing overnight temperatures diminishes.

Another frequent inquiry the department has received involves the city’s splash pad, which has been winterized to protect its pipes, tank and filters from damage.

Boyle explained that preparing the splash pad for public use can be time-consuming, and reopening it prematurely risks wasting labor, water and chemicals if weather patterns shift unexpectedly.

“We understand how eager families are to use the splash pad on warm days,” Boyle said. “But if we open too early, a cold snap could force us to drain and shut it down again, causing unnecessary expenses and delaying other park improvements.”

City officials anticipate having the splash pad ready in early to mid-May, once outdoor temperatures remain consistently above freezing.

Residents are encouraged to monitor the City of Hays website and social media channels for updates regarding restroom openings, splash pad availability and other seasonal amenities.

Hays begins preparing parks for warmer weather, increased use

Sunflower Electric Power Corporation is pleased to announce the construction of its newest renewable energy resource, the Sunflower Electric Solar @ Russell facility, is complete.

&nbsp;The commissioning process and initial synchronization to the electric grid are now underway, marking a significant step forward in Sunflower’s commitment to supplying reliable, cost-effective energy to its member utilities.

Commissioning a solar facility is a critical phase of the project. It ensures the solar photovoltaic (PV) system is installed correctly, safe, and ready for reliable operation. This process involves rigorous testing and inspections to confirm the system’s readiness to synchronize with the electric grid.

Located on 143 acres three miles east of Russell, the $36 million project was designed and constructed by <a href="https://www.depcompower.com/">DEPCOM Power</a>. The facility features 44,408 solar panels equipped with single-axis tracking technology designed to rotate throughout the day and continually face the sun for maximum efficiency and production.

Once fully operational, the facility is expected to generate nearly 50,000 megawatt hours annually, which accounts for about 1% of Sunflower’s total energy needs.

“Solar resources produce energy during the hottest days of the year when our system experiences its highest demand,” said Corey Linville, senior vice president and chief operations officer of generation at Sunflower. “Having generation resources that complement weather patterns boosts both reliability and affordability.” 

The Sunflower Electric Solar @ Russell facility not only capitalizes on the abundant solar resources in the region but also provides strategic benefits to Sunflower and its members. By interconnecting to the bulk electric grid near Russell, the facility reduces loading on a nearby transmission line nearing capacity, saving costs for Sunflower’s members by eliminating the need for expensive infrastructure upgrades. Additionally, the project provides a fixed-price hedge against market energy prices.

Ken Webre, director of project delivery at DEPCOM Power, shared his thoughts on the project: “DEPCOM Power is proud to partner with Sunflower on the development and construction of this state-of-the-art solar facility. The success of this project is a testament to our shared commitment to advancing energy solutions that are both efficient and cost-effective. We’re excited to see this facility begin delivering renewable energy to Kansas communities.”

The Russell solar project was developed by Sunflower in partnership with National Renewables Cooperative Organization (NRCO). They were also involved in the development of Sunflower’s first solar facility, the Johnson Corner Solar Project near Johnson City, Kan. Johnson Corner Solar is comparable in size to the Russell facility and has been operational since April 2020. The combined 40 megawatts (AC) of clean electricity produced by the two facilities is enough to power more than 8,400 homes across Sunflower’s service territory.

The Kansas Department of Transportation has reopened eastbound lanes of I-70 between the Colorado border and Oakley. Both directions remain closed between Salina and Oakley because of disabled vehicles blocking the roadway.

Several state highways have also reopened throughout northwest Kansas.

Western Cooperative electrical outage update

A resolution to set a public hearing date for establishing a Reinvestment Housing Incentive District in Tallgrass 2nd Addition, Phase 4, will be considered by Hays city commissioners during their work session Thursday.

The local developer, Heart of America, Ellis County, wants the district implemented on the 101 lots north of 22nd Street and east of Wheatland Avenue. It's the largest known housing development ever created in Hays.&nbsp;

Heart of America proposes the city finance and construct the district eligible items, and the city utilize district revenues to offset its costs. Heart of America would also provide a deposit equal to 30% of the projected infrastructure costs.

If the Reinvestment Housing Incentive District  is created, the fund would collect incremental property tax revenues for a maximum period of 25 years, an estimated $6.8 million.&nbsp;

The commission will also hear proposed updates to the 2024 city building code, which was last adopted in 2017 as well as a request for permission by the Downtown Hays Development Corporation to build a small storage building adjacent to the pavilion in the Union Pacific Plaza Park, a city park.

In light of the current drought and its projected continuation by the National Weather Service, a wellfield status update of the Smoky Hill River Wellfield will be presented by City Manager Toby Dougherty.

"The wellfield is used every day and is one of our main sources of water," said Jarrod Kuckelman, assistant city manager.&nbsp;
