HAYS, Kan. - The Fort Hays State volleyball team held serve with 3rd-ranked Nebraska-Kearney early on Tuesday evening, winning the first set before the undefeated Lopers rallied back to win the match in four, 27-25, 17-25, 22-25, 16-25. The Tigers' (9-5, 1-4 MIAA) first-set victory was just the third set UNK (17-0, 5-0 MIAA) has lost this season.

The Tigers came out on a mission in the first set, posting an attack percentage of .317 with 16 kills and three errors on 41 attempts. Fort Hays State jumped out to an early four-point lead before the Lopers rallied to tie the score at 12. The Tigers continued to lead until UNK scored three in a row to go in front, 18-17.

FHSU later trailed 21-18 before going on a 5-1 run to go back on top. A combo block from&nbsp;<a href="https://fhsuathletics.com/sports/womens-volleyball/roster/taytum-lovesee/7946">Taytum Lovesee</a>&nbsp;and&nbsp;<a href="https://fhsuathletics.com/sports/womens-volleyball/roster/claire-olson/7947">Claire Olson</a>&nbsp;tied the score at 22 before Lovesee teamed up with&nbsp;<a href="https://fhsuathletics.com/sports/womens-volleyball/roster/grace-schmedding/8180">Grace Schmedding</a>&nbsp;to give the Tigers the lead. The visitors answered by scoring the next two points to reach set point, but a kill from Olson kept the Tigers alive. The Black and Gold then scored three in a row on two Loper errors and a Schmedding kill to secure the set, 27-25.

After totaling five kills on six attempts in the first set, Olson duplicated that effort in the second frame, posting a swing rate of .833 through the first two sets (10-0-12). The teams went back-and-forth for much of the second frame that included 11 ties and six lead changes. Neither side led by more than two until a late Loper run turned a 16-16 tie into a 25-17 win.

Nebraska-Kearney tried to pull away in the third set, leading by as many as six, 21-15, before the home team came storming back. Back-to-back kills from&nbsp;<a href="https://fhsuathletics.com/sports/womens-volleyball/roster/gracie-rains/7948">Gracie Rains</a>&nbsp;helped FHSU close within two, but the Lopers punched back with two points to stretch the lead back to six. The Tigers then used a 5-1 run to close within two, including kills from Lovesee and Olson and a trio of blocks from a combination of Lovesee, Olson and Rains. After a Lovesee solo block trimmed the deficit to 24-22, the Lopers finished off the frame with a kill.

The Tigers jumped in front again in the fourth set, scoring six-straight points to go in front, 11-5. Olson opened the run with a kill before the FHSU front line of defense recorded three blocks over the next four rallies. Lovesee and Schmedding teamed up for two of the rejections, with Lovesee going up with Olson for the third. UNK answered back by scoring the next eight points, taking the lead for good before winning the frame, 25-16.Fort Hays State forced the Lopers into 27 errors, their most in a match in nearly two years (33 errors at NWMSU, 10/29/22). The Tigers finished the match with a swing rate of .185 (50-22-151), the second-highest attack rate recorded by a Loper opponent this season.

The Tiger defense teamed up for 15 total blocks, the most blocks by a team against the Lopers this year. Lovesee totaled 11 blocks, tying the program's rally scoring era record of total blocks in a four-set match and one off the single game record. The redshirt-freshman also chipped in six kills.

Olson finished the match without an error, posting an attack percentage of .500 with 13 kills on 26 attempts. ⛳ Oakley wins individual title, HHS 2nd at Great Bend Invite

EDMOND, Okla. - The Fort Hays State women's golf team placed 23rd at the Grace Shin Regional Preview, held this week (Oct. 7-8) at KickingBird Golf Course, a par-70, 5,905-yard layout.

The Tigers turned in a team score of 322 in round one, sitting in 22nd place, before shaving seven shots off that score with a second-round total of 315 for a tournament total of 637.

<a href="https://fhsuathletics.com/sports/womens-golf/roster/avery-blasi/8363">Avery Blasi</a>&nbsp;led the team with a two-round total of 12-over 152, finishing in a tie for 59th out of 120 competitors. The freshman posted a 9-over 79 in the first round before firing a round of 3-over 73 on Tuesday.

<a href="https://fhsuathletics.com/sports/womens-golf/roster/madison-kerr/8370">Madison Kerr</a>&nbsp;finished in a tie for 91st, firing rounds of 81 and 78 to finish at 19-over 159.&nbsp;<a href="https://fhsuathletics.com/sports/womens-golf/roster/kiley-maier/8371">Kiley Maier</a>&nbsp;was one shot behind her teammate, placing t-96th at 20-over 160. Maier led the team with a 6-over 76 on Monday before posting an 84 in round two. She led the team with three birdies on the week.

The Tigers will be back in action next week (Oct. 14-15) when they travel to Terradyne Country Club in Andover, Kan. for the Newman Invitational.

More than 230 deaths have been attributed to Hurricane Helene which made landfall in Florida on Sept. 26. The storm dumped more than 40 trillion gallons of rain across six states in less than a week, including nearly 31 inches in one North Carolina town. Even a week after the storm, still more than a million people were without power in the Carolinas and Georgia. Alli Conine, director of member services and corporate communication for Wheatland Electric, said a dozen Wheatland linemen from Kansas headed to South Carolina last Thursday to assist with restoration efforts.

"They had more than 100,000 members without power," Conine said. "Ninety-two percent of their system was down. It's a part of our seven cooperative principles: cooperation amongst cooperatives. We've sent crews for mutual aid before and we've also had assistance from crews in the past as well when we've had major storms."

Wheatland linemen can express interest in traveling out of state when mutual aid is needed, but a little strategy is involved in selecting which linemen will go.

"Obviously, we can't take an entire crew from one location so we just split it up," said Conine. "We sent crew members from Syracuse, Tribune, Leoti, Garden City, Great Bend, and Caldwell."

In all, Kansas electric cooperatives sent 16 crews east following the hurricane. On Sunday, Aiken Electric Cooperative in South Carolina, which handles 5,700 miles of power lines, reported that 40,000 members had power restored. Because the cooperative serves a rural area, each mile of line restored impacts an average of seven customers.

Linemen from Kan. respond to restore services after Hurricane Helene

KANSAS CITY, Mo. - Fort Hays State women's cross country junior&nbsp;<a href="https://fhsuathletics.com/sports/womens-cross-country/roster/emily-diercks/8438">Emily Diercks</a>&nbsp;has been named MIAA co-Athlete of the Week, announced Tuesday by the league office.

In her most recent competition, Diercks&nbsp;placed third in a field of 307 finishers at the sixth running of the Gans Creek Classic in Columbia, Mo. on September 27. The transfer completed the six-kilometer trek in 21:24.7, the fastest time among all DII runners in the field.

A native of Hoxie, Kan., Diercks passed nine runners over the final 2,000 meters to finish third, including running her best 1,000m split of 3:24.1 over the final 1K. Fort Hays State, now ranked No. 21 in the latest USTFCCCA National Coaches' Poll, placed first out of 26 schools with a team total of 40 points.

Diercks was also the top non-DI runner at her first race of the season, posting a time of 17:53.1 at the JK Gold Classic in Wichita, Kan. on September 7.The Tigers will return to the course Friday (Oct. 11) when they travel to Emporia, Kan. for the ESU Invitational. DOVER, Del. (AP) — A Delaware judge has refused to dismiss a defamation lawsuit against sports website Deadspin over an article accusing a 9-year-old NFL fan and his family of racism because of his game-day attire.

The lawsuit was filed by California residents Raul Armenta Jr. and his wife, Shannon, on behalf of themselves and their son, Holden, who attended a game between the Kansas City Chiefs and the Las Vegas Raiders last November.

According to the lawsuit, Holden, referred to in the lawsuit as “H.A.”, is a Chiefs fan who also loves his family’s Chumash-Indian heritage. He wore a Chiefs jersey to the game, with his face painted half-red and half-black, and a costume Native American headdress. Holden got the opportunity to pose with Raiders cheerleaders and was also shown briefly during the television broadcast of the game, with his red-and-black face paint visible. An Associated Press photographer also captured an image of Holden showing both sides of the boy’s painted face.

However, using a screenshot that showed only the side of Holden's face painted black, Deadspin writer Carron Phillips published an article the next day accusing the boy of being racist.

“The NFL needs to speak out against the Kansas City Chiefs fan in Black face, Native headdress,” the headline on the article reads. “They’re doubling up on the racism,” a subhead reads. “Are you going to say anything, Roger Goodell?” — a reference to the NFL commissioner.

In the article, Phillips wrote that the boy had “found a way to hate black people and the Native American at the same time.” He suggested that the boy had been taught “hatred” by his parents.

Deadspin posted the article on X, generating more than 18,000 comments and a “community note” clarifying its falsity. Phillips, described in the Armentas’ lawsuit as “someone who makes his livelihood through vicious race-baiting,” nevertheless doubled down.

“For the idiots in my mentions who are treating this as some harmless act because the other side of his face was painted red, I could make the argument that it makes it even worse,” Phillips wrote on X. “Y’all are the ones who hate Mexicans but wear sombreros on Cinco.”

The Armentas started receiving hateful messages and death threats, with one person threatening to kill Holden “with a wood chipper," according to the lawsuit. The Armentas say they made repeated demands for Deadspin to retract the article and apologize. In response, Deadspin instead republished an edited version that retained the accusations of racism and continued to display Holden’s picture. Deadspin later updated the article again, removing Holden’s picture and changing the headline to read, “The NFL Must Ban Native Headdress And Culturally Insensitive Face Paint in the Stands.”

“We regret any suggestion that we were attacking the fan or his family,” the article reads.

Unsatisfied with Deadspin’s updates instead of a formal apology and retraction, the Armentas sued for defamation.

On Monday, Superior Court Judge Sean Lugg denied Deadspin’s motion to dismiss the Armentas’ lawsuit, rejecting arguments that the article was opinion and thus protected from liability for defamation.

“Deadspin published an image of a child displaying his passionate fandom as a backdrop for its critique of the NFL’s diversity efforts and, in its description of the child, crossed the fine line protecting its speech from defamation claims,” the judge wrote.

“Having reviewed the complaint, the court concludes that Deadspin’s statements accusing H.A. of wearing black face and Native headdress ‘to hate black people and the Native American at the same time,’ and that he was taught this hatred by his parents, are provable false assertions of fact and are therefore actionable,” Lugg added.

Lugg also refused to dismiss the lawsuit based on Deadspin’s argument that it should have been filed in California, where the Armentas live, instead of Delaware, where Deadspin’s former parent company, G/O Media, is incorporated. One month after the Armentas filed their lawsuit, G/O Media sold the Deadspin website to Lineup Publishing, and the entire staff was laid off.

“Deadspin and Carron Phillips have never shown a morsel of remorse for using a 9-year-old boy as their political football,” Elizabeth Locke, an attorney for the Armentas, said in an email. “The Armenta family is looking forward to taking depositions and presenting this case to a jury at trial.”

A spokesperson for G/O Media said in an email that the company had no comment.

After high school Jack served his country and enlisted in the United
States Air Force and served during the Korean War era.&nbsp; After serving his country he worked for many
years for the telephone company as a telephone lineman.&nbsp; He met, fell in love and was united in
marriage to Ruth Ann Pierce on May 31, 1991, in Denton, Texas. He was a member
of the Church of Christ of Russell, American Legion Post #309 of Luray, Kansas,
and V.F.W. Post #6240 of Russell.&nbsp; Jack
enjoyed having a good time with his buddies at the American Legion and V.F.W.&nbsp; 

Surviving family include his
daughters Beverly K. Bickery and husband Bill of Bloomington, Illinois, Debra
S. Freeman of Tool, Texas and Laura Benander of Arizona; his son Jimmie Dean
Furst and wife Stella of Baytown, Texas, sister Darlene Smith of Hays, Kansas;
9 grandchildren and 13 great grandchildren.&nbsp;

their own tournament Monday at Smokey Hill Country Club, edging Concordia by
one shot. 

Jenna Brull paced four Monarchs who finished inside the top

Wasinger fired a 111 and tied for 12th. Ava Schumacher finished tied

The Indians finished with nine team points and tied with the host Panthers.

The Hays USD 489 school board approved a $30,200 contract with Mammoth to design tennis courts at Hays High School.

The current four tennis courts at HHS will be resurfaced, and four more courts will be built. Seating and a shade structure also will be added.

The current courts are in poor repair and are in the construction zone for the new Hays High School building.

HHS has about 80 players, a combination of girls and boys, out for tennis each year.

The boys' and girls' teams play on the Fort Hays State University courts, which cost about $3,300 per year.

Having eight courts would allow HHS to host tournaments, which it can't now. Board member Ruth Ruder said this could increase the community's revenue by attracting people to eat meals, buy gas and stay in hotels in Hays.

Board members Allen Park and Derek Yarmer said they wanted the district to seek bids for the design work.

Superintendent Ron Wilson said the district has worked with Mammoth before and has been pleased with its work. Mammoth is a Kansas company that specializes in sports projects.

He said the design bid was in line with what would be expected for this work. Wilson said he doubted that the district would save much in searching for other designers for the project.

Board member Jayme Goetz also expressed concerns about the project being delayed by searching for other companies to bid for the design work.

The design bid was approved 5-2, with Park and Yarmer voting against it.

Mammoth will develop the project's design specs, but the construction bids will be submitted to the school board for approval.

The board also approved a bid from Nex-Tech to purchase surveillance cameras and devices for the new high school at a cost of $379,000.&nbsp;

The bid is a one-time cost. Funds will come from bond money.

Nex-Tech was the only bidder on the project. The same system already exists in all other schools in the district.

Live views from the cameras will be available in the HHS office. The video will be kept on local servers for 90 days.

The bid also includes video doorbells for entrances at the school.

"We have done a really good job of upgrading our cameras over the last three years," Wilson said.

Chris Hipp, assistant superintendent of business services, said the district has had difficulty filing some classified nine-month positions, especially custodians and cooks.

On Monday night, the board voted to enter into a contract with ATS Facility Services to assist with recruiting classified staff.

ATS will recruit employees for the district at slightly higher pay but with a lesser benefits package.

The employees will be under the district's direction but will be paid and employed by ATS.

Hipp said the district still interviews and chooses which ATS candidates it would like to fill positions.

Hipp said the district's net cost is the same whether it employs the workers or ATS employs the workers.

Although ATS has worked successfully at other districts across the state, filling 12-month contract positions, this is their first time working with a district to fill nine-month positions.&nbsp;

However, Hipp said he was confident that the relationship could be beneficial, and he is hoping to work with ATS immediately to fill two cook positions that have been open for some time.

In other business, the board conducted its first readings on classified and administrator handbooks and heard an update from Doug Williams of Grow Hays.

Hays USD 489 school board approves design contract for tennis courts

KANSAS CITY, Mo. (AP) — Taylor Swift was back at Arrowhead Stadium on Monday night to see her boyfriend, Travis Kelce, and the Kansas City Chiefs play the New Orleans Saints after the pop superstar had missed the team's previous two games on the road.

SALINE COUNTY —The Salina Police Department has completed its investigation of an incident that occurred at South Middle School on September 6.

Police eported a 13-year-old was bench pressing in the school weight room. When the student finished the exercise the 39-year-old male teacher sat on him. 

Shortly thereafter, the student passed out and rolled off the bench striking his head on a portion of the bench resulting in a cut to his head.

Upon completing interviews of all those present during the incident, the case was forwarded to Salina Municipal Court who requested the case be reviewed by the Saline County Attorney’s Office.

The Saline County Attorney declined prosecution based on all witness statements indicating they did not feel it met the threshold for filing criminal charges.

The County Attorney determined based on the prevailing witness opinions, that most felt the incident was playful. Therefore they could not establish criminal intent.

SALINE COUNTY —USD 305 Salina is actively investigating a report of a student injury that occurred during class in a weight room within Salina Public Schools, according to a statement from the school district.

&nbsp;"The safety and well-being of our students remain our top priority. In accordance with district procedures, the teacher involved has been placed on administrative leave. We are committed to conducting a thorough review," the district wrote in a statement on the incident.

&nbsp;The student received medical care under the supervision of parents/guardians

Due to the investigation, USD 305 said it was unable to provide further details including the name of the teacher or the injury to the student.l.&nbsp;&nbsp;

No charges against Kan. teacher after student injured in weight room

A 16 year-old was killed in a rollover accident southwest of
Hays in the early morning hours Saturday.

In a press release Monday, Ellis County Sheriff Scott Braun said that the accident was reported at approximately 12:30 a.m. near 230th
Ave. and Spring Hill Rd.

Braun said the teen was one of four teenagers in the car
that left the roadway and rolled.

The unidentified 16-year-old was not wearing a seatbelt and
was pronounced dead at the scene, according to Braun.

A second passenger was transported to the emergency room,
treated and has been released.

"Alcohol was suspected to be Involved, but deputies
will await lab reports before issuing any further details,” Braun said.

Braun added, "It is with a heavy heart that I share the
tragic news of losing a teenager from our community in a devastating accident.
Our thoughts and prayers are with his family and friends."

Teen killed in Ellis County accident

SHAWNEE COUNTY —Authorities are investigating a fatal house fire in Topeka. Just after 6p.m. Sunday, crews from the Topeka Fire Department&nbsp; responded to a reported house fire at 1640 SW Buchanan Street, according to department spokesperson Rosie Nichols.

Firs responders found heavy smoke and flames coming from the two-story residence. Firefighters performed a search and found an individual on the second floor of the residence who was later pronounced deceased. 

Crews extinguished the fire. Investigators have not released the cause of the fire or the name of the victim.&nbsp; Check the Post for additional details as they become available.

Cause of deadly Kansas house fire under investigation

Tax filing season is still months away, but volunteers are now being sought in Hays for the <a href="https://www.aarp.org/aarp-foundation/get-involved/tax-aide/">AARP Foundation Tax-Aide program</a>.&nbsp;&nbsp;

Chuck Henry, Kansas Foundation state coordinator in Manhattan, said Tax-Aide focuses on serving older adults with low to moderate incomes and helping them secure much-needed tax refunds.

The service is free. Although the focus is on elderly taxpayers, anyone is welcome to have their taxes prepared, and there are no income limitations.

Volunteers are being recruited in Hays to provide tax preparation and filing services and tech support. The site will be the Hays Public Library, 1205 Main.&nbsp;

"Volunteers are trained, and classes are generally held in December or January," Henry said. "The amount of training required depends on the position."

Volunteers are IRS-certified every year, so they understand the latest changes and additions to the tax code. 

Several volunteer positions are available. They include an intake greeter who ensures the taxpayer's paperwork is in order. Another person prepares the tax return, which is then reviewed by a second, more knowledgeable volunteer to ensure its accuracy before it's filed.&nbsp;

At least three volunteers are needed at each site.&nbsp;

"Typically, an appointment at the AARP site will last an hour to 90 minutes," Henry said. "You'll get it prepared, reviewed, filed and a paper copy, and then you're on your way.

"Our Tax-Aide volunteers make sure they don't miss out on the credits and deductions they have earned and need."

Volunteers are able to prepare most federal and Kansas filing paperwork.

You don't necessarily need a financial background to be a Tax-Aide volunteer.&nbsp;

"All levels and types of experience are welcome," Henry said. "Volunteers come from a variety of job experiences and range from retirees to college students."

Keren, the comfort dog, is visiting Fort Hays State University to comfort and relieve students' stress with her warm, fluffy hugs just before their midterm exams.

Keren visits FHSU three times each semester. She will offer emotional support on Monday at the Memorial Union.

Lutheran Church Charities Top Dog, Carol Kratzer, oversees Keren's ministry work and said students tend to perform better on their tests after Keren's visits.

"Many students talk about how much better they do after they pet her. They are more focused and are able to recall information in tests," Kratzer said.

"Keren's calm, attentive and loving deminer brings people in," she said.

Keren is one of 130&nbsp;Lutheran Church Charities  K-9 comfort dogs who support those in need across 27 states. She has been based at Immanuel Lutheran Church in Ellsworth since 2021.

Keren is a 5-year-old purebred Golden Retriever who started training at 8 weeks old and knows more than 35 commands for her role. In her free time, she loves playing with her ball.

Kratzer said Keren can sense someone in emotional distress, even without the handler's awareness. On one occasion, Keren focused on an individual who revealed they had recently experienced a significant loss.

"Part of the reason [Lutheran Church Charities] chooses golden retrievers is their empathy. Keren has taken us to people who needed her that we didn't even know we would be visiting," she said.

While Keren has three sisters, she is the only&nbsp;Lutheran Church Charities comfort dog in Kansas. She travels throughout the state, providing comfort in schools, hospitals, nursing homes and disaster areas.

She has also provided support during personal tragedies, including the community of Independence, Missouri, after the death of <a href="https://www.facebook.com/share/p/JFh5eV2vx5TKdybL/">police officer Cody Allen</a> earlier this year.

"She has done a number of disaster responses here in the state. She has been to Natoma three times and was in Andover after the tornado," Kratzer said.

In addition to Kansas communities, Keren also visited Robb Elementary School in Uvalde, Texas, following the 2022 shooting.

Kratzer said there are misconceptions about Keren and her services due to her affiliation with a church.

"She belongs to a church organization, but we're not here to convert you. We're here to share mercy and compassion," she said.
