Dr. Jerod Grove has sued HaysMed in U.S. District Court to stop the hospital from enforcing a noncompete clause that he says prevents him from practicing medicine in western Kansas.

Grove, a general surgeon, resigned from the hospital on Nov. 12. HaysMed has employed him for nine years.

Grove has signed a contract with Greeley Health to practice at Tribune Medical Center in Tribune, Kansas.&nbsp;

The hospital administration indicated they were under a board directive to enforce Grove's noncompete clause, prohibiting him from practicing at Tribune Medical Center and most of western Kansas.

The noncompete stipulates Grove can't practice medicine within 110 miles of the city of Hays and within 30 miles in any direction from the city limits of any other city or town where the physician performs services on behalf of the hospital for two years.

Grove's attorney argues in the lawsuit the noncompete:

• Interferes with Grove's ability to make a living. • Constitues HaysMed operating a monopoly • Creates a health care access issue in western Kansas in which Grove is only one of 10 general surgeons in the region.

"... the prevention of Dr. Grove from providing his services in western Kansas is likely to significantly reduce access to medical care in western Kansas, and more specifically may cost someone their life," the lawsuit said.

Grove is seeking an injunction to allow him to continue practicing medicine in Tribune while the lawsuit is being resolved. He is also requesting unspecified damages to be determined at trial.

According to the lawsuit, during his time at Hays Med, "Dr. Grove began to notice certain troubling aspects of the treatment of HaysMed staff. Various issues were brought to his attention, and ultimately, he felt the best course of action was to resign his employment."

Grove attempted to resign in August. However, the HaysMed administration brought the noncompete clause of his contract to his attention. According to the lawsuit, Grove was told the hospital would file an injunction against him practicing in western Kansas if he resigned.

The lawsuit states, "His concern regarding rural access to critical services was ignored and disregarded."

Grove is not the first physician to leave HaysMed in recent years. According to the lawsuit, HaysMed has lost 12 physicians, two certified registered nurse anesthetists, and three midlevel providers. None of these have remained in the region and provide services to the residents of the state's western half.

Services impacts include cardiology, urology, orthopedics, OB/GYN, hospitalists, oncology, nephrology and general family medicine, the lawsuit said.

The Federal Trade Commission recently issued a final Non-Compete Rule banning most non-compete agreements between an employer and its workers. The commission said noncompete clauses were an unfair method of competition.

However, that rule was overturned by a U.S. District Court ruling in Texas, which said the&nbsp;Federal Trade Commission had no authority to make such a rule.

Grove's lawsuits cited several findings from the Federal Trade Commission specifically related to the harms that noncompete clauses can cause in health care, including:

•&nbsp; Hundreds of physicians and other commenters in the health care industry stated noncompetes negatively affect physicians’ ability to provide quality care and limit patient access to care. • Noncompetes increase retaliation if physicians object to the practices' operations, poor care or services. • Noncompetes limit access to care or patient choice.&nbsp; • Noncompetes resulted in physicians leaving the area and severing patient relationships, and this caused a loss of knowledge, trust and compatibility in physician-patient relationships.

HaysMed issued a written statement to the Hays Post via email Monday afternoon.

“We have received and reviewed Dr. Grove’s complaint. We disagree with his allegations and look forward to responding through the appropriate legal process.

Noncompete agreements are standard practice in health care and provide assurance to our patients that the hospital and its clinics have the medical staff and expertise to provide for their oftentimes complex medical needs.

HaysMed remains dedicated to providing specialty care for the residents of Hays and Western Kansas, just as we have for many decades.”

The case was filed on Nov. 12. No dates for hearings had been set as of this post.

Doctor files lawsuit against HaysMed, seeks to continue practicing in western Kansas

Carol Jean (Schuckman) Howell, 79, passed away
on Saturday, November 16th, 2024, at Via Christi Village in Hays,
Kansas.&nbsp; She was born November 6, 1945,
in Hays, Kansas, to Edwin and Isabella (Herrman) Schuckman.&nbsp; Carol was the oldest of 12 children, raised
in La Crosse, Kansas, where she attended parochial&nbsp; and high school. She married Jay Pfeiffer in
1962. There were two children born of that marriage, Alan and Lori. They later
divorced.&nbsp; 

She attended Fort Hays State University, Hays,
Kansas, and Oklahoma Panhandle State University, Goodwell, Oklahoma.&nbsp; Much of her life was spent living in Rush
County where she was very active in many volunteer organizations, including The
American Cancer Society, Band Mothers, &amp; Hospice.&nbsp; She was both a Cub Scout and Girl Scout
Leader.&nbsp; Carol was an excellent
seamstress, cook, gardener and an avid reader.&nbsp;
She loved being outside and working in her yard.&nbsp; Once her family grew and moved further away,
she enjoyed traveling to see them.&nbsp; She
LOVED the color purple, but mostly she loved her family and spending time with
them. She worked for Stromgren’s in Hays, Kansas, Security Title in Wichita,
Kansas, and the Rush County Memorial Hospital, La Crosse, Kansas.&nbsp; 

She is survived by her children, Alan Pfeiffer,
Broomfield, Colorado, and Lori (Chad) Folkerts, Rush Center, Kansas; two
grandchildren, James (Sara) Folkerts, Shawnee, Kansas, and Jenna (Chris) Reynolds,
Frisco, North Carolina;&nbsp; five great
grandchildren, Isabella, Everett &amp; William Folkerts, and Oliver &amp; Owen
Reynolds; three brothers, Rodney Schuckman, Ruben (Kerry) Schuckman, and Chad
(Nellie) Schuckman;&nbsp; six sisters, Velita
(Daryl) Larson, Marlene (Tom) Wasinger, Diona Patterson, Emily Hallam, Jennifer
Leapheart, and Germaine Barrows;&nbsp; sister
in law, Susan Schuckman; and many nieces and nephews.

She was preceded in death by her parents;
brothers, Bill &amp; Curtis Schuckman; one nephew; and three nieces.

She will be greatly missed by those she loved
and who loved her.

Carol Jean (Schuckman) Howell

Janet Sue (Bird) Kaba-Moss, 79, of Hoxie, Kansas, passed
away peacefully on November 14, 2024, following a brief illness. Janet was born
on May 15, 1945, in Hutchinson, Kansas, to John E. and Norma Jean (Hornbeck)
Bird.



After graduating from Plainville High School, Janet attended Fort Hays State
University for one year. She later settled in Hoxie, where she devoted 35 years
as the beloved school secretary of Hoxie High School, making a lasting impact
on generations of students.



On October 3, 1964, Janet married Kenneth Kaba at Sacred Heart Catholic Church
in Plainville, Kansas. Together, they had two sons, Douglas Paul and Steven
Frederick. In 2002, two years after Ken’s passing, Janet was blessed to
reconnect with her daughter, Wilinda Shaffer-Harmon, shortly thereafter. This
reunion became a source of immense joy, and Wilinda and her family were a
treasured part of Janet’s life ever since.



In 2005, Janet married Archie Moss at The First Christian Church in Hoxie. They
shared eight wonderful years together, enjoying dinners, movies, and card games
with dear friends, before Archie’s passing in October 2013.



In her later years, Janet found companionship and joy in spending time with her
friend Doug Cass. They enjoyed trying new restaurants and playing cards with
friends.



Janet’s life was defined by her kind and nurturing spirit. She had a deep sense
of care for those around her, whether it was supporting students during her
years at Hoxie High School or lovingly caring for her family, including Archie,
her father, John, and her brother, Jerry, during their final years. She was
always ready to help anyone in need.



Janet is survived by her three children: Doug (Templeton, CA), Steve (Topeka,
KS), and Wilinda (Greg) Shaffer-Harmon (Fairview, OK). She also leaves behind
her stepchildren: Rick Moss, Don Moss, Shelia (Moss) Krannawitter, and Pam
(Moss) Erwin. Janet was deeply proud of her grandchildren: Eric Schmidt,
Brendan Schmidt, Cale Harmon, Taylor Kaba (Kailee), Clayton Kaba (Sophie), Kami
Kaba, Rhys Kaba, as well as her great-grandchildren, Addison and Rowan, who
held a special place in her heart. Janet is also survived by her sister, Connie
(Jim), Nephew Chad (Candi) Teichman, great nephew Trent Teichman.



She was preceded in death by her first husband, Ken; her second husband,
Archie; her parents, John and Norma Jean Bird; her brother, Jerry Bird and
niece Leaa Teichman Shaffer.



Visitation will be held on Thursday, November 21, 2024, from 2:00 to 7:00 p.m.
at Mickey Leopold Funeral Home in Hoxie, with the family present from 5:00 to
7:00 p.m. Funeral services will take place on Friday, November 22, 2024, at
10:30 a.m. at The First Christian Church in Hoxie, followed by lunch. Graveside
services and burial will be held at 2:00 p.m. at Plainville Cemetery, with a
gathering to follow at The VFW in Plainville.

Jana’s Campaign and Options Domestic and Sexual Violence Services invite all community members to participate in a survey to help them better understand the factors that contribute to violence and safety within local communities.

The agencies are conducting a quality of life survey in Ellis, Thomas and Russell counties to gain insights into the risks and protections against violence, with a particular focus on sexual violence. 

This survey's purpose is to gather valuable information that will guide their efforts in creating safer, more supportive communities.

If you are an Ellis, Thomas or Russell County resident, you are encouraged to take 10 to 15 minutes to complete this survey.

INDIANAPOLIS - Six, 3-loss teams made the cut and are in the 28-team NCAA Division II football playoff field, Fort Hays State is not one of them. The Tigers (8-3) were left out of the postseason tournament field announced by the NCAA Sunday evening.

Two MIAA teams made the Super Region 3 field. Regular season champ Central Oklahoma (10-1) will host Ouachita Baptist (10-1) Saturday. Pittsburg State (8-2), who finished runner-up in the conference, will host defending national champ Harding Saturday.

Kansas State University is continuing community visits across the state and invites residents of Ellis County for a special afternoon focused on water education and conservation.

The “Know Your Water” event will take place on November 18, starting at 2 p.m. at the Agricultural Research Center in Hays. Organizers say that participants will have the chance to learn about water systems, efficient irrigation techniques, and non-point source pollution.

“We want our residents to see these demonstrations first-hand and to hear about science-based water management strategies. K-State will use this visit to help everyone dive deeper into the important topic of water,” said Stacie Minson, an extension watershed specialist with K-State Research and Extension.

This community visit will feature experts from the university and Extension who will lead the hands-on showcases and demonstrations. Participants will also have a tour of Pleasant View Farms, where water quality improvements have been put into action.

The continuation of K-State’s community visits shows the university’s commitment to prioritizing engagement and driving partnerships that address real-world challenges — whether through educational outreach, innovative research or service programs that benefit the people and industries of Kansas.

K-State comes to Ellis Co. for community visit about water

After President-elect Donald Trump's victory over Vice President Kamala Harris, a Fort Hays State University political science professor said there has been a nationwide shift to the right in 2024.

Fort Hays State University wrapped up the election cycle on Thursday by analyzing the 2024 election results.

Presented by FHSU's American Democracy Project, FHSU Assistant Professor of Political Science Jay Steinmetz offered insights and conducted research after Nov. 5.

"There are a lot of important questions that we can ask and critical insights that can be derived from looking at election stats," he said.

Steinmetz attributes the shift to the right to several possible theories, such as the establishment/anti-establishment theory, the economy theory, the Joe Biden theory, the identity theory and the immigration backlash theory.

"Why did we have what we have? Is this a Republican Party success? Is this a Democratic Party failure? It's a little bit of both," he said.

Steinmetz said the establishment/anti-establishment theory centers on the difference between establishment politics, which refers to mainstream political structures, traditional party leadership and established institutions.

Steinmetz said anti-establishment sentiment rejects these institutions and is not exclusive to the U.S. Trump has focused on this message since 2016.

"It was a good message for 2016," he said. "But it's almost a perfect fit for 2024 in our post-COVID world. We're angry with the establishment, and Trump's anti-establishment ethos is the perfect fit."

Steinmetz said this message resonated with voters who felt alienated from traditional political structures and frustrated with the current state.

Steinmetz said economic concerns such as inflation, housing costs, consumer confidence and job security played the second-most significant role in the election.

Steinmetz said many people who don't usually vote but do so when critical issues arise tend to view their votes through a transactional lens.

Steinmetz referenced a PBS exit poll that indicated the economy was the primary factor influencing the votes of Black, Hispanic and young voters.

"These are voters who are coming into an economy that's not very good and that dealt with many issues of dislocation," he said.

Steinmetz said Trump successfully framed economic issues in a way that resonated with working-class voters.

He said voters with economic hardship are less concerned with overall policy impacts and more focused on immediate impacts on their daily lives, such as gas prices and the cost of living.

Steinmetz said Biden's leadership may have played a significant role in the Democratic Party's underperformance in 2024.

He suggested the election outcome might have differed if Biden had chosen not to run again after the Democrats' success in the 2022 midterms.

"Had Biden been 'thumped' in the 2022 midterm elections, he very well might have said, 'I'm going to sit out the 2024 election,'" Steinmetz said.

Steinmetz said the Democratic Party did not have difficult discussions about broadening their base and whether Biden should run again due to their 2022 success. Trump announced his candidacy shortly after the midterms.

Steinmetz said this tied Harris to the unpopular Biden administration despite accomplishments like economic acts and infrastructure reforms.

"It brought what I think is one of the more powerful messages from the Republican Party, which is 'If you had four years to fix these problems, why didn't fix them,'" he said.

He added the vice president does not influence policy.

Steinmetz explained identity politics refers to the notion that group identities, rather than individual traits, serve as the primary foundation for political action, policy and change.

He said gender and race played a role in 2024, with Harris facing unique challenges. As a woman, she was held to a different standard than Trump.

"Part of the disadvantage Kamala Harris had in this matchup was the fact that she was a woman, a Black woman and an Asian American Woman. Those factors had a role to play," Steinmetz said.

Steinmetz said Obama ushered in an "age of identity" in 2008, and Trump's anti-identity politics is, in itself, a form of identity politics as it includes positive affirmations of specific identities that support him.

Steinmetz discusses how border policies and immigration were on voters' minds but were not significant enough to be the principal factor in Trump's victory.

Although border politics and immigration were central to Trump’s movement, there are links to other policy issues.

"The border is connected to our drug crisis, fentanyl, overdose crisis and crime in this country. It's connected to national security imperatives, a whole bunch of other policy avenues," Steinmetz said.

Steinmetz said this is important for progressives and independents to reflect on, as it highlights the importance of border-related issues for Trump supporters.

Steinmetz said while it's subjective, one could argue Harris ran a campaign of integrity with few errors, though there were some missteps.

Steinmetz points to Harris's limited media presence and lack of policy substance, which may have impacted her appeal to specific voter groups.

"On the whole, I would say it was a pretty normal campaign, and I don't see a lot of huge missteps or huge errors," he said. "In fact, probably one of the biggest errors was Joe Biden opening his mouth and calling Trump supporters garbage."

According to data from Steinmetz, there was a 3.1% shift toward Trump in swing states compared to 2020, while outside swing states, the shift was 6.7% in his favor.

Steinmetz said the time and money spent in swing states helped mitigate what would have been a more significant loss to Trump if Harris had not run a strong campaign.

Based on Steinmetz's analysis, Trump's return to the White House is a pivotal moment for the Republican Party and the country. However, the rightward shift in the electorate in 2024 may not be permanent.

"They could be [permanent], but I think it's going to depend on how Republicans govern," he said.

Steinmetz said young voters are low-propensity voters, and Black voters are traditionally Democratic, meaning the recent shift could swing back in the other direction.

He said Hispanic voters in Florida and Democratic strongholds in Texas shifted more toward the Republican Party due to concerns about immigration and economic issues.

Steinmetz specializes in political theory, American politics and public law. His research focuses on liberal theory in American political culture, presidential memory in popular culture and the legal evolution of free speech in the 20th century.

Is this a Republican Party success? Is this a Democratic Party failure? FHSU professor discusses conservative shift in 2024 election analysis

LOGAN – The Dane G. Hansen Foundation is pleased to welcome Mike Erhart as the newest member of the Foundation’s board of trustees, effective immediately. Erhart comes to the Foundation with an impressive history of work in Kansas – and for the last 20+ years, in Northwest Kansas.

A graduate of Emporia State University with a B.S. in Biology and Chemistry, Erhart has spent most of his career in the agriculture and energy fields. He says he started humbly at a local co-op where he was responsible for increasing sales but was not afraid to step in wherever he was needed, including delivering fuel and rebuilding equipment – really anything the company needed and could help it increase productivity.

He worked in sales and management for various agricultural companies from 1975 to 1990 and then for Archer Daniels Midland from 1990 to 2002. He then went to work for Western Plains Energy in Oakley until 2006 when he came to Phillipsburg to work for Prairie Horizon Agri Energy.&nbsp;&nbsp;

In 2016, Erhart combined his work experience and people skills to establish DK Developments LLC, a private consulting company in Phillipsburg. He specializes in process, production, market development, financial and operational analysis for businesses and organizations.&nbsp;

Erhart grew up in central Kansas and worked on the family farm for his grandfather during his early years and upon entering high school, when his family moved to another town, he went to work on a tree farm and hired out to area farmers in the evenings.&nbsp; He said he has always lived in small rural towns and continues to support rural communities through various committees and activities.&nbsp;

In 2022, the Dane Hansen Foundation contracted with DK Developments and Erhart to serve as the owner representative for the recently opened LIFE Project in Logan. As such, Erhart handled the communication between the Foundation and outside parties including contractors and architects. He oversaw the budget and schedule to get the facility open on time.

The last few years of working together made it clear that Erhart could bring value to the Hansen Foundation beyond the LIFE Project.

Erhart’s appointment follows the retirement and subsequent passing of former Trustee, Cy Moyer, who served the Foundation for more than 27 years.&nbsp; He joins current board members, Doug Albin, WaKeeney; Carol Bales, Logan; Warren Gfeller, Russell; Rhonda Goddard, Penokee; Robert Hartman, Hays; and Brien Stockman, Logan.

Dane G. Hansen Foundation announces new Trustee

The Tigers finished eighth in the league's final KPI rankings, which were used to determine seeding for the tournament due to the unbalanced nature of the conference schedule this year.

As the No. 8 seed in the tournament, the Tigers will take on regular season champion Nebraska-Kearney in the conference quarterfinals on Thursday. First serve is set for 5 p.m. from the St. Joseph Civic Arena. The full schedule for the tournament can be found below.

This is FHSU's first trip to the postseason since 2021 and its fifth trip to the MIAA Volleyball Championship Tournament since joining the league in 2006.
