On Friday, Aug. 28, Rep. Jim Banks of Indiana introduced a bill called the <a href="https://banks.house.gov/uploadedfiles/peaceful_protest_act.pdf" target="_blank">“Support Peaceful Protest Act.”</a>
 Despite the cheery title, its very purpose appears to be to make 
individuals think twice before attending any sort of protest. If the 
bill were to pass, it would make it so that an individual “convicted of a
 federal offense related to their conduct at and during the course of a 
protest” policed by federal law enforcement officers would be required 
to pay the cost of that policing, and would be deemed ineligible for 
COVID-19 unemployment benefits. This would be on top of the penalty 
imposed on the protester for committing that federal offense in the 
first place.

 for this piece of legislation? “Antifa thugs are descending on 
suffering communities, disrupting peaceful protests and leaving 
violence, looting and vandalism in their wake … Due to enhanced federal 
benefits, taxpayers are giving wages to jobless rioters that are 
destroying our communities. We need to cut them off from their funding 
and make them feel the full financial consequences of their actions.”

The handful of comments on the congressman’s website were mostly 
positive, with the general sentiment being, “What’s wrong with a law 
that holds people accountable for the damage they cause?”

To start with, some of the commenters might be surprised to learn about what, exactly, constitutes a federal offense.<a href="https://theprosecutionproject.org/2020/08/29/tracking-federal-cases-related-to-summer-protests-riots-uprisings/" target="_blank"> As documented by the Prosecution Project</a>,
 in many cases the charges that federal prosecutors are pursuing against
 protesters don’t involve violence or even property damage. For example,
 a <a href="https://cbsaustin.com/news/local/austin-man-charged-with-civil-disorder-during-houston-protest" target="_blank">Texas man was charged with “civil disorder”</a>
 for trying to barge through a police line and then passively resisting 
arrest by placing his arms underneath his body as he lay on the ground. 
Six individuals were charged with inciting riots, not because of actions
 they took at protests, but because of posts they made on social media. (<a href="https://www.lawfareblog.com/federal-governments-aggressive-prosecution-protestors" target="_blank">As the blog Lawfare reports</a>,
 the federal statute that they are charged with violating has long been 
criticized for infringing on First Amendment rights “because it broadly 
prohibits a class of speech without tying that speech to any imminent 
action.”)

But even when it comes to federal offenses that are truly violent and
 destructive, I have an instinctive skepticism about laws that do 
nothing but take acts that are already illegal and make them even more illegal.
 If you are convicted of, say, destroying government property because 
you vandalized a police car, you will already be facing jail time and/or
 heavy fines. So why should vandalizing a police car at a protest incur 
an extra layer of punishment over doing the exact same thing on a 
regular day? If anything, it’s a lot more difficult to ascertain who did
 what at a protest than it is at almost any other time — it’s very easy 
for peaceful protesters to be swept up in charges for violent acts they 
had nothing to do with. Interestingly, when a commenter in a <a href="https://www.facebook.com/wlwt5/posts/10157211698911852" target="_blank">Facebook discussion about the “Support Peaceful Protest Act”</a>
 pointed this out (“I see this going horrendously wrong and people being
 punished for something they didn’t do”), many of the responses implied 
that that’s simply the price one must pay for going to a protest in the 
first place (“if your [sic] there peacefully protesting and don’t do 
anything to stop the ones who are rioting then yes you are just as 
guilty”). In other words: if you want to exercise your First Amendment 
freedom to peacefully protest, you need to accept that you’re risking 
your federal employment aid should violence break out nearby.

Laws like the ones proposed by Congressman Banks create what we call a
 “chilling effect” on First Amendment rights. They don’t outright ban 
assembly, but create repercussions that intimidate and dissuade people 
from doing it. This law in particular seems aimed at keeping people who 
have suffered economic misfortune from politically participating.

CATHARINE — The United States Post Office is taking the final steps to permanently close the post office in Catharine.

The Catharine Post Office, 1676 St. Martin St.,  was shut down in August 2014. The building had structural problems. The landlord refused to fix the issues and the lease was eventually terminated.

The Catharine postmaster also retired about the same time.&nbsp;

There were 58 post office boxes in Catharine at the time the post office closed in 2014.

Postal customers in Catharine were placed on a rural route out of Hays. Postal customers were directed to Victoria, which is six miles away, for any in-person services that they needed.

Revenue at the Catharine Post Office was on the decline when the USPS temporarily closed the office on Aug. 13, 2014. Revenue at the office for the last full year it was open, which was 2013, was $7,610.

 Permanent closure of the office would save the USPS $33,860 the first year of the closure and $268,810 over 10 years, according to the USPS report on the closure.

The USPS began researching making the Catharine Post Office closure permanent in March. USPS's report determined the former post office building was not historical.

Local residents have until Thursday, Sept. 10, to provide comments about the permanent closure of the Catharine Post Office.

Letters were sent to local residents that included a survey on area postal service. A public comment sessions was conducted at the Catharine School in June.

A 60-day comment period started in July.&nbsp;

Copies of the proposal are available at the Victoria Post Office, 1003 Fourth St.&nbsp;Concerned parties can provide written comments forms, which are available at the Victoria Post Office c/o Guy Moeckel, 706 Fort St., Hays, KS 67601.

The comments will be made part of the public record. 

Once the USPS makes a final decision about the Catharine location, there is an additional 30-day appeal period.

However, the Hays Post talked to a couple of Catharine residents who said they were unconcerned about the USPS's move to make the temporary closure permanent.

One resident moved to Catharine four years ago, after the Catharine Post Office closed its doors. All he has received is rural route delivery.

"They mix up mail sometimes," he said, "but it's OK."

USPS seeks to permanently close the Catharine Post Office

A request for variance on additional building wall signage is the subject of a public hearing scheduled for Sept.9 by the Hays Area Board of Zoning Appeals.

Miller's of Claflin is asking for 493 square feet of additional wall signage on the north side of the&nbsp;building at 3300 Vine Street. 

The applicant is in the process of remodeling the&nbsp;northern space, site of the former Hastings store, for an Ashley HomeStore distribution center and furniture clearance center.&nbsp;

According to Curtis Deines, PIE superintendent, the current sign regulation allows a maximum of 200 square feet of wall signage&nbsp;per façade. 

The applicant is proposing&nbsp;two wall signs for their new business for visibility to customers from&nbsp; I-70. The signs would be 270 square feet and 110 square feet.

The multi-tenant building houses Hobby Lobby, which has a sign on the north facade, and Westlake Ace Hardware.

City staff recommends approving the variance as submitted.&nbsp;

Signage zoning appeal set for new Ashley distribution center 

Kansas voters have the power to protect their own votes. Plan ahead. Choose the voting method that works best for you. Act early. Act responsibly. Advocate for yourself.&nbsp;

In-person Election Day voting:&nbsp;&nbsp;Poll worker shortages could make lines longer this year, increasing your Covid exposure risk. Will your wait be mercifully short and sanitary, or long and uncomfortably crowded? In-person voting still has problems that threaten your ballot, but it’s familiar and comfortable for many voters. Plus, it avoids challenges unique to mail voting.&nbsp;

In-person early voting: You might have lower Covid risk here since early voting lines are often shorter than Election Day lines. Great option if you prefer the familiarity of in-person voting.&nbsp;

Voting by mail: Low Covid risk, secure, and convenient. However, mail voting introduces certain challenges.&nbsp;&nbsp;

In 2016, nearly 25% of voters nationally voted by mail, according to the US Election Assistance Commission. Election officials rejected nearly 320,000 of those ballots—about 1%. Already in 2020, over 500,000 mail ballots have been disqualified nationally in primaries, per&nbsp;National Public Radio.&nbsp;&nbsp;

Those rejections mostly stem from voter error, especially among first-time mail voters. Using the wrong color ink. Using a pencil if a pen is required. Stray ballot marks. Not signing the return envelope. Signing the ballot rather than the envelope. Using a different signature than the state has on file. Missing postmark and return deadlines.&nbsp;

Mail voting only works if done correctly. Following the directions is solely the voter’s responsibility, though in Kansas local election officials are supposed to help voters fix those signature issues.&nbsp;

How can Kansans mail vote confidently?&nbsp;

First, apply for your mail ballot now. The deadline is October 27. Apply at&nbsp;<a href="http://www.ksvotes.org/">www.ksvotes.org</a>, or print an application from the Kansas Secretary of State website. Election officials start mailing ballots to voters on October 14. Applying online before October 14 would be your best bet.&nbsp;

Second, vote your ballot immediately upon arrival. Read the directions. Mark your ballot. Prepare your signed return envelope. Use stamps if necessary.&nbsp;&nbsp;

Third, return your ballot on time. In Kansas, mail ballots must be postmarked by Election Day (November 3), and delivered to your county election office by the close of business on Friday, November 6. Procrastinating risks missing deadlines.&nbsp;

Beware: you are responsible for your ballot while the postal service has it. If it’s postmarked on time but arrives at the election office late, then your ballot won’t count. Returning your ballot immediately gives it three weeks to arrive. Plenty of time! To be safe, assume your ballot will take a week to reach the elections office. The latest that I would mail a ballot locally is Friday, October 30.&nbsp;

Luckily, Kansans who procrastinate can also return mail ballots in-person rather than mailing them. Google your county elections office. Ask them where to find secure ballot drop off boxes and how early they are accessible.&nbsp;&nbsp;You can also return mail ballots at any voting location in your county on Election Day itself or before at early voting locations in your county.&nbsp;

If you still have your mail ballot on October 31, return it in-person. Don’t risk mailing your ballot that late.&nbsp;

Also, ask if your county has an online ballot tracker. Use it to check that officials received your ballot.&nbsp;

INSIGHT KANSAS: Kansans must protect their own votes this year 

YODER —&nbsp;Twenty-one new law enforcement officers graduated from the Kansas Law Enforcement Training Center on Aug. 28 at a ceremony held in KLETC’s Integrity Auditorium.&nbsp;

Tyler Stephenson of the Baldwin City Police Department was the graduating class president. Rob McClarty, KLETC instructor of police and class coordinator for the 267th Basic Training Class, was the speaker for the ceremony.

Stephenson was named to the Director’s Honor Roll and was also the recipient of the Welch Academic Award. Deputy Chandler Ford from the Meade County Sheriff’s Office and Officer Logan Higbee from the Beloit Police Department were acknowledged for having shot 100% on their firearms qualification, with Higbee being recognized as the class “Top Shot.”

McClarty also singled out students Higbee, Levi Chermak, Austin Sievert, Stephenson, Shawn Hyde, Tanner Houck, Blake Stromgren and Ford for assisting a motorist whose car had flipped. 

The students were en route to Cheney on their downtime when they noticed the overturned vehicle. They worked together to ensure that not only was the motorist safe, but that the area was safe as well. The students tended to the motorist and controlled traffic until the Reno County EMS, Pretty Prairie Fire Department and Kansas Highway Patrol arrived on the scene.&nbsp;

Graduates receive certificates of course completion from KLETC and Kansas law enforcement certification from the Kansas Commission on Peace Officers’ Standards and Training, the state’s law enforcement licensing authority. The training course fulfills the state requirement for law enforcement training. Classroom lectures and hands-on applications help train officers to solve the increasingly complex problems they face in the line of duty.

Established by the Kansas Legislature in 1968, KLETC trains the majority of municipal, county and state law enforcement officers in Kansas and oversees the training of the remaining officers at seven authorized and certified academy programs operated by local law enforcement agencies and the Kansas Highway Patrol.

 </figure>YODER —&nbsp;Twenty-one new law enforcement officers graduated from the Kansas Law Enforcement Training Center on Aug. 28 at a ceremony held in KLETC’s Integrity Auditorium.&nbsp;Tyler Stephenson of the Baldwin City Police Department was the graduating class president. Rob McClarty, KLETC instructor of police and class coordinator for the 267th Basic Training Class, was the speaker for the ceremony.Stephenson was named to the Director’s Honor Roll and was also the recipient of the Welch Academic Award. Deputy Chandler Ford from the Meade County Sheriff’s Office and Officer Logan Higbee from the Beloit Police Department were acknowledged for having shot 100% on their firearms qualification, with Higbee being recognized as the class “Top Shot.”<figure>

 </figure>McClarty also singled out students Higbee, Levi Chermak, Austin Sievert, Stephenson, Shawn Hyde, Tanner Houck, Blake Stromgren and Ford for assisting a motorist whose car had flipped. The students were en route to Cheney on their downtime when they noticed the overturned vehicle. They worked together to ensure that not only was the motorist safe, but that the area was safe as well. The students tended to the motorist and controlled traffic until the Reno County EMS, Pretty Prairie Fire Department and Kansas Highway Patrol arrived on the scene.&nbsp;Graduates receive certificates of course completion from KLETC and Kansas law enforcement certification from the Kansas Commission on Peace Officers’ Standards and Training, the state’s law enforcement licensing authority. The training course fulfills the state requirement for law enforcement training. Rooks, Russell Co. officers among western Kan. graduates at KLETC 

September is National Food Safety Education Month, a great time to explore ways to promote safe food handling and prevent foodborne illnesses. I know that there were more gardens planted this year as compared to the past year and some gardens are producing great crops. When all those tomatoes are ripe at the same time, what do you do? Preserve them!

Karen Blakeslee with K-State’s Rapid Response Center shares that home canning of foods is done using two processing methods based on the type of food being canned. <a href="https://www.rrc.k-state.edu/preservation/canning.html#low">Low acid foods</a>, such as vegetables and all meats, must be pressure canned. <a href="https://www.rrc.k-state.edu/preservation/canning.html#high">High acid foods</a>, such as most fruits, <a href="https://www.rrc.k-state.edu/preservation/canning.html#tomato">tomatoes</a>, <a href="https://www.rrc.k-state.edu/preservation/pickling.html">pickled foods</a>, <a href="https://www.rrc.k-state.edu/preservation/jam-jelly.html">jams and jellies</a>, are processed using a boiling water bath. This is based on the acidity, or pH, of the food. The dividing point is a pH of 4.6. Any food above 4.6 is a low acid food. Any food below 4.6 is a high acid food.

A change from what you may remember from the past is that it is a requirement to add acid to home canned tomatoes. This used to be an unnecessary step in canning tomatoes, but tomatoes available in today’s market are not as acidic as they used to be. This is for water bath and pressure canned tomatoes. Tomatoes that are acidified for canning are done so to prevent the botulism poisoning and other bacterial concerns by a combination of heat and acid. The prevention control in vegetables, meat and other naturally low-acid foods is by heat alone.&nbsp;

Tomatoes can have a natural pH above 4.6 (at least up to 4.8). But rather than develop a pressure-only process as if they were all low-acid, since they are close to 4.6, USDA decided instead to recommend adding a small amount of acid so they can be treated as a food with a pH less than 4.6 for home canning. Therefore, they are suitable for boiling water when the acid is added.&nbsp;

&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Tomatoes can be waterbathed, but you must add two tablespoons of bottled lemon juice or 1/2 teaspoon of citric acid per quart of tomatoes. For pints, use one tablespoon bottled lemon juice or 1/4 teaspoon citric acid. Acid can be added directly to the jars before filling with product. Add sugar to offset acid taste, if desired. &nbsp;

&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; One additional thing to remember is to adjust processing times for altitude. Many think Kansas is flatter than a pancake, but Kansas altitudes can range from below 1,000 feet to just over 4,000 feet.&nbsp;Not adjusting for altitude will lead to under-processed food because water boils at lower temperatures in higher altitudes.&nbsp;If you live over 1,000 feet, then you must adjust your canning recipe to compensate for the higher altitude. Information on elevation can be found at the website listed above.&nbsp;

UNRUH: Canning food safely

MANHATTAN — A pair of studies at Kansas State University is bringing new insight to farmers and producers seeking to incorporate industrial hemp in cattle feed. After the 2018 Farm Bill legalized hemp production in the U.S., interest has grown in industrial hemp as an agricultural commodity, including as feed for animals. FDA approval, however, through the Association of American Feed Control Officials would be required before hemp could be fed to livestock or pets. "Although hemp can be legally cultivated under license in Kansas, feeding hemp products to livestock remains prohibited because the potential for cannabinoid drug residues to accumulate in meat and milk has not been studied," said Hans Coetzee, professor and head of the anatomy and physiology department in the&nbsp;<a href="https://www.vet.k-state.edu/" target="_blank">College of Veterinary Medicine</a>. A team of K-State researchers recently received a $200,000 Agriculture and Food Research Initiative Competitive Grant from the U.S. Department of Agriculture's National Institute of Food and Agriculture to establish concentrations of cannabinoids in livestock after exposure to industrial hemp.

"Industrial hemp is typically grown to produce oil, seed, fiber and medicines," said Michael Kleinhenz, assistant professor of beef production medicine. "While varieties of hemp may be planted for a single or dual purpose, such as for seed and fiber, byproducts consisting of leaves, fodder and residual plant fibers remain after harvest. These byproducts could serve as potential feedstuffs for animals. Because these are predominantly cellulose-containing plant materials, the ideal species for utilizing these feeds are ruminant animals, specifically cattle." While there is interest in the use of hemp for cattle feeds, there are questions about whether the feed can be used safely because of concerns about tetrahydrocannabinol, or THC, intoxication and the presence of other bioactive cannabinoids. Kleinhenz noticed that most research was focused on humans, mice and swine, but not on cattle. "This is surprising because cattle can readily utilize industrial hemp byproducts as they can digest cellulose plant materials in their rumens," Kleinhenz said. Kleinhenz is part of a multidisciplinary research team consisting of pharmacologists, toxicologists, analytical chemists and horticulture experts. The hemp used in the studies was grown at K-State's John C. Pair Horticultural Center near Wichita. Other K-State researchers involved include Geraldine Magnin, Zhoumeng Lin, Steve Ensley, Jason Griffin, Katie E. Kleinhenz, Shawnee Montgomery, Andrew Curtis, Miriam Martin and Coetzee. The research team also included John Goeser and Eva Lynch, Rock River Laboratories. "We observed that the acidic cannabinoids, such as CBDA and THCA, are more readily absorbed from the rumen than other nonacid cannabinoid forms, such as CBD and CBG," Kleinhenz said. "Now that we have found that some cannabinoids are readily absorbed from the rumen, the next steps are to study the tissue and milk residue depletion profiles of these compounds after animal feeding experiments. The effects of cannabinoids on cattle are also unknown." Follow-up experiments will include pilot studies to examine the effect of feeding hemp on animal behavior and immune function. "Our goal is to fill in the knowledge gaps," Kleinhenz said. "Until feedstuffs containing hemp are established as safe in animals, our data will assist producers in managing situations involving intentional or unintentional hemp exposures." The two published studies are "<a href="https://www.sciencedirect.com/science/article/pii/S2590286520300859?via%3Dihub" target="_blank">Nutrient concentrations, digestibility, and cannabinoid concentrations of industrial hemp plant components</a>," which can be found in the journal Applied Animal Science, and "<a href="https://www.nature.com/articles/s41598-020-69768-4" target="_blank">Plasma concentrations of eleven cannabinoids in cattle following oral administration of industrial hemp (Cannabis sativa)</a>," which was published in Scientific Reports.&nbsp;

K-State research analyzes safety of industrial hemp as cattle feed

The Ellis County Health Department on Friday announced 57 new cases of COVID-19 had been identified in the county since Wednesday.

There are now 161 active cases, including three active hospitalizations, with 368 recovered cases.

Since reporting began, there have been 530 total cases of coronavirus in Ellis County, including one death.

The seven-day average of percent of positive tests fell from more than 18 percent Wednesday to 14.6 percent Friday.

deep cleaning; and are maintaining open communications with family members, residents and staff.

As a result of mass testing for COVID-19 at The Good Samaritan Society-Hays, one resident and two staff members have been identified as testing positive for the virus, Administrator Noe Gillespie said in a news release Friday.&nbsp;

One resident, two staff test positive for coronavirus at Good Sam

WAKEENEY — The Trego County Health Department reported a second death related to a cluster of COVID-19 cases.

The individual was a resident of Trego County Long Term Care.

The department also reported seven new cases of coronavirus since Tuesday, along with 15 recovered cases. There have been a total of 37 cases of COVID-19 reported in Trego County since reporting began.

Ellis volleyball seniors will be honored next week

The August report of progress on various city of Hays projects was presented recently by Collin Bielser, assistant manager, to city commissioners.

Bielser noted the north Vine Street improvement project is about 14% complete, and the fire department has a new pumper fire truck, replacing a 1998 truck.

The Department of Water Resources has announced a water main break near the intersection of 15th and General Custer.

Workers responded to the leak shortly be 7 a.m.

There were two water main leaks in Hays Thursday.

A small leak occurred near 38th and Fairway about 8:30 p.m.&nbsp;

A large waterline break happened about noon near 27th and Walnut while a contractor was doing work in the area. 

All water customers north of 27th Street were affected during the repair and the street was closed .

Water leak repair underway at 15th and General Custer

Five more downtown Hays properties owned by Plainville businessman Chuck Comeau will be up for sheriff sale.

Emprise Bank has been granted foreclosures on properties at 1107, 1109, 1111 Main, 106 W. 12th streets as well as 110 W. 11th St. Bank of Hays is listed as a second mortgage holder on the properties.

The storefronts at 1107 Main St., 106 W. 12th St. and 110 W. 11th St. are vacant, while 1109 and 1111 Main St. are occupied by Couture for Men.

The sheriff's sale has been set for 10 a.m. Sept. 29 at the Ellis County Courthouse.

Tracts 1-3, 1107, 1109, 1111 Main and 106 W. 12th St. will be sold together, with 110 W. 11th St. being sold separately.

Court records indicate $495,311 is owed on tracts 1-3 and $130,244 is owed on tract 4.

More former Comeau properties up for sheriff's sale

The fourth annual Thunder on the Plains car show is set for Saturday, but while the event will still feature classic cars and food, like so much else in 2020, the event was impacted by COVID-19.

Normally, sponsors would donate throughout the year that would be given out to local charities and fund prizes for the car show.

"In the past four years, we have had the car show we have given away over $36,000 to local charities," said Jackie Lang, Thunder on the Plains organizer. "We love to do this, we love to have fun with it, we like to bring people together with the passion for their cars, trucks and motorcycles and have a good time with it. But at the heart of it all, we want to give back to the community."

However, this year, with so many struggling in the community as the pandemic has shut down businesses, Lang said they were hesitant to try to ask for donations.

"We didn't feel like it was right to go out and ask people to donate money when we knew people were struggling," she said.

Early donations already collected will be used to fund this year's show and remaining funds will be added to next year's collection that will be distributed to local charities.

Sponsors this year include Adams, Brown, Beran &amp; Ball, Chad Beiker Insurance, Dillons, Discovery Drilling, Dr. Mark Schupman, D.C., FHSUGasper Auto Trim &amp; Upholstery, Glassman, Bird, Brown &amp; Powell LLP, Hays Convention &amp; Visitors Bureau, Hess Corporation, Insurance Planning, Dr. Jeffery &amp; Connie Curtis, Lynn Kinderknecht DDS, Paul-Wertenberger Construction Inc., RockAuto.com and Auto World.

While fundraising efforts were curtailed this year, Lang was grateful to the sponsors that contributed.

"We could not do what we do without our sponsors and we hope that we will be back to normal next year, raising funds to give back to the community," Lang said.

Despite the challenges this year organizing the event, the Thunder on the Plains will still offer an opportunity for car aficionados to gather and enjoy cars and company.

"We decided to have the car show, but it was going to be a free car show," Lang said.

Without funds to give large prizes to category winners, they also decided to not charge entry fees.

Despite the change, she said the event should still be a fun way for people to gather and believes the turnout will generate a sizable turnout.

"We've heard as a group that there are a lot of people interested in coming," Lang said.

A few entries have been preregistered, but anyone wanting to participate can simply arrive Saturday morning.

"You can pull up the day of the show and park your car, that's no problem," Lang said. "Most of the cars come the day of the show and have not preregistered."

And while there will not be large prizes this year, drawing for small prizes will go on throughout the event.

This year's show will also feature a new event.

With the monthly Poker Runs organized by Thunder on the Plains curtailed this year, the decision was made to add one to the show.
