DAWSON COUNTY—Law enforcement authorities are investigating a suspect on drug charges after finding 11 pounds of fentanyl during a traffic stop in Dawson County, Nebraska.

Just after 11:00 p.m. Monday, a trooper observed an eastbound BMW sedan with defective lighting traveling on Interstate 80 near Lexington, according to a media release. 

The trooper performed a traffic stop. During the traffic stop, the trooper and a Dawson County Sheriff’s Deputy observed marijuana in plain view inside the vehicle.

A search of the vehicle revealed 11 pounds of fentanyl and a small amount of marijuana.

Troopers arrested the driver, Alexis Murillo Godoy, 27, of Long Beach, California, on requested charges of possession of a controlled substance, possession with intent to deliver, and other charges.

JUNCTION CITY—A bomb threat ruined the first day of school at Spring Valley Elementary School in Junction City on Aug. 11.

Fortunately a bomb was never found and no one was injured. But since there have been social media concerns expressed about the JCPD response to the incident. Tuesday police and school district administrators met for an after action review.

Capt. Cory Odell, noted that an unsubstantiated threat about a bomb came in from the school district at approximately 7:34 a.m. and dispatchers contacted school resource officers who just preparing to come to work. "Due to the way that the information came in it was not a lights-sirens run so it was not a 30-second response like people anticipate just because of morning traffic going all the way from the east side of town to where we're at all the way to the west side of town where the school's located. "

JCPD officers did not arrive on scene until about 8:04 a.m. nearly 30-minutes later. JC Post asked about the 30 minutes it took to respond. "He was just finishing up getting ready to come in to work. He had to get all of his work stuff together and get loaded into his vehicle, " said Odell. Police Chief John Lamb pointed out that at time it was still an unsubstantiated threat. "Nobody had called in. This was based on a group meet message that was put out by the school district telling staff to check your areas. If you see anything out of sorts report to us. It was still perceived by them as a low threat so we weren't going to endanger the community more by trying to get over there by lights and sirens."

Lamb said a 911 call came in shortly after receiving the group meet text and a second SRO, school resource officer, was sent to the school on the west side of Junction City. Lamb said some sheriff's department personnel were also at the school because they happened to be dropping off their children.&nbsp;

Odell said after 8:04 police linked up with school officials and did an immediate walk-through of the building and nothing seemed out of place. School staff had also conducted an earlier walk through and nothing seemed out of place. Lamb commented that eventually four walk-throughs were done by police or school personnel. "A lot of people think the kids were evacuated. The kids were never allowed in the school. School staff had made the decision I am not going to put the kids in school and then run the chance of possibly evacuating them which we understand, so the kids were never allowed in school, they were just taken to a safe distance away and cared for away from the school.

Police said the students were allowed into the school about 10:27 a.m. It was the first day of the new school year.

Some improvements will be made. Lamb said police have assessed their policies and there are some things that have been identified where changes need to be made. "Working with the school board comparing their policy to ours, make sure that policy matches practice and that we're working together and everybody understands everybody's role as we respond. " Lamb said a committee will review it to make sure the policy is compliant with accreditation standards, will identify best practices in the profession, and what works well with not just schools but also other large facilities. While not identifying specific changes now, Lamb did confirm there will be some to make it more clear on response so entities can understand the police role and what to expect. 

Lamb also stated, "There are some things that we have identified that we can improve on. Just like I said at the after action report with the school who we're working closely with, there were some ah-ha moments in that. No situation like this is ever going to be perfect. There's no cookie cutter response to any situation in law enforcement. " Lamb also added, "So what you do is remain fluid, calm." He commented that the main goal is to protect the students and the staff, and the chief added that all agencies were combined in that effort.

Lamb noted that he wants to ensure communication between the JCPD and school district is strong, they want to build on it, identify each other's roles so next time it will run a lot smoother. The goal is to strive to do better in the future.&nbsp;

Police criticized for response to Kan. school bomb threat 

TOPEKA&nbsp;- The Kansas Department of Health and Environment (KDHE) announced Wednesday the release of the Kansas COVID County Ranking report, according to a media release from the agency.

This report is designed to help county commissioners and local leaders stop the spread of COVID-19 in their communities by tracking critical COVID-19 metrics including testing, case and vaccination rates.

“I believe that data is a powerful tool we can use to guide our response to COVID-19,”&nbsp;Dr. Lee Norman said. “I am hopeful this report empowers action in communities and encourages sharing and implementation of best practices across Local Health Departments. This report is not a report-card, as multiple factors impact COVID-19 testing, case and vaccination rates in our communities. It brings together the most critical COVID-19 metrics at a local level to help state, county, and local leaders work together to stop the spread of the dangerous COVID-19 delta variant and keep Kansans safe and keep the economy open.

interest rates will remain the same for the calendar quarter beginning 
October 1, 2021. The rates will be:

Under the Internal Revenue Code, the rate of interest is 
determined on a quarterly basis. For taxpayers other than corporations, 
the overpayment and underpayment rate is the federal short-term rate 
plus 3 percentage points.

Generally, in the case of a corporation, the underpayment rate is the

for large corporate underpayments is the federal short-term rate plus 5 
percentage points. The rate on the portion of a corporate overpayment of

KANSAS CITY (AP) — A woman involved in a fatal crash in Kansas City told investigators she had been fleeing gunfire when she ran a red light and crashed into another car, police there said.

The crash happened earlier this month on the morning of Aug. 3 at an eastern Kansas City intersection, police said. Thee woman was driving east on Truman Road when she ran a red light and slammed into a northbound car, according to investigators.

The 80-year-old driver of the northbound car was taken to a hospital and died there Monday from his injurieS, police said. His name has not been released.

Police said the woman involved in the crash told officers she fled when someone started shooting at her.

Police have not said whether charges will be filed in the cash.

Woman in fatal KC crash says she was fleeing gunfire

A federal grand jury in St. Louis has indicted an Overland Park 
anesthesiologist on charges he conspired to defraud Medicare out of $26 
million.

The 25-count indictment of Dr. Scott Taggart Roethle 
alleges that telemedicine and marketing companies paid him more than 
$674,000 in kickbacks between 2017 and 2020 to sign prescriptions and 
orders for patients he had never met.

Between October 2017 and 
April 2019, the indictment says he ordered knee braces for 3,584 
patients for which Medicare was billed $6.5 million.

He also 
allegedly signed orders for genetic tests after receiving an email from a
 company called Encore Telemedicine/Locum Tenens USA asking if he was 
interested in signing about 180 genetic test orders. The labs that 
received those tests billed $53 million to Medicare, which ended up 
paying more than $18 million for 2,853 patients for whom Roethle signed 
orders.

The indictment also charges that Roethle ordered medically
 unnecessary topical creams for 206 patients, causing Medicare to pay 
out more than $365,000.

Roethle did not respond to a message KCUR left on his cellphone. It is not known if he is represented by an attorney.

The
 indictment says two durable medical equipment companies in Cape 
Girardeau, Missouri — MC Medical Supply and Integrity Medical Supply — 
paid kickbacks to Roethle in exchange for orders he sent to them.

Court
 records show the owner of MC Medical Supply, Brandy McKay, pleaded 
guilty in St. Louis last October to defrauding Medicare and Medicaid. 
She is awaiting sentencing.

The owners of Integrity Medical 
Supply, Jackson Siples III and Jamie McCoy, were indicted in connection 
with the same scheme. McCoy pleaded guilty last November to defrauding 
Medicare and Medicaid and is scheduled to be sentenced on Oct. 14. 
Siples has pleaded not guilty and is awaiting trial.

Roethle’s 
indictment says he worked as a telemedicine doctor for at least 10 
medical supply companies, including MC Medical Supply and Integrity 
Medical Supply. That work was in addition to his work as an 
anesthesiologist in Kansas and Missouri, according to the indictment.

“It
 was part of the conspiracy that marketing companies ran television and 
online ads offering orthotic braces and other services, at no cost, to 
patients,” the indictment alleges. “When a patient responded to the ad, 
an employee of a call center collected pertinent information from the 
patient, including the patient's name and address, the name of the 
patient's primary care physician, insurance information, Medicare 
number, and areas of pain. In some instances, the marketers made ‘cold 
calls’ to patients.”

The companies then allegedly sent the patient
 information to Roethle and other telemedicine doctors, who certified 
that the patients needed the products in question, even though they had 
no doctor-patient relationship with them and didn’t determine the items 
or services were medically necessary.

In many instances, patients 
complained to Roethle that they didn’t need or want the items he had 
ordered for them, according to the indictment.

Michael Bradley, a spokesman for the U.S. Attorney’s Office in St. 
Louis, which is prosecuting the case, told KCUR that Roethle was 
indicted in St. Louis because many of the affected patients live there.

Roethle
 obtained licenses to practice in 22 states and, according to the 
indictment, signed orders for thousands of patients living in those 
states.

Records show he has been sanctioned in at least 10 states 
for prescribing medications via telemedicine to patients with whom he 
did not have a physician-patient relationship.

In December 2018, <a href="https://bmp.hlb.state.mn.us/ostate/ROETHLE,%20Scott%20T%20(PY64266)/ROETHLE,%20Scott%20T%20ID%206-26-20.pdf" target="_blank">the Idaho State Board of Medicine cited him</a> for prescribing testosterone to three patients via telemedicine and publicly reprimanded him.

In December 2019, <a href="https://bmp.hlb.state.mn.us/ostate/ROETHLE,%20Scott%20T%20(PY64266)/ROETHLE,%20Scott%20T%20IA%2012-20-19.pdf" target="_blank">the Iowa Board of Medicine cited him</a> for prescribing medications to a patient via telemedicine. Roethle agreed to pay a $5,000 civil penalty.

Reciprocal
 disciplinary actions over the Idaho and Iowa cases have been issued 
against Roethle by medical boards in Arizona, Colorado, Illinois, 
Alabama, Minnesota, Mississippi, Maine and Texas, records show.

Various
 health care-related websites state that Roethle received his medical 
degree from the University of Minnesota Medical School in 2005. 
(Doximity, an online networking service for health care providers, <a href="https://www.doximity.com/pub/scott-roethle-md" target="_blank">says he received his medical degree from the University of Texas Medical School</a> and did his internship and residency at the University of Texas Health Science Center.)

An Overland Park company called <a href="https://www.in2greatkc.com/about-us/" target="_blank">In2Great Functional Medicine</a>
 lists Roethle as its medical director. A bio on its website describes 
Roethle as a board-certified anesthesiologist “with a passion for 
helping people get and stay healthy.”

A person who answered the phone at In2Great Functional Medicine said he was not in the office. 

Several
 health care websites list Roethle as being affiliated with Overland 
Park Regional Medical Center, Menorah Medical Center and Children’s 
Mercy Hospital. But spokespersons for those hospitals said he was not 
affiliated with them.

The indictment says Roethle was licensed in 
Missouri and Kansas but doesn’t say where he worked. His Kansas Board of
 Healing Arts profile lists his address as 13725 Metcalf Ave. in 
Overland Park, which turns out to be a UPS store where he maintains a 
mailbox.

He lists the same phone number for Bothwell Regional 
Health Center in Sedalia, Missouri, where he was employed until June of 
this year.

Dana Kelchner, a spokeswoman for the hospital, said 
Roethle left after saying he had found another job. She said the 
hospital had not experienced any problems with Roethle and the hospital 
was not mentioned in the criminal charges against Roethle.

The 
indictment underscores how readily telemedicine, the practice of using 
telecommunication technology to provide long-distance health care, can 
be abused. The technology has proven particularly popular during the 
COVID-19 pandemic because it reduces disease exposure for providers and 
patients, preserves scare supplies of personal protective equipment and 
reduces patient demand on facilities.

Two weeks ago, <a href="https://www.justice.gov/opa/pr/telemedicine-company-owner-charged-superseding-indictment-784-million-health-care-fraud" target="_blank">a federal grand jury charged</a>
 the Florida owner of multiple telemedicine companies with an illegal 
kickback scheme involving the submission of $784 million in allegedly 
fraudulent claims to Medicare.

About a year ago, 345 defendants 
were charged in a major telehealth takedown that prosecutors said 
resulted in $6 billion in losses to federal health care programs, 
including $4.5 billion related to telemedicine.

And in April 2019, <a href="https://www.kcur.org/2019-04-10/feds-charge-24-in-alleged-1-2-billion-medicare-fraud-scheme" target="_blank">federal prosecutors charged 24 individuals and telehealth companies</a>
 for allegedly accepting kickbacks from medical equipment companies and 
defrauding Medicare of $1.2 billion by persuading patients in 
telemedicine visits to accept items that were not medically necessary.

anesthesiologist on charges he conspired to defraud Medicare out of $26 
million.The 25-count indictment of Dr. Scott Taggart Roethle 
alleges that telemedicine and marketing companies paid him more than 
$674,000 in kickbacks between 2017 and 2020 to sign prescriptions and 
orders for patients he had never met.Between October 2017 and 
April 2019, the indictment says he ordered knee braces for 3,584 
patients for which Medicare was billed $6.5 million.He also 
allegedly signed orders for genetic tests after receiving an email from a
 company called Encore Telemedicine/Locum Tenens USA asking if he was 
interested in signing about 180 genetic test orders. The labs that 
received those tests billed $53 million to Medicare, which ended up 
paying more than $18 million for 2,853 patients for whom Roethle signed 
orders.The indictment also charges that Roethle ordered medically
 unnecessary topical creams for 206 patients, causing Medicare to pay 
out more than $365,000.Roethle did not respond to a message KCUR left on his cellphone. It is not known if he is represented by an attorney.The
 indictment says two durable medical equipment companies in Cape 
Girardeau, Missouri — MC Medical Supply and Integrity Medical Supply — 
paid kickbacks to Roethle in exchange for orders he sent to them.Court
 records show the owner of MC Medical Supply, Brandy McKay, pleaded 
guilty in St. Louis last October to defrauding Medicare and Medicaid. 
She is awaiting sentencing.The owners of Integrity Medical 
Supply, Jackson Siples III and Jamie McCoy, were indicted in connection 
with the same scheme. McCoy pleaded guilty last November to defrauding 
Medicare and Medicaid and is scheduled to be sentenced on Oct. 14. 
Siples has pleaded not guilty and is awaiting trial.Roethle’s 
indictment says he worked as a telemedicine doctor for at least 10 
medical supply companies, including MC Medical Supply and Integrity 
Medical Supply. That work was in addition to his work as an 
anesthesiologist in Kansas and Missouri, according to the indictment.“It
 was part of the conspiracy that marketing companies ran television and 
online ads offering orthotic braces and other services, at no cost, to 
patients,” the indictment alleges. “When a patient responded to the ad, 
an employee of a call center collected pertinent information from the 
patient, including the patient's name and address, the name of the 
patient's primary care physician, insurance information, Medicare 
number, and areas of pain. In some instances, the marketers made ‘cold 
calls’ to patients.”The companies then allegedly sent the patient
 information to Roethle and other telemedicine doctors, who certified 
that the patients needed the products in question, even though they had 
no doctor-patient relationship with them and didn’t determine the items 
or services were medically necessary.In many instances, patients 
complained to Roethle that they didn’t need or want the items he had 
ordered for them, according to the indictment.Michael Bradley, a spokesman for the U.S. Attorney’s Office in St. 
Louis, which is prosecuting the case, told KCUR that Roethle was 
indicted in St. Louis because many of the affected patients live there.<h2>Medical licenses</h2>Roethle
 obtained licenses to practice in 22 states and, according to the 
indictment, signed orders for thousands of patients living in those 
states.Records show he has been sanctioned in at least 10 states 
for prescribing medications via telemedicine to patients with whom he 
did not have a physician-patient relationship.In December 2018, <a href="https://bmp.hlb.state.mn.us/ostate/ROETHLE,%20Scott%20T%20(PY64266)/ROETHLE,%20Scott%20T%20ID%206-26-20.pdf" target="_blank">the Idaho State Board of Medicine cited him</a> for prescribing testosterone to three patients via telemedicine and publicly reprimanded him.In December 2019, <a href="https://bmp.hlb.state.mn.us/ostate/ROETHLE,%20Scott%20T%20(PY64266)/ROETHLE,%20Scott%20T%20IA%2012-20-19.pdf" target="_blank">the Iowa Board of Medicine cited him</a> for prescribing medications to a patient via telemedicine. Roethle agreed to pay a $5,000 civil penalty.Reciprocal
 disciplinary actions over the Idaho and Iowa cases have been issued 
against Roethle by medical boards in Arizona, Colorado, Illinois, 
Alabama, Minnesota, Mississippi, Maine and Texas, records show.Various
 health care-related websites state that Roethle received his medical 
degree from the University of Minnesota Medical School in 2005. 
(Doximity, an online networking service for health care providers, <a href="https://www.doximity.com/pub/scott-roethle-md" target="_blank">says he received his medical degree from the University of Texas Medical School</a> and did his internship and residency at the University of Texas Health Science Center.)An Overland Park company called <a href="https://www.in2greatkc.com/about-us/" target="_blank">In2Great Functional Medicine</a>
 lists Roethle as its medical director. A bio on its website describes 
Roethle as a board-certified anesthesiologist “with a passion for 
helping people get and stay healthy.” A person who answered the phone at In2Great Functional Medicine said he was not in the office. Several
 health care websites list Roethle as being affiliated with Overland 
Park Regional Medical Center, Menorah Medical Center and Children’s 
Mercy Hospital. But spokespersons for those hospitals said he was not 
affiliated with them.The indictment says Roethle was licensed in 
Missouri and Kansas but doesn’t say where he worked. His Kansas Board of
 Healing Arts profile lists his address as 13725 Metcalf Ave. in 
Overland Park, which turns out to be a UPS store where he maintains a 
mailbox.He lists the same phone number for Bothwell Regional 
Health Center in Sedalia, Missouri, where he was employed until June of 
this year.Dana Kelchner, a spokeswoman for the hospital, said 
Roethle left after saying he had found another job. She said the 
hospital had not experienced any problems with Roethle and the hospital 
was not mentioned in the criminal charges against Roethle.The

Kan. doctor accused in $26M telemedicine abuse scheme 

WASHINGTON (AP) — Two members of Congress flew unannounced into Kabul airport in the middle of the chaotic evacuation stunning State Department and U.S. military personnel who had to divert resources to provide security and information to the lawmakers, U.S. officials said.

Rep. Seth Moulton, D-Mass., and Rep. Peter Meijer, R-Mich., flew in and out on charter aircraft and were on the ground at the Kabul airport for several hours Tuesday. That led officials to complain that they could be taking seats that would have otherwise gone to other Americans or Afghans fleeing the country, but the congressmen said in a joint statement that they made sure to leave on a flight with empty seats.

“As Members of Congress, we have a duty to provide oversight on the executive branch,’” the two said in their statement. “We conducted this visit in secret, speaking about it only after our departure, to minimize the risk and disruption to the people on the ground, and because we were there to gather information, not to grandstand.”

The two lawmakers are both military veterans, with backgrounds in the region. Moulton, a Marine who has been outspoken critic of the Iraq War, served multiple tours in Iraq. Meijer was deployed as part of the Army Reserves and later worked in Afghanistan at a nongovernmental organization providing aid. Moulton serves on the House Armed Services Committee and Meijer is on the House Foreign Affairs Committee.

Three officials familiar with the flight said that State Department, Defense Department and White House officials were furious about the incident because it was done without coordination with diplomats or military commanders directing the evacuation.

The U.S. military found out about the visit as the legislators’ aircraft was inbound to Kabul, according to the officials. The officials spoke on condition of anonymity to discuss ongoing military operations.

One senior U.S. official said the administration saw the lawmakers’ visit as manifestly unhelpful and several other officials said the visit was viewed as a distraction for troops and commanders at the airport who are waging a race against time to evacuate thousands of Americans, at-risk Afghans and others as quickly as possible.

House Speaker Nancy Pelosi issued a statement Tuesday evening taking note of the desire of some legislators to visit Afghanistan and saying she was writing to “reiterate that the Departments of Defense and State have requested that Members not travel to Afghanistan and the region during this time of danger. Ensuring the safe and timely evacuation of individuals at risk requires the full focus and attention of the U.S. military and diplomatic teams on the ground in Afghanistan.”

The Pentagon has repeatedly expressed concerns about security threats in Kabul, including by the Islamic State group. When members of Congress have routinely gone to war zones over the past two decades, their visits are typically long planned and coordinated with officials on the ground in order to ensure their safety.

President Joe Biden on Tuesday said he is sticking to his Aug. 31 deadline for completing the risky airlift as people flee Taliban-controlled Afghanistan.

The two congressmen said they went into their visit wanting “to push the president to extend the August 31st deadline. After talking with commanders on the ground and seeing the situation here, it is obvious that because we started the evacuation so late, that no matter what we do, we won’t get everyone out on time, even by September 11.”

KDHE: 37 new COVID deaths, 3,478 new cases

DEATH VALLEY NATIONAL PARK, Calif. (AP) — Death Valley National Park rangers are reminding visitors to limit stressful activities during blazing summer heat after another hiker died along the same trail within days.

Blake Chaplin, 52, of Leawood,&nbsp;Kansas, was found dead on Aug. 21 along the Golden Canyon Trail, the park said in a statement Tuesday.

A search-and-rescue team recovered the body after it was reported by an early morning hiker. The cause of death was being investigated by Inyo County authorities but foul play was not suspected, the park said.

Temperatures on Aug. 21-22 reached 109 degrees Fahrenheit ), below the daily normal of 115 F.

Authorities said Lawrence Stanback, 60, of San Francisco died on the same trail on Aug. 18. Heat stroke was suspected in his death.

Heat danger: Kan. man dies in Death Valley National Park

SHAWNEE COUNTY– Law enforcement authorities investigating a Tuesday afternoon shooting have identified the victim as James Epps, Jr., 37, of Topeka.

Just before 2 p.m. officers were dispatched to Travelers Inn, 3846 SW Topeka Blvd. on a report of a shooting, according to police spokesperson Gretchen Spiker.

Responding officers located Epps suffering from life-threatening injuries. American Medical Response personnel pronounced him deceased at the scene.

Multiple people were taken into police custody to be interviewed.

A suspect was identified as Isaiah Krainbill, 19, of Topeka. Police located and took him into custody and later booked him into the Shawnee County Department of Corrections on a requested charge of First Degree Murder, according to Lt. John Trimble.

SHAWNEE COUNTY– Law enforcement authorities are investigating a Tuesday afternoon shooting that left one person dead.

Responding officers located an adult male suffering from life-threatening injuries believed to be associated with a shooting. American Medical Response personnel pronounced the man deceased at the scene.

Multiple people were taken into police custody to be interviewed. Police have not released the name of the victim.

American Medical Response personnel pronounced the man deceased at the scene.Multiple people were taken into police custody to be interviewed. Police have not released the name of the victim.

19-year-old accused in fatal Kansas motel killing

SEDGWICK COUNTY —Law enforcement authorities investigating a fatal 2-vehicle crash that occurred just after 6p.m. Tuesday in Sedgwick County and have identified the victim as 53-year-old Dana Pabst of Wellington.

An eastbound Nissan Rogue driven by a 61-year-old woman struck a northbound Chevy Malibu driven by Pabst at the intersection of 79th Street South and HIllside, according to Lt. Benjamin Blick.

 The Malibu crossed the centerline and Pabst lost control as she was negotiating a curve at the intersection.&nbsp;Pabst died at the scene.

EMS transported the other driver to a local hospital with non-life threatening injuries, according to Blick. The circumstances of the collision are under investigation.

Sheriff IDs Kansas woman who died in 2-vehicle crash

SHAWNEE, Kan. (AP) — Officials in suburban Kansas City, Kansas, say a man pulled from the basement of a burning home in Shawnee has died from his injuries at a hospital. 

The Shawnee Fire Department says in a news release that firefighters were called to the home on West 52nd Terrace Street late Monday night. Officials say four of five people in the home were able to safely escape, but firefighters had to enter the house to try to rescue 53-year-old Matthew Deckard from the basement. 

Firefighters pulled him from the home, started CPR and rushed him to a Kansas City hospital in critical condition. Officials say Deckard died at the hospital the next day.

Just before 1:30 a.m., Sunday, a citizen at the Quik Trip at Murdock and Broadway in Wichita contacted police, according to Officer Trevor Macy.

 While the officer was at the scene with reporting party, 24-year-old Alex Flores entered the patrol vehicle and drove to the 1000 block of South Topeka, where the patrol struck a parked vehicle causing heavy damage to both vehicles. 

Police located Flores at the scene and took him into custody without incident. He<a href="https://ssc.sedgwickcounty.org/sheriffinmates/SheriffInmateDetail.aspx?nameId=20070463"> remains jailed on requeste</a>d charges of auto theft, hit and run, drive under the influence, drive with a suspended driver's license and an active warrant.

Police are also investigating&nbsp; the officers' actions.

 Police: Man took joy ride in Kansas officer's patrol car

WASHINGTON (AP) — The Supreme Court on Tuesday said the Biden administration likely violated federal law in trying to end a Trump-era program that forces people to wait in Mexico while seeking asylum in the U.S.

With three liberal justices in dissent, the high court refused to block a lower court ruling ordering the administration to reinstate the program informally known as Remain in Mexico.

It’s not clear how many people will be affected and how quickly. Under the lower court ruling, the administration must make a “good faith effort” to restart the program.

There also is nothing preventing the administration from trying again to end the program, formally called Migrant Protection Protocols.

A federal judge in Texas had previously ordered that the program be reinstated last week. Both he and the 5th U.S. Circuit Court of Appeals refused the administration’s request to put the ruling on hold.

Justice Samuel Alito ordered a brief delay to allow the full court time to consider the administration’s appeal to keep the ruling on hold while the case continues to make its way through the courts.

The 5th Circuit ordered expedited consideration of the administration’s appeal.

The court offered little explanation for its action, although it cited its opinion from last year rejecting the Trump administration’s effort to end another immigration program, Deferred Action for Childhood Arrivals. In that case, the court held that the decision to end DACA was “arbitrary and capricious,” in violation of federal law.

The administration has “failed to show a likelihood of success on the claim that the memorandum rescinding the Migrant Protection Protocols was not arbitrary and capricious,” the court wrote Tuesday in an unsigned order.

The three dissenting justices, Stephen Breyer, Elena Kagan and Sonia Sotomayor, did not write an opinion expressing their views of the case.

In a statement, the Department of Homeland Security said it regrets that the high court declined to issue a stay. The department said it would continue to challenge the district court’s order.

The American Civil Liberties Union called on the administration to present a fuller rationale for ending Remain in Mexico that could withstand court scrutiny.

“The government must take all steps available to fully end this illegal program, including by re-terminating it with a fuller explanation. What it must not do is use this decision as cover for abandoning its commitment to restore a fair asylum system,” said Omar Jadwat, director of the ACLU’s immigrant rights project.

During Donald Trump’s presidency, the policy required tens of thousands of migrants seeking asylum in the U.S. to turn back to Mexico. It was meant to discourage asylum seekers but critics said it denied people the legal right to seek protection in the U.S. and forced them to wait in dangerous Mexican border cities.

The judge, U.S. District Judge Judge Matthew J. Kacsmaryk in Amarillo, Texas, ordered that the program be reinstated in response to a lawsuit filed by the states of Texas and Missouri, whose governors have been seeking to reinstate some of the hard-line anti-immigration policies of the Trump administration.

The Biden administration argued in briefs that the president has “clear authority to determine immigration policy” and that Homeland Security Secretary Alejandro Mayorkas had discretion in deciding whether to return asylum seekers to Mexico.

The policy has been dormant for more than a year and the administration argued that abruptly reinstating it “would prejudice the United States’ relations with vital regional partners, severely disrupt its operations at the southern border, and threaten to create a diplomatic and humanitarian crisis.”

The Trump administration largely stopped using the “Remain in Mexico” policy at the start of the pandemic, at which point it began turning back virtually everyone crossing the Southwest border under a different protocol — a public health order that remains in effect.

President Joe Biden suspended the program on his first day of office and the Homeland Security Department ended it in June.

Kacsmaryk was nominated to the federal bench by Trump. The 5th Circuit panel that ruled Thursday night included two Trump appointees, Andrew Oldham and Cory Wilson, along with Jennifer Walker Elrod, nominated to the appeals court by President George W. Bush.

At the high court, at least five of the six conservative justices, including three Trump appointees, voted for the restart of the program. Under the court’s opaque treatment of emergency appeals, the justices don’t always say publicly how they voted.

Supreme Court: Biden must reinstate Trump's 'Remain in Mexico' policy

WASHINGTON—The Federal Communications Commission on Tuesday proposed a $5,134,500 fine against John M. Burkman, Jacob Alexander Wohl, and J.M. Burkman &amp; Associates LLC for apparently making 1,141 unlawful robocalls to wireless phones without prior express consent in violation of the Telephone Consumer Protection Act.  This is the largest TCPA robocall fine ever proposed by the Commission.  It is also the first action where the FCC was not required to warn robocallers before robocall violations could be counted toward a proposed fine, per Congress’s recent amendment of the TCPA. 

The FCC’s Enforcement Bureau investigation found that the calls in this case were apparently prerecorded and made to consumers’ wireless phones without the required prior consent.  Subject to narrow exceptions, the TCPA prohibits making prerecorded voice calls to wireless phones without the consent of those receiving the calls – regardless of the content of the calls.  The robocalls in this case, made on August 26 and September 14, 2020, used messages telling potential voters that, if they vote by mail, their “personal information will be part of a public database that will be used by police departments to track down old warrants and be used by credit card companies to collect outstanding debts.”  The Commission began its investigation following consumer complaints and concerns raised by a non-profit organization. 

The Enforcement Bureau worked with the Ohio Attorney General’s Office to identify two dialing service providers that provided subpoena responses confirming the robocall campaigns and identifying the clients who had hired them for this service.  The Bureau used the subpoenaed call records and recordings of the calls to determine that the calls apparently went to wireless phones and the message was prerecorded.  The consumers who agreed to speak with the Bureau about the calls confirmed they had not provided prior consent to the callers.  The subpoenas also produced email exchanges between the dialing service vendors and Wohl and Burkman about the call campaigns – including choosing which zip codes to target and “the tape we want to go out.”

The calls themselves identified Wohl and Burkman by name and used Burkman’s wireless phone number as the caller ID.  Wohl and Burkman also both admitted under oath to their involvement in the creation and distribution of the robocalls, with Burkman stating in the U.S. District Court for the Southern District of New York, “That is our call, yes, yes” with confirmation from Wohl.

The Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence (TRACED) Act of 2019 amended the TCPA so as to make inapplicable a provision of the law that previously had required the Commission to issue citations to non-FCC-regulated parties that apparently violated the TCPA.  These citation requirements did not apply to the Truth in Caller ID Act, which established caller ID spoofing limits and under which the agency has issued numerous, large fines. 

The proposed action, formally called a Notice of Apparent Liability for Forfeiture, or NAL, contains only allegations that advise a party on how it has apparently violated the law and may set forth a proposed monetary penalty.  The Commission may not impose a greater monetary penalty in this case than the amount proposed in the NAL.  Neither the allegations nor the proposed sanctions in the NAL are final Commission actions.  The parties will be given an opportunity to respond and the Commission will consider the party’s submission of evidence and legal arguments before acting further to resolve the matter.

Just after 7p.m. Tuesday officers were dispatched to a Topeka hospital in regards to an adult woman with a gunshot wound, according to Lt. Ron Ekis. 

A private vehicle brought to the hospital. Her injuries are considered non-life threatening. Police released no additional details late Tuesday.

The Kansas Highway Patrol reported a&nbsp; 2002 Jeep Liberty driven by Chelsie Faith Randel, 19, Topeka was westbound on Interstate 70 in Leavenworth County.

The Jeep traveled onto the outside shoulder, collided with the outside guardrail, traveled across all westbound lanes, collided with the inside barrier wall, rolled and the driver was ejected.

Randel was pronounced dead at the scene. She was not wearing a seat belt, according to the KHP.&nbsp; The accident remains under investigation.

KANSAS CITY (AP) — Jackson County Prosecutor Jean Peters Baker is asking that a special prosecutor be appointed to investigate the&nbsp;<a href="https://apnews.com/article/kansas-city-michael-brown-kansas-police-shootings-07c9ee2bca9013d73d8751a263932aa5">fatal police shooting of a Kansas City man that has been criticized by some area clergy and civil rights activists.</a>

Peters Baker asked in a court filing that an assistant prosecutor from St. Louis County determine if the police shooting of Malcolm Johnson, 31, was justified, The Kansas City Star&nbsp;<a href="https://www.kansascity.com/news/local/crime/article253681523.html">reported.</a>

Peters Baker said her office's prosecutions of Johnson in prior criminal cases could be seen as a conflict of interest during the shooting investigation. Baker's office charged Johnson in 2014 in a fatal shooting, and he later pleaded to reduced charges of involuntary manslaughter and armed criminal action.

Johnson was shot and killed by police on March 25 inside a Kansas City convenience store.

Police had identified him as a suspect in a non-fatal shooting when they approached him in the store. Police said Johnson shot an officer during an altercation while he was being arrested.

But videos of the shooting raised questions about the police version, and the leader of a group of clergy who questioned the circumstances called Johnson's death “an execution.”

Special prosecutor sought for Kansas City police shooting

A pickup reported stolen Monday afternoon in Salina was later found across town with two 13-year-old occupants.

A 62-year-old Salina man told police that sometime between 2-2:15 p.m. Monday, someone stole his 2001 Dodge Ram 1500 from where it was parked in front of his residence in the 700 block of State Street, according to Salina Police Captain Paul Forrester. The pickup was valued at $1,500.

While officers were at the call, a citizen reported the same pickup driving recklessly in the 2600 block of S. Ohio Street in Salina.

A Kansas Highway Patrol trooper who was in the area located and stopped the pickup in the 1300 block of Meyer Drive. The pickup had struck a mailbox, Forrester said.

A 13-year-old boy had been driving, he said. The passenger in the pickup was a 13-year-old girl.

Police arrested the boy was arrested on requested charges&nbsp; of Felony possession of stolen property, no driver's license, Possession of tobacco, Duty upon striking other property and Reckless driving. He is being held at the North Central Kansas Regional Juvenile Detention Facility in Junction City.

By LESLIE EIKLEBERRY Salina PostA pickup reported stolen Monday afternoon in Salina was later found across town with two 13-year-old occupants.A 62-year-old Salina man told police that sometime between 2-2:15 p.m. Monday, someone stole his 2001 Dodge Ram 1500 from where it was parked in front of his residence in the 700 block of State Street, according to Salina Police Captain Paul Forrester. The pickup was valued at $1,500.While officers were at the call, a citizen reported the same pickup driving recklessly in the 2600 block of S. Ohio Street in Salina.A Kansas Highway Patrol trooper who was in the area located and stopped the pickup in the 1300 block of Meyer Drive. The pickup had struck a mailbox, Forrester said.A 13-year-old boy had been driving, he said. The passenger in the pickup was a 13-year-old girl.Police arrested the boy was arrested on requested charges&nbsp; of Felony possession of stolen property, no driver's license, Possession of tobacco, Duty upon striking other property and Reckless driving. He is being held at the North Central Kansas Regional Juvenile Detention Facility in Junction City.

Manhattan— Authorities are working to determine the cause of a fire at a home in Manhattan.

Just before 6:30 p.m. Tuesday,&nbsp; the Manhattan Fire Department was dispatched to a fire at a home at 1310 Fremont Street, according to Deputy Fire Chief Ryan Almes.

Upon arrival, crews found a large single-family home with fire showing from the rear.&nbsp; The fire reached a second alarm before it was contained in just over 10 minutes. 

The occupants were home at the time of the fire and were able to exit the structure prior to the fire department's arrival.&nbsp; Crews were able to locate and remove an uninjured dog in the home.&nbsp; No injuries were reported.&nbsp; The building is a 2 1/2 story single-family residence. &nbsp; Loss is estimated at $30,000 to contents and $50,000 to the structure. The house next door located at 1314 Fremont Street had an estimated $1000 damage to the exterior from the fire.&nbsp;

Kansas poison control hotline after self-medicating for COVID-19 with a 
drug intended to fight parasitic infections in animals.Ivermectin can cause severe health problems in humans, and medical experts <a target="_blank" href="https://www.fda.gov/consumers/consumer-updates/why-you-should-not-use-ivermectin-treat-or-prevent-covid-19">warn against using the drug to treat or prevent COVID-19</a>.
 Interest in the drug is being driven by disinformation on social media 
platforms and claims from lawmakers, including a Kansas state senator.Dana Hawkinson, medical director of 
infection prevention for University of Kansas Health System, said the 
organization’s poison control hotline receives one to three calls per 
month regarding ivermectin. That number is increasing, he said.Under certain medical conditions, 
ivermectin can be beneficial for humans, but self-dosing is a higher 
risk than the COVID-19 vaccine, Hawkinson said.“There are much more and worse side 
effects with ivermectin. It’s amazing to me people still would like to 
do this,” Hawkinson said. “If you take ivermectin in the wrong way or 
you take too much you can certainly get toxicity from it, including 
central nervous toxicity.”Throughout the pandemic, alternative 
treatments to the COVID-19 virus — including the use of 
hydroxychloroquine and ivermectin — have become popular despite 
universal warnings from medical experts. The recent surge in those 
seeking out the antiparasitic has Kansas and national medical experts 
uneasy.Both the Infectious Disease Society 
of America and the World Health Organization recommend against 
ivermectin use to treat or prevent COVID-19. The <a target="_blank" href="https://www.fda.gov/consumers/consumer-updates/why-you-should-not-use-ivermectin-treat-or-prevent-covid-19">Food and Drug Administration also recommended against this</a>
 use, and said it received multiple reports of patients who have 
required medical attention and hospitalization after self-medicating 
with ivermectin.“You are not a horse. You are not a cow. Seriously, y’all. Stop it,” the agency said in a tweet.The FDA noted use of the drug in 
doses intended for animals could prove fatal — and even smaller doses 
could interact dangerously with other medications if not reviewed by a 
doctor. Overdosing on ivermectin can cause nausea, vomiting, low blood 
pressure, seizures, coma and even death.Ivermectin is sold at several chain 
pharmacies, including CVS, Walgreens and Walmart. The product also is 
readily available at retailers such as Tractor Supply Co. for as little 
as $6.<figure>

Mark Steffen, R-Hutchinson, said it was a <a target="_blank" href="https://kansasreflector.com/2021/01/31/kansas-senator-believes-political-propaganda-fearmongering-impairs-covid-19-response/">mistake not to prescribe ivermectin</a> to decrease hospitalizations and deaths from COVID-19.“As a physician who’s battled this 
thing from the start, I never felt like our leadership … has learned 
lessons from this virus and adapted its strategies,” Steffen said during
 a joint House and Senate hearing on COVID-19 attended by KDHE secretary
 Lee Norman. “We’ve been starved for early outpatient treatments. We’ve 
been starved, and they’ve been there and we’ve denied their use through 
the CDC, through the NIH, through our administration.”In June, Steffen referenced the drug 
in a post on his Facebook page. Alongside a Fox News video clip, Steffen
 claimed several federal government agencies, Anthony Fauci, big tech 
and doctors were blocking access to alternative treatments, resulting in
 many unnecessary deaths.“This conspiracy killed tens to 
hundreds of thousands of innocent people. Manslaughter or premeditated 
murder? The Courts will decide,” Steffen wrote.Matt Lara, a spokesman for the Kansas
 Department of Health Environment, repeated warnings made by medical 
experts against the use of ivermectin to treat COVID-19.“Ivermectin is not an antiviral 
drug,” Lara said. “It has been approved in humans for use in some 
parasitic worms, head lice and certain skin conditions. Taking large 
doses of this drug is dangerous and can cause serious harm.”
