Virtual Wings & Wetlands Festival set for March 24-26

One of the first priorities of the Senate was to address property tax reform. The bill requires local government to practice “Truth in Taxation” when they desire to use revenues from higher property valuations to increase taxes. This legislation is similar to legislation that has been used in several states, including Utah for over 20 years. The highlights of the bill: Transparency-The bill would establish new notifications and public hearing requirements for taxing subdivisions seeking to increase property taxes above those provided for by their “revenue-neutral rate.” A taxing subdivision would be prohibited from levying taxes exceeding its revenue-neutral rate without first approving a resolution or ordinance in accordance with the procedure provided by the bill. It requires county clerks to notify the public about the intent to exceed the “revenue neutral rate” via publishing such notification on their website as well as via a mailing to each taxpayer impacted. The public hearing would have to he held by September 10th. The governing body of the taxing district would have to vote to exceed the revenue neutral rate by a majority vote. Those entities not complying would be required to refund the property taxes. Regular Maintenance of Property-The bill would prohibit an increase in the appraised value of real property solely as a result of normal repair, replacement, or maintenance of existing structures, equipment, or other improvement on the property. Payment Plans-The bill would authorize county treasurers to accept partial payments and establish payment plans for all property taxes. Current law allows treasurers to accept partial payments for delinquent property taxes. Finally, this bill will eliminate the property tax lid, which currently requires a public vote or certain property tax increases by cities and counties. The process of navigating the property tax lid could be cumbersome and often resulted in no practical benefit to the taxpayer.

The process included with SB13 greatly enhances the ability of Kansas taxpayers to understand what their local government is doing and then object. By requiring local officers to vote to exceed a revenue neutral rate, taxpayers can hold local officials accountable. The House amended the bill to include all local taxing jurisdictions in the state, including school districts. The Senate accepted the amendments, and the bill is now headed to the governor.

The Kansas Senate voted on SB50 which will provide fairness to main street businesses in Kansas that are attempting to compete with out-of-state online retailers. SB50 would mandate the collection and remittance of sales and compensating use tax by most marketplace facilitators beginning July 1, 2021. Entities with an annual gross receipt from sales into Kansas in excess of $100,000 would be subject to the mandate, which also would apply to out-of-state retailers with annual receipts from sales sourced into Kansas in excess of $100,000. In the Wayfair decision, the United States Supreme court made it clear that states needed to have a threshold in order to be in compliance. This will help level the playing field with Kansas businesses that are already collecting sales tax on sales in Kansas.

The Senate Ways and Means committee completed our work on the budget last week and the budget bill is scheduled to be debated on the floor Tuesday.

Three-day weather outlook

The Ellis County Health Department on Monday reported the average number of new coronavirus cases per day in the last seven days remained at one.

There were just three new cases of COVID-19 identified in Ellis County since Friday. There are currently 11 active cases and 3,692 recovered cases. There were no active hospitalizations of Ellis County residents.

As of Monday, there were four COVID-19 inpatients at HaysMed, with just three of those active patients and one in the recovery phase.

The seven-day average of percent of positive tests fell slightly to 2.3 percent.

Since reporting began, there have been 3,703 cases of COVID-19 identified in Ellis County, including 73 coronavirus-related deaths.

Of the total 25,661 tests administered, 13.3 percent have returned positive for COVID-19.

NOTE:&nbsp;"New cases" reflects cases reported by the Ellis County Health Department between regular reporting periods of Monday, Wednesday and Friday. "Total cases" reflects all cases reported by the department. Fort Hays State University is pleased to announce the plan for spring 2021 commencement ceremonies in two different formats — in-person and virtual. Four in-person commencement celebrations will be held in Gross Memorial Coliseum, and they will be live-streamed and recorded for later viewing. Two virtual commencement programs will also be live-streamed and recorded.

For those who plan to participate in person, several things will be different from previous commencement celebrations on campus. UPDATE: I-70 westbound now open

Hays is the only municipality in Kansas with a population greater than 15,000 that is not located near a sustainable source of water. 

 Current water supplies fluctuate based on precipitation. Conserving water has become a "way of life" for Hays residents and the city.

Through the Department of Water Resources, programs and incentives are available to encourage water conservation. One of those is an annual proclamation of "Fix a Leak Week."

Mayor Sandy Jacobs read and signed the proclamation Thursday declaring March 15 to 21 as "Fix a Leak Week" in Hays.&nbsp;

The observation is in partnership with WaterSense, a&nbsp;voluntary program sponsored by the U.S. Environmental Protection Agency to protect the future of the nation's water supply by promoting water efficiency and use of WaterSense labeled appliances and products.&nbsp;

According to the EPA, household leaks account for nearly 1 trillion gallons of water wasted across the United States each year - equal to the annual household water use of nearly 11 million homes.&nbsp;

People are encouraged to check their household fixtures and irrigations for water leaks during the third week of March.

Many common household leaks are easily correctible, including worn toilet flappers, leaking showerheads, and dripping faucets.&nbsp;

Fixing leaks can save homeowners an average of more than 10,000 gallons of water per year - the amount of water in a typical backyard swimming pool- the EPA says.

Water rates in Hays are tiered; the more you use, the more you're charged per cubic foot.

Holly Dickman, water conservation specialist, will be distributing red dye tablets and information to all elementary school students in Hays, encouraging the kids to be "leak detectives" and check for silent leaks in their household toilets.&nbsp; &nbsp;

If a leak is found, follow up tips are provided, including the city's toilet rebate program.&nbsp;

The "Leak Detective" program, which includes prizes, was cancelled last year because of the coronavirus pandemic.&nbsp;

🎥 Residents encouraged to check, test, replace during 'Fix a Leak Week' 

Area legislators representing Ellis County and portions of northwest Kansas are unhappy with the Kansas Department of Labor and are working together to find answers for constituents who have been unable to file for unemployment months after they lost their jobs due to the coronavirus pandemic.

Sen. Rick Billinger, R-Goodland, says another problem - with fraudulent unemployment claims being paid by the state - started a year ago.

"I had a local implement dealer call me who said he has two employees who've worked for him for 30 years and he just received unemployment claims on them," Billinger said from his home office during Saturday's Hays Chamber Virtual Legislative Coffee. "I got hold of the Department of Labor and tried to let them know there's fraud going on."

Billinger said the problem wasn't addressed then and it kept growing, as he and other legislators reported more fraudulent claims coming from their constituents.

"It took them a year to even respond to us, which is so disappointing.&nbsp; They didn't do anything.

"And the sad part of the whole thing is, we don't have anyone in the office. They're all working remote," Billinger added. "I don't believe the right hand knows what the left hand is doing."&nbsp;

Rep. Barb Wasinger, R-Hays, 111th Dist., and Rep. Ken Rahjes, R-Agra, 110th Dist., constantly nodded their heads in agreement with Billinger. They also were appearing virtually from their home offices.&nbsp;

A Feb. 24 audit by the non-partisan Kansas Legislative Division of Post Audit estimates at least <a href="https://hayspost.com/posts/1a6888b8-071a-4288-ba24-e6e041031185">$600 million may have been paid to fraudsters</a>.&nbsp;

"The state of Kansas unemployment is upside down and we've got people losing their homes, their cars," Billinger said. "I heard a week ago that somebody committed suicide, just gave up. We can't have these kinds of things going on in Kansas. Unfortunately, we paid $600 million in fraudulent claims and we can't get Kansans money that need it."

Billinger asked&nbsp;Mike Zamrzla, deputy state director for Republican U.S. Senator Jerry Moran, about a timeline for direct payment checks to most Americans that are part of the <a href="https://hayspost.com/posts/3820050f-0695-4338-858b-9312156bda8a">$1.9 trillion relief package</a> signed by Pres. Joe Biden on Thursday. The funds from the American Rescue Plan were to start showing up in bank accounts as early as the weekend.

"I'm hoping at least these federal $1,400 checks will reach these folks quicker probably than the unemployment in Kansas (will)," Billinger said.

"I wish my crystal ball was a little bit clearer there," Zamrzla answered from his Wichita office.

"We'll be in touch with the IRS and folks with the Treasury Department and in the administration to see that that timeline is certainly encouraged. Now that the bill has passed, certainly those dollars need to get out to Kansans and Americans just as quickly as possible."

Zamrzla noted that Sen. Moran had voted against the FY2021 Budget Reconciliation, which included the $1.9 trillion COVID-19 relief package.

"It was just too large. (Moran) was actually part of group of senators several weeks back that met with the president and proposed what they considered a more reasonably sized package - $618 billion - that was more generally focused to COVID relief. But, unfortunately, from Senator Moran's perspective, that was not taken," Zamrzla said.

Billinger later said he had talked with acting Kansas Dept. of&nbsp; Labor Secretary Amber Shultz  last week and urged her to have KDOL employees return to the office.

"Put up plexiglass. Get them shots. If they're not essential employees at this particular time, I don't know who is.

"We owe it to Kansans who are unemployed."

Wasinger and Rahjes again agreed with Billinger and said they also are working daily on unemployment issues.

"I have one gentleman who's been contacting me since early November," Wasinger said. "It breaks your heart."

Billinger contends the problems are not all related to a decades-old computer system that was overwhelmed with the four million claims made shortly after Democratic Gov. Laura Kelly issued a statewide stay-at-home order last spring to help slow the spread of COVID-19.

"Well, yeah, maybe the system is outdated," Billinger agreed. "This administration has had over two years. Not once did I see a request in our budget to upgrade the computers or anything else."&nbsp;

Rahjes talked about a young family in Ellis County "who's gonna lose not just their home but their electricity, formula for their baby.

"These are people. These are not numbers."

Rahjes said he drives by the Department of Labor building in Topeka and there's nobody in the office.

"(It) started out to be 24 to 48 hours (response time)," Rahjes recalled. "We got contacted Thursday about something over a month ago, and, of course, it'd been before that they had tried (to file for unemployment.)

"What happens is they get an email from the Department of Labor saying something's not quite right and to call them. That's a joke.&nbsp;

"The Department of Labor says they're going to set up another hotline. That's a joke."&nbsp;

The system that existed during Republican Gov. Sam Brownback's administration was working, according to Rahjes. 

"Nobody knew we were gonna have a thousand times more people filing claims who were gonna be out of work.

"Everything was not perfect before. But let's work on solutions," Rahjes urged. "Let's move forward."

He also related the problem of another constituent who got a 1099 form from the federal government showing the state of Kansas had paid her $21,000 in&nbsp; unemployment during 2020. She actually received $1,250 in unemployment compensation.

Billinger encouraged people who received a 1099 form with a false unemployment claim payment to request a new 1099-G form from the Kansas Dept. of Revenue.&nbsp;&nbsp;

"You don't own that money and you shouldn't pay taxes on it."

HB 2196 has been passed by the Kansas House which would create the Unemployment Compensation Modernization and Improvement Council.

According to Wasinger, it requires the Department of Labor to modernize its IT infrastructure and would be made up of employers and employees tasked to make some changes to the program. The penalty for fraud is also strengthened.&nbsp;

HB 2196 creates a fund "so that businesses and not-for-profits and their employees are held harmless from all this fraud," Wasinger said.

She related a comment from Mark Burghart, Secretary of Revenue, who was asked in the Taxation Committee about so many inquiries coming in to his office from Kansans concerned about their inaccurate federal 1099s.

"He said 'it's not our job to worry about it. We have to do what they (federal government) send us.'"

 "And, I said to him, I have a real problem with that. I think it's all our problem. We all need to work together to get this fixed."

"It seems like passing some legislation through seems to put a fire under them," Wasinger said Saturday, "so hopefully, we'll get somewhere.&nbsp;

Billinger, vice-chair of the Senate Ways and Means Committee, says the federal dollars coming to the states have a lot of strings attached.

"I want to make sure we actually target and make things better for Kansas and Kansans."

He hopes one of those areas for one-time payments will be the unemployment fund.&nbsp;

"Many of these employers, especially those who've had all these fraudulent unemployment claims, I don't think it's fair or right to put this on the back of our small businesses in Kansas.&nbsp;&nbsp;

"I think we need to look for ways to beef that account back up.

"Before the pandemic, we were getting close to a billion dollars in that fund. That's not state money. That's the employers' money.&nbsp;&nbsp;

"I'm hopeful we'll be able to help there some."

Billinger would also like to see a one-time payment with the federal money go to deferred maintenance on state buildings, particularly universities.&nbsp;

He plans to find out if a one-time expenditure of the federal dollars could be put into the under-funded KPERS, the Kansas Public Employees Retirement System.&nbsp;

Beginning Monday, Season 2 of the North Vine Street Corridor Project will begin. 

During this phase, work will take place in the center medians under and around the I-70 overpass, and left turns will not be allowed at the I-70 ramps. Only right turns will be allowed to and from the I-70 ramps. 

Detours will be signed directing traffic around the construction zones. 

Southbound Vine Street to eastbound I-70, as well as eastbound I-70 to northbound Vine Street will be detoured to use the 32nd Street Roundabout. Northbound Vine Street to westbound I-70, as well as westbound I-70 to southbound Vine Street will be detoured to use 41st Street, General Hays Road, and 43rd Street.

Annual review of Hays Comprehensive Plan on tap for Planning Commission 

The Center for Empowering Victims of Gender-based Violence is a regional hub of collaborative research and service, housed in the Department of Criminal Justice at Fort Hays State University.

In 2018, Dr. Ziwei Qi of Criminal Justice and Dr. Hsin-Yen Yang of Communication Studies were selected as entrepreneurship faculty fellows by the Robbins College of Business and Entrepreneurship and the Provost's Office at Fort Hays State University. This fellowship supports Drs. Qi and Yang in pursuing their innovative approaches in empowering survivors of gender-based violence from rural communities to gain economic independence and long-term security.

Drs. Qi and Yang’s initiative addressed the importance of social entrepreneurship, safe housing, employment, counseling, and healthcare for survivors' financial freedom and social justice. With the support from the Departments of Criminal Justice, Communication Studies, Sociology, and Art and Design, in March 2020, the Center for Empowering Victims of Gender-based Violence (CEVGV) was established and housed in the Department of Criminal Justice.

Dr. Tamara Lynn, chair of the Department of Criminal Justice, became the Center's third co-founder alongside Drs. Qi and Yang. The Center recently welcomed four senior research consultants, Dr. Christy Craig of Sociology and Drs. Morgan Steele and April Terry of Criminal Justice, and Dr. Rachel Dolechek of Applied Business Studies, who will provide research and policy recommendations on gender-based violence in the rural community. The Center also has two undergraduate research assistants, Brandi Hanson and Cristina Jimenez, and one graduate research assistant, Viviana Lizarraga.

The Center for Empowering Victims of Gender-based Violence aims to reduce the constraints survivors face, promote freedom of economic independence, and empower survivors to pursue opportunities freely. It commits to providing sustainable support and improvement to help survivors break the cycle of violence and transform themselves from victims/survivors to social entrepreneurs.

The Center facilitates cross-disciplinary research and collaborative networks researchers use to apply evidence-based approaches and investigate best practices addressing gender-based violence in rural communities.

The Center establishes and develops academic-community collaborations through service-learning, research, assessment, and educational opportunities and policy recommendations that enhance the well-being of rural communities. FHSU initiative will support victims of gender-based violence

The Kansas Department of Transportation plans to begin work on a shoulder improvement project along a portion of U.S. 281/24 near Osborne the week of March 15, weather permitting.

Crews will be flattening out shoulder slopes and removing guardrail approximately 1 mile north of Osborne. Most of the work will take place off the roadway, however traffic may be reduced to one lane at times and controlled by flaggers. Motorists are reminded to slow down and stay alert when traveling near and through work zones.

Esfield Construction Inc. of Great Bend is the primary contractor for the $240,000 project. Work is expected to be completed in early May, weather permitting.

With all but the southern edge of Ellis County in a <a href="https://hayspost.com/posts/c24db742-04fb-45aa-951b-4070ae05df67">moderate drought</a>, the rain was a welcome sight in Hays Saturday.

According to official records at the K-State Agricultural Research Center, 2.46 inches of rain was measured in Hays by 8 a.m. Sunday.

So far in March, 2.97 inches of moisture has been recorded, more than twice the average total for March, which is 1.25 inches.&nbsp;

Hays is also more than an inch ahead of the average amount of moisture by the end of March, with 3.66 inches. The 152-year cumulative average by March 31 is 2.46 inches.

The <a href="https://hayspost.com/posts/72893f1e-372e-4172-871a-969761751fc4">weather forecast</a> calls for more rain through Tuesday.&nbsp;

A Flash Flood Watch issued by the National Weather Service in Dodge City remains in effect until 1 p.m. Sunday.

More than 2 inches of much-needed rain falls in Hays

A Fort Hays State University graduate student is trying to break down barriers and eliminate stigma on and off the court.

Will Fried, who has Asperger's syndrome, a high-functioning form of autism, is living a dream he's had since he was in the fourth grade, being a basketball referee.

Fried, of Bethesda, Md., came to FHSU in the fall to work on a master's degree in higher education and student affairs. He is a member of the FHSU Student Accessibility Services Committee.

His hopes after he finishes his degree is to work full time in disability services, diversity, inclusion or intramurals at the college level.

Fried played basketball through his high school years. He played on a level A amateur team, which was a competitive team with some travel. He attended Coach K's Duke basketball camp as a youth where he said learned heart, strength and grit.

"You have to be enthusiastic about what you want to do and keep going," he said.&nbsp;

He was also a season ticket holder from time he was a kid for the University of Maryland women's basketball team and is still a great fan.&nbsp;

"I've seen competitive games," he said. "I've officiated. I have seen both sides. I understand the situations coming from both sides."

Fried's first had the opportunity to wear the black and white stripes when he was 18 and was selected to be an official at a basketball camp in Frostburg, Md.&nbsp;

He continued refereeing intramurals when he entered college at the University of Maryland,&nbsp;Salisbury. After two years in the program, he was promoted to a supervisor and was in charge of other officials.

He sought to continue refereeing in Hays and has landed assignments to referee rec, middle school and JV basketball games.

"You enjoy it and still have the pride in [the game]."As a student, Fried said he has had to become more aware of his own needs and works to overcome barriers. He may have to read an article two or three times to gain a deep understanding of its content.As someone who has autism, he said he works to try to be aware of how he is interacting with others in his classes and how he is contributing to the discussions in classes.Fried said he hopes to create more awareness about autism and disabilities through his future career and his involvement in sports."People believe that people with disabilities can't do anything, but people [should] be allowed to do whatever they want with their own self determination," he said.Autism has a range of symptoms, but common symptoms include difficulty with communication and social interactions, obsessive interests, and repetitive behaviors.Fried said people who have autism have a range of abilities, as well as challenges."Each person with a disability is not the same," he said. "Some people might have autism as well, but you can't give them the same treatment you do to someone else because they are a totally different person.&nbsp;"Different people have different specialties and activities they like to do. It has to be more customized from person to person."He explained some people who have autism are non-verbal and use communication devices to speak. They also may have sensitives to sound or touch. "Then you have the highest spectrum for people who are formally known as Asperger's, which are people like myself who are smart, who are very detailed, know what they're doing, but at times can be deemed as socially awkward," he said.He asked the community to not stereotype individuals who have autism."You have to see the whole person as themselves and for the uniqueness they bring to society," he said.Fried said he is seeing awareness of disabilities grow in sports. Last year, Kent State awarded the first Division I basketball scholarship to a person who has autism, Kalin Bennett.A high school basketball manger who also has autism, Jason "J-Mac" McElwain scored 20 points in a game his senior year in high school. He is now a marathon runner and public speaker.People who have disabilities need to have mentors to help them be better athletes and officials, Fried said. He&nbsp;said he seeks mentors to watch his games and give him feedback so he can improve his officiating."I think people have seen my officiating and how much heart, strength, grit and passion I bring to the kids and the coaches with the knowledge of the game," he said. ... "It definitely has inspired other people to work harder and break down things."Fried said he wants to help others strive for greatness. He is already mentoring two other people who hope to be disability advocates.&nbsp;Fried said he is following the lead of disability activist Ed Roberts, who was the first student who relied on a wheelchair to attend the University of California, Berkeley. "Go out and change the old attitudes," Fried quoted Roberts. "Bring other people with disabilities around with you. Help them strive for greatness too. We need to be all in this together, and we can do great things."
