Two agricultural district rezoning requests and final plats will be voted upon by the Hays City Commission Thursday.

Both requests have previously been unanimously approved by the Hays Area Planning Commission.

An application by Richard Werth of L &amp; M Development, LLC, has been submitted to request a change in zoning from agriculture district to residential suburban district for a tract of land east of the Hays City Airport along Airflyte Drive, near 280th Ave. and Old Highway 40, called Airflyte Acres 2nd Addition. 

The proposed area is outside city limits and there are no plans for annexation.&nbsp;If developed, the area will be served by private utilities. Existing and proposed streets will continue to be maintained by other parties.&nbsp;

Airflyte First Addition, located east of the subject property was platted in 1961, with only half of the plat developed.&nbsp;

An application has been submitted by the Pfannenstiel Family Trust for the final plat of the Heritage Heights Addition, west and northwest of Tractor Supply, 235 W. 48th St., which consists of 27 acres. The applicant has proposed three large lots and two lots for existing residences within the plat. The large lots will be able to accommodate larger industrial type uses. A rezoning request has also been submitted from agricultural district to light industrial district.&nbsp;

Access will be primarily from 48th St. The property is currently not within the city limits of Hays. The need for annexation would be determined upon development of the property.   The property has city water and sanitary sewer nearby, but it would need to be extended in order to serve the property.

City staff is recommending approval of both requests.&nbsp;

Commissioners will also consider awarding a bid for replacing several deteriorated areas of the cart path at Fort Hays Municipal Golf Course.

Reconstruction includes hole #10, hole #18, and the entire front-nine, plus an alternate project to allow small sections of the cart paths to be re-routed to proper locations. 

Low-bidder for all the work is  $444,472.13 by Morgan Brothers, La Crosse.

Other agenda items are related to water with an update on water conservation programs by Hollie Dickman, water conservation specialist and an update on the R-9 Ranch long-term water supply project by Toby Dougherty, city manager.

“Need-based student financial aid is one of the most important tools that our state has to keep a college education accessible and affordable for Kansas families,” said Kansas Board of Regents chair Jon Rolph. “The Kansas Comprehensive Grant Match will create opportunities for students across our state to earn a degree and unlock lifelong opportunities. The Hunt Institute will serve as the Task Force’s primary convener, provide policy and research expertise, and manage a statewide community engagement tour. The Hunt Institute has provided similar services in the review of early childhood programming in states including New Mexico, Missouri, North Dakota, Alabama, and Delaware.

“By establishing the Early Childhood Transition Task Force, Governor Kelly has placed Kansas on the leading edge of a national conversation about early childhood system governance,”&nbsp;Dr. Javaid Siddiqi, President and CEO, The Hunt Institute, said.&nbsp;“Our team at The Hunt Institute looks forward to supporting the state as it works to make its systems more efficient and coordinated on behalf of children, families, and Kansas taxpayers.”&nbsp;

THOMAS COUNTY—One person was injured in an accident just after 8p.m. Wednesday in Thomas County.

The Kansas Highway Patrol reported a 2007 Kenworth semi driven by Alfredo G.&nbsp;Castelli Gomez, 61, Dodge City, was westbound on Interstate 70 three miles west of the Oakley exit.

Gomez thought a passing vehicle was going to strike him and moved over too far to the right. The semi overturned in south ditch.

EMS transported Gomez to the Logan County Hospital. He was properly restrained, according to the KHP.

Hays man takes Alford Plea in criminal case involving a minor

TOPEKA — House members celebrated a “historic” effort to address the state’s looming water crisis by advancing <a target="_blank" href="https://kansasreflector.com/2023/02/16/kansas-house-committee-advances-bills-to-conserve-water-in-ogallala-aquifer/">a pair of bills</a>
 that would earmark funding for water-related projects and hold 
Groundwater Management Districts accountable for conservation efforts.

The chamber gave first-round approval to House Bill 2279, which deals
 with the GMDs, and House Bill 2302, which sets aside 1.231% of state 
sales tax revenue to support water plans. Both bills received bipartisan
 support.

Water issues have been brought into focus by the unimpeded depletion 
of the Ogallala Aquifer, which farmers have used for decades to irrigate
 crops in western Kansas, and an ongoing drought. The House formed a 
water committee two years ago, but efforts to take meaningful action 
were torpedoed last year by large agricultural interests.

“This is a historic day,” said Rep. Ken Rahjes, R-Agra. ” This is the
 beginning of a journey that many of us have been on for years to get to
 where we are, hopefully secure a funding source for what really affects
 all of us.”

Rep. Lindsay Vaughn, D-Overland Park, said the aquifer will run out 
of water within her lifetime if nothing changes. But, she said, “there’s
 still hope.”

“We’re hoping to address this the Kansas way, through grit and 
compassion, and by bringing all people to the table to address this very
 serious concern, to conserve and sustain the aquifer for future 
generations and for the benefit of the entire state of Kansas,” Vaughn 
said.

Some parts of the aquifer have an estimated 10 or 20 years of water left. <a target="_blank" href="https://kansasreflector.com/2023/02/15/audit-finds-western-kansas-keeps-losing-water-despite-local-efforts/">A state audit found efforts by GMDs</a> to save the aquifer vary widely.

HB 2279 would require GMDs to produce an annual written report on 
expenses and activities, with an explanation of how money was used to 
conserve groundwater and prevent deterioration of the aquifer. GMDs also
 would have to file action plans with state agencies.

Rep. Jason Goetz, of Dodge City, said the legislation will address concerns with transparency and accountability.

“It’s great to see people working together to solve this without mandating a solution,” Goetz said.

HB 2302 would provide about $50 million annually to support water 
projects across the state. It also pays down longstanding debt for 
Milford and Perry Lake reservoirs, and would allow the Kansas Water 
Authority to add 10 full-time positions for engineers, geologists, 
hydrologists, environmental scientists and those with similar areas of 
expertise.

The House planned to take final action on the two bills later this 
week. If adopted, they would go to the Senate for consideration.

In a committee hearing Monday, the chairman, Rep. Jim Minnix, R-Scott City, praised committee members for their historic work.

“When when you go back to your home communities this next weekend, 
and you have legislative coffees or discussions within your community, 
we need to spread the word and explain what we’re trying to do here,” 
Minnix said.

SHERMAN COUNTY — Law enforcement authorities are investigating suspects for alleged crimes at a northwest Kansas community living facility.

Last month, the Goodland Police Department, along with State of Kansas Adult Protective Services interviewed several employees of ResCare, 208 West Second Street in Goodland, stemming from complaints received by Adult Protective Services, according to a media release from police.

After conducting the interviews, police reported Tuesday the arrest of four people with recommended charges forwarded to the Sherman County Attorney’s Office.&nbsp; 

The police department did not release the names of those arrested or possible charges.

The anticipated cold front arrived sooner than expected, the National Weather Service in Dodge City said. The NWS also issued a wind chill advisory for Hays and Ellis County from 2 to 8 a.m. Thursday.

With an overnight low of only 4 projected, wind chill values could drop as low as 20 below zero, the NWS warned, cold enough to cause frostbite in as little as 15 minutes.

The high Thursday is expected to be in the mid-20s, increasing to the low-30s Friday before a warmup arrives. The highs Saturday through Tuesday are expected to range from the low-50s to low-60s.

The change in weather also bring a chance of rain. There is a 20 percent chance of rain Sunday, increasing to 60 percent Sunday night.

NWS: Cold air rushes into NW Kan.; wind chill advisory issued

The Hays USD 489 school board agreed Monday night to keep the Hays High Indian mascot.

A motion to change the Hays Middle School mascot to the Indians failed. However, a motion passed that would make the HHS middle and high school colors consistent. Both schools also will be using "brave and true" from the high school's alma mater for their new motto.

The discussion on both of the schools' mascots has been ongoing for several months. The district has passed a bond issue that will include building a new high school and renovating the current high school into a middle school.&nbsp;

Superintendent Ron Wilson asked the board to consider what branding it wanted for the new schools. The district conducted a survey, had a public meeting and formed a committee to consider the schools' mascots.

Although some members of the community and the rebranding committee said they thought the Indian mascot is hurtful and racist, more than 90 percent of survey respondents said they wanted to keep the Indian mascot.

Superintendent Ron Wilson made several recommendations to the school board on Monday. They included:

• Hays High remains the Indians • Hays Middle School transitions to the Indians by August 2026, when the middle school is set to occupy its new space at the former high school • The graphics department with DLR, the district's bond architect, will develop a new Indian logo that does not include a human depiction of a Native American • A legacy committee would be created to decide what current logos and images no longer meet the standards of the school or district logos or mascots • The district will create a style guide. All future official uses of school logos and colors would have to conform to that style guide and be approved by the administration.

Board member Curt Vajnar said as a coach and teacher neither he nor his students ever misrepresented the Indian mascot. He said he was very supportive of using "brave and true" as the high school's new motto.

Board member Allen Park also said as a parent, teacher and coach he also never saw the Indian mascot dishonored.

Board member Tammy Wellbrock said she appreciated the district had the discussion at this point because it is going to have blank walls and a blank slate at the new high school.

"I think sometimes we forget in society that dialogue in itself is not dangerous, asking questions don't have to be harmful, but certainly this has been a polarizing topic," she said.

She added she hopes people don't look at the issue as having winners and losers.&nbsp;

"We want all of our students to be winners, but that is not because of their mascot," she said.

&nbsp;Board president Craig Pallister said the strong pride the community expressed in the Indian mascot convinced him to keep the mascot.

"We have images that are racist. We have images that are hurtful," he said. "Our speaker said I won't have had some of those in my building or any building."

Pallister said he supported Wilson's recommendations that would have those images ultimately eliminated.&nbsp;

"We needed to make some big changes if we were going to keep the Indians," Pallister said.

He said he hopes the district doesn't have to revisit the issue in the next several years. The Kansas School Board has already recommended all Kansas public schools eliminate Native American mascots within the next five years.

"We need to do what is right for our community, but not cause harm to others," Pallister said.

He said he did not support adding the Indian mascot at the middle school.

Board member Meagan Zampieri-Lillpopp, who has been outspoken against the Indian mascot, said she hopes Hays students will one day know all the four tribes that landed in this area.

She also said she did not support expanding the Indian mascot to the middle school.

Wilson said more than 80 percent of survey respondents said they wanted the middle school and high school to have the same mascot.

Bruce Rupp, HMS athletic director, said the district could save money if it didn't have to change the gym floor and wall pads to a different logo or colors.

He also said he thought carrying the same mascot through both schools would create more unity among students and coaches.

"We are going to be one big campus. Why don't we be one mascot with one color and a lot more unity," he said.

Hays High to remain Indians, Hays Middle will not become Indians

Hands were waving, feet were moving and smiles were bright Monday as students from Styles Dance Centre in Hays practiced with DSNWK clients for a special recital set for Sunday.

The event, Dancing Together, is back this year after a break because of COVID. The recital will be at 5:30 p.m. Sunday at Beach/Schmidt Performing Arts Center. Doors open at 5 p.m.

Forty-four DSWK clients will participate in the recital.

Although the event had been organized by Fort Hays State University students in the past, this year two seniors from Thomas More Prep-Marian stepped up to lead the event for their senior capstone project, which is a service project for students at TMP.

Karlyn Rohr and Arin Schibi have both been dancing since they were little girls and have been long-time students at Styles Dance Centre. Both girls have participated in the recital before.

Rohr said she enjoys working with the DSNWK clients.&nbsp;

"They're so fun," she said. "They're so positive. They love to dance."

Schibi&nbsp;said she loves participating in the event and is excited about working with Styles and DSNWK to bring the event back to Hays.

"It's fun to go from being the dancer to now organizing it," she said. "It's eye-opening how much work goes into it. It's been a good experience."

Rohr is an instructor at Styles and hopes to continue working with younger dancers.

Schibi said she hopes to try out for a dance team when she goes to college.

Steve Keil, DSNWK director of development, said DSNWK always appreciates opportunities for their clients to be involved in the community.

"This gives them an opportunity to be able to do something they have never really been able to do before — a chance to be up on stage, a chance to dance. A lot of them really love this event," Keil said.

Admission will be a freewill donation to DSNWK. There also will be a basket raffle.

Hays Middle School athletic director Bruce Rupp was honored Monday at the Hays USD 489 school board meeting.

He was named the Kansas Middle School Athletic Director of the Year by the Kansas Interscholastic Athletic Administrators Association.

Rupp, who has worked for the Hays school district since 1991, will be officially recognized at a conference in March in Mulvane.

He has taught middle school social sciences and language arts, PE, weights and basic training, as well as Hays High psychology for concurrent college credit.

He's been the driver's education coordinator since 1995. Rupp was also the district's first high school softball coach, a position he had for 13 years. He's also been the HMS football coach for 20 years.

He's served as the HMS athletic director for 28 years and as the assistant principal for two years.

In 2016, Rupp received his certified athletic administrator license from KIAAA.&nbsp;

HMS Principal Tom Albers was not able to be at the school board meeting Monday night, but Superintendent Ron Wilson read written remarks from him at the meeting.

"Bruce Rupp is well-respected throughout the middle school athletic director community not only in our league but throughout the state," Albers said in his statement. "He excels in organization, is very budget conscious and is very middle school proud.

"He makes every coach, player, fan and event worker feel special when they attend a Hays Middle School event."

Albers said Rupp performs all of his duties professionally. There are many behind-scenes moments that the Hays community does not get to witness during which he "works his magic," Albers said.

Wilson said Rupp models the district's core values and is a champion for all kids.

"He brings his best every day and carries the banner for the district and sells kids on possibilities and opportunities for the future and at Hays Middle School," Wilson said. "He does things top shelf, and we are very proud to recognize Bruce Rupp tonight for this award."

KANSAS CITY, Kan. — Nineteen undergraduate students were honored for their scientific research presentations at the 21st annual Kansas IDeA (Institutional Development Awards) Network of Biomedical Research Excellence (K-INBRE) Symposium in January in Overland Park.

The annual symposium is part of the program’s initiative to prepare promising undergraduate students for careers in bioscience. Led by the University of Kansas Medical Center,&nbsp; 10 institutions in Kansas and Oklahoma participate in the collaborative network.

“The symposium is a great opportunity to support the biomedical sciences in Kansas,” said Douglas Wright, principal investigator for K-INBRE and professor and vice chair in the department of anesthesiology at the University of Kansas Medical Center. “Students are encouraged to showcase their hard work with poster or oral presentations. And young and established faculty researchers are also invited to present and share their research and developments in the field.”

Among those honored was Audrey Rymer, Hays, a student at Fort Hays State University. She is a sophomore in biology pre-med and her oral presentation was “Comparing the Presence of Antibiotic Resistance Bacteria in Wastewater Systems to Assess the Population Health of Kansas Counties." Her parents are Ryan and Alicia Rymer, Hays.

Under the guidance of faculty mentors, students are afforded opportunities to work in laboratories or their communities developing research projects. With these opportunities, students are provided the tools and guidance to better inform their future academic and career choices in the biomedical sciences. 

The annual Symposium brings together students, faculty, and staff from the University of KansasMedical Center, Emporia State University, Fort Hays State University, Haskell Indian Nations University, Kansas State University, Pittsburg State University, University of Kansas, Washburn University, Wichita State University, and Langston University in Langston, Okla. Nearly 150posters were presented by undergraduate and graduate students from all 10 of the institutions in Kansas and Oklahoma. In addition, eight students presented orally along with several faculty speakers.

The annual Symposium brings together students, faculty, and staff from the University of KansasMedical Center, Emporia State University, Fort Hays State University, Haskell Indian Nations University, Kansas State University, Pittsburg State University, University of Kansas, Washburn University, Wichita State University, and Langston University in Langston, Okla. Nearly 150posters were presented by undergraduate and graduate students from all 10 of the institutions in Kansas and Oklahoma. World Water Day is an annual observance focusing on the importance of water. 

To celebrate, the City of Hays and the KSU Big Creek Middle Smoky Hill River Watersheds are once again
partnering to host a World Water Day Fun Fest from 10 a.m. to noon Tuesday, March 14t, at the Sternberg Museum of Natural History. 

This free event will feature fun, hands-on, "water-related"
activities for kids of all ages. In addition, educational information regarding water conservation
and water quality will be provided.

World Water Day Fun Fest scheduled next month in Hays

A board member at Monday night's Hays USD 489 school board meeting alleged the school district was not keeping proper minutes of the board's meetings.

Board member Allen Park alleged the board clerk was not including all the information that is required in the board minutes.&nbsp;

He argued his comments about why he voted no on an agenda item should be included in the minutes.

"The law says to keep an accurate journal of what the meeting is like," Park said.

The district began using a program called BoardDocs when Superintendent Ron Wilson was hired to lead the district in 2019. The program allows the public to access meeting agendas, minutes and documents related to board meetings online.

Park said more information was contained in the minutes prior to BoardDocs being used. This predates any of the current board members' election to the board.

"When a patron looks at our minutes, it's just the agenda with what the results are," Park said.

Board member Tammy Wellbrock said in her prior work she was advised not to explain in minutes the reasons behind yes or no votes.

Wellbrock asked the district's general counsel Bill Jeter to comment on Park's concerns.

"You are stating that it's illegal and I want legal interpretation," Wellbrock said to Park.

Board president Craig Pallister said to Park, "You said we were breaking the law."

Jeter said he had researched the issue. He said when he first looked at the law he thought it should be interpreted the same way that Park was interpreting it.

&nbsp;However, after further research, he found that was not correct.

"There is no Kansas law that tells the board of education what you need to have in your minutes," Jeter said.

The Kansas Attorney General has issued an opinion that says that all the law means is that the clerk has to maintain a journal in the district office with a copy of all the board minutes.

"It is not a directive in what needs to be contained within the individual minutes," Jeter said.

In Robert's Rules of Order and recommendations to other government bodies, there is a minimum list of things that need to be in the minutes, Jeter said.

That includes • Date and time of the meeting • Is there a quorum and which board members are present • Approval of all prior minutes that have not been approved • Synopsis of each motion and if that motion passed or failed • Time the meeting is adjourned

The Kansas Attorney General also said boards have the right to direct their clerks what they want in their minutes.

However, the Hays school board already has a policy on what should be contained in minutes, Jeter said.

That policy says minutes should contain a summary of all motions, including those that do not pass and shall not contain summaries of comments by a board member, guest or staff either written or oral unless the board chooses to make written remarks a part of the minutes.

Jeter said that would mean the board as a whole would have to vote to have any remarks added to the minutes.

"There was not a law broken because there is none," Pallister said. "I resent the question that we broke a law when there was not a statute."

Jeter said he has recommended to other organizations that the bare minimum is what the minutes should be.

"The only things that really are important are what is the outcome of the vote and what's the motion," Jeter said. ... "It's not important for history how anybody voted, just whether it passed or not."

During his tenure on the board, Park has made repeated allegations that the board has been in violation of various policies. However, no wrongdoing has ever been found.
