PHILLIPS COUNTY —A man is in custody after allegedly firing a gun near the middle school in Phillipsburg.

Just before 8a.m. Thursday, the Phillips County Sheriff's Office received a call that there was an individual shooting a gun south of the middle school in Phillipsburg, according to a social media report from the sheriff.

A deputy who was patrolling school zones in Phillipsburg arrived shortly.  The Deputy began shouting orders and then the individual dropped both weapons and laid them on the ground.  The suspect,&nbsp;identified as 26-year-old Morgan William Thieben, who lives in the 500 block of 7th street in an apartment. 

 From eyewitness statements it has been concluded that he fired two shots into the air with a 9mm Pistol, but also had an AR Rifle on his person as well, according to the sheriff's office.

Thieben was then taken into custody on requested charges of Criminal Threat, Aggravated Assault and Unlawful Discharge of a firearm within city limits.

He had one full magazine for the pistol and the rifle magazine and chamber were empty.  A search warrant was done on the suspect’s apartment.  During the search only a single 9mm round was found in the apartment.  There was no evidence leading to a motive or agenda. 

Thieben is currently incarcerated in the Phillips County Jail where he is being mentally screened.  There were multiple people in the area who helped get the kids to safety at the nearby school and others who attempted to control the situation.

  Sheriff Kyle Pinkerton said, “We should all be proud of how our community reacted, it was quick, and everyone prioritized the safety of our children, and also to the Deputies that responded and ran directly to the threat and ended it."

The Hays Arts Center has three exhibits opening on Friday, featuring five artists, representing five different artistic media.

"We have got three very unique and very different exhibitions for our fall features," Brenda Meder, Hays Arts Council director, said.

The first exhibit, "Bits and Pieces," which will be in the main gallery, will feature Shannon Trevethan and Tracy Hanzlick, both of Russell.&nbsp;

"Shannon loves assemblage work and putting things together," Meder said. "She is also a fabulous painter. That's not what is included in this exhibition, but you can see elements of that incorporated into her assemblages."

"Everybody likes getting a close look and seeing what they're made of," she said. "She's always upcycling, repurposing and finding things. It is wonderful to see what her imagination allows her to put together."

Hanzlick rolls pieces from magazines or brochures to produce the color in her collages. Some are more abstract, but she also has a piece that depicts two feathers.

The exhibit will also feature some of her paintings.

"There are some similarities in color, so I've tried to put things together so that the moods and feelings of these two artists' work come together," Meder said.

"Painting with Sun" watercolors by Margie Hammerschmidt will be displayed in the center's hallway.

Hammerschmidt, of Hays, is a retired nurse and began painting in earnest later in life.

"Life, career and family, although she was always a creative person, kept her from really immersing herself in [painting]. Margie has not been a watercolor painter until the last four to four and half years," Meder said.

"I have just watched her work grow amazingly."

"Sunset Duets" by George Jerkovich of Salina and Debbie Wagner of Bennington will be in the Founder's Gallery.

Each piece of artwork coordinates with a sunset on a set day, although the pieces may portray a different location.

Wagner's media is pastels. Jerkovich is a photographer.

The images are titled with the dates of the sunset depicted.

"Debbie, following on the heels of some very traumatic brain surgery and some brain tumors, decided in gratitude that she wanted to look at the world in a new way," Meder said.&nbsp;

Since 2005, she has painted the sunrise each morning.

Jerkovich, who was not an early riser, proposed the sunset collaboration from late 2012 through 2013.

"It's really wonderful to see that artistic creation from two different perspectives but on the same night very near those same bewitching hours of dusk and sunset," Meder said.

The exhibits' opening reception will be from 5:30 to 8 p.m. today at the Hays Arts Center. The event is free and open to the public. The exhibit will be on display through Nov. 26.

"With diverse as the art that is in here right now," Meder said, "everybody will gravitate toward one of the forms or another and be completely drawn to it."

Hays Arts Center offers trio of diverse exhibits for fall show

The Center for Life Experience (CFLE), which has provided grief support services to Hays and the surrounding area for 24 years, is closing its office in Hays.

However, even though the office at 103C E. 27th St. is closing effective Oct. 28, the nonprofit organization itself will remain open until after the first of the year.

The nonprofit 501(3)c Center has been one of the few such organizations in Northwest Kansas to offer grief support programs for both children and adults. Some of those programs will continue, said Linn Ann Huntington, who serves on the Center’s Board of Directors.

“The center is closing because of an alarming drop in individual contributions over the last year,” Huntington said. “The board pursued other operational models to try to keep the organization afloat, but, unfortunately, we were not successful.”

One of the services that will continue is the center’s grief support group. 

“Two of our support groups have decided to merge,” Huntington said, “and that combined group will continue to meet, just in a new location.”

The group will begin meeting at its new location, the Hays Senior Center, 2450 E. Eighth St., beginning on Thursday, Nov. 21, from 6:30 to 8 p.m. It will continue to meet there the third Thursday of every month.

The group welcomes any adult who has lost a child of any age, including miscarriages and stillbirths. While many members are parents, the group also welcomes grandparents, aunts, uncles, teachers, etc.

The group also welcomes any adult who has lost another adult in their life, such as a spouse, parent, sibling, friend, etc.

“Dr. Kate McGonigal, who holds a Ph.D. in sociology, has agreed to continue as the facilitator for this group on a volunteer basis, and we are very grateful to her for that,” Huntington said.

McGonigal teaches in the Sociology Department at Fort Hays State University. Among the classes that she teaches is Death &amp; Dying.

Another traditional event coming up is the “Healing Hearts Memorial Tree Dedication,” which will be at 10 a.m. Saturday, Nov. 23, at the Hays Public Library.

“At this event, grief support group members place ornaments on a special Christmas tree remembering children they have lost. Each child’s name is read aloud, and it is very poignant to see the ornaments honoring each child,” Huntington said.

The public is welcome to attend this event. Individuals may simply watch, or they may bring their own special ornaments to remember a child they have lost. The group will provide a free ornament to anyone who wants one, she said.

CFLE will continue to operate until after the first of the year because it is still in the process of paying off some debts, Huntington said.

“We are expecting some pledged funds toward the end of this calendar year and the first of 2025, so CFLE will continue to operate until then,” she said. “We will have some last-minute legal things to do, such as filing our 2024 tax return before we can officially dissolve.”

She added, “The board would like to thank all of the CFLE donors, volunteers, group members, paid staff, group facilitators, and other board members over the years,” Huntington said, “especially our current Executive Director Laura Allen.” Her last day with CFLE will also be Oct. 28.

“The board has been blessed to work with some wonderful individuals who care very deeply about the center’s mission, helping people navigate their own journeys through grief.

“Losing a loved one is something we all experience in our lives. Grief is not something we ever get ‘over.’ It is a journey that we get through,” Huntington said. “I speak on behalf of the board when I say it is our hope that those wanting the comfort that a grief support group can provide will seek out the one that is continuing to meet.”

As October marks Cybersecurity Awareness Month nationwide, Fort Hays State University (FHSU) stands at the forefront of cybersecurity education and innovation through its Cybersecurity Institute and Technology Incubator (CITI). Focused on enhancing the cybersecurity landscape, CITI is poised to not only elevate the cybersecurity posture of Kansas but also to foster business ventures that leverage technological advancements in the region.

CITI's mission is to leverage the distinctive strengths of FHSU to advance the Kansas economy, particularly in asset preservation and entrepreneurial development. “Our goal is to collaborate with local community partners to build a robust cybersecurity framework and fortify defenses against the growing cyber threats that impact small and medium-sized businesses across the state,” said Jason Zeller, CITI’s operations director.

Central to CITI's efforts lies a commitment to developing a pipeline of skilled cybersecurity professionals capable of empowering local businesses. The institute actively promotes micro-internships, which allow students to engage with real-world projects that enhance the cybersecurity readiness of local businesses. Through this innovative approach, CITI bridges the gap between theoretical knowledge and practical application, enabling students to apply their learning meaningfully.

Gage Giffin, a sophomore from Sedgwick, Kansas, became aware of CITI during a Cybersecurity Club meeting and quickly seized the opportunity for a summer micro-internship. “My experience as a lab assistant in the CITI CyberLab has been invaluable. I maintain computers, manage server applications, and build cybersecurity testing environments. I’ve explored vital areas like firewalls and virtualization security, which has paved the way for a promising career in DevOps—a critical sector in cybersecurity,” Gage said.

Caden Mayer, another sophomore and fellow CyberLab assistant, has also made significant contributions by helping to establish infrastructure and support environments for other students. Recognizing the vital role of education in preparing future cybersecurity professionals, Caden said, “This semester, I’ve taught Hays High School students about servers and their applications. Understanding cybersecurity is essential—it’s everywhere, and being proactive is crucial.”

Through micro-internships, CITI offers various services to meet the diverse needs of businesses seeking cybersecurity support. These services include website development, security reviews, basic and advanced network setup, and vulnerability assessments. These services will help local businesses understand and rectify their cybersecurity posture, a need that Chance Anderson—a graduate assistant at CITI—has recognized through his experiences.

Chance chose FHSU for its unique offerings, stating, “The people here make FHSU exceptional. The professors genuinely care about my success. Additionally, pursuing my bachelor’s and

graduate degrees with minimal debt is a significant advantage. Our cybersecurity program emphasizes real-world application, allowing ample hands-on experience rather than endless textbook readings. I’ve honed technical and soft skills, learning that every business presents unique challenges requiring tailored cybersecurity solutions.”

Reflecting on his experiences, Chance explains, “I’ve encountered many local businesses that lack essential cybersecurity resources, and it’s our role at CITI to address these gaps. We’re here to help navigate the increasingly complex cybersecurity landscape.” Drawing on his leadership background as a former president of the Cybersecurity Club, he underscores the need to connect student talent with community requirements, ensuring no local business remains vulnerable to cyber threats.

Despite CITI's robust initiatives, challenges persist, particularly in getting the word out to small businesses about the available support. FHSU is actively seeking a Business Relations Director to amplify awareness of CITI’s offerings. Our greatest obstacle is effectively reaching out to companies to show them that we’re ready and equipped to support their IT and cybersecurity needs.

While micro-internships are the foundation for student engagement, CITI emphasizes venture creation through its in-residence business incubator. The incubator is designed to cultivate tech and cybersecurity startups that can flourish within Kansas. CITI aims to transform innovative ideas into successful business ventures by providing specialized guidance and support.

Jason said the incubator will initially focus on nurturing one to two startups with potential future referrals to the Small Business Development Center (SBDC) as they mature. He said, " Our mission is to facilitate the development of new businesses in sectors that align with Kansas's unique opportunities.”

Officers arrest fugitive in Larned after standoff

So…no see ums in hordes visited us this fall. When I say no see um, I mean that. I can bury arms, legs, and trunk in jungle-like tomato vines as I search for ripe or nearly ripe fruits. In no time, creatures so small I barely see them ferociously bite the tarnation out of me.

The first time it happened, the little devils chomped ankles and calves. Keep in mind I’m tall so it’s a distance from eyes to feet. For all the stinging I felt, I saw nothing I could blame for the pain. I hauled my now itching carcass out of those entwining vines and plopped onto a sunny step to contort my ankle into position so I could see well. All I noted were tiny black dots that looked like pepper flakes I sprinkle on our scrambled eggs each morning. While staring at these miniscule purveyors of pain, I saw one move, followed by a sharp biting sensation out of proportion to its size. The next morning, welts polka-dotted my lower body. One felt like a super-fine thorn protruded from it, but despite scratching and razoring the area, the sensation remained.

After spending another day searching for ripe tomatoes tucked into dark recesses, I ended up with swollen lumps covering my entire body and the realization that the thorn I thought I felt was actually one of these cotton-pickin’ bug bites. Again, the insects are smaller than poppy seeds or grains of pepper. Despite their miniscule size, their bites rival the discomfort of wasp and bee stings.

Apparently, I scratched in my sleep that night so I awakened to Richter scale irritations. Off to the prednisone and Neosporin aisle at our local store. The good news is I found no pepper-flake size bodies in my bed so the bites originated in the garden.

While I waited for anti-itch treatments to work, I searched the internet to learn what sort of invasion was ruining harvest. News sites reported on miniscule black bugs delivering painful bites. I sorted through suggestions, knowing this wasn’t a tick or chigger. I felt sure it wasn’t a flea either. Though I never found a definitive answer, reporters suggested labels—no see ums or midges (perfect for midget-size bugs) for these creatures.

That actually sounded familiar. My husband has used both terms in the past to describe small, biting insects that show up in the fall. Somehow, I had previously dodged them.

Our daughter, who lives on a ranch, confirmed they too suffered from masses of them this year as well. She dressed her girls in long sleeves, long pants, and tall boots before they worked cattle that weekend to protect them. I guess I should have skipped the t-shirts and capris during my tomato picking sessions. I’d have suffered less.

What I did learn, was that regardless of what you call these irritations, they eat destructive bugs such as aphids. So, while I may be doing an itchy-twitchy dance, the tiny invaders help my garden.

MADORIN: A bite bigger than the bug

Hays city commissioners will consider approving a charter ordinance allowing for a 1.25% increase in the city's transient guest tax (TGT) to 8.25% during their meeting this afternoon.

The 2025 Convention and Visitors Bureau budget was developed using the 8.25% guest tax rate. "It's necessary to ensure the fund’s sustainability," Collin Bielser, deputy city manager said at last week's work session.

Several items will be voted upon to move forward The Grove retiree-focused housing project north of Hays Medical Center. They include a recommended bid award of $3 million to Sporer Land Development, Oakley/Colby, for construction of street, water, storm water, sanitary sewer, and other infrastructure improvements.

Commissioners are also expected to sign a construction engineering services agreement with Driggs Design Group, Hays, for $100,438, and to approve&nbsp;the development agreement with Grow Hays.&nbsp;

Erin Giebler, human resources director, will present a proposed renewal agreement with Blue Cross Blue Shield of Kansas for a triple-option employee health insurance plan. The premium increased nearly 13% for 2025.&nbsp; City staff also recommends continuing to provide up to $625 in employer match for employees’ health savings accounts.&nbsp;

Qualifying city employees will be honored with service awards from commissioners.

City commission expected to approve increase to 8.25% in guest tax rates for Hays visitors

A recent <a href="https://www.kslpa.gov/audit-report-library/estimating-the-economic-impacts-of-tax-increment-financing-districts/">state audit</a> of the <a href="https://www.kansascommerce.gov/program/taxes-and-financing/tif/">Tax Increment Financing (TIF) districts</a> in six of Kansas' largest cities showed&nbsp;half did not recover their costs in a timely manner.&nbsp;

Two cities, Wichita and Topeka, aren’t likely to recover the costs of three projects through TIF revenue by the end of the districts’ lifetimes, according to the audit. 

The cities and their local taxpayers could potentially be responsible for the costs.

That can't happen in Hays under the city's current&nbsp;<a href="https://www.haysusa.com/DocumentCenter/View/608/Economic-Development-Policy---6-24-2021-PDF">economic development policy</a>.

"The difference is those cities have issued debt for those districts, and those districts are not generating enough revenue to cover the debt service," said Hays City Manager Toby Dougherty.&nbsp;"We don't have that problem because the developer takes care of their own debt."

The state does allow bonds to be issued for a TIF, "but our economic development policy doesn't allow that, so it's a 'pay-as-you-go' TIF," said Kim Rupp, city finance director.&nbsp;

"They have to finance on their own, and then the TIF can pay them back."

"Issuing bonds for a TIF is something that local governing bodies can do, and Wichita, Topeka and Olathe have done so, but it's not something Hays does," said Jarrod Kuckelman, Hays management analyst.

Developers considering Hays projects first meet with Grow Hays, the city's economic development partner, to determine what financial incentives are available and appropriate.

TIF districts are often blighted or undeveloped areas identified for specific development projects.

Any increase in property taxes (city, county, school district) is reinvested to the developer for eligible project costs such as land acquisition and site preparation.&nbsp;&nbsp;

Hays has two TIF districts, each effective for 20 years as state statute dictates.

One is at the Hilton Garden Inn, 221 W. 43rd, and the development in front of it. The second is the  Hess property at the Interstate 70 Exit 157.

The Hess property is inactive. However, the developer has paid millions of dollars for water, sewer and street infrastructure improvements in the past six years.&nbsp;

The developer has not built anything at that location to generate TIF proceeds.

"If we were to have issued debt for that, we'd be pretty nervous because we'd be on the hook, " Dougherty said.

No increment has been captured at the Hess property TIF.

"Right now, I think we're just frustrated because the developer has a lot of incentives out there they could be utilizing, but they haven't built anything above ground. But it doesn't hurt us financially,"&nbsp; Dougherty said.

Several years ago, a different developer asked the city to essentially act as the bank for a project.

"The developer wanted a lot of incentives, but they also wanted the city to issue debt. So, the burden of performance was more on us than the developer,"&nbsp; Dougherty said.

 After lengthy discussions of incentives and risks, the city commission changed its economic development policy.

"Commissioners voted to be a little more liberal with the incentives they allow but they would not issue debt for a private developer," Dougherty said. "The developer takes the risk and can be reimbursed if the district performs."

Hays did issue debt for the Home Depot development, 1310 E. 41st, a project Dougherty refers to as a "TIF Lite."

Home Depot guaranteed the general obligation debt.

Only the city's portion of the property tax increment was rebated to the Home Depot developer. The Ellis County and Hays USD 489 property tax portions were not rebated.&nbsp;

"From an investment standpoint, that was a very successful district," Dougherty said.&nbsp;

Creating a TIF is a lengthy complicated procedure.

Rupp said the city leans heavily on the public finance law firm Gilmore Bell, Kansas City and Wichita.

 "They know the statutes inside and out and are guiding us all the way through the process," Rupp said.

The bottom line is that Hays taxpayers are not liable for any underperforming TIF districts, Dougherty said.

"Governing bodies can always change their mind, and they can issue debt for TIF districts, but current policy is that they don't, and it's worked out pretty well for us," he said.

The Hays USD 489 school board discussed entering into a contract with Enterprise to manage its vehicle fleet at its work session on Monday.

The contract with Enterprise would include all vehicles except buses.

Prior to 2019, the Hays school district bought vehicles through the state bid system at steep discounts. Staff drove the vehicles until they wore out, and then they were auctioned at low prices.

Since the pandemic, that state bid system has not been available. The district has 12 Suburban SUVs, none of which are newer than 2019.

Enterprise has several programs the districts could choose from. One includes Enterprise managing the purchases and sales of the district's vehicles.

The company also offers maintenance and fuel programs.

Both the city of Hays and Ellis County use one of Enterprise's fleet programs.

Ken Olsen of Enterprise said the purchasing and sale program allows entities to decrease their costs while operating newer, safer vehicles.

All manufacturers are available through these programs, Olsen said.

Based on its significant connections and volume, Enterprise is able to obtain 10 percent over the average auction price for most of its vehicles.

Enterprise estimates the district would save almost $89,000 over 10 years using its program to purchase and sell vehicles.

Chris Hipp, assistant superintendent for business services, said he is still calculating if the district's savings would be advised for the maintenance and gas programs.

The district now has a single staff mechanic performing vehicle maintenance. Its fleet includes 39 non-bus vehicles.

However, Russ&nbsp;Henningsen, transportation director, said the program would rotate vehicles about every three years, and not much maintenance would likely be needed.

The district purchases the bulk of its gas from the co-op. Enterprise provides a gas card that can be used at most stations for a 5% discount.

Enterprise also uses data from those gas purchases in maintenance and sales decisions.

Although the vehicles will be newer, Olsen said district insurance costs usually do not increase because of the improved safety features on the newer vehicles.

The district would still use local dealerships for warranty work.

Board member Ken Brooks asked how easy it would be to exit the program if the board found it was not working well for the district.

Olsen said the district would maintain a master agreement with Enterprise, but the obligation would be divided among individual vehicles.&nbsp;

Board attorney Bill Jeter said he had reviewed the contract and gave his approval from a legal standpoint.

Hipp said he recommends the district involve its entire fleet for the district and Early Childhood Connections. Those two fleets must be maintained separately because of the federal funds involved with Early Childhood Connections.

The new vehicles would be phased into the fleet over several years.&nbsp;

"We don't want to be worrying about a vehicle coming back from Liberal at 2 in the morning. If we are rotating vehicles out every three years, we will not even be buying tires," he said.

Hipp said the district would still benefit even if it broke even. Students and staff will be in safer vehicles, and the cost and time to repair vehicles will be less, he said.
