The Hays USD 489 school board discussed entering into a contract with Enterprise to manage its vehicle fleet at its work session on Monday.

The contract with Enterprise would include all vehicles except buses.

Prior to 2019, the Hays school district bought vehicles through the state bid system at steep discounts. Staff drove the vehicles until they wore out, and then they were auctioned at low prices.

Since the pandemic, that state bid system has not been available. The district has 12 Suburban SUVs, none of which are newer than 2019.

Enterprise has several programs the districts could choose from. One includes Enterprise managing the purchases and sales of the district's vehicles.

The company also offers maintenance and fuel programs.

Both the city of Hays and Ellis County use one of Enterprise's fleet programs.

Ken Olsen of Enterprise said the purchasing and sale program allows entities to decrease their costs while operating newer, safer vehicles.

All manufacturers are available through these programs, Olsen said.

Based on its significant connections and volume, Enterprise is able to obtain 10 percent over the average auction price for most of its vehicles.

Enterprise estimates the district would save almost $89,000 over 10 years using its program to purchase and sell vehicles.

Chris Hipp, assistant superintendent for business services, said he is still calculating if the district's savings would be advised for the maintenance and gas programs.

The district now has a single staff mechanic performing vehicle maintenance. Its fleet includes 39 non-bus vehicles.

However, Russ&nbsp;Henningsen, transportation director, said the program would rotate vehicles about every three years, and not much maintenance would likely be needed.

The district purchases the bulk of its gas from the co-op. Enterprise provides a gas card that can be used at most stations for a 5% discount.

Enterprise also uses data from those gas purchases in maintenance and sales decisions.

Although the vehicles will be newer, Olsen said district insurance costs usually do not increase because of the improved safety features on the newer vehicles.

The district would still use local dealerships for warranty work.

Board member Ken Brooks asked how easy it would be to exit the program if the board found it was not working well for the district.

Olsen said the district would maintain a master agreement with Enterprise, but the obligation would be divided among individual vehicles.&nbsp;

Board attorney Bill Jeter said he had reviewed the contract and gave his approval from a legal standpoint.

Hipp said he recommends the district involve its entire fleet for the district and Early Childhood Connections. Those two fleets must be maintained separately because of the federal funds involved with Early Childhood Connections.

The new vehicles would be phased into the fleet over several years.&nbsp;

"We don't want to be worrying about a vehicle coming back from Liberal at 2 in the morning. If we are rotating vehicles out every three years, we will not even be buying tires," he said.

Hipp said the district would still benefit even if it broke even. Students and staff will be in safer vehicles, and the cost and time to repair vehicles will be less, he said.

Board vice-president Jayme Goetz said, "If we're driving vehicles until the wheels fall off, they are not safe. We are carrying precious cargo."

Monday's meeting was a work session. The Enterprise contract could be brought before the board for a vote as soon as its next meeting, which is Nov. 11.

26 of my 33 years of law enforcement experience has been spent in Trego County. I have served on the USD 208 School board, FFA Alumni board, and 4-H volunteer, and I am currently on the CASA of the High Plains board, Trego Out of Town Bus committee, Lions Club, Screaming Eagles Booster Club, and 10-33 Foundation (a peer support group for first responders).&nbsp; &nbsp;

My wife and I attend the WaKeeney Church of God and actively support our schools. I have also worked with local law enforcement to improve the safety of our schools, churches and children.&nbsp;

What experience and skills would you bring to the position?

&nbsp;I have spent over 33 years in law enforcement, 30 years being with the Kansas Highway Patrol. With this, I bring a perspective of experience, having personally dealt with many of the crimes I will likely adjudicate. I have also given testimony in countless courts in numerous counties and states, both on state and federal levels.

I have spent a great deal of my career developing my own leadership and the leadership in others. I look forward to the possibility of bringing this background into the courts of the 23rd Judicial District.

What are the specific aspects of this judicial position that moved you to run?

I have enjoyed my career as a State Trooper but knew that this season would not last forever. I knew some day, before I reached “normal” retirement age, I would need to seek employment in a position suitable to my aging abilities.

I have always been intrigued by judicial proceedings and have been very successful in trials that I have testified in.

I understand the importance of impartiality and practice it in my current position as Troop Captain with the KHP.

I have sought this path for over 10 years as a next chapter and feel that I would be able to continue to serve the public as a qualified magistrate judge for the 23rd Judicial District.&nbsp;

I believe the ideal judge should have the inherent ability to be an impartial listener of the facts. The ideal judge should ensure that proceedings before them are adjudicated with decorum and fairness. &nbsp; 

The ideal judge should seek justice and justice alone, ensuring that those victimized by crime receive their due justice, and those falsely accused receive justice as well. The ideal judge should instill confidence as a part of the judicial process that justice will prevail.

Describe the most challenging ethical dilemma you have encountered. How did you handle it?

During my career, I have faced many challenges, many with different ethical outcomes, many involving critical incidents. Due to laws and policies on releasing sensitive information, I can not discuss, in detail, such matters, but I will say that the decision to engage another human who is actively attempting to take another human’s life creates such a dilemma.

One occasion, I utilized my patrol vehicle to prevent a wanted felon, traveling the wrong direction on interstate, from colliding with others head on.

The outcome was favorable aside from extensive damage to the vehicles involved. Many of these ethical dilemmas involving life and death require quick and concise decisions that others will review for months.&nbsp;

As a prospective judge, what do you consider your greatest strengths and weaknesses?

I feel one of my greatest strengths would be the perspective I bring having been directly involved with the criminal justice system for over 33 years.

I have developed my leadership abilities, attending many leadership courses from KU, FBI and West Point. My career has placed me in the Troop D Captain position for the past five years. So, I feel my greatest strength is the knowledge I bring to the magistrate judge position of over 33 years of serving in law enforcement. &nbsp;

I feel my greatest weakness will be following the career of Magistrate Judge Flax and his 28 years of experience and gaining the confidence of defense and prosecuting attorneys.

I understand the reservations attorneys who I’ve faced in court proceedings over the past 33 years but look forward to building professional relationships with the entire judicial system to ensure justice is being served impartially and justly.

Have you ever been arrested? When and on what charges? What was the outcome? 

Some 37 years ago, while attending Oktoberfest as a teenager, I engaged in youthful indiscretion as I possessed an alcoholic beverage while under the age of 21.

It was a good lesson in life, teaching me as a teenager that trying to fit in and giving in to peer pressures has its consequences. I was guilty of the crime, and though I was not physically arrested, I was sighted for the violation of underage possession of alcohol and plead to the charge.&nbsp;

Have you ever been a principal, named litigant in a civil matter? How did it affect you?

I cannot recall having ever been named as a litigant in a civil matter. I have received erroneous notices over the past 33 years of frivolous suits that addressed a dislike in my capacity as a government official. None had merit. and none were ever filed officially to my knowledge.

Have you ever been a victim of a crime? How did it impact you (if at all)?

I have been named as the victim in crimes such as “battery on a law enforcement officer” and others throughout my career.&nbsp; One of the most serious would be the crime of “attempted murder of a law enforcement officer."

A suspect had engaged me from a tree row with a high-powered rifle, sending rounds through my patrol vehicle.

The Kansas Highway Patrol does an outstanding job of equipping and training its Troopers.&nbsp; The outcome involved the successful containment of the suspect while holding the perimeter that I was on.

Unfortunately, such crimes against law enforcement tend to affect the officer’s family more than the officer. So, the impact on me stemmed more from watching my family deal with such a crime than from me personally dealing with it.

Magistrate Judge 23rd Judicial District, pos. 3: Travis Phillips

I am not a member of the Kansas Bar. To be a member of the Kansas Bar, a person must have earned a J.D. from an accredited law school and passed the Kansas Bar Examination. Magistrate judges in Kansas are not required to have a law degree, nor are they required to pass the Kansas Bar Examination. They are, however, required to pass a Supreme Court examination within 18 months of being elected, which I have done.&nbsp;I am a member of the Ellis County Bar Association.

I was a registered football official until retiring from that position, working junior high, junior varsity and high school varsity football. I’m an active member of the WaKeeney Lions Club, serving as the president for the last several years. I’m a member of Lift up WaKeeney and an active member of Christ the King Catholic Church.

3. What experience and skills would you bring to the position?

I have served as the Trego County Magistrate since being elected in 1996. I have presided over thousands of cases of various types and difficulty. I have attended numerous regular training seminars and continuing judicial education classes, as is expected of everyone in my position.

With my 28 years of experience, I have gained the knowledge, skills and temperament to serve as a fair and efficient judge. I believe I bring the right attitude to the position to make sure everyone is dealt with fairly, legally and with a concern for both the individual case in front of me, the parties involved and the community as a whole.

4. What are the specific aspects of this judicial position that moved you to run?

Before being elected, I was summoned to sit on the Federal Grand Jury for 18 months, where I learned a great deal about the legal process in general. After further consideration, I felt I could make a positive difference to the citizens of Trego County if they chose to elect me as the new magistrate judge.

I’ve continued to run for this position every four years since because I love this job. I get up bright and early every morning, ready to work hard for the court and the people of Trego County.

I most enjoy getting to work with people, the court staff, the attorneys, other judges and the public. As a judge, it is my duty to uphold the law and to ensure my courtroom is an orderly, fair and efficient place to settle legal disputes. I take great pride in seeing to it that my courtroom is exactly that.

I am grateful to everyone for allowing me to serve them in that capacity over the last 28 years.

Any judge, not just an ideal judge should be well prepared, on time, knowledgeable, ethical and fair. A judge should also be patient, a good listener and able to make a decision based upon the facts of the case as applied to the law.

I don’t know how challenging it is, but the most common is dealing with people who want to speak to me about their case without the others side present. For the most part, I am not allowed to hear from one side in a case without the other side present and must tell them to wait until their court hearing to tell me.

My strength would be my integrity and experiences. I have cultivated an understanding of the law and courtroom procedure. I am comfortable on the bench and can command a courtroom.

Most people do not know that some magistrate judges in Kansas have not been to law school, and therefore, most magistrate judges’ biggest weakness is a lack of experience and knowledge about the law and courtroom procedure, but with my experience for the last 28 years, I have gained the knowledge to bridge that gap.

Setting next to the hall were shade trees and the former 1800 black smith shop. Citizen Herb Hachmeister donated the deteriorating building and property to the Post. Clearing of the property was provided by a grant from the Osborne County McFadden Family Charitable Trust. With the property cleared, a gazebo and parking lot will enable veterans, their families, children, youth, and community a quiet place for celebrations on the High Plains of Kansas.&nbsp;

The Natoma American Legion continues hosting events at the post with the recent National American Legion Commander visiting Kansas from the National headquarters in Indianapolis, Indiana. American Legion Post 109 overcomes challenges through volunteer efforts

KANSAS CITY (AP) —A reporter was injured slightly Tuesday when a rifle fired by a Democratic U.S. Senate candidate during a campaign event caused metal fragments to hit the journalist in the arm.

The KSHB-TV reporter was hit in the arm by flyaway metal as&nbsp;<a href="https://apnews.com/article/2022-midterm-elections-politics-missouri-josh-hawley-united-states-government-276bc7fa34f2447e042c5fb94ac77a53">Lucas Kunce</a>, a Marine, fired an AR-15-style rifle at targets at an exurban Kansas City home.

Kunce provided first aid to the reporter, who continued covering the event. The Kansas City TV station&nbsp;<a href="https://www.kshb.com/news/local-news/kshb-41-reporter-injured-at-lucas-kunce-campaign-event">reported</a>&nbsp;the journalist later was treated for a minor injury at a local hospital.

“We had four first aid kits, so we were able to take care of the situation,” Kunce on Tuesday posted on X, the social media platform formerly known as Twitter. He added that he’s glad the reporter is OK.

Kunce is trying to unseat Republican U.S. Sen. Josh Hawley next month.

The Tuesday shooting event appears to have been designed to appeal to moderate and Republican voters in a state now defined by the GOP’s political dominance, including a strong belief in gun rights. Such events are now increasingly common&nbsp;<a href="https://apnews.com/f78805588e844602a07dcb7b5e49d8ac">tactic used by some Missouri Democrats.</a>

No Democrats serve in statewide office. Kunce’s rival, Hawley,&nbsp;<a href="https://apnews.com/29d1b3371d7e4f8da3359febaee1945e">ousted</a>&nbsp;former Democratic powerhouse Sen. Claire McCaskill in 2018.

Nationally, Democratic Vice President Kamala Harris has not shied away from&nbsp;<a href="https://apnews.com/article/harris-trump-policy-border-guns-credit-card-ivf-democrat-republican-87cd75cfa0d82b0e2b026c69278ff912">guns</a>, either. She told Oprah Winfrey last month that she owns a gun and is prepared to shoot home invaders.

Kunce later wrote on social media that he had a “great day at the range” with former Illinois U.S. Rep. Adam Kinzinger, a Republican.

“We got to hang out with some union workers while exercising our freedom," Kunce wrote in the post that also referenced the accidental shooting.

For his part, Hawley responded jokingly to the accident.

“I condemn all acts of violence against reporters and call on Kunce never to shoot another one,” he wrote on X, ending the post with several laughing-face emojis.

This is Kunce's second bid for the U.S. Senate. He&nbsp;<a href="https://apnews.com/article/2022-primary-elections-missouri-senate-b1a514d69210c507c0f4812550aeb80f">lost the Democratic primary</a>&nbsp;in 2022 to beer heir Trudy Busch Valentine, who went on to lose to now-Sen. Eric Schmitt, a Republican, in the&nbsp;<a href="https://apnews.com/article/missouri-senate-race-2022-midterm-elections-91f950681a72abe1ea6bc20f45bf42ec">general election</a>.

KC reporter struck by bullet fragment at Dem Senate candidate campaign event

LOS ANGELES (AP) —&nbsp;<a href="https://apnews.com/article/75388564292e401abeeb63e708f65099">Ron Ely,</a>&nbsp;the tall, musclebound actor who played the title character in the 1960s NBC series “Tarzan,” has died at age 86.

Ely's daughter, Kirsten Casale Ely, told The Associated Press on Wednesday that her father died Sept. 29 at his home in Los Alamos, California, an unincorporated community in Santa Barbara County.

While Ron Ely was not quite as well-known as&nbsp;<a href="https://apnews.com/article/olympics-2024-paris-games-tarzan-53767dd3d09e67a0e2fb017493732454">Johnny Weismuller, the Olympic swimmer</a>&nbsp;who played Tarzan in movies in the 1930s and 1940s, Ely helped form the image of the shirtless, loincloth-wearing character further immortalized by Disney.

“He was an actor, writer, coach, mentor, family man and leader,” Kirsten Ely said in an&nbsp;<a href="https://www.instagram.com/p/DBeR-voveE4/?utm_source=ig_embed&amp;ig_rid=cede5900-8a98-4a57-9f07-a67519310234&amp;img_index=1">Instagram post</a>. “He created a powerful wave of positive influence wherever he went. The impact he had on others is something that I have never witnessed in any other person - there was something truly magical about him.”

In 2019, he tragically returned to the news when his 62-year-old wife, Valerie Lundeen Ely, was stabbed to death at their Santa Barbara, California, home by their 30-year-old son, Cameron Ely, who was&nbsp;<a href="https://apnews.com/general-news-television-a419275023e441498a1a1bd99c22af32">subsequently shot and killed by police</a>. Ron Ely, who was home during the stabbing, challenged the prosecutor's report that his son's shooting was justified.

“If he didn’t have a gun or he didn’t have a weapon, what was the basis of shooting him?”&nbsp;<a href="https://apnews.com/general-news-99072e47be63da685cd2fa4aecc09da6">Ely's attorney John Burris said in 2020.</a>&nbsp;“They may have very well thought he was involved in some other activity involving the mom. But that’s not a basis to shoot and kill him. You have to have a lawful basis to do that.”

In the early 1980s, Ely was host of the Miss America pageant and met Valerie, a Miss Florida, there. They married in 1984. The couple had three children, and Ely retired from acting to focus on his family in 2001.

“Late in life I had a young family. I decided to stop acting and work at home, as an author, that way I could be with the kids all through school and be able to attend their sports games and things,” he told London's Daily Express in 2013, expressing interest in the time at reentering acting. He would return briefly in the 2014 TV movie “Expecting Amish.”

Ely’s Tarzan didn’t speak in the monosyllabic grunts often associated with the character, originally created by novelist Edgar Rice Burroughs. He was instead an educated bachelor who had grown sick of civilization and had returned to African jungle where he was raised.

Ely said in interviews that he did his own stunts on the show, working directly and precariously with the tigers, chimpanzees and other wild animals that were Tarzan’s friends and servants.

“They first tried to cast a former American football player called Mike Henry but he didn’t like chimpanzees and from the moment he got on set, things went south in a hurry,” Ely told London’s Daily Express in 2013.

A chimp attacked Henry and injured his jaw when the show’s pilot was being filmed, and Ely was cast in his place at the last moment.

“I met with them on a Monday and when they offered me the role I thought: ‘No way do I want to step into that bear trap. You do Tarzan and you are stamped for life’,” Ely told the Daily Express. “Was I ever right! But my agent convinced me it was a quality show and was going to work. So on the Friday I was on a plane to Brazil to shoot the first episode.”

Ely also played the title character in the 1975 action film “Doc Savage: The Man of Bronze,” but otherwise had mostly small roles in TV and films, including the 1958 movie musical “South Pacific.”

He also wrote a pair of mystery novels featuring a detective named Jake Sands, 1994’s “Night Shadows” and 1995’s “East Beach.”

Born in Hereford, Texas, and raised in Amarillo, he married his high school sweetheart in 1959, but divorced two years later.

Along with Kirsten Casale Ely, he is survived by daughter Kaitland Ely Sweet.

Ron Ely, TV's 'Tarzan' in the 1960s, dies at 86

Roberta Josephine 'Tinker' Jacobs, 89, of
Aurora, Colo., passed away on March 28, 2024. She was born July 23, 1934 to
Simon and Ida Jacobs, in Hays, one of six children.

A 1952 graduate
from Hays High School, Tinker helped blaze a trail for women while becoming a
renowned biochemist after earning a B.A. degree at the Fort Hays Kansas State
College (now FHSU) in 1956 with a major in biology and minor in zoology.

She spent her career researching immunology possibilities with a focus on finding ways to
improve treatments for arthritis and lupus, among other health issues. While
working at the Oklahoma Medical Research Foundation in the 1980s, at least
three of her research papers were published in the Journal of Immunological
Methods. She retired from her career as a research scientist from the&nbsp;University
of Colorado Health Science Center in Denver.

Throughout
her career, she continued to teach and learn while earning multiple post-graduate degrees. Beginning at the University
of Buffalo with an M. Med in medicine (1962), continuing at the University of
Kansas with an M. Arts in biology (1966), and concluding at the State
University of New York-Buffalo with a Ph.D. in biochemistry (1980), Tinker was
focused on helping others.

When
not studying or working, Tinker spent time hiking and cycling, honing her
photography skills, and caring for a collection of pets, including her beloved
‘Little Guy’ after retiring in the Denver area. While living in Oklahoma City,
Okla., she became a handywoman as she worked through the process of fixing
problems and making improvements as a homeowner.

She
is survived by her sister, Stephanie Schumacher (Leon) of Hays, four nephews,
seven nieces, and 12 great-nephews and great-nieces. She was preceded in death
by her parents, Simon and Ida (Linenberger) Jacobs, brothers David Jacobs,
Leroy Jacobs and Norman Jacobs, sister Verna Lou (Jacobs) LaBan, and two nieces,
Robin LaBan White and Stacey Schumacher Badger.

A
memorial service will take place at 11:00 am on October 26, 2024 in the St.
Joseph Cemetery in Hays, Kansas. &nbsp;Please

The Hays USD 489 school district has detailed plans to deal with various crises, but it doesn't always release those details to the public.

The school board heard from Julie Zollinger, school psychologist and USD 489 crisis consultant, about the crisis training and tabletop drill conducted with the staff during a recent in-service.

"Engaging in these activities can minimize the chaos and protect from physical harm in an emergency," she said. "It also builds the confidence in our staff to be able to quickly respond and remain calm as their students will look to them for direction and their reaction, especially those children in early childhood and elementary."

While the school district staff may train on incidents that are more likely to happen, such as an accident or injury, they are also preparing for events that are less likely to happen, like an active shooter or a tornado.

"Where we really need to be good is those non-fatal illnesses and injuries that sometimes happen every day," she said. "Kids fall on the playground, break something, or the death of a close family member of a student."

Zollinger briefly discussed the district's Raptor software, which can send alerts to staff in an emergency.

Superintendent Ron Wilson said teachers have used the team feature to request assistance from the office when they need help with a student without having to send a person physically to the office or pick up a wall phone.

The district has also installed crisis posters in all classrooms and offices. The posters outline step-by-step procedures for responding to alerts.

The district is working to roll out a similar graphic that will be sent to parents with instructions on how to respond in a crisis.

The USD 489 Foundation for Education Excellence helped fund crisis bags, which are backpacks of supplies for each classroom and office.

Zollinger said it has been costly to replace items in those bags when they are used or have expired. Those bags were placed in the building about five years ago.

In September, a rash of school threats circulated on social media. Some students stayed home from school.

Board member Ruth Ruder asked Zollinger about active shooter training for the students.

"The issue that happened a couple of weeks ago we had all received an email, I think it was from a parent, about do we train our kids for an active shooter. The cops that I have visited with said you don't really want to have training because if the active shooter knows what do, then he knows what to watch for," Ruder said. "In most cases, the active shooter is a student."

Ruder said she thought it was important to let parents know that teachers are receiving crisis training.

Zollinger said another consideration in crisis training is the potentially harmful psychological effects on both students and staff.

"Two [Hays Police Department] officers and I have been working since June on how to roll out this training appropriately to protect from psychological harm to the staff," she said.

Zollinger said when she practiced lockdown with elementary school staff members, she could almost feel the heart rates increase in the room.

"We want [the staff] to know what to do, but they may be a little more nervous about it because they know they have these 25 little people. It's very different if you have seniors in your classroom."

"As far as teaching kids what to do, we've gone back and forth about the appropriateness of that," she said.

Zollinger emphasized there is a difference between the terms lockdown and active shooter.

Lockdowns put students behind locked doors, and school districts have a low threshold for doing that. A district could initiate a lockdown for merely a perceived or potential threat.

A school might lock a school down over an angry parent in the office, she said.

An active shooter is a term used by police for a person actively attempting to kill people at a location.

Zollinger quoted a recent research article examining student responses on social media after active shooter or lockdown drills.

The researchers found a 30 to 40 percent increase in the amount of anxiety and depression expressed by students when the procedures are talked about.

"It's not worth it because we've caused psychological harm over something that we didn't have to do with them," Zollinger said.

"As long as the adults know exactly what to do and can do it calmly given the situation ... if they are confident in any situation they make, that helps all the children who are with them."

When the school threats happened in September, Wilson said the district was contacted by parents. He said district staff addressed each concern individually.

"The thing that we have learned is that in crisis situations when things are happening, kids will follow the person who is in charge of that classroom," Wilson said. "That is where we are putting our planning and preparing into is that person understanding what they need to do."

Former Trump chief of staff John Kelly says the former president — his former boss — “certainly falls into the general definition of fascist, for sure.” Speaking to the New York Times, Kelly, a retired Marine Corps general, told the paper that Trump “certainly prefers the dictator approach to government.”

They marked the former top aides’ most extended public comments about the former Republican president and the party’s 2024 nominee for the White House. Kelly declined to endorse any candidate for the White House, but told the paper, “it’s a very dangerous thing to have the wrong person elected to high office.”

Trump is lashing out at former Republican Rep. Liz Cheney, who has been campaigning with Kamala Harris in a bid to appeal to Republican voters who are uneasy about Trump.

Trump says of Cheney that “her father brought years of war and death to the Middle East.” He was referring to former Vice President Dick Cheney, who served under President George W. Bush.

He asserted that Harris would do poorly in Michigan for aligning with Cheney.

“Why would a Muslim or why would an Arab want to vote for someone that has Liz Cheney as her hero,” Trump said.

Trump has a long history of Islamophobic rhetoric, including, at one point, calling for a ban on Muslims entering the country during his 2016 campaign.
