FORD COUNTY – The Kansas Bureau of Investigation (KBI)updated information on the conditions of the law enforcement officers in the Monday morning fatal shooting in Dodge City with a&nbsp; man wanted for a double homicide in Phoenix, Arizona.

The deputy from the Ford County Sheriff’s Office, who was hospitalized in Wichita, underwent surgery today. He is improving, and is currently in good condition. The deputy from the Clark County Sheriff’s Office was released from the hospital today, and he is now recovering at home. The KHP trooper is also now recovering from his injuries at home.

The condition of the female subject involved in the shooting is improving, but she continues to be treated for serious injuries.

The sheriff’s deputies involved in the shooting are all on paid administrative leave pending further investigation.&nbsp;

Preliminary information indicates that deputies from the Clark County Sheriff’s Office observed a blue Toyota Tundra driving through Minneola, Kansas.

The Tundra matched the description of a vehicle connected to a double homicide in Phoenix, Arizona. When deputies initiated a traffic stop, the female driver and her male passenger, who was later identified as Leroy D. Malone, 39, of Phoenix, Arizona, fled prompting a vehicle pursuit.

The vehicles headed north on U.S. Highway 283 into Ford County, where deputies from the Ford County Sheriff’s Office and the KHP joined the pursuit. Deputies and troopers deployed stop sticks to try to slow the truck, and a deputy from the Clark County Sheriff’s Office used a maneuver to force the truck into the ditch.

After the vehicle came to rest east of the intersection of U.S. Highway 50 and 113 Road in Dodge City, gunfire was exchanged. Deputies from the Clark County Sheriff’s Office and the Ford County Sheriff’s Office discharged their firearms. A handgun was recovered from inside the truck.

Leroy Malone was hit multiple times by gunfire, and was pronounced dead at the scene. The female subject received multiple gunshot wounds and was transported to Wesley Medical Center in Wichita.

SEDGWICK COUNTY –Law enforcement authorities investigating a man's death as a homicide.

Just before 2 p.m. Monday, police responded to a suspicious death call in the 500 block of N. New York in Wichita, according to Officer Trevor Macy.

 Officers contacted a 53-year-old woman who reported finding 63-year-old Loyd Alexander deceased in the living room of his home.

Police released no additional details including the cause of death. Anyone with information on Alexander's death is asked to contact police.

Homicide: Woman found 63-year-old Kan. man dead in his home

FARMINGTON, Mo. (AP) — Authorities are piecing together how five inmates escaped from a Missouri jail.

The inmates escaped from the the St. Francois County Jail in Farmington, about 75 miles south of St. Louis on Jan. 17. All five were captured over the weekend.

Chief Sheriff's Deputy Gregory Armstrong said that the inmates got into a cell that was supposed to be closed off due to plumbing repairs, removed the sink and toilet, climbed through the wall and made it down from the roof using a ladder that a contractor had left standing against the building. Jail cameras&nbsp;<a href="https://www.stltoday.com/news/local/crime-and-courts/five-inmates-at-large-after-crawling-through-cell-hole-escaping-st-francois-county-jail/article_fb0b9e11-bc6f-5ea8-922b-3c58d7e1310c.html">that would have captured them leaving</a>&nbsp;were down due to the construction.

After escaping from the jail, the inmates ran to an office building parking lot and somehow found a car with the keys in it and a full tank of gas.

“They just got lucky,” Armstrong said. “It's a black eye, of course, that we didn't want. Sometimes things happen.”

All five inmates have criminal records that go back years.

The sheriff's department said in a statement that all five had been recaptured by mid-morning Saturday. One inmate was located at a second-hand retail store in Poplar Bluff, Missouri, on Friday morning.

The other four were apprehended in Ohio on Friday and Saturday.

The Ohio State Highway Patrol said troopers tried to stop a suspected stolen car in Fairfield Township north of Cincinnati on Friday evening. The car fled and after a short chase, four people got out of it and ran. Troopers quickly captured two of them and arrested a third in West Chester Township to the south around 2 a.m. Saturday.

Butler County Sheriff Richard Jones told reporters on Saturday that a report of a suspicious person in a Liberty Township subdivision led a bloodhound to a parked car where the fourth inmate was found hiding in the backseat.

TOPEKA — Byron Lewis was a 
student at Topeka High School when allowed to use study hall to read to 
kindergartners at his old elementary school.

It was the first time Lewis — now an elementary school teacher in the
 Turner district — thought a career in education could be in his future.
 He earned an education degree at Kansas State University and was 
introduced to programs that urge men of color to enter the profession. 
Statewide, it’s just not enough. Entering the fall 2022 academic year, 
there were an estimated 1,500 teacher vacancies in Kansas.

“It’s an uphill battle,” Lewis said during a panel discussion Monday 
sponsored by Kansas State’s College of Education at the Topeka Center 
for Advanced Learning and Careers.

Debbie Mercer, dean of education at K-State, said it was “absolutely 
critical” educators win the rhetorical battle to persuade young people 
that education was a worthy career path and teaching a type of public 
service valued by a cross-section of society. Gone are the days when 
every education school graduate competed against dozens of other 
applicants for jobs, she said.

“We’ve seen a shift,” Mercer said. “There have been a variety of 
reasons. Teaching is hard work. It’s hard emotionally and it’s hard 
intellectually. Teachers need a great deal of grit.”

The KSU dean, however, said people dedicated to teaching could be 
part of something larger than themselves: “There is nothing better.”

Mercer said the foundation of public education had been shaken by 
ideological attacks, complaints from legislators about the cost of state
 funding to K-12 education, demise of teacher tenure and concern about 
deficient salaries.

In the current 2023 session of the Kansas Legislature, the 
Republican-led House and Senate also plan to debate bills driving tax 
dollars to private schools with voucher-like tax incentives and 
“scholarship” programs, imposing a parental bill of rights to influence 
curriculum and library holdings, and mandates that transgender students 
participate in sports activities based on gender at birth.

Tiffany Anderson, superintendent of Topeka public schools, said 
societal challenges meant teachers could play a life-changing role in 
the lives of students. She said her parents were active in the civil 
rights movement and education was a central component of that ongoing 
work.

“For me,” she said, “moving into education was a natural next step to continue to advocate for equality across the board.”

Lewis, who taught in Topeka before moving to the Kansas City, Kansas 
area, said Kansas lawmakers ought to look closely at proposals for 
compensation of financially strapped student teachers as they completed 
requirements for a bachelor’s degree in education.

A task force of educators affiliated with Kansas Board of Regents 
universities suggested the Legislature appropriate $9 million annually 
to pay 1,800 student teachers an average of $5,000. The state would pay 
for 75% of the program and local districts would pick up 25%.

In addition, the task force recommended the state expand a $2.8 
million teacher scholarship program requiring educators to work in an 
underserved area.

Sen. J.R. Claeys, R-Salina, said the Kansas Board of Education ought 
to address the teacher shortage by approving participation in an 
interstate compact allowing out-of-state teachers to more easily 
transition to vacancies in Kansas. The compact would enable Kansas 
school districts to recognize teacher licenses from other states.

“The agreement is legally binding and proposes to remove some 
licensure and assessment requirements for teachers to receive Kansas 
licenses,” Claeys said. “Teachers wishing to teach in another state 
would still need to meet all requirements to receive a license in their 
home state, such as a full bachelor’s degree. Each candidate would also 
undergo the customary background check, and any disciplinary action 
taken against them would be considered.”

Kansas educators on quest to reverse teacher shortage

As we get settled into the first and second week of the 2023 legislative session, most of our work is concentrated in committees where bills are being prioritized and vetted. The Senate has 19 standing committees which cover many different topics, including education, agriculture, judiciary, budget, and utilities—to name a few.&nbsp; Once a committee completes hearings and votes on a bill, if passed, it will then make its way to the Senate floor and the full body will begin to debate and vote on the measure. Floor debates and votes will begin in the coming weeks. At the end of the 2nd&nbsp;week, over 170 bills have been introduced.&nbsp;

<a>SWEARING IN CEREMONIES – SESSION OPENING</a>

On Monday, January 9th, Governor Laura Kelly was sworn into office for her second term.&nbsp; Her speech reflected on the past four years, the impact of COVID-19 on the state of Kansas, and the plan for her final term.&nbsp; In addition, the new Attorney General Kris Kobach and State Treasurer Steven Johnson, as well as re-elected Insurance Commissioner Vicki Schmidt and the Secretary of State Scott Schwab were sworn in.&nbsp;&nbsp;<a></a>The 2023&nbsp;Senate legislative session began on Monday, January 9thth, at 2:00 p.m. with the swearing in of Senator Ron Ryckman, Sr. and new Senator Chase Blasi.&nbsp; Senator Blasi is familiar with the Senate, having served on staff for both Presidents Wagle and Masterson the past few sessions.&nbsp;On Tuesday, Senator Tom Hawk (D-Manhattan) gave his retirement speech and his replacement, Senator Usha Reddi, was sworn into office on Wednesday.&nbsp;

On Wednesday afternoon, Chief Justice Marla Luckert delivered the state of the Judiciary address in a joint session of the legislature.&nbsp; Luckert highlighted the specialty courts across the state, raising judicial pay, and the need for attorneys in rural Kansas.&nbsp; Near the end of 2022, Chief Justice Luckert signed an order to create the Kansas Rural Justice Initiative.&nbsp; The goal of the committee is to examine the legal needs of rural Kansans related to a lower ratio of attorneys to population in contrast to urban areas.&nbsp; According to statistics given in their news release, 43% of Kansans live in rural areas, but only 20% of Kansas attorneys live in rural communities.&nbsp; This leaves an attorneys to population ratio of one active attorney for every 808 residents.&nbsp; In contrast, Kansans in urban areas have two active attorneys for every 535 residents.&nbsp; This is a select committee I was assigned to.&nbsp; I am looking forward to working with the Judicial branch and others in our 18-month time frame to offer solutions for this problem which exists in other states across the nation as well.&nbsp;&nbsp;&nbsp;

State law in Kansas requires that certain appointments by the Governor or other state officials be confirmed by the Senate prior to the appointee exercising any power, duty, or function of the office.

Judge Rachel Pickering had her confirmation hearing in the Judiciary Committee and was confirmed in the Senate on Thursday to the Kansas Court of Appeals.&nbsp; In addition to Judge Pickering, fifteen additional appointments to boards and commissions were also confirmed by the Senate on Thursday, January 19th.&nbsp; Among these confirmations,&nbsp;Ray C. Walling was confirmed as the 18th&nbsp;Kansas State Librarian since 1870.&nbsp;

SB3 –&nbsp;AN ACT designating Silvisaurus condrayi as the official state land fossil

Senate District #36 – Ottawa County

In 1955, Warren Condray, a farmer and rancher in Ottawa County, discovered this fossil in his pasture.&nbsp; His son, Jettie Condray who was the Ottawa County Historical Museum director, and his son Joel now a teacher in Goddard School district, promoted this fossil to be named a state fossil.&nbsp; Joel’s 6th&nbsp;grade class worked on this bill as a project to learn about the process of a bill (an idea) turning into a Kansas statute.&nbsp; The fossil was&nbsp;a one-ton armored ankylosaur approximately 13-feet long that walked across Kansas during the late cretaceous period of the mesozoic era.&nbsp; SB3 was heard in Senate Federal and State affairs on Wednesday, January 18th, and will be on the Senate Calendar next week.&nbsp; It will pass over to the House of Representatives, the students again will testify in committee (41 students and a few administrators attended the hearing), then a full House vote, and to Governor for her signature.&nbsp; With an early start on their project, there is a very good chance it will be signed in law before session and school ends.&nbsp;&nbsp; The fossil is currently on display in Lawrence at the KU Natural History Museum.&nbsp;

BOWERS: 2023 Senate Scene Weeks 1 and 2

SHAWNEE COUNTY — Family members have established an <a href="https://www.gofundme.com/f/tragedy-strikes-family-that-needs-help?qid=c95fbfdf038303f79dfa0f20979a986f">online fundraiser</a> to assist with the final expenses of a Kansas woman and her two children who died in a house fire January 20, in Topeka.

&nbsp;Thirty-year-old Genny L. Fitzpatrick, 9-year-old  Peyton L. Tyler and 1-year-old Kourtney K. Tyler, all of Topeka died in the fire that investigators believe was intentionally set.

Just 5:00 a.m. Friday, crews responded to the report of house fire at 916 SW Warren Avenue in Topeka, according to fire department spokesperson Rosie Nichols.

First responding crews found heavy smoke and flames coming from the two-story house. Crews entered, searched the home and found four individuals.&nbsp;An adult and child were pronounced deceased on the scene.

Fire crews rescued an adult and a juvenile from the home and firefighters began immediate life-saving treatment.&nbsp; American Medical Response (AMR) transported both including 32-year-old Kyle Tyler to a local hospital. The child later died at the hospital, according to Nichols.

The cause of the fire has been determined by Topeka Fire investigators as intentionally set. The incident is being investigated by police as a homicide. The incident is domestic in nature, according to Nichols.

&nbsp;Kyle J. Tyler, 32, of Holton, was released from the hospital Saturday, and transported to the Law Enforcement Center to be interviewed. Police arrested and booked him into the Shawnee County Department of Corrections on requested charges of Murder in the 1st degree; In the commission of a felony, Aggravated Arson and Aggravated Child Endangerment.

TOPEKA
 — A recently introduced bill would bring the abortion fight to the 
county and city level, allowing local government to limit access to 
reproductive health care.

The latest in a series of attempts to restrict abortion, <a target="_blank" href="http://www.kslegislature.org/li/b2023_24/measures/documents/sb65_00_0000.pdf">Senate Bill 65</a>
 would give cities and counties the right to enact stricter laws on 
abortion than current state law. Sen. Chase Blasi, R-Wichita, introduced
 the bill without putting his name on it as a sponsor.

Under current state law, use of drugs
 or devices that inhibit ovulation, fertilization or implantation of the
 embryo — meaning birth control, such as IUDS, pills and condoms, are 
deemed legal, as is disposing of 
the products of in-vitro fertilization before implantation, such as 
fertilized eggs. The state, along with any political subdivision of the 
state, doesn’t have the right to prohibit these practices and devices.

SB65 seeks to undo this, repealing 
the statewide protections of these drugs and devices. The legislation 
stipulates that as long as the abortion regulations are as strict or 
stricter than state law, cities and counties have the right of 
regulation within the boundaries of the area. The bill would overrule 
statewide protections, upholding the “more stringent local regulation.” 
If passed, SB65 would take effect immediately.

During a Thursday meeting of the 
Senate Federal and State Affairs Committee, lawmakers chuckled as Blasi 
introduced the bill to limit reproductive rights for Kansas women.

“Any objections? Seeing none, that 
bill is introduced,” said committee chairman Mike Thompson, R-Shawnee, 
as he leaned back in his chair and laughed with Sen. Rick Kloos, 
R-Topeka, and other legislators on the committee.

In Kansas, abortions<a target="_blank" href="https://kansasreflector.com/2022/07/15/amid-amendment-rhetoric-heres-what-abortion-actually-looks-like-in-kansas/"> are illegal after 22 weeks of gestation</a>,
 except in cases where the mother’s health is in jeopardy. There have 
been no abortions performed outside of this 22-week window in recent 
years, according to state records.

In 2019, the Kansas Supreme Court determined the state constitution’s right to bodily autonomy includes the right to terminate a pregnancy. Republicans have repeatedly stated their intentions <a target="_blank" href="https://kansasreflector.com/2022/12/05/ahead-of-the-kansas-legislative-session-abortion-rights-once-again-under-discussion/">to restrict abortion access in the state</a>,
 even though Kansans in August voted down a proposed constitutional 
amendment that would have given lawmakers the authority to ban abortion 
without exceptions.

In the Kansas GOP legislative agenda, abortion limitations are mentioned as a high priority. Republican lawmakers want to <a target="_blank" href="https://kansasreflector.com/2023/01/10/kansas-gop-rails-against-woke-agenda-will-work-toward-stricter-abortion-rules/">implement stricter abortion laws</a> and fund more crisis pregnancy centers in the state.

Republican Sens. Molly Baumgardner, of Louisburg, and Rob Olson, of 
Olathe, said Monday they haven’t had a chance to review the legislation 
yet but that they oppose abortion.

“I’m not going to comment on the bill, but I’m 100% pro-life and I don’t support abortion,” Olson said.

Other abortion-related legislation introduced includes <a target="_blank" href="http://www.kslegislature.org/li/b2023_24/measures/documents/sb5_00_0000.pdf">Senate Bill 5</a>,
 sponsored by Sen. Mark Steffen, R-Hutchinson. The bill would prohibit 
the prescription of abortion drugs by telemedicine and take away the 
governor’s ability to alter the prohibitions during a state of 
emergency.

House Minority Leader Vic Miller, 
D-Topeka, said he remained committed to defending women’s reproductive 
rights. Miller referenced the November retention of Kansas Supreme Court
 justices who upheld the right to abortion, saying it showed widespread 
support for these rights.

“These facts are why it is so 
profoundly insulting to the vast majority of Kansans who voted ‘NO’ that
 Republicans in the Kansas Senate have introduced multiple pieces of 
legislation to ban abortion,” Miller said in a statement. “We have a 
simple job in the Legislature — represent
 our constituents. With nearly 600,000 Kansans choosing to protect the 
right to reproductive health care, there is no excuse for this 
negligent, harmful, and misogynistic legislation.”

Sunday marked the 50th anniversary of Roe v. Wade, the landmark decision that declared a constitutional right to abortion.

Emily Wales, president and CEO of 
Planned Parenthood Great Plains, said the organization would honor the 
anniversary by fighting to protect abortion and contraception access in 
Kansas, Arkansas, Missouri and Oklahoma.

 “We
 may assume the long arc of history bends towards justice, but we have a
 duty to grab hold of it and pull it in that direction,” Wales said in a statement. “We
 have worked to do that at Planned Parenthood Great Plains for the past 
year, by serving as many patients as possible seeking abortion care, 
fighting intensely to protect access in Kansas and working to reassure 
and support all patients in our four states that we are here, and our 
doors remain open.”

Proposed Kansas abortion bill seeks to undo state protections

NEW YORK (AP) — Documents with classified markings were discovered in&nbsp;<a href="https://apnews.com/hub/michael-pence">former Vice President Mike Pence</a>&nbsp;'s Indiana residence last week, his lawyer says, the latest in&nbsp;<a href="https://apnews.com/article/biden-politics-united-states-government-us-federal-bureau-of-investigation-donald-trump-ba4bfb9855f01ca2a66e732025b34973">a string of recoveries</a>&nbsp;of papers meant to be treated with utmost sensitivity from the homes of current and former top U.S. officials.

“A small number of documents,” taken into FBI custody last Thursday, “were inadvertently boxed and transported" to the former vice president's home at the end of the last administration, Pence's lawyer, Greg Jacob, wrote in a letter to the National Archives shared with The Associated Press.

He said that Pence had been “unaware of the existence of sensitive or classified documents at his personal residence” until a search last week and that he “understands the high importance of protecting sensitive and classified information” and stands ready to cooperate with "any appropriate inquiry.”

The revelation came as the Department of Justice was already investigating the&nbsp;<a href="https://apnews.com/article/biden-politics-delaware-0827b59ee141b33af95023377713e075">discovery of documents with classification markings</a>&nbsp;in President Joe Biden's home in Delaware and his former Washington office, as well as&nbsp;<a href="https://apnews.com/article/donald-trump-mar-a-lago-government-and-politics-9e8d683afe87389407950af7ccfdbdd6">former President Donald Trump's Florida estate</a>. Democrat Biden has indicated he will seek reelection, Republican Trump is already a declared candidate, and Pence has been exploring a possible 2024 campaign that would put him in direct competition against Trump, his former boss.

The newest discovery thrusts Pence, who had previously insisted that he followed stringent protocols regarding classified documents, into the debate over the handling of secret materials by officials who have served in the highest ranks of government.

Trump is currently under criminal investigation after roughly 300 documents with classified markings, including at the top secret level, were discovered at his Mar-a-Lago. Officials are trying to determine whether Trump or anyone else should be charged with illegal possession of those records or with trying to obstruct the months-long criminal investigation. Biden is also subject to a special counsel investigation after classified documents from his time as a senator and in the Obama administration were found at his properties.

Trump, who denies any wrongdoing, reacted to the new development on his social media site: “Mike Pence is an innocent man. He never did anything knowingly dishonest in his life. Leave him alone!!!” Trump and Pence have clashed over Pence's refusal to go along with Trump's efforts to overturn the results of the 2020 election.

While a very different case, the Pence development could bolster the arguments of Trump and Biden, who have sought to downplay the significance of the discoveries at their homes. The presence of secret documents at all three men's residences further underscores&nbsp;<a href="https://apnews.com/article/biden-politics-us-national-security-council-donald-trump-united-states-government-e8c56297702daf253b9e0fcb45e17b6c">the federal government’s unwieldy system</a>&nbsp;for storing and protecting the millions of classified documents it produces every year.

Pence’s lawyer, Jacob, said in his letter that the former vice president had “engaged outside counsel, with experience in handling classified documents" to review records stored at his home on Jan. 16 “out of an abundance of caution” amid the uproar over the discovery of documents at Biden's home.

Jacob said the Pence documents with classification markings were immediately secured in a locked safe. FBI agents visited the residence the night of Jan. 19 at 9:30 p.m. to collect the documents that had been secured, according to a follow-up letter from the lawyer dated Jan. 22. Pence was in Washington for an event at the time.

A total of four boxes containing copies of administration papers —- two in which “a small number” of papers bearing classified markings were found, and two containing “courtesy copies of vice presidential papers” — were discovered, according to the letter. Arrangements were made to deliver those boxes to the National Archives Monday.

Congressional leaders were notified of the discovery by Pence's team on Tuesday.

The boxes, according to a Pence aide, were not kept in a secure location, but were taped shut and were not believed to have been opened since they were packed. The former vice president's staff also searched the Washington office of his advocacy group last week and did not discover additional documents, according to the person, who spoke on condition of anonymity because of the sensitive nature of the search.

Material found in the boxes came mostly from Pence's Naval Observatory vice presidential residence, the packing of which would not have been handled by the vice president's office or its lawyers. Other material came from a West Wing office drawer, the person said.

The National Archives declined to comment on the discovery. A Justice Department spokesman also declined to comment, and a lawyer for Pence did not immediately respond to an email seeking elaboration.

Pence&nbsp;<a href="https://apnews.com/article/donald-trump-mar-a-lago-iowa-classified-information-merrick-garland-94814cb950a2a9f89dc0c54aec46ce7c">told the Associated Press in August</a>&nbsp;that he did not take any classified information with him when he left office.

Asked directly if he had retained any such information, he said, “No, not to my knowledge.”

In an&nbsp;<a href="https://www.foxbusiness.com/media/mike-pence-troubled-reports-bidens-alleged-mishandling-of-classified-docs-known-before-election">interview this month with Fox Business</a>, Pence described a “very formal process” used by his office to handle classified information as well as the steps taken by his lawyers to ensure none was taken with him.

“Before we left the White House, the attorneys on my staff went through all the documents at both the White House and our offices there and at the vice president’s residence to ensure that any documents that needed to be turned over to the National Archives, including classified documents, were turned over. So we went through a very careful process in that regard," Pence said.

On Capitol Hill, members of the Senate intelligence committee expressed incredulity over the mishandling of documents by top U.S. officials.

Republican Sen. John Cornyn of Texas noted that classified documents are only moved out of the committee’s offices in locked bags.

“In my book, it’s never permissible to take classified documents outside of a secure facility" except by a secure means of transport between such facilities, he said.

House Intelligence Chairman Mike Turner, a Republican, said he planned to request a formal intelligence review and damage assessment.

And Republican Sen. Rick Scott of Florida, another potential 2024 candidate, said, “I don’t know how anybody ends up with classified documents. ... I mean, every classified document I’ve ever seen has a big ‘Classified’ on it."

Sen. Ron Wyden, D-Ore., and a senior member of the Senate Intelligence Committee, pointed to broader concerns with the classification system, complaining that it “is at the point where there is so much out there it is hard to determine what ought to be classified, and then it is hard to determine what should be declassified.”

Meanwhile, some Republicans pressed for a search of former President Barack Obama's personal records.

An Obama spokesperson referred to a 2022 statement from the National Archives that said the agency took control of all of his records after he left office and “is not aware of any missing boxes of presidential records from the Obama administration."

Representatives of former presidents George W. Bush and Bill Clinton and former Vice President Dick Cheney said all of their classified records had been turned over to NARA upon leaving the White House.

Mike Pompeo, who served as Trump's secretary of state and is mulling his own 2024 GOP presidential bid, told the AP in August that he had not taken any any classified material with him after leaving the administration.

But he told Fox News channel Tuesday, “When you’re in the executive branch, you have these documents in your home. One can imagine a note getting someplace, getting stuck. I suspect that may be what happened."

The Justice Department already is using special counsels to investigate the presence of documents with classification markings taken from the Florida estate of former President Donald Trump and from Biden’s home and former Washington office. The department says roughly 300 documents marked classified, including at the top-secret level, were taken from Mar-a-Lago, and officials are trying to determine whether Trump or anyone else should be charged with illegal possession of those records or with trying to obstruct the months-long criminal investigation.

Pence's lawyer said in his letter that the former vice president “was unaware of the existence of sensitive or classified documents at his personal residence” and "understands the high importance of protecting sensitive and classified information and stands ready and willing to cooperate fully with the National Archives and any appropriate inquiry.”

Jacob said that Pence immediately secured the documents that were discovered in a locked safe. And according to a follow-up letter from the lawyer dated Jan. 22, FBI agents visited Pence's residence to collect the documents.

A Justice Department spokesman declined to comment Tuesday, and a lawyer for Pence did not immediately respond to an email seeking elaboration.

The agency said Jost placed felled trees and other debris in approximately 4,155 feet of Mud Creek and approximately 1,800 feet of Sand Creek in 2021 without obtaining a Clean Water Act permit.

“The unauthorized placement of fill material into streams and other water bodies degrades watershed health, increases downstream erosion, and creates loss of wildlife habitat,” said David Cozad, director of EPA Region 7’s Enforcement and Compliance Assurance Division. “These acts also deprive downstream landowners and the public from the use and enjoyment of public waters.”

In response to EPA’s findings, Jost removed the materials from the stream.

Under the Clean Water Act, parties are prohibited from discharging fill material into federally protected streams and other water bodies unless they first obtain a permit from the U.S. Army Corps of Engineers (USACE). If parties place fill material into water bodies without a permit, the USACE may elect to refer an enforcement case to EPA. The USACE’s Kansas City District referred this case to EPA in January 2022.
