Three-day weather outlook

Tuesday was <a href="https://nationalvoterregistrationday.org/" target="_blank">National Voter Registration Day</a> — an election-year effort since 2012 to encourage all of us to vote.

Ironically, the idea of voter registration started with the opposite 
idea in mind: Creation of a system to deny voting to certain people, 
such as recent immigrants, Blacks and even those just deemed low-income.

The registration system — actually “systems,” since each state 
controls how its voters register — also has been used to spur 
participation: The Voting Rights Act of 1965 voided a number of Southern
 states’ Jim Crow discriminatory practices, such as requiring 
prospective Black voters to state exactly, “How many bubbles are there 
in a bar of soap?” or to name obscure federal office holders.

Mail-in and “motor-voter” provisions made it easier to register, or 
extensions of the time period to qualify overwhelmed occasional attempts
 to exclude groups of poorer working people who often were not at home 
when registrars visited.

In 1993, President Clinton signed the <a href="https://www.justice.gov/crt/about-national-voter-registration-act" target="_blank">National Voter Registration Act</a>,
 which mandated that states allow citizens to register to vote by mail, 
at motor vehicle/licensing branches or local public offices. More than 9
 million new voters registered once the act took effect in 1995, 
according to Alexander Keyssar’s in “The Right to Vote: The Contested History of Democracy in the United States,” published in 2000.

If you need information on where to register for the upcoming elections on Nov. 3, <a href="http://www.NationalVoterRegistrationDay.org" target="_blank">www.NationalVoterRegistrationDay.org</a>
 provides a list of events and resources nationwide and online that can 
help. The organization says nearly 3 million Americans in the last eight
 years have used the day to register and it expects to exceed the record
 participation of 2018, when more than 800,000 signed up on National 
Voter Registration Day.

Voting and being able to register to vote seem obvious extensions of 
First Amendment rights. Of what ultimate good are the rights to freely 
think, speak and write, gather and seek change in our government if we 
are unable to participate in the actual decision about the people who 
carry out its policies?

Still, as my colleague Lata Nott <a href="https://www.freedomforuminstitute.org/2020/02/27/the-first-amendment-protects-activities-adjacent-to-voting-but-stops-short-of-voting-itself/" target="_blank">observed in a First Five column</a>
 in February, “The First Amendment protects so many activities that are 
adjacent to voting — spending money to influence voters, expressing 
political views near polling stations, signing petitions to put 
initiatives on a ballot — but stops short of voting itself.”

At the time the column was written, courts were deep into battles 
over gerrymandered districts aimed at splitting certain voter groups 
into differing districts to dilute those groups’ influence. It also was 
clear that voter registration would be another contentious issue during a
 primary season extended, due to COVID-19 delays and measures, well into
 summer. Now, mail-in voting is the subject of presidential attacks, as 
largely Republican state leaders defend limits on certain registration 
efforts seen as more favorable to likely Democratic voters.

To the disappointment of some, the U.S. Supreme Court has not risen 
as the champion of registration and voter rights, either directly under 
the First Amendment or through the 14th Amendment’s guarantee of due process for all. (The 15th Amendment does make it clear that racial discrimination in registration and voting is illegal.)

The high court generally uses a doctrine called “strict scrutiny” in 
deciding most election-related amendment cases such as restrictions on 
campaign finance and even the wearing of election-related T-shirts in 
polling places. But it has used a lesser standard in direct registration
 and voting cases, allowing authorities to offer so-called “compelling 
public interest” arguments — sometimes accepting unsupported claims of 
potential registration and/or voter fraud — in deferring to those 
officials on restrictive state laws.

Writing on the Pacific Standard blog, author Noah Berlatsky notes “in 2013, the Supreme Court <a href="https://www.brennancenter.org/blog/qa-voting-rights-five-years-after-supreme-courts-shelby-county-decision" target="_blank">invalidated key sections of the Voting Rights Act of 1965</a>,
 making it possible for Southern states to pass restrictive voter ID 
laws and erect other barriers … In 2016, Wisconsin’s strict voter ID law
 prevented many poor and marginalized people from voting … (and) just 
before 2018 mid-terms, the Supreme Court <a href="https://www.rollingstone.com/politics/politics-news/supreme-court-voting-rights-735696/" target="_blank">upheld a law in North Dakota</a>
 that required voters to provide a residential street address — 
effectively disenfranchising many Native American voters on 
reservations, who often don’t have street addresses.”

Still, efforts like National Voter Registration Day are buttressed by
 dozens of national state and local “get-out-the-vote” campaigns, 
ranging from ongoing work by the League of Women Voters and the NAACP to
 more partisan efforts by both major parties to independent groups such 
as Rock the Vote and ServiceVote Challenge. Most are available online.

The inherent values of voting and being registered to vote have been hailed since the nation’s early days. Alexis de Tocqueville’s “<a href="https://www.gutenberg.org/files/815/815-h/815-h.htm" target="_blank">Democracy in America</a>,” first
 published in 1835, had great hopes for American democracy to succeed, 
based on a principle of constitutionally protected independent thinking 
and actions and what he called “the reconciliation of personal interests
 and the public good.”

Starting with our First Amendment freedoms, the nation’s founders 
devised a system on the free exchange of views to create an informed 
body of citizens, who then could exercise self-governance through the 
process of elections.

Registering to vote is the first step in that reconciliation of 
measuring our individual views and needs against the overall needs of 
our society. Voting on Nov. 3 is the next step — the ultimate expression
 of our First Amendment right “of the people peaceably to assemble, and 
to petition the government for a redress of grievances.”

So don’t let Tocqueville — or your fellow citizens and democracy — down. Register. Vote.

FIRST FIVE: Speak, assemble, petition — and register to vote

Fall is in the air and that is exciting. For many families it means the start of a new school year with a schedule of extra-curricular activities that could make your head spin. For others it is a time of slowing down, and preparing your home and garden for cooler weather. For the Cottonwood Extension District, fall is a time when educational programs abound.&nbsp;

Are you a life-long learner? Moms and dads, grandmas and grandpas are never too old to learn something new. I don’t mean you have to enroll in a formal class, complete with a syllabus and a final exam. I am talking about the many educational programs offered by the Cottonwood Extension District. Whether you are a farmer interested in controlling honey locust trees in your pastures, or you have youngsters who are ready to join the 4-H and youth program, Extension has something for everyone. One program I am excited to share in the month ahead is about fermented foods. (Next weeks’ column will provide all of the details) &nbsp;

The year 2020 has created challenges for many. In Extension, our Administrative team has encouraged us to turn these challenges into opportunities. When our face-to-face meetings were restricted for a few months, our use of technology kicked into high gear. While Zoom meetings and webinars became the norm, our Cottonwood Extension Educators found ways to stay connected.

And just a reminder that our offices in both Great Bend and Hays are open and ready to serve you. We do ask that you wear a mask when entering our offices. If your questions can be answered through an e-mail or phone call we encourage that.

I would also like to encourage you to check out our Cottonwood website and like our Facebook page. Then you will see first hand the many learning opportunities that are highlighted. NORTON COUNTY —One person died in an accident just after 3:30p.m. Wednesday in Norton County.

The Kansas Highway Patrol reported a 2012 Chevy Malibu driven by Trenton Jacob&nbsp;Brinkman, 25, Norton, was eastbound on U.S. 36 four miles east of Norton.

The driver turned onto Kansas Highway 67 in front of a westbound 2020 Kenworth semi driven by Tucker Levi Johnson, 31, Billings, Montana.

EMS transported Brinkman to Norton County Hospital where he died.&nbsp; Johnson was not injured. Brinkman was not wearing a seat belt, according to the KHP.

ELLIS — Ellis High School announced this week its Homecoming 2020 Royalty and activity schedule.

Royalty includes:&nbsp;Brady Frickey, son of Stacy &amp; Brad Frickey; Daniel Eck, son of Geoff &amp; Mindy Eck; Tegan Cain, son of Brent &amp; Darci Cain; Abigail North, daughter of Travis &amp; Ava North; Grace Eck, daughter of Mark &amp; Sarah Eck; and Morgan Bittel, daughter of Brady Bittel and Tammy Rudd.

The theme is 2020 Homecoming is Bash the Buffs, and the Ellis football team will take on Thomas More Prep-Marian on Friday, Oct. 2.

The parade will be on Friday afternoon starting at 2:30 p.m.  The Homecoming Dance is 9 p.m. Saturday, Oct. 3.

Ellis High announces Homecoming royalty, schedule

Hays Catholic Schools, TMP-Marian and Holy Family Elementary will be in Onsite Learning for the week of 9/28 - 10/2.

HFE has two confirmed cases of COVID-19, 8 students quarantined and 4 students absent due to COVID-19 like symptoms.  Holy Family has made the decision that 6B will go to remote learning through Thursday, October 8, 2020 due to potential exposure. The rest of the school will remain in Onsite Learning.

Holy Family’s decision was made after conferring with the Ellis County Health Department and school leaders. Affected students/parents have been communicated with regarding their children’s remote learning as necessary. 

TMP-Marian is not currently addressing any positive cases, and 5 students are in quarantine due to potential exposure. 

While decisions regarding the method of learning (onsite, hybrid, or remote) are made based on our established plan and collaboration with others, we do however have the discretion to change the mode of instruction in the event of clusters of infection or loss of staffing. 

Mrs. Wentling, Mr. Meitner and Mr. Andrews continue to be in regular communication with Ellis County health officials, local educational leaders and medical professionals to determine the phase of education for our students. This collaborative group daily monitors local COVID positive numbers to continue to safely educate our students according to data which consists of medical statistics and community/parent feedback.

Due to pending COVID tests and staffing issues, O’Loughlin Elementary School will
move to a remote learning environment for the remainder of this week –
Thursday, Sept. 24, and Friday, Sept. 25.


On-site learning will resume Monday, Sept. 28, unless notified otherwise. This
decision is made in an effort to ensure the health and safety of our students and
staff. This time will also allow for continual cleaning and disinfecting of the
building. The understanding and flexibility of our families and community is
greatly appreciated.


For the next two days, Sept. 24 and 25, O'Loughlin Elementary students will have
the opportunity to receive breakfast and lunch from the school. Please sign up by

O'Loughlin will move to remote learning remainder of the week

The Ellis County Health Department on Wednesday reported the seven-day average of new coronavirus cases per day fell slightly since Monday to 17.

The department said 33 new cases of COVID-19 have been identified since Monday. There are now 183 active cases, including three active hospitalizations, and 736 recoveries.

The seven-day percent of positive tests was 27.1 percent. Of the 7,731 total tests returned, 11.4 percent, or 878, have returned positive.

Since reporting began, there have been 922 cases of COVID-19 identified in Ellis County, including three deaths.

NOTE:&nbsp;"New cases" reflects cases reported by the Ellis County Health Department between regular reporting periods of Monday, Wednesday and Friday. "Total cases" reflects all cases reported by the department. Because of delayed test results, total cases might include cases prior to the previous reporting period, so the figures might not necessarily correspond.

HAYS - More than a month after the MIAA announced
the suspension of fall sports due to the COVID-19 pandemic, three of the
conference’s schools have announced they are moving forward with a partial 2020
football schedule beginning in late October.

Despite the move by Pittsburg State, Missouri
Western State and Nebraska-Kearney to play games this fall, Fort Hays State
has no such plans.

“We felt like that was going against what we
had originally voted on.” said FHSU athletic director Curtis Hammeke. “We made
our plans and our practice structures with the idea of not playing any games
this fall, so we’re going to stick to that.”

The move by the three schools to play comes
after last Thursday’s 10-2 vote by the MIAA athletic directors to move forward with
a four-game fall schedule. The motion did not gain approval from the conference’s
presidents who had a 5-5 split on the vote with two of the league’s presidents
abstaining.

Pittsburg State, Missouri Western State and
Nebraska-Kearney will each play two games against one another while filling out
the remainder of the schedules with other NCAA II and NCAA I FCS institutions.

And while there’s technically nothing wrong
with conference schools scheduling games, Hammeke senses some frustration amongst
the other MIAA members.

“I do believe the intent of that action was
for no one to participate against outside competition this fall for a number of
reasons in terms of safety with their student athletes.” Hammeke said. “Fort
Hays has chosen not to go against that, feeling like it’s the ethical thing to
do, but I do think there is a sense of frustration.” 

“I think we’ll probably see some others maybe
try to put themselves in a position to play games this fall, we just aren’t going
to follow along in that path. I don’t think it makes sense.” Hammeke added. “We’re
going to hold to our plans that we had in place and hopefully have a sense of
gratitude for how much we are able to do right now rather than focus on what we’re
not getting to do.”

FHSU head football coach Chris Brown agrees
with Hammeke’s decision to no play this fall.

“When we heard that the season was canceled
and there would be no fall competition, we set a plan for our kids to make sure
they were healthy and safe and ready to actually play a true football game and
I just don’t think we’re there yet.” Brown said. “We moved things a little bit
slower than we normally do during the fall, but that’s because we didn’t really
do much through the spring and through the summer. We’ve had a plan set since
this all happened and we’re going to stay to that plan and make sure our kids are
ready to play when that time comes.” 

Discussions are ongoing for MIAA spring
volleyball and soccer schedules. Brown said football will likely have three or four
playing dates in the spring that will be either games or scrimmages against
outside competition.

A chemical spill has temporarily closed Rarick Hall on the campus of Fort Hays State University, the school announced Wednesday morning.

The spill occurred on the first floor, and the Hays Fire Department is currently on scene.&nbsp;

North Campus Drive also is temporarily shut down between the Schmidt Foundation Center for Art and Design and Park Street to allow a hazardous materials teams to contain the spill and decontaminate the area.

Renovation work has been underway at Rarick, which houses a mix of office and classroom space.

Chemical spill temporarily closes Rarick Hall at FHSU

Recent Hays Academy of Hair Design graduate Kenzie Wolf
capped off her studies in a pretty big way, taking the top spot in the Future
Star category in the 2020 Beauty Envision Awards.

The national contest brings in hundreds of constants from
around the county. 

“It was such an exciting moment,” Wolf said. “It’s one of
those things where anything is possible and it made me realize all my hard work
was worth something and that I could really go far in this industry.”

But she wasn’t always sure that cosmology was in her future.

“Hair has always been in the back of my head. I’ve known I
wanted to do that for a while,” Wolf said. “But I was always told I wouldn’t
make money or be successful.”

After receiving an associate’s degree from Barton County
Community College, she took a tour of the academy and took the plunge.

During her time at the academy, she continued to live in
Hoisington and hopes to open her own salon there in the future.

“I’ve talked about going somewhere big, it’s in my mind, but
I think I want to end up opening a salon here in Hoisington. I think that is my
main goal,” Wolf said.

While Wolf was able to snag the top spot, the academy had four
others make it into the top 10 including Courtney Crawford, Plainville, who was also a top
three finalist.

“For us to have that many represented is absolutely an honor,” said Danielle
Markley, co-owner. “We are very proud of Kenzie and the hard work that all the
students put in.”

Typically, the top three finalists will compete in a live competition
in Las Vegas, but ongoing COVID-19 concerns pushed the contest online, with a
virtual show.

“Enter a total look
that highlights your creativity and visionary determination while showcasing
your clear understanding of cutting, styling, texture and color. Looks must be
commercial, contemporary, and wearable,” the listing for the contest said. “Your
design should be limitless, bold, bright and fearless. Your cut should enhance
your color work, and your finish should showcase your color. When these
elements come together in just the right way, your total look (hair, fashion and makeup) should capture the audience.”

To enter the first round of the contest, Wolf said she had
to find a model and create an inspiration board showing their idea initially struggling
to find an idea, but landed on a bold concept.

“I went with the more edgy stuff,” Wolf said. “The girls at
my school I was competing with were all doing long cuts, with color melts and I
wanted to do something way different than everyone.”

After finding a style she liked, she created the look for her
model.

“I just wanted to be different than everybody else and stand
out,” Wolf said.

That strategy would pay off with her win.

That a big reason for the contests — Markley said they help
the students find their own style.

“Whenever it comes to a competition, they really have to put themselves
out there,” she said. “For them to really put themselves out there and go for
it, we are proud of them for that.

“We have a motto at Hays Academy, and it’s get comfortable being uncomfortable
and when students step out of their comfort zone they are going to grow,” Markley
said.

Hays Academy student wins national award

ROOKS COUNTY — The U.S. Bureau of Reclamation recently
announced $22.1 million in repairs and upgrades for Webster Dam in Rooks
County, allowing for continued operation of the dam and protection for
residents downstream.&nbsp;

The aging infrastructure requires high-quality concrete replacement to repair the spillway chute floor.&nbsp;

“Webster Dam is critical to protecting the way of life in Webster and the surrounding communities,” Nebraska-Kansas Area Manager Aaron Thompson said.

 “The main purpose of the dam is flood control, and when construction was finalized in 1956, the locals hosted a parade, dance, and free barbecue dinner to celebrate its completion and the protection it provided the town. We want to continue to safeguard these communities from potential disaster from Solomon River flooding for years to come.”

Webster Dam was approved under the Pick-Sloan Missouri Basin Program to support flood control and irrigation efforts. Construction of the dam began in 1953, following devastating floods of 1951 that killed 17 people, exceeded $935 million in damages, and displaced more than half a million residents in Kansas and Missouri.

Repairs are scheduled to begin in early 2021 and to be completed within three years.

HPD Activity Log, Sept. 10-13

We are clearly in the middle of fall and that means harvest. Harvest is one of the most thrilling, rewarding, happiest time of the year. Of course, that is when things go right. It can also be the most maddening, frustrating, disappointing times of the year when they do not. If you are in agriculture and you do not look forward to this time of the year you might be in the wrong business. Fall is our Super Bowl.

Good or bad, harvest is all about the rush, time crunch and stress. We are always in a hurry, and it must be done yesterday. I know we do not have any free time during this time of the year, but I want you to take just a moment. Think about what you are a part of. In just a few short weeks we will harvest enough food to feed most of the world. You are part of a well-oiled machine that feeds more people, with fewer resources and less of an impact to our environment than any where else in this world.

As a Kansas Farmer you utilize the best technology along with the latest research and techniques to produce more grain from a single acre than our grandfathers could have ever imagined 50 years ago. I am pretty sure we are all on the run so much that we don’t ever take a minute to just sit back and think about what we are doing, much less do we share what amazing work we are doing.

Look out across those acres of the best hybrid technology in your fields be it corn or soybeans. How many bushels would those same acres have produced 20 years ago or even 10. What farming methods are you using? It is stunning to think about how far our business has come in just a few short years, and I guarantee you that we will be stunned again 10 years from now. We are part of one of the most innovative, progressive industries, and we have to be.

In the next 50 years we must find a way to produce more food than we have ever produced. You know what — I have no doubt we will do it. Those of us in agriculture have always risen to the challenge and we always will. No one is more productive than the American farmer, we are without a doubt the best in the business. We do not often acknowledge it because that is the kind of people we are. We have our nose the grindstone, do our job and wake up the next day and do it all over again.

I challenge you to take a moment and think about the work we all do, go ahead, and stick your chest out, you deserve it. While you are at it, tell others about it. Take pride in it. The last few months have proven just how important agriculture is. After the moment is over, get back to work, you have a lot to get done.

Kansas Farm Bureau Insight: Taking pride in agriculture

PRATT – It could be time to reduce the daily creel limit for striped bass at Wilson Reservoir, but for anglers who are familiar with the recent history of the 9,040-acre impoundment – this proposed reduction could be considered good news; it signifies the lake’s gizzard shad and striped bass populations are once again healthy.

In 2017, Wilson’s population of gizzard shad ­– a critical food source for many of Kansas’ sportfish – crashed as a result of drought conditions in previous years. Subsequently, the health and growth rates of the lake’s prized striped bass population tanked from lack of available forage.

Kansas Department of Wildlife, Parks and Tourism Fisheries biologists raised the striped bass daily creel limit from two, as it had been for decades, to five to allow the gizzard shad population to recover more quickly. That would eventually mean more food, and better health, for the lake’s remaining stripers, too.

Thanks to the compliance of Kansas anglers, the strategy worked so well that Wilson’s shad population has fully recovered. The lake’s stripers have regained their health, but the population has dropped low enough to warrant protection.

The proposed daily creel limit change from five to two would begin Jan. 1, 2021, if passed by the KDWPT Commission. 

Commissioners will vote on the matter during their next public hearing via Zoom on Thursday, Sept. 24. Public comment regarding the proposed regulation change is encouraged, and can be shared with:

When healthy, Wilson Reservoir’s striped bass population provides a trophy fishery for anglers, to include the current state record striped bass that weighed in at 44 pounds.

Striped bass also help control invasive species such as white perch, which if left unchecked, can overpopulate and decimate a sport fishery.

Wilson’s striped bass are raised at KDWPT’s Milford Hatchery and usually thrive in the impounded waters of the Saline River, growing upwards of 21 inches within just three years.

Located in Russell County – amid the Smoky Hills of northcentral Kansas – Wilson Reservoir is also home to excellent largemouth and smallmouth bass fishing, as well as walleye and white bass.

TMP-M announces Homecoming 2020 royalty, schedule

CORRECTED, 4 p.m. Tuesday: Due to a change in Ellis County reporting methods, the numbers reported Monday were incorrect. The corrected story is below.

Ellis County averaged 18 new cases of COVID-19 per day in the last seven days, the health department reported Monday. The metric is a new reporting method also announced by the county Monday, and new cases between reporting periods is currently no longer available for the public.

Hays Post has filed a Kansas Open Records Act request with county officials to return the new cases to the regular reporting days of Monday, Wednesday and Friday.

There are now 193 active cases of coronavirus in Ellis County, including six active hospitalizations, and 689 recovered cases.&nbsp;

The seven-day percent of positive tests rose to nearly 30 percent. Of the 7,580 total tests conducted on county residents, 11.3 percent have returned positive for coronavirus.

Since reporting began, there have been 885 total cases of COVID-19 in Ellis County, including three deaths. The number of total cases jumped from 738 since Friday as the county health department and Kansas Department of Health and Environment continues to work to make case reporting consistent. <a href="https://hayspost.com/posts/a05345cc-9d08-4622-b2e7-b9bc0c5f439e">The state reported 870 cases in Ellis County on Monday.</a>

Ellis County officials are preparing for changes
within the county attorney’s office following the August primary election.

After more than 20 years in office, current County Attorney
Tom Drees decided not to seek re-election and ran for and was elected district
judge in the 23rd Judicial District.

In the race to replace Drees, Hays attorney Robert Anderson
handily defeated former Assistant County Attorney Chris Lyon. 

There was no Democratic candidate to file for county
attorney and no write-in challenger has emerged, so a transition from Drees to
Anderson is underway.

Drees recently presented the transition plan to the county
commission. Drees told the commission they would hire Anderson as a special,
independent contractor starting Oct. 1. They have also hired on a legal
assistant.

“Robert’s going coming in and start learning the office,”
Drees said. “That way we can hopefully have a very smooth transition for law
enforcement and for everyone in the court system.

“He’ll do a great job with that,” Drees added.

Anderson said he is in the process of finishing up
his work as a defense attorney.

“I probably have well over half of my cases closed out
already,” Anderson said.

He said he stopped taking new cases several months ago.

Anderson has served as a contract defense attorney with
Ellis County and said he has been transferring his cases to Cassy Zeigler, an
Ellis attorney. She is expected to take Anderson’s spot working as a defense
attorney through the county.

Anderson will take over as Ellis County Attorney on Jan. 11.
