Hays PD Activity Log, Jan. 8-14

Greg Doering, Kansas Farm Bureau Kansas Farm Bureau had a good 2022 as evidenced by the Pinnacle and New Horizon awards it received at the American Farm Bureau’s 104th convention recently. The Pinnacle award is the highest honor a state Farm Bureau can earn for program and membership achievement. KFB received the New Horizon award, which highlights innovative new programs, for the Casten Fellows Program, developed to honor the life of staffer Jill Casten-Downing through leadership development and international travel. The honors are well deserved, and it’s nice to take a few minutes to appreciate the amount of work required to go from the initial idea to implementation and execution. The destination is important, but so is the journey. There’s no shortage of challenges today in agriculture, as evidenced by just some of the ongoing work from last year, like KFB’s End Hunger campaign to ensure all our state’s residents have access to the food they need. From Sept. 1 to Dec. 31, individuals and businesses contributed more than $50,000 toward the campaign. That money will go to innovative programs run by county Farm Bureaus to address the needs they’ve identified locally. By no way is this problem solved, but progress is being made. Next year’s goal is to raise $75,000. Another ongoing project includes KFB’s purchase of Shop Kansas Farms (SKF) which allows our farm and ranch members to reach consumers in a new way. SKF founder Rick McNary is also helping communities develop local food systems to capture the full economic value from farm gates to dinner plates. Announced late last year, the Rural Kansas Apprenticeship Program will really get rolling in 2023 as the state’s first ever initiative to match agriculturists and rural business owners with a structured plan to train and retain employees. It’s not a silver bullet for the lack of help available in rural areas, but it’s the beginning of addressing a skills gap to meet our current and future workforce needs. As always, KFB will continue to ensure the voices of farmers and ranchers are heard in Topeka with a special focus on three topics: water, taxes and broadband. KFB will continue to support the basic tenets of Kansas water law, which have provided our members the ability to plan, invest and defend their private property rights for decades. KFB policy also supports the development of a Kansas Water Plan, either through the state general fund or dedicated statewide revenue sources. Any redesign of tax structures comes with the potential to shift taxes from one source to another with significant consequences. KFB will continue to steadfastly advocate for the constitutionally required use-value system that accurately and appropriately values agricultural lands and provides stable tax revenues to local units of government. Agricultural operations are businesses, and they should receive fair and equal tax treatment as it pertains to sales tax exemptions. Access to a vibrant, high-speed broadband network is essential to the future of both rural and urban Kansas. Statewide broadband deployment will provide new opportunities for the delivery of healthcare, education, entertainment, business development and enhance the capabilities of precision agriculture. Efforts by the state to facilitate telecommunications connectivity throughout Kansas should consider the technology-dependent nature of the agriculture industry, and its significant impact on the Kansas economy. For those paying attention, this isn’t a new list, and there’s a good chance it will be similar in 2024. There will be advancements on some fronts and setbacks on others. The key is stick to your priorities and have the patience to withstand the mundane and incremental nature of progress.

Three-day weather outlook

One of the many fond memories I have growing up as an Ohio farm kid was of something called John Deere Days. Back in my generation, local farm equipment dealerships were small and as numerous as ice cream flavors. John Deere Days was an annual winter event, about this time each year, where all John Deere dealerships in Ohio (and maybe nationwide) circulated a film (now do you realize how long ago that was) that depicted unusual and often unheard-of farming operations around the country and around the world. These were interspersed with clips that high-lighted all the new John Deere farm machinery for the year, like combines with cabs and massive twelve-foot headers…YIKES! Of course, the evening began with ham sandwiches and potato chips before the film.&nbsp;

The odd and extraordinary farming operations included stork farming in Europe (without storks, where would babies come from), mouse farming in Minnesota (yes, there are people who actually raise mice on purpose), worm farming in Canada, and my all-time favorite, alligator farming in Florida. The farmer harvested eggs from nesting alligators, hatched them in an incubator then moved the growing reptiles into concrete pens. Eventually they were harvested for their meat and hide a few years later; akin to how ranchers in the Midwest run cow-calf operations, only with beasts that could take-off your hand or foot, leaving it impossible for you to ever get back on a horse. The interesting part was how the farmer interacted with his “breeding herd.”

So, picture this; the segment began with the farmer bouncing along in an old 1950 something pickup and ended up parked on the bank overlooking a big swamp/pond. He got out and climbed into the bed of the pickup (amazingly he still had all four limbs) and began rattling around metal containers. By now we were all wondering what in tarnation he was doing, when out-of-nowhere the swamp water began boiling with six- and eight-foot-long alligators as they crawled out of the water and swarmed around the truck like a bunch of herd cows. He tossed them fish like a rancher tossing range cubes of hay slices to a bunch of heifers, then they each filled their mouth and slipped back into the water. He climbed back into the cab and drove off.

Here are the problems my twisted and pessimistic mind sees with this. Harvesting alligator eggs means “robbing” gator nests, plain and simple, and knowing my luck, I’d find the one momma alligator that was a “prepper” and living unseen underground with her eggs; you see the problem there? I’d dig into the nest and become lunch.

Next problem would involve the feeding process. As my luck goes, my “herd” would have that one momma that could eat fish faster than I could chuck them at her and she’d never have to get back into the pond, leaving me stuck in the back of the pickup. By then the others would be coming back for seconds and I’d be out of fish. Remember these were pre-cell phone days, so my only hope would be that my family actually missed me when I didn’t show up for dinner (which would be debatable) and they’d eventually find me curled up on the roof of the pickup, ghost-white and hypothermic.

Anyway, I guess that farmer had all those issues figured out, as do the alligator ranchers of today. But call me old fashioned, it’s just that I’d rather raise something that I could reach through the fence and scratch now and then without fear of having my arm removed in return…continue to Explore Kansas Outdoors.

Exploring Outdoors Kansas: Farming, Everglades style

HUTCHINSON, Kan. — Kansas First District Congressman Tracey Mann is serving on the House Agriculture Committee again. That's important because this is a Farm Bill year.

"Our current Farm Bill, these are five-year bills, expires Sept. 30 of this year," Mann said. "Getting that right for agriculture and for rural Kansas will be incredibly important. We'll put a lot of effort and focus there. We have been and we'll continue to do that until we get that done."

The new Republican Agriculture Committee chair is&nbsp;Congressman Glenn "GT" Thompson from Pennsylvania. Thompson visited Kansas last year.

"We toured a farm, feedyard and ethanol plant and had some other meetings around the district," Mann said. "I enjoyed introducing him to our ag producers. I'm excited for the Ag committee under his leadership."

Mann is hoping to get a legislative hearing in the Farm Bill process brought to Kansas.

"I'm optimistic that we'll be able to have a field hearing in our state," Mann said. "That's not a promise, but that's something I'm working towards. We are not going to like the Farm Bill we get if we don't have ag producers input and stakeholder input in it. It's incredibly important to me and we've been meeting with people and listening to folks."

Mann is back out on his Big First town hall meeting tour this week.

Mann is back on Ag committee

The National Weather Service in Dodge City has issued a winter weather advisory for the Hays area from midnight Tuesday to midnight Wednesday.

Rain or snow is expected to arrive after midnight Tuesday, changing to all snow by 3 a.m. as overnight temperatures drop.

While significant snowfall is expected in extreme northwest Kansas and southern Nebraska, the NWS is calling for less than an inch of total moisture to arrive in the Ellis County area.

St. Francis is expected to receive 5 to 9 inches of snow, and 2 to 5 inches is predicted in Colby. The NWS in Goodland warned that even a slight deviation of the storm track could dramatically change snowfall totals across the region.

With the possibility of freezing rain, the NWS is warning of slippery road conditions for the Wednesday commute and through the day.

There are slight chances of snowfall in the Hays area Friday night and Sunday night, as well, the NWS predicted.

An afternoon of fancy and fun is planned soon at the Hays Public Library.

From 2 to 4 p.m. Feb. 5, the Hays Public Library Foundation
will host a traditional afternoon tea in the Schmidt Gallery of the library at 1205
Main.

“We're
going to have an afternoon of different kinds of teas and some fantastic treats,”
said Hays Public Library Communications Coordinator Callie Kolacny. “We'll have
some bread from Cathy's Breads. We're going to have some cookies and just
different kinds of yummy things that go with the different kinds of teas.”

For
those unfamiliar with the etiquette of a proper afternoon tea party, she said in
line with the library’s mission, the event will be a learning experience and
all are welcome.

“One of
our foundation board members is really into these, and she goes to them all the
time,” Kolacny said. “She's the lead on this and knows what she's talking about
when you're talking about an afternoon tea party.”

She said
attendees would be taken through the different types of teas and things that
you can do with the teas.

“It's
just going to be a fun, fun way to experience something a little bit different
for this area,” Kolacny said.

While
formal dress is not required, Kolacny said it is encouraged.

“Some
ladies will wear dresses, they might wear big hats, pearls and gloves, things
like that,” she said. “The men will dress up a little bit nicer than they might
otherwise.”

The
event, while geared toward a more adult crowd, could also be a fun experience for
an older child, she said.

And while
the experience will be an enjoyable experience, it will also serve as a
fundraiser for the foundation.

“The Hays
Public Library Foundation is basically the fundraising arm of the library,”
Kolacny said. “And so when donations come in, then it goes through the
foundation.”

Along
with events like the Afternoon Tea Party, she said there are various ways to support
the organization throughout the year.

“You can
… write a check to the foundation, or you can bequeath something when you're
looking at your financial planning for the future, you can include the public
library in that, and that goes through the foundation,” Kolacny said. “We also
have an account with the Heartland Community Foundation, so you can make
donations in that way.”

Those foundation
funds go to support the library in various ways.

“They
kind of fund the needs that aren't already budgeted,” Kolacny said. “The
library, of course, has its budget, and we have our plans of what we're going to
do, but other things come up, and we need funding for them.”

She
noted a few recent examples that the foundation helped fund include the Bookmobile
and the large remodel of the facility.

“All of
the donations do support the library in some fashion,” Kolacny said.

Those
services and upgrades, in turn, allow the library to serve as more than just a repository
for books but also a gathering place for the community.

“With
all the digital resources, we still have a significant collection of physical
books, and people want those,” Kolacny said. “But we also have all of the
programs, and they're for all ages. We've got stuff for the littlest kids, the
teenagers, we try to keep them active, especially after school we have some programs
for them. And then, of course, adults, we have lots of programs for adults too. So, it's more of a community center. It's a meeting place, it's a
place to gain some knowledge, to socialize and to just enjoy yourself.”

Public Library Foundation is basically the fundraising arm of the library,”
Kolacny said. “And so when donations come in, then it goes through the
foundation.”Along
with events like the Afternoon Tea Party, she said there are various ways to support
the organization throughout the year.“You can
… write a check to the foundation, or you can bequeath something when you're
looking at your financial planning for the future, you can include the public
library in that, and that goes through the foundation,” Kolacny said. “We also
have an account with the Heartland Community Foundation, so you can make
donations in that way.”Those foundation
funds go to support the library in various ways.“They
kind of fund the needs that aren't already budgeted,” Kolacny said. “The
library, of course, has its budget, and we have our plans of what we're going to
do, but other things come up, and we need funding for them.”She
noted a few recent examples that the foundation helped fund include the Bookmobile
and the large remodel of the facility.“All of
the donations do support the library in some fashion,” Kolacny said.Those
services and upgrades, in turn, allow the library to serve as more than just a repository
for books but also a gathering place for the community.“With
all the digital resources, we still have a significant collection of physical
books, and people want those,” Kolacny said. “But we also have all of the
programs, and they're for all ages. We've got stuff for the littlest kids, the
teenagers, we try to keep them active, especially after school we have some programs
for them. And then, of course, adults, we have lots of programs for adults too. So, it's more of a community center. It's a meeting place, it's a

RAWLINS COUNTY—Law enforcement authorities are investigating after gas pump skimmers were found in the city of Atwood, according to a social media report from police.&nbsp;The skimming device is used to capture the magnetic strip containing a customer's personal information, name and credit card number.

"These skimmers are attached inside of the gas pumps, which makes them undetectable to the customers or store employees. Atwood Police recommend that when purchasing gas to pay with cash or credit card inside if possible. 

"If you must pay at the pump, police ask that you look closely at the gas pump for any signs of tampering. Look to see if the lock has any visible damage or if the gas pump door appears to have been pried on."

"Check the safety seals near the lock to make sure they're intact and it has not been tampered with. If you see signs of tampering notify the store immediately."

"If you see anyone that appears to be acting suspicious around or tampering with a gas pump, call 911 or 785-626-3833."

The operators of the Keystone Pipeline have updated their recovery numbers at the spill site in Washington County, Kansas. Workers had recovered 12,289 barrels of oil, and more than 32,000 barrels of oil and water through Saturday, according to the company's Web site. TC Energy estimates about 14,000 barrels of oil spilled when the pipeline ruptured last month. The entire system is operational now, with reduced pressure and other safety measures. In a consent order signed earlier this month, the pipeline division of TC Energy agrees to pay any bills incurred by the government in its response to the Keystone spill. The company agrees to recover all spilled oil, all oil-contaminated soil and vegetation, and to contain the further spread of oil in Mill Creek. The Environmental Protection Agency will oversee the cleanup. Curtis Carey, EPA's Director of Public Affairs, said in an email response that discharging pollutants into protected waterways is a violation of the Clean Water Act. But Carey says this agreement is part of EPA's regulatory enforcement process. Any penalties or injunctive relief would have to come from a separate, future enforcement action. The Kansas Department of Health and Environment last week announced the results of weekly water testing along Mill Creek following the oil spill Dec. 8. The tests show improvements, notably "...a decrease in the concentration of contaminants over time, and a downward trend in contaminants on the Little Blue River." &nbsp;KDHE says a stream advisory remains in effect for Mill Creek between the pipeline spill and the Little Blue River. Officials warn area residents not to come into contact or allow pets and livestock to contact the creek water.&nbsp; Kansas Common crude at CHS in McPherson starts the week at $70 a barrel after jumping a dollar-and-a-quarter on Friday. That's half a dollar less than the price on the first of January. Crude prices in New York posted six dollars gains last week, settling Friday at $79.86 per barrel for the benchmark contract. In morning trading Monday, the near-month Nymex contract for light sweet crude dropped below $79. London Brent was also slightly lower, with prices just over $84 per barrel. So far this year, 29 operators have drilled 40 wells across Kansas with total footage estimated just over 40,000 feet. Independent Oil &amp; Gas Service is monitoring 489 new wells in various stages of drilling and completion. Drilling was underway on a lease in Barton County Friday, and operators in Ellis County were about to spud two new wells. Operators across the state completed 51 wells last week, 99 so far this year. Independent Oil &amp; Gas Service says that includes 32 in Western Kansas, with one new completion in Barton County, three in Ellis County, and one in Stafford County,&nbsp; Kansas regulators OK'd 29 new drilling locations across the state, 46 so far this year, including one new drilling permit each in Barton, Ellis and Stafford counties. In a monthly energy analysis the government predicts a decline in future energy consumption, rising energy production and dramatically lower profit margins at US refineries. That could lead to a big drop in diesel prices. The EIA says pump prices for diesel could drop about forty cents a gallon by the end of this year and another half dollar by the end of next year. US crude inventories posted a dramatic increase last week. The Energy Information Administration says stockpiles increased by 19-million barrels to 439.6 million barrels as of Jan. 6. EIA says inventories are about one percent above the five-year average for this time of year. The government reported the best weekly US production tally since April of 2020. Operators pumped 12.248 million barrels per day in the week through January 6th. That's up nearly 200,000 barrels from the week before and more than half a million barrels higher than a year ago. Crude imports averaged 6.4 million barrels per day last week, an increase of 637,000 barrels per day from the week before. Wonder Women League offers three $1,000 scholarships

The Hays High FFA Alumni and Supporters has scheduled a benefit dinner, auction and concert featuring the Peterson Farm Brothers. The Peterson Brothers are fifth-generation
farmers from Central Kansas who promote agriculture through entertaining and educational
videos on YouTube and post farming and video updates on social media.&nbsp;

The benefit event will
be Saturday, Feb. 4, at the Ellis County Fairgrounds, Schenk building. Doors
open at 5 p.m.,and dinner will be served at 6 p.m. with the concert and auction to follow. Cash bar
will be available.


The goal of the Hays High FFA Alumni and Supporters organization is to support the Hays High
FFA Chapter by providing students with potential scholarships, FFA jackets, meal stipends for
travel, or other needs that may arise. Anyone that supports agriculture, and the development of
future leaders is encouraged to attend.

Tickets for this evening of food and fun are $20 per person with children 5 and under
free. Tickets can be purchased at Vanderbilt’s of Hays, the Hays Welcome Center, or from
any FFA Alumni board member. Limited tickets may be available at the door if the event is not
sold out.

Recently, I introduced you to a fact sheet I wrote that focuses on healthy living. A long and healthy life doesn’t just happen. Everyday choices influence the quality of life you experience. Decisions start before your feet hit the floor in the morning. For instance, you make a decision whether or not to set an alarm or what time to set the alarm. Many decisions during the day are food centered. Perhaps you think you just make three food decisions daily: breakfast, lunch, and dinner. Well, think again. You choose how much or what kind of milk to pour on your cereal, whether to have a second helping of lasagna, if you will eat that pastry or drink soda or coffee at the office, and on and on.&nbsp;

Other important decisions revolve around physical activity. Take the stairs or elevator? Exercise before or after work? Watch TV or go for a walk? Since&nbsp;all of&nbsp;these decisions affect how your day goes, it is important to consider making a few common-sense changes. Many serious health problems are directly related to personal habits or behavior. Having a written plan is an important first step in regaining or maintaining a healthy lifestyle.

The bullet points that revolve around eating habits include:&nbsp;

•Start your day with breakfast •Include a fruit or vegetable with every meal or snack •Reduce portion sizes •Eat slowly and eat only until you are no longer hungry •Choose to eat more nutrient-dense foods •Eat whole foods instead of highly processed foods.

Along with choosing to consume healthier food, many people can a achieve a healthy lifestyle by increasing physical activity. Start by investing in a good pair of walking shoes and walk around your neighborhood or indoor exercise facility. Make sure you start slow, especially if you have been inactive for&nbsp;a period of time. Find a buddy to exercise with. It will help to have someone to hold you accountable for increasing you level of physical activity.

The most important part of an action plan is to choose something you want to do. If your doctor or a family member tells you that you need to walk more, but&nbsp;that is not something you want to do, it will most likely not be successful. Next, it needs to be something reasonable, such as something you can expect to be able to accomplish in a week or a month. A true action plan is behavior specific. Losing weight is not a behavior; cutting out a 20 ounce soda every day is. An action plan answers these questions: What? How much? When? How often?

The final piece of a successful action plan is to assess the confidence level that you will fulfill the contract. On a scale of 1 to 10 where 1 represents little confidence and 10 represents total confidence, your plan should rank at least a 7.&nbsp;

KRUG: Making an action plan for the New Year

A flock of electronic birds hit the streets of Great Bend in late March
2021. Less than two years later, the electronic scooters are no longer a form
of transportation.

At Monday’s Great Bend City Council meeting, Community
Coordinator Christina Hayes said the local investor decided they were not
interested in managing the 100 scooters in Great Bend anymore. Bird Rides has
also told the city of their lack of interest in bringing the scooters back. "You can see Birds were used all over our community, which is great because it is another form of transportation," said Hayes. "We need to look for another local investor. Even if we do find one that will partner with Bird and follow their rules, it's not guaranteed that Bird will come back." 
In 2021, there were 10,469 rides from the scooters in Great Bend. In 2022, that
number fell to 4,193, a near 60% drop. Total miles traveled on the scooters
went from 21,743 in 2021 to 8,506 in 2022. 
Although they were of no cost to the city, Hayes said the city would like to
keep the form of transportation and entertainment if another investor could be
found, but she was not hopeful they would return in 2023. 
"When we signed up as a city entity, we knew that we didn't want to be in charge of all the scooters...it would take too much time and effort," said Hayes. "We needed to look at someone to maintain them." 
The scooters could reach a maximum speed of 15 miles per hour and allowed
anyone to pinpoint the location of the ride by opening the mobile app.&nbsp; &nbsp;&nbsp;

GREAT BEND — Our four grizzly bears have been bedded down and spending the winter in their stalls since mid-November. During this time, they slow down and spend much of their time sleeping and are not very active. We check them daily and offer food and they constantly have access to water. On Saturday, keepers noticed Winnie, one of our 10-year-old male bears, was not as interested in his food as he normally is. Because it’s winter, that is not something that is abnormal from time to time. On Sunday, he appeared to still not be interested in food and was more lethargic, so staff tried to give him some electrolytes and some other types of food and he did consume a small amount.

Unfortunately, during our morning rounds today, he was discovered to have passed away sometime overnight. Our veterinarians performed a necropsy, and preliminary results indicate that he suffered from gastric torsion. This is a life-threatening and often fatal condition in which the stomach becomes overstretched and rotated and can cut off the blood supply to the gastrointestinal tract. An exploratory surgery would have been the only way to discover this condition and is not something easily accomplished in an animal as large as a grizzly bear. We did come across a few other abnormal findings and samples and tissues were sent to K-State for further evaluation.

Our staff is absolutely devastated by this unexpected loss and would appreciate your respect during their grieving process. We consider these animals to be a part of our family and losing one of our family members takes a significant toll on our staff. Winnie’s siblings, Piglet and Pooh, appear to be handling it as expected and will have each other and their keepers during their grieving process.

The National Weather Service has increased the chances of wintry weather returning to Hays and northwest Kansas this week — but is predicting western Kansas won't see much moisture from the system.

The NWS said models show the storm system tracking farther north, with the heaviest snow in northeast Colorado and Nebraska.

While there is a 70 percent chance of rain, freezing rain and snow before midnight Tuesday and throughout Wednesday, less than an inch of total accumulation is predicted for the Hays area.

Areas in extreme northwest Kansas could see snowfall totals in excess of 4 inches, the NWS said.

After a Monday high expected to hit the upper-50s, the temperature will drop quickly this week, with a high of 45 predicted Tuesday and a high of just 35 predicted Wednesday.

CHEYENNE COUNTY—One person was injured in an accident just after 6a.m. Monday in Cheyenne County.

The Kansas Highway Patrol reported a 2001 Peterbilt semi driven by William Wilger, 62, St. Francis, was eastbound on U.S. 36 eight miles east of St. Francis.

The&nbsp;driver lost control due to icy roads. The semi entered the south ditch struck a culvert, went airborne for a brief time then landed back in the ditch.

EMS transported Wilger to the Cheyenne County Hospital. He was wearing a seat belt, according to the KHP.

UPDATED 12:35 p.m. Jan. 22 to clarify Wilger was properly restrained.&nbsp;

CORRECTED: NW Kansas man hospitalized after violent semi crash

Ellis Police Department Press Release

On Jan. 15 at 7:05 p.m., Ellis Police Department Officers were alerted to a possible erratic driver that was reported to be driving at high rates of speed through residential areas. 

Officers located the vehicle in question, a 1999 Chevrolet Silverado 1500, driving northbound in the 1500 block of Monroe Street. 

EPD officers attempted to initiate a traffic stop on the vehicle, but the driver, later identified as Clinton Evans, 40, of Ellis failed to yield to law enforcement and a pursuit ensued. 

Clinton led officers on a brief pursuit that lasted approximately 8 minutes. 

An Ellis County Sheriff’s Deputy was successful in deploying a tire deflation device that deflated all four tires on the suspect vehicle, ultimately bringing it to a stop in the 900 block of Old Highway 40.

A felony stop was initiated where officers attempted to take Clinton into custody. 

Clinton further failed to comply with lawful orders from Law Enforcement and a standoff occurred.

 Law Enforcement attempted to negotiate a peaceful resolution but negotiations failed. 

Making use of an armored vehicle as cover, officers were able to force entry into the suspect vehicle and deploy a chemical agent to attempt to gain compliance. 

When that failed, Law Enforcement formed an arrest team that was successful in taking Clinton into custody without further incident.

Clinton is being held in the Ellis County Jail on requested charges of Felony Fleeing or Attempting to Elude, Felony Interference with Law Enforcement, Criminal Carrying of a Weapon, and numerous traffic offenses. Clinton is innocent until proven guilty by a court of law. 

No further information about this incident will be released at this time.

Sunday night chase in Ellis leads to arrest

Mayor Mason Ruder likes to point out he was four years old in 1995 when the city of Hays purchased the R9 Ranch in Edwards County as a long-term water supply.

Now, 28 years later, the project is finally picking up speed, especially in the past year.&nbsp;

"Every day is now an R9 Ranch Day," Ruder declared with a smile during last week's city commission meeting.&nbsp;&nbsp;

City Manager Toby Dougherty updated commissioners on the R9 water transfer process. It started in February 2014 when the then-city commission voted to apply to the state to change the water use from agricultural irrigation to municipal, and begin the approval process.

In June 2015, the change applications were filed and three years later a draft master order was issued through the Division of Water Resources in the Kansas Department of Agriculture.&nbsp;

The master order was issued in March 2019.

&nbsp;The Kansas Water Transfer Act has never been enacted; by statute, the process is purposely slow and meticulous to determine if it's in the best interest of the state for the transfer of water from Edwards County to Ellis County, and then on to Russell County, which owns a small portion of the ranch.

The timeline has been dramatically slowed by several petitions and appeals starting in April 2019 by WaterPACK,&nbsp;Water Protection Association of Central Kansas, the <a href="https://hayspost.com/posts/5dd42db8897d147ad4bb113a">only active opponent</a> in the project.&nbsp;

On June 29, 2022 Judge Bruce Gatterman, chief district judge of the Edwards County District Court, affirmed the Kansas Department of Agriculture’s&nbsp;<a href="https://archive.hayspost.com/2019/03/28/chief-engineer-approves-hays-russell-r9-ranch-water-change-applications/">chief engineer’s 2019 approval of the cities’ change applications</a>.&nbsp;&nbsp;

The group of irrigators believes Hays and Russell are being allowed to take too much water from the R9 Ranch, southeast of Kinsley, and there is potential harm in that.

"If they want to drag this out, fine," Dougherty said with a shrug of his shoulders. 

"We've received our positive ruling. We're starting the transfer process. We're moving forward. We don't think they're going to be successful."

Commissioner Sandy Jacobs interrupted Dougherty's report to express her anger at the continued delays and resulting increased cost to the city.

According to Dougherty, the deviations have cost the city about $2 million to date "in attorneys, in engineers. That's hard costs. Soft costs, inflation, you're talking $30-$40 million dollars, in what we could have done versus what it's going to cost now."&nbsp;

Converting water rights for one use to another is a widely used practice across Kansas, Dougherty told the commissioners.&nbsp;

"When you convert irrigation water rights to municipal water rights, you don't get 100% of that. You get a formulaic reduction to protect the water rights around you and to protect the aquifer, to make sure the new use does not use more water than the previous use," he explained.

Early on in the process, Hays and Russell voluntarily agreed to reduce their water rights by another 30% "because we want to make sure we don't do anything to potentially harm the aquifer.

Administrative law judge Matt Spurgen was appointed October 21 as hearing officer of the transfer hearing panel.&nbsp;

By the end of February, replies to the WaterPACK appeal are due from the cities and the Division of Water Resources, followed by another reply from WaterPACK.

By statute, oral arguments should be scheduled this summer with a final decision by the water transfer panel anywhere between October 2023 and May 2024.

With the entire state of Kansas currently in a drought - to various degrees - "it's getting serious again," said Jacobs.&nbsp;

"I would think this is to our benefit. We're talking about water for people, for sustainability of life in our area," she said.

Dougherty again emphasized he has "no doubt we will prevail" in the appeal process and decision by the water transfer panel.&nbsp;

"I am finalizing the wellfield and pipeline project design contracts," he told the commission. "I hope to have those in front of you within the next couple of months for your approval so we can get started on the design contract.&nbsp;&nbsp;

"As soon as the design contracts are approved, we're gonna send that RFQ (Request For Quote) for a land acquisition services firm ... and then start acquiring the land for the pipeline itself."

The R-9 Ranch is being converted to native grass and walk-in hunting from irrigated cropland.

Dougherty said he's been searching for federal funding to help pay for that conversion and a possible move to more public use of the property.

🎥🎤 City: R9 Ranch water project delays costing Hays millions of dollars

A new Hays resident is planning to open a new American-style restaurant in the former Mokas building, 1230 E. 27th.

Chester Mayhew will be expanding his family's restaurant business, Cattleman's Cafe, to Hays. Mayhew said he hopes to have the restaurant open by mid-Febraury.

Chester will be the owner and operator of the business, but his parents, Chester and Carolyn, have a combined 60 years of experience in food service.

The family also has restaurants in Liberal and Sublette.

"Hays seems to be a growing community, and it seems to be welcoming to people who want to grow Hays," he said.

The cafe will offer comfort food favorites, such as chicken-fried steaks, meatloaf, pot roast, hamburgers, salads and steaks.

All the steaks and hamburgers will be charbroiled.

The cafes are known for their chicken-fried steaks, which are hand-breaded in-house and fried fresh to order.

"It's going to be good food, good prices and good service," he said.

Everything will be homemade, including mashed potatoes and ranch dressing. Other sides will include carrots, green beans and corn.

The cafe will have kids' meals, as well as half-portion options for light eaters.

"It's a family restaurant, and we are a family operation. We want to serve the customers with good food and good prices and good service," Mayhew said.

He said the at-home atmosphere will set the restaurant apart. He said the food is "like grandma's cooking." 

Mayhew said he is waiting on equipment but could start hiring as soon as next week. He acknowledged the job market in Hays is tight, but he said he intends to offer competitive wages.

Mayhew is in the process of remodeling the former coffee shop. The restaurant will have a capacity of about 90 people.

The restaurant will be open seven days a week. Sundays through Thursdays it will be open from 11 a.m. to 9 p.m. and Fridays and Saturdays from 11 a.m. to 10 p.m.

"Hays seems to be a growing, moving town," Mayhew said. "The traffic never stops. It's a little different atmosphere than southwest Kansas. I'm excited for the new customer base."

Mayhew said he hopes to have the restaurant open by mid-Febraury.Chester will be the owner and operator of the business, but his parents, Chester and Carolyn, have a combined 60 years of experience in food service.The family also has restaurants in Liberal and Sublette. "Hays seems to be a growing community, and it seems to be welcoming to people who want to grow Hays," he said. The cafe will offer comfort food favorites, such as chicken-fried steaks, meatloaf, pot roast, hamburgers, salads and steaks.All the steaks and hamburgers will be charbroiled. The cafes are known for their chicken-fried steaks, which are hand-breaded in-house and fried fresh to order. "It's going to be good food, good prices and good service," he said.Everything will be homemade, including mashed potatoes and ranch dressing. Other sides will include carrots, green beans and corn.The cafe will have kids' meals, as well as half-portion options for light eaters."It's a family restaurant, and we are a family operation. We want to serve the customers with good food and good prices and good service," Mayhew said.He said the at-home atmosphere will set the restaurant apart. He said the food is "like grandma's cooking." Mayhew said he is waiting on equipment but could start hiring as soon as next week. He acknowledged the job market in Hays is tight, but he said he intends to offer competitive wages. Mayhew is in the process of remodeling the former coffee shop. The restaurant will have a capacity of about 90 people.The restaurant will be open seven days a week. Sundays through Thursdays it will be open from 11 a.m. to 9 p.m. and Fridays and Saturdays from 11 a.m. to 10 p.m."Hays seems to be a growing, moving town," Mayhew said. "The traffic never stops. It's a little different atmosphere than southwest Kansas. I'm excited for the new customer base."
