Merla Jean Rhodes, age 90, a longtime resident of Hays, Kansas, passed away on Monday, September 4, 2023, at the Good Samaritan Society in Ellis, Kansas. She was born on October 21, 1932, in rural Decatur County, Kansas, to Merle E. and Lorna M. (Stimbert) Bishop. 

She married Delbert Rhodes in 1956. Sadly, Delbert preceded her in death on August 22, 1969.

Merla's early years were spent on a farm in rural Decatur County, where she received her education in Oberlin and attended a country school. She dedicated 27 years of her life to working in housekeeping at the Oberlin Good Samaritan Society Care Center. Afterward, she lived at Centennial Towers in Hays for 18 years before relocating to Ellis two years ago.

Merla had a passion for playing cards, listening to country music and was an avid reader. She also held a deep affection for animals, particularly horses, and enjoyed riding.

She is survived by her loving children: Marty Rhodes of Hays, KS; Lori Leiker and her husband, Ron, of Hays, KS; and Dennis Rhodes and his wife, Mary, of Gardner, KS. She is also survived by her six cherished grandchildren: Jeff Leiker, Drew Rhodes, Daniel Rhodes and his wife, Alyssa, Sarah Hilgenkamp and her husband, Tyler, Joshua Rhodes and his wife, Brittney, and Gabrielle Rhodes, along with her 11 great-grandchildren.

In addition to her husband Delbert, Merla was preceded in death by her parents, her brother Derry Bishop, and her granddaughter-in-law, Katherine Leiker.

A Celebration of Life will be held on Sunday, with the family receiving friends from 1:00 to 2:00 p.m. at Cline's-Keithley Mortuary of Hays, located at 1919 East 22nd Street, Hays, Kansas 67601. Inurnment will be held at a later date.

In lieu of flowers, the family suggests making memorial contributions payable to the Humane Society of the High Plains, care of Cline's-Keithley Mortuary of Hays.

Richard A. “Rich” Rupp, 81, Hays, died Saturday, September 2, 2023 at HaysMed.

He was born May 29, 1942 in Hays, the son of Edward and Rose (Groff) Rupp. 

He worked as a cement truck driver for Allied, Inc. 

On October 12, 1968, he was united in marriage to Vickie Ann Walters in Hays, and she preceded him in death on February 6, 2015. 

Rich was an avid music listener, loved animals, especially dogs and had numerous hobbies, including lawn care, carpentry, target shooting, tinkering, motor work, and riding motorcycle and snowmobiles. He loved the Fourth of July, treating his grandchildren to ice cream and watching them open Christmas presents.

Survivors include his two daughters, Kendra Vaughn and husband Johnathan and Laura Wellbrock and husband Christopher, both of Hays, two sisters, Patty “Doll” Rogers of Kansas City and Betty Chew and husband Otto of Hays, five grandchildren, Noah Vaughn and fiancé Mia “Levi” Weilert, Katie and Daylen Vaughn, Savanna and Lillian Wellbrock.

He was preceded in death by his parents, wife Vickie, five brothers, Bill, Francis “Hammie”, Thomas, Edward Jr., and Robert Rupp, and a sister, Delores Rupp Froelich-Gross.

To celebrate and remember Rich’s life, the family will receive friends from 4:00 p.m. until 6:00 on Saturday, September 9, 2023 at Hays Memorial Chapel Funeral Home. Inurnment will be in St. Joseph Cemetery at a later date.

NORTON — The Kansas Department of Transportation plans to begin resurfacing work on portions of U.S. 36 and K-261 in Norton County on Wednesday.

Project activity will include milling and overlay on approximately 15 miles of U.S. 36 starting at the Decatur County line and ending near West Avenue in Norton. Construction crews will also complete a mill and overlay on 1.2 miles of K-261 near the Prairie Dog State Park. 

Traffic will be reduced to one lane in the construction zones and directed by flaggers and a pilot car during daylight hours. Motorists should plan for delays of up to 15 minutes.

KDOT expects the projects to be completed by the end of October, conditions permitting.

APAC-Kansas Inc., Shears Division, of Hutchinson is the primary contractor for the projects with a combined contract cost of approximately $6 million.

U.S. 36, K-261 highways to be resurfaced in Norton County

DUBAI, United Arab Emirates (AP) —&nbsp;<a href="https://apnews.com/hub/saudi-arabia">Saudi Arabia</a>&nbsp;and Russia agreed Tuesday to extend their voluntary oil production cuts through the end of this year, trimming 1.3 million barrels of crude out of the global market and boosting energy prices.

The dual announcements from Riyadh and Moscow pushed benchmark Brent crude above $90 a barrel in trading Tuesday afternoon, a price unseen in the market since November.

The countries' moves could increase inflation and the cost for motorists at gasoline pumps. It also puts new pressure on Saudi Arabia's relationship with the United States, as President Joe Biden last year warned the kingdom there would be unspecified “consequences” for partnering with Russia on cuts as&nbsp;<a href="https://apnews.com/hub/russia-ukraine">Moscow wages war on Ukraine</a>.

Saudi Arabia's announcement, carried by the state-run Saudi Press Agency, said the country still would monitor the market and could take further action if necessary.

“This additional voluntary cut comes to reinforce the precautionary efforts made by OPEC+ countries with the aim of supporting the stability and balance of oil markets,” the Saudi Press Agency report said, citing an unnamed Energy Ministry official.

State-run Russian news agency Tass quoted Alexander Novak, Russia's deputy prime minister and former energy minister, as saying Moscow would continue its 300,000 barrel a day cut.

The decision “is aimed at strengthening the precautionary measures taken by&nbsp;<a href="https://apnews.com/hub/opec">OPEC+ countries</a>&nbsp;in order to maintain stability and balance of oil markets,” Novak said.

Benchmark Brent crude traded Tuesday above $90 a barrel after the announcement. Brent had largely hovered between $75 and $85 a barrel since last October. A barrel of West Texas Intermediate, a benchmark for America, traded over $87 a barrel.

The White House did not immediately respond to a request for comment, though Biden and U.S. lawmakers have criticized Saudi Arabia and Russia over their past production decisions.

Bob McNally, the founder and president of the Washington-based Rapidan Energy Group and a former White House energy adviser, said Saudi Arabia and Russia had “demonstrated their unity and resolve to proactively manage" the risk of oil prices potentially dropping in tougher economic conditions with their announcement Tuesday.

“Barring a sharp economic downturn, these supply cuts will drive deep deficits into global oil balances and should propel crude oil prices well above $90 per barrel,” McNally said.

The average gallon of regular unleaded gasoline in the U.S. stands at $3.81, according to AAA, just under the all-time high for Labor Day of $3.83 in 2012. However, gasoline demand typically drops for U.S. motorists after the holiday so it remains unclear what immediate effect this could have on the American market, AAA spokesman Andrew Gross said.

“I’m more concerned about what the rest of hurricane season may hold,” Gross told The Associated Press. “A big storm along the Gulf coast could move prices dramatically here.”

<a href="https://apnews.com/article/florida-hurricane-idalia-2136985ceea53f5deb600c43aeea1138">Hurricane Idalia</a>&nbsp;just plowed through Florida and U.S. forecasters said Tuesday that a new tropical depression in the Atlantic Ocean could become a “major hurricane.”

Meanwhile, higher gasoline prices can increase transportation costs and ultimately push the prices of goods even higher at a time when the U.S. and much of the world is already raising interest rates to combat inflation.

“The impact these cuts will have on inflation and economic policy in the West is hard to predict, but higher oil prices will only increase the likelihood of more fiscal tightening, especially in the U.S., to curtail inflation,” said Jorge Leon, a senior vice president at Rystad Energy. “Western leaders, wary of an oil price spike, could explore import adjustments or open diplomatic discussions to help mitigate the impact and tame inflation.”

The Saudi reduction, which began in July, comes as the other OPEC+ producers have agreed to&nbsp;<a href="https://apnews.com/article/saudi-oil-production-cut-6d34316ce6820c749d2a6cd66a9fffea">extend earlier production cuts</a>&nbsp;through next year.

The Kansas Department of Transportation will complete a surface recycle and chip seal on approximately 11 miles of U.S. 36 starting at the Cheyenne County line and ending at County Road 11. 

Traffic will be reduced to one lane through the work zone and directed by flaggers and a pilot car during daylight hours. Delays, not exceeding 15 minutes, should be expected.

The project is scheduled to be completed by the end of October, conditions permitting.

Dustrol Inc. of Towanda is the primary contractor for the $1.7 million project.

U.S. 36 resurfacing to start today in Rawlins County

WASHINGTON — Following the Supreme Court’s summer ruling against 40 million federal student loan borrowers who would have qualified for debt relief, the Biden administration crafted a year-long delay in repayments.

The policy, known as an on-ramp, is set to begin next month.

Additionally, hours after the Supreme Court’s decision, the Department of Education unveiled a new repayment plan for those with federal student loans, known as Saving on a Valuable Education, or SAVE.&nbsp; The new income-driven repayment plan calculates payments based on a borrower’s income and family size and forgives balances after a set number of years.

It’s estimated by the administration that more than 20 million borrowers will benefit. Borrowers can apply&nbsp;<a target="_blank" href="https://studentaid.gov/announcements-events/save-plan">here.</a>&nbsp;A campaign is being launched to publicize the new program, by the Department of Education in collaboration with groups like the Student Debt Crisis Center, UnidosUS and the NAACP.

“This plan is a game changer for millions of Americans, many of whom are putting off having children, buying their first home, or even starting a business because they can’t get out from under their student loans,” said White House Domestic Policy Advisor Neera Tanden on a call with reporters on Monday. “Student loans will be manageable.”

Last year, the Biden administration rolled out a debt forgiveness plan for borrowers with federal student loans that would have been a one-time cancellation of up to $10,000. Borrowers who had received Pell Grants — federal aid to help low-income students pay for higher education — could qualify for an additional $10,000 in forgiveness.

Following that decision from the court, the Biden administration initiated rulemaking through the Higher Education Act to try again to enact debt relief, and finalized a rule for the new repayment plan known as SAVE.

Here are some questions and answers about the on-ramp policy and SAVE plan.

“Financially vulnerable borrowers who miss monthly payments during this period are not considered delinquent, reported to credit bureaus, placed in default, or referred to debt collection agencies,” according to a&nbsp;<a target="_blank" href="https://www.whitehouse.gov/briefing-room/statements-releases/2023/06/30/fact-sheet-president-biden-announces-new-actions-to-provide-debt-relief-and-support-for-student-loan-borrowers/">fact sheet</a>&nbsp;released by the White House.

The Department of Education did not respond to questions from States Newsroom asking how the agency would prevent loan servicers from reporting borrowers to credit bureau or debt collectors.

How is the on-ramp policy different from the pause on federal student loan repayments?

The pause on federal student loan repayments was first put in place by the Trump administration in 2020 at the start of the coronavirus pandemic, and has been extended several times.

The pause meant those with federal student loans did not have to repay, and no interest accrued. With this new policy, interest will still accrue, but borrowers have a year before having to start paying back their loans.

What does a final rule for the SAVE plan mean?

<a target="_blank" href="https://www2.ed.gov/policy/highered/reg/hearulemaking/2021/idrfactsheetfinal.pdf">This is an income-driven repayment plan</a>&nbsp;that the Department of Education said will cut borrowers’ monthly payments in half. The&nbsp;<a target="_blank" href="https://www.ed.gov/news/press-releases/biden-harris-administration-launches-most-affordable-repayment-plan-ever-transforming-income-driven-repayment-cutting-undergraduate-payments-half-and-preventing-unpaid-interest-accumulation?utm_content=&amp;utm_medium=email&amp;utm_name=&amp;utm_source=govdelivery&amp;utm_term=">official launch&nbsp;</a>of the application was Tuesday.

“This is a giant step forward in decreasing the burden of crushing debt that rests on so many borrowers’ shoulders,” Senate Majority Leader Chuck Schumer said in a statement. “Low-income students, whose burdens will be cut in half, and most other students, who will never pay more than 5% of their income, will breathe a sigh of relief across every corner of America.

“While there will be those that will challenge this in court, the administration has carefully crossed the legal t’s and dotted the legal i’s. The fight to cancel student debt is far from over, but this is a massive step in the right direction. President Biden deserves accolades and support for this action.”

A borrower could save more than $1,000 per year on payments, compared to other income-driven repayment plans. And, depending on income levels, it will allow more than 1 million additional borrowers to make $0 monthly payments without their interest accruing, the Department of Education estimates.

Borrowers with undergraduate loans will pay 5% of their discretionary income, rather than the 10% required under previous income repayment plans. Borrowers with undergraduate and graduate loans will pay a weighted average between 5% and 10% of their incomes.

The White House said a borrower’s monthly payment will be based on their discretionary income, defined in the plan as the difference between their adjusted gross income and 225% of the U.S. Department of Health and Human Services poverty guideline amount for the family size. Borrowers who earn a minimum wage of $15 an hour will not have to make a monthly payment.

According to the Department of Education, that means borrowers will not owe loan payments if they are a single person earning $32,800 or less or a family of four earning $67,500 or less, though the amounts are higher in Alaska and Hawaii.

The plan also forgives loan balances after as little as 10 years of payment, rather than 20 years under previous income repayment plans. The plan also does not charge borrowers with unpaid monthly interest, as long as those borrowers are making their monthly payments.

Who qualifies for the SAVE student loan repayment plan?&nbsp;

Most federal student loan borrowers are going to qualify for this plan. However, those with Direct PLUS loans to parents and certain other loans will not qualify for it; the list can be found&nbsp;<a target="_blank" href="https://studentaid.gov/announcements-events/save-plan">here.</a>

Borrowers signed up for the current Revised Pay as You Earn (REPAYE) plan will automatically be enrolled in SAVE.

How is SAVE different from previous federal student loan repayment plans?

With this plan, if your calculated payment ends up to be less than the amount of interest that accrues every month, that remaining interest will be forgiven. The previous plan did not have that element, so borrowers were continuing to see their balances grow.

Here’s what to know about new federal policies for repaying student loans

WASHINGTON (AP) — The U.S. Department of Health and Human Services has delivered a recommendation to the Drug Enforcement Administration on&nbsp;<a href="https://apnews.com/hub/marijuana-legalization" target="_blank">marijuana policy</a>, and Senate leaders hailed it this week as a first step toward easing federal restrictions on the drug.

HHS Secretary Xavier Becerra said Wednesday on X, the platform formerly known as Twitter, that the agency has responded to President Joe Biden's request “to provide a scheduling recommendation for marijuana to the DEA.”

“We’ve worked to ensure that a scientific evaluation be completed and shared expeditiously,” he added.

Senate Majority Leader Chuck Schumer said in a statement that HHS had recommended that marijuana be moved from a Schedule I to a Schedule III controlled substance.

“HHS has done the right thing,” Schumer, D-N.Y., said. “DEA should now follow through on this important step to greatly reduce the harm caused by draconian marijuana laws.”

Rescheduling the drug would reduce or potentially eliminate criminal penalties for possession. Marijuana is currently classified as a Schedule I drug, alongside heroin and LSD.

According to the DEA, Schedule I drugs "have no currently accepted medical use in the United States, a lack of accepted safety for use under medical supervision, and a high potential for abuse."

Schedule III drugs “have a potential for abuse less than substances in Schedules I or II and abuse may lead to moderate or low physical dependence or high psychological dependence.” They currently include ketamine and some anabolic steroids.

Biden&nbsp;<a href="https://apnews.com/article/biden-marijuana-government-and-politics-2d5e3d9e2cfbbbe3ee114536738894a8" target="_blank">requested the review in October 2022</a>&nbsp;as he pardoned thousands of Americans convicted of “simple possession” of marijuana under federal law.

Senate Finance Committee Chairman Ron Wyden, D-Ore., issued a statement calling for marijuana to be completely descheduled. “However, the recommendation of HHS to reschedule cannabis as a Schedule III drug is not inconsequential," he added. “If HHS’s recommendation is ultimately implemented, it will be a historic step for a nation whose cannabis policies have been out of touch with reality.”

In reaction to the Bloomberg report, the nonprofit U.S. Cannabis Council said: “We enthusiastically welcome today’s news. ... Biden Admin. moves to classify marijuana as a lower-risk drug

Mayor Quinton Lucas is alleged to have violated the Missouri Sunshine Law, which allows the public to request government records

A Kansas City activist has filed a lawsuit alleging&nbsp;<a target="_blank" href="https://missouriindependent.com/tag/quinton-lucas/">Mayor Quinton Lucas</a>&nbsp;attempted to intimidate her into withdrawing a request for public records from his office.

Lora McDonald, executive director of the Metro Organization for Racial and Economic Equity, or MORE2, sued the city earlier this month over alleged violations of the Missouri Sunshine Law. She alleges in her lawsuit that the mayor called her “speaking with a raised, angry voice, asserting his discontent” with a request she filed a week earlier.

“Plaintiff felt Mayor Lucas’s call was an attempt to intimidate, harass and/or coerce because of the tone and demeanor of his voice and because he was suggesting she withdraw the request,” the lawsuit says.

Jazzlyn Johnson, a spokesperson for Lucas, said in an email that the mayor’s office disagreed with the characterization.

“In a decade of public life featuring challenging airport negotiations, protestors at his home, multiple recall efforts, hate mail during the COVID-19 crisis, and a public uprising on the Plaza, the mayor has never been characterized as an ‘angry man,’” Johnson said.

McDonald’s alleged exchange with Lucas —&nbsp;and, later, a city staffer —&nbsp;paints a picture of a city government that resists releasing public information and takes requests for records as an affront. The lawsuit also outlines four instances where City Hall has failed to promptly release records or even respond when McDonald sought an estimate as to when she could expect the request to be fulfilled.

“If you didn’t do anything wrong, why are we having this phone call?” McDonald said in an interview about her conversation with Lucas.

McDonald’s request sought communications between the mayor and attorneys —&nbsp;both employed by the city and outside counsel —&nbsp;concerning litigation attempting to overturn a state&nbsp;<a target="_blank" href="https://missouriindependent.com/briefs/gov-parson-signs-bill-requiring-kansas-city-to-put-more-money-toward-police/">law that requires Kansas City to increase funding to the police department</a>.

Kansas City is the only major U.S. city that does not control its police. The Kansas City Police Department is governed by a board appointed by the Missouri governor. But the city funds the department.

Last fall, Missouri voters passed a constitutional amendment requiring Kansas City to dedicate 25% of its general revenue to the police department. The Missouri General Assembly passed legislation to force the increase in the spring of 2022, but it required a statewide vote to go into effect.

In August of 2022,&nbsp;<a target="_blank" href="https://missouriindependent.com/2022/08/17/kansas-city-mayor-sues-to-block-missouri-law-requiring-higher-police-spending/">Lucas filed a lawsuit against the state</a>&nbsp;alleging that it’s unconstitutional for the state to force Kansas City to spend more on its police unless it appropriates money to the city.

He filed the lawsuit as an individual rather than in his official capacity and is represented by a city-employed attorney and private counsel. His case was later combined with a similar, though broader, lawsuit filed by Gwen Grant, president and CEO of the Urban League of Kansas City.

After Lucas’ call, McDonald says she didn’t hear anything from City Hall for more than a month despite following up with city staff. Her lawsuit goes on to say that it wasn’t until her attorney sent an email saying he would advise McDonald to sue if they didn’t get a response that Kansas City provided an estimated cost and timeframe for when it would release the records.

Just two days before the city had promised it would release records, the lawsuit states that Melesa Johnson, then the mayor’s general counsel and deputy chief of staff, called McDonald’s attorney and texted McDonald, questioning why she filed a request for records given that MORE2, like City Hall, supports local control of the Kansas City police.

“As an avid supporter of you and MORE2 who routinely assists with the mayor’s support of your organization, I am trying to understand why we are pitting our respective offices against each other when we share the overall same goal of seeing state control dismantled,” Melesa Johnson said in a text, according to the lawsuit.

Bernie Rhodes, a First Amendment attorney with Lathrop GPM who has represented The Independent in the past, said he hears complaints about Kansas City ignoring Sunshine Law requests “virtually every week.”

“As long as the city feels that it has other priorities than being responsive to the citizens, these problems will continue,” Rhodes said in an interview.

Rhodes said he also frequently hears about government agencies questioning citizens’ motivations in requesting records in an attempt to intimidate them.

“That’s why the law is crystal clear that your reason doesn’t matter,” Rhodes said. “You’re entitled to the information because you’re the people who are paying the salary of these folks in office.”

Asked about the claim against Lucas, Rhodes said: “I find it troubling anytime anyone in authority attempts to intimidate someone who’s making legitimate Sunshine Law requests.”

Jazzlyn Johnson said the mayor considers McDonald a friend and the two share the view that the police department should be controlled locally “even if he disagrees with Ms. McDonald perhaps on the most efficient path to that outcome.”

“While the mayor suggested to Ms. McDonald and her counsel that collaboration is a better approach, the mayor shared with Ms. McDonald that she has every right to pursue her requests and the city has responded to all of her requests.”

In the case of McDonald’s request for communications about the police funding lawsuits, the city ultimately produced some records but withheld others, citing attorney-client privilege, McDonald said. Her lawsuit challenges that assertion.

Steve Leben, a law professor at the University of Missouri-Kansas City and former Kansas judge, said it appeared the claim of attorney-client privilege was reasonable.

However, the lag between when McDonald requested the records and when the city deemed them closed because of attorney-client privilege raised “substantial concerns,” Rhodes said.

The Missouri Sunshine Law requires governmental agencies to respond to requests within three business days. If locating or producing the records is expected to take longer than that, the agency is required to explain the delay to the requestor and provide a date at which the agency expects to be able to release the records.

The law, Rhodes said, “allows for extra time to make the production but not to decide whether you’re going to give documents or not.”

She alleges in her lawsuit that the mayor called her “speaking with a raised, angry voice, asserting his discontent” with a request she filed a week earlier.“Plaintiff felt Mayor Lucas’s call was an attempt to intimidate, harass and/or coerce because of the tone and demeanor of his voice and because he was suggesting she withdraw the request,” the lawsuit says.Jazzlyn Johnson, a spokesperson for Lucas, said in an email that the mayor’s office disagreed with the characterization.“In a decade of public life featuring challenging airport negotiations, protestors at his home, multiple recall efforts, hate mail during the COVID-19 crisis, and a public uprising on the Plaza, the mayor has never been characterized as an ‘angry man,’” Johnson said.McDonald’s alleged exchange with Lucas —&nbsp;and, later, a city staffer —&nbsp;paints a picture of a city government that resists releasing public information and takes requests for records as an affront. The lawsuit also outlines four instances where City Hall has failed to promptly release records or even respond when McDonald sought an estimate as to when she could expect the request to be fulfilled.“If you didn’t do anything wrong, why are we having this phone call?” McDonald said in an interview about her conversation with Lucas.McDonald’s request sought communications between the mayor and attorneys —&nbsp;both employed by the city and outside counsel —&nbsp;concerning litigation attempting to overturn a state&nbsp;<a target="_blank" href="https://missouriindependent.com/briefs/gov-parson-signs-bill-requiring-kansas-city-to-put-more-money-toward-police/">law that requires Kansas City to increase funding to the police department</a>.Kansas City is the only major U.S. city that does not control its police. The Kansas City Police Department is governed by a board appointed by the Missouri governor. But the city funds the department.Last fall, Missouri voters passed a constitutional amendment requiring Kansas City to dedicate 25% of its general revenue to the police department. The Missouri General Assembly passed legislation to force the increase in the spring of 2022, but it required a statewide vote to go into effect.In August of 2022,&nbsp;<a target="_blank" href="https://missouriindependent.com/2022/08/17/kansas-city-mayor-sues-to-block-missouri-law-requiring-higher-police-spending/">Lucas filed a lawsuit against the state</a>&nbsp;alleging that it’s unconstitutional for the state to force Kansas City to spend more on its police unless it appropriates money to the city.He filed the lawsuit as an individual rather than in his official capacity and is represented by a city-employed attorney and private counsel. His case was later combined with a similar, though broader, lawsuit filed by Gwen Grant, president and CEO of the Urban League of Kansas City.After Lucas’ call, McDonald says she didn’t hear anything from City Hall for more than a month despite following up with city staff. Her lawsuit goes on to say that it wasn’t until her attorney sent an email saying he would advise McDonald to sue if they didn’t get a response that Kansas City provided an estimated cost and timeframe for when it would release the records.Just two days before the city had promised it would release records, the lawsuit states that Melesa Johnson, then the mayor’s general counsel and deputy chief of staff, called McDonald’s attorney and texted McDonald, questioning why she filed a request for records given that MORE2, like City Hall, supports local control of the Kansas City police.“As an avid supporter of you and MORE2 who routinely assists with the mayor’s support of your organization, I am trying to understand why we are pitting our respective offices against each other when we share the overall same goal of seeing state control dismantled,” Melesa Johnson said in a text, according to the lawsuit.Bernie Rhodes, a First Amendment attorney with Lathrop GPM who has represented The Independent in the past, said he hears complaints about Kansas City ignoring Sunshine Law requests “virtually every week.”“As long as the city feels that it has other priorities than being responsive to the citizens, these problems will continue,” Rhodes said in an interview.Rhodes said he also frequently hears about government agencies questioning citizens’ motivations in requesting records in an attempt to intimidate them.“That’s why the law is crystal clear that your reason doesn’t matter,” Rhodes said. “You’re entitled to the information because you’re the people who are paying the salary of these folks in office.”Asked about the claim against Lucas, Rhodes said: “I find it troubling anytime anyone in authority attempts to intimidate someone who’s making legitimate Sunshine Law requests.”Jazzlyn Johnson said the mayor considers McDonald a friend and the two share the view that the police department should be controlled locally “even if he disagrees with Ms. McDonald perhaps on the most efficient path to that outcome.”“While the mayor suggested to Ms. McDonald and her counsel that collaboration is a better approach, the mayor shared with Ms. McDonald that she has every right to pursue her requests and the city has responded to all of her requests.”In the case of McDonald’s request for communications about the police funding lawsuits, the city ultimately produced some records but withheld others, citing attorney-client privilege, McDonald said. Her lawsuit challenges that assertion.Steve Leben, a law professor at the University of Missouri-Kansas City and former Kansas judge, said it appeared the claim of attorney-client privilege was reasonable.However, the lag between when McDonald requested the records and when the city deemed them closed because of attorney-client privilege raised “substantial concerns,” Rhodes said.The Missouri Sunshine Law requires governmental agencies to respond to requests within three business days. If locating or producing the records is expected to take longer than that, the agency is required to explain the delay to the requestor and provide a date at which the agency expects to be able to release the records.The law, Rhodes said, “allows for extra time to make the production but not to decide whether you’re going to give documents or not.”

KANSAS CITY, Mo. - The Fort Hays State men's golf team will head into the 2023-24 season ranked eighth in the MIAA Preseason Coaches Poll, released Thursday (Aug. 31) by the league office.

The Tigers received 27 points in the balloting process, 12 behind seventh-place Missouri Western and 13 clear of ninth-ranked Lincoln. Defending conference champion Missouri Southern tops the poll after picking up just one more point than second-ranked Central Missouri.

Fort Hays State placed eighth in the season-long points standings in the league last season, including a sixth-place finish amongst league competition at the Newman Fall Invitational last October. The Tigers' top finish of the season was a t-4th result out of 20 teams at the NSIC Conference Preview Invitational in March.

The Tigers return five golfers from last year's squad, including four players that competed in at least four events last fall. Jackson Rader returns for his junior season after picking up All-MIAA accolades a year ago. FHSU also added three new players to the roster this season, including a pair of junior college transfers and one true freshman.

FHSU will open the season with an MIAA mandated event at the LU Invitational, hosted by Lincoln at The Club at Porto Cima in Sunrise Beach, Mo. September 11-12.

Hays Chamber names vice president of marketing and communications

Sandra Kay (Nuss) Brown, 76, of Russell, Kansas, passed away Thursday, June 15, 2023 at the Hays Medical Center in Hays, Kansas.

Sandra was born February 20, 1947, in Hoisington, Kansas. She was the daughter of Milton and Edna (Maier) Nuss. She grew up in the Susank and Hoisington areas.

Sandra was united in marriage to John Brown on October 16, 1964, in Great Bend, Kansas. From this union they were blessed with two daughter, Misty and Melodie. They were divorced later in life.

Sandra cleaned homes and offices in Russell for over 40 years. She enjoyed being outdoors, gardening, mowing, spending time at the lake, spending time with her grandsons and loved caring for her animals.

Surviving family include her daughters, Misty Brown (Michael Werth) and Melodie Anschutz (Derrick) all of Russell, Kansas; foster daughter, Tammy Pellant of Wilson, Kansas; sister, Pam Aldrich (Troy) of Lacrosse, Kansas; brothers, Warren Nuss (Shelia) of Hoisington, Kansas and Gary Nuss (Janet) of Silver Creek, Washington; and two grandsons, David Brown and Jordan Werth (Sierra) and foster grandson Colton Pellant.

Sandra was preceded in death by her parents; brother, Richard Nuss; and ex-husband, John Brown.

A gathering service to celebrate Sandra’s life will be held from 6 p.m. to 8 p.m. on Friday, September 8, 2023, at the Pohlman-Varner-Peeler Mortuary in Russell, Kansas. Cremation has taken place and the family will have a private burial of ashes at a later date. 

Condolences may be sent to Pohlman-Varner-Peeler Mortuary, who are in charge of these arrangements.

Officer Spencer has taught an 8-week course covering social skills to youth at the Douglas County Juvenile Detention Center. &nbsp;

Officer Spencer has also participated in the Hays Police Department’s Adopt-A-Cop program with our local schools. &nbsp;

Officer Spencer has dual bachelor’s degrees from the University of Kansas in psychology and applied behavioral science emphasizing in juvenile justice. &nbsp;

New School Resource Officer Announced for Hays High School

The Defense Department will begin training Ukrainians to fly and maintain F-16 fighter jets, according to Pentagon Press Secretary Air Force Brig. Gen. Pat Ryder.

The training is expected to begin in October at the Morris Air National Guard Base in Tucson, Arizona, and will be facilitated by the Air National Guard's 162nd Wing. &nbsp;

The U.S.-led training is "in support of the international effort to develop and strengthen Ukraine's long-term defenses," Ryder said. &nbsp;

The Netherlands and Denmark have announced their intentions to make F-16 aircraft from their fleets available to Ukraine. &nbsp;

Secretary of State Antony Blinken signaled the United States' willingness to approve the third-party transfer of the U.S.-made F-16s to Ukraine in a letter to his European counterparts last week. &nbsp;

"The training provided by the United States will complement the F-16 pilot and maintenance training that's already underway in Europe and further deepens our support of the F-16 training coalition led by Denmark and the Netherlands," Ryder said. "Moving forward we will remain in close consultation with the Danes, the Dutch and other allies to ensure U.S. training complements the broader coalition training efforts."

Ryder added that by announcing the training, the U.S. is preempting any training capacity constraints in Denmark and the Netherlands' training pipeline to ensure the aircraft are fielded to Ukraine as quickly as possible. &nbsp;

He said Ukraine will ultimately determine the number of pilots that will require the training. &nbsp;

During a briefing last week, National Security Advisor Jake Sullivan said U.S. approval for the transfer would come after consultation with Congress and after completion of training for Ukrainian pilots on the aircraft.&nbsp;

Ryder said the complete training pipeline would likely take several months, depending upon the pilots' proficiency coming into the course. &nbsp;

"Part of this training will be assessing the individual pilots' skill level, which will determine help to determine how long that training will last," he said. "Your basic, new F-16 pilot with not a lot of training on the U.S. side, that training typically lasts about eight months."

That training includes a series of courses ranging from basic flight training to instruction on fighter fundamentals, weapons employment, combat maneuvering and tactical intercepts among other concepts. &nbsp;

He said training for more experienced pilots could be completed in about five months.&nbsp;

Beyond flight training, Ryder said the F-16s require significant logistics and maintenance training for ground support personnel that ensures the aircrafts remain combat capable.

Prior to flight training, the pilots will receive language training at Lackland Air Force Base in San Antonio, Texas beginning in September.&nbsp;

The language training will ensure that all pilots have sufficient language skills to be able to fully comprehend the "complexities and specialized English required to fly the aircraft," Ryder said. &nbsp;
