The trial for a Hays woman accused of aiding and abetting a felony murder is set to proceed in Ellis County District Court after pre-trial motions were heard Thursday afternoon.
A 12 member jury will hear the case against Kylie Jo Waldschmidt,25, who was charged with aiding and abetting felony first-degree murder with the alternative charge of aggravated assault or aggravated battery related to the shooting death of 26-year-old Diego Gallaway on Feb. 27, 2019, in Hays.
Waldschmidt was also charged with interference with a law enforcement officer.
During the pre-trial hearing, Waldschmidt's attorney, Joe Shepack said he has no plans to introduce an alibi defense and will offer no motions to suppress evidence.
He also said Waldschmidt has not yet determined if she will testify during the trial.
Ellis County Attorney Tom Drees said that 13 subpoenas had been issued and served already, and the process was nearly complete.
Two other people in the case have already been sentenced.
Out of a jury pool of 40 persons, 12 jurors and two alternates will be selected for the trial that is set to begin at 9 a.m. on March 23.
