Suspect in Hays rape case makes first court appearance

A suspect in a 2014 rape in Hays made a first appearance in Ellis County district Monday.

Cody Schultz, 32, Victoria, made the appearance via a Zoom teleconferencing call from the Ellis County jail before 23rd Judicial District Chief Judge Glenn Braun.

He was represented by court-appointed attorney Joe Shepack.

He is currently being held in the Ellis County jail in lieu of a $500,000 bond.

Schultz became a suspect in the case after being arrested for sex-related crimes alleged to have occurred in 2019 involving two females under the age of 14 that led to DNA samples being run through the Kansas Bureau of Investigations database. The sample returned as a potential match in the 2014 case.

During the appearance, Schultz acknowledged he understood his rights in the case and had it explained by Braun that, if convicted, he faces 147 to 653 months imprisonment.

Preliminary hearings for both cases are set for Dec. 15. The first hearing will begin at 10 a.m. The second will follow immediately after.
