🎥 Big Creek Crossing to ask for amendment of 2014 CID agreement

The owner of Big Creek Crossing, 2918 Vine, is asking the Hays city commission to adopt a resolution that would modify the Nov. 13, 2014, Community Improvement District development agreement with the shopping center.

According to Collin Bielser, assistant city manager, the amendment would allow the Big Creek Crossing owner, Hays Mall LLC, to be reimbursed for up to $1 million of eligible improvements it is making to the facility. 

"The city commission approved a one-cent Community Improvement sales tax on the Big Creek Crossing property," Bielser said. "As part of that agreement, the owners had an allowance up to $1 million for the property owners to accommodate a large retailer." 

The 2014 agreement required Phase 2 improvements for a large retailer to be completed by Dec. 31, 2016. 

"That project was not completed within the agreed-to timeline so it was not eligible to be reimbursed by the CID proceeds," Bielser said. "The property owner is now asking for a modification to the development agreement that would make the $1 million eligible for reimbursement costs related to the forthcoming Ollie’s Bargain Outlet." 

Improvements at the north end of the property would include the interior of the facility, HVAC system, exterior and parking lot.

Commissioners will discuss the request at their work session Thursday.

Other agenda items include discussion of recommended bid awards for:

* Additonal projects in the 2022 street maintenance program
* Sanitary sewer point repairs
* Replacement of self-contained breathing apparatus equipment for the fire department
* New parking lot in East Frontier Park
