SHAWNEE COUNTY — A space heater was responsible for starting a Tuesday morning Kansas house fire.

Just before 4:30a.m., crews responded to a fire in a home lat 427 NE Emmett Street in. Topeka, according to Fire Marshal Todd Harrison.

Upon arrival, fire crews found smoke and flames coming from the two-story home. 

Firefighters kept the fire confined to the home and during a primary search found one dog and one cat deceased. A preliminary investigation indicates the fire cause to be accidental, associated with a space heater.

Estimated dollar loss – $25,000.00; of which $20,000.00 is associated with structural loss and $5,000.00 associated with contents loss.

Working smoke detectors were located within the structure of fire origin, according to Harrison. There were no other injuries reported.

KANSAS CITY (AP) — R&amp;B artist Trey Songz was jailed Sunday night after he scuffled with police officers during his arrest for not following coronavirus protocols and other rules at the AFC championship game in Kansas City, police said Monday.

Songz, 36, whose name is Tremaine Aldon Neverson, was released Monday while an investigation continues, Jackson County Sheriff’s spokesman LeVanden Darks said. No charges have been filed.

Songz’s representative, Sydney Margetson, declined to comment Monday.

Songz is a three-time Grammy-nominated singer. He earned his third No. 1 on Billboard’s Top R&amp;B Albums chart with “Back Home” last year. His other two chart-topping albums are “Trigga” and “Tremaine The Album.” He has also appeared in films including “Texas Chainshaw 3D,” “Baggage Claim” and he starred in “Blood Brother” in 2018.

In October, Songz&nbsp;<a href="https://www.instagram.com/p/CF-zMKTh4bA/?utm_source=ig_embed&amp;utm_campaign=embed_video_watch_again" target="_blank">posted</a>&nbsp;on Instagram that he had tested positive for COVID-19. He said he was taking the disease very seriously and urged his fans to do the same.

Kansas City police said in a statement that fans at the game between the Kansas City Chiefs and Buffalo Bills complained about a man who was not following COVID-19-related protocols and other code of conduct rules for fans, which include not being disruptive, intoxicated, or using obscene language.

The statement did not identify the man as Songz and did not say exactly which rules he was breaking.

Police said the man refused to follow orders from private security guards at Arrowhead Stadium and was asked to leave. When he refused, officers from the Kansas City police and Jackson County sheriff’s office were called and he was told he would be arrested if he didn’t comply, police said.

He punched one officer and put him in a headlock, police said.

TMZ released&nbsp;<a href="https://www.tmz.com/2021/01/24/trey-songz-chiefs-game-fight-police-officer-arrest/" target="_blank">a video</a>&nbsp;Monday that showed Songz was not wearing a mask and struggled with several officers before he was led away in handcuffs.

The video does not show how the confrontation began. Some fans can be heard yelling at officers to leave him alone.

The video shows at least one officer without a mask and others with masks not completely covering their mouth and nose.

Kansas City police told The Associated Press that officers working Chiefs games “comply with all mask mandates.”

“He clearly had his mask on prior to being assaulted and placed in a headlock,” KCPD spokeswoman Donna Drake said in an email.

Law enforcement officials said several agencies work NFL games, making it difficult to know how many other fans might have been ejected or arrested Sunday.

Earlier this month, Songz was set to perform at&nbsp;<a href="https://apnews.com/article/houston-sylvester-turner-coronavirus-pandemic-bow-wow-us-news-83d3da44fe3f904924ce955699e5bd92">a concert in Houston</a>&nbsp;but police shut it down after seeing hundreds of people lining up to enter the venue, which was supposed to be operating at 50% capacity.

In 2017, Songz&nbsp;<a href="https://apnews.com/article/c6ea528012e94fd38a9d8ed217744580">was charged</a>&nbsp;with felony assault and assaulting a police officer after he became upset when he was told to end a performance in Detroit. Authorities said microphones and speakers were thrown from the stage during the concert.

Songz pleaded guilty in August 2017 to two counts of disturbing the peace and was sentenced to 18 months of probation.

Like a lot of people, Bob Litan and his wife, Margaret, have been cooped up in their Lawrence home during the pandemic.

Other than the occasional walk and visit to the doctor’s office, they’ve been indoors for nearly a year.

Vaccinations have begun, but Litan says he’s concerned not enough people will voluntarily get one.

Litan
 is a non-resident senior fellow in economic studies at the Brookings 
Institution, a public policy organization based in Washington, D.C.

He said he did some "back-of-the-envelope calculations" that showed 
about 250 million people will need to get vaccinated for the country to 
reach herd immunity and return to life pre-pandemic.

But if not enough people voluntarily step forward, Litan is <a href="https://www.brookings.edu/opinions/want-herd-immunity-pay-people-to-take-the-vaccine/" target="_blank">proposing a kind of Plan B</a>:
 He says the government should pay people to take the vaccine — $200 
when people get the shot, and another $800 when the country reaches herd
 immunity.

Litan was born in McPherson and grew up in Wichita. He has a law degree and doctorate in economics from Yale University.&nbsp;

He
 talked with Tom Shine and The Range about his plan, why the cost is 
worth it and what it says about our current political climate that 
people may skip the vaccine.

The interview was edited for length and clarity.

Tom Shine: Give us a general outline of your thoughts on paying people to take the vaccine.

Bob Litan: So last August I <a href="https://www.brookings.edu/opinions/want-herd-immunity-pay-people-to-take-the-vaccine/" target="_blank">wrote a piece</a>
 that came out of really conversations with my wife. We're both in the 
70 age group, and we're talking to ourselves, we're saying, 'How are we 
ever going to get out of the house if not enough people take the 
vaccine?'

And so the only two ways you can really get there are 
either mandating people to take the shot, which I think in this current 
environment would probably come close to inciting a revolution, or a 
monetary inducement. And that's what led me to propose $1,000 per 
person.

You call your idea Plan B; Plan A being that 
enough people would agree on their own to take the vaccine. … You're not
 confident that we'll hit that mark to get to herd immunity.

Well,
 I'm really glad you mentioned Plan B because it is a Plan B. I'm not 
advocating that tomorrow the administration roll out with this plan 
because we ought to give public health officials and the administration 
and other people … a chance to encourage people to voluntarily take the 
vaccine And the reason we need a Plan B is what happens if we don't get 
there?

Your plan would cost about $250 billion … but you've argued that still makes economic sense. Explain that a little bit.

Basically
 it's money to pay the country and ourselves to get the economy back to 
full employment. Because if we don't reach herd immunity, we're going to
 be at a sub-optimal level of economic output and employment, and 
therefore sub-optimal amount of tax revenue and just not having our 
lives back.

And for $250 billion, I know it sounds like a lot of 
money, but you know, we're talking about trillions now of helping people
 in various rescue packages. And if we could just do this once and for 
all, and just get rid of this thing, I think that it would be money that
 would be well worth it.

There's been critics of your 
plan, which is not a surprise. The most common one I see is that 
offering payments somehow sends a signal that the government is unsure 
that this vaccine is totally safe. What are your thoughts on that 
particular line of thinking?

It would be a concern if 
this were Plan A, in other words, we were doing it now. And if you were 
worried about turning people off, then you wouldn't want to do it at the
 beginning.

But when you couch the plan as a Plan B, which is 
basically after all the voluntary people are done, then the question is:
 What do you have to lose at that point? You've got a good portion of 
the country that has not taken the shot when they had the chance to do 
so. It's not as if now all of a sudden they're going to change their 
mind.

So it's not as if we're going to make things worse. We can 
only make things better as a Plan B because then we can switch some 
people who were on the fence. They would say to themselves, 'You know, 
for $1,000' — and by the way, for a family of four that's $4,000, that's
 a lot of money to kiss away — 'we'll take the money and take the shot.'

Is there a precedent in our history or in the world's history for this type of a plan?

Not
 in the U.S., but there are examples in less-developed countries for 
paying people to take vaccines in a lot lower amount. But we haven't had
 something like this since 1918.

We haven't had a program to 
actually pay people, but then we haven't been as divided as we have 
been. So this is not like polio back in the 1950s … and there was no 
mass resistance. People did it, but now you got a lot of people who 
don't trust science. They don't trust the government. They don't trust 
doctors.

And in a world of very low trust, the only way I can 
think of to overcome that is to actually pay people to overcome it. It's
 the price we have to pay for our political division if we really want 
to get out of this mess.

Get paid to get vaccinated? Economist offers herd immunity idea

ROME (AP) — The Vatican has essentially slapped a retired U.S. bishop on the wrist for “flagrant" imprudent behavior with teenagers, even though a diocesan review board determined a half-dozen allegations of sexual abuse against him were credible.

The Vatican’s Congregation for the Doctrine of the Faith cleared retired Cheyenne, Wyoming Bishop Joseph Hart of seven accusations abuse, determined that five others couldn’t be proven “with moral certitude” and that two cases involving boys, who were 16 and 17, couldn’t be prosecuted given the Catholic Church didn’t consider them minors at the time of the alleged abuse, the diocese reported Monday. Another allegation wasn’t addressed in the decree.

Hart, 89, had long maintained his innocence and denied all allegations of misconduct.

The Vatican decision clearly disappointed Hart’s successor, Bishop Steven Biegler, who stressed that the Vatican’s findings didn’t mean Hart was innocent, just that the Holy See determined that the high burden of proof hadn’t been met.

Biegler has previously stood by the findings of his review board, and a diocesan statement noted the qualifications of its members: “law enforcement; school administration; a doctor of psychology; a pediatrician; a psychotherapist, who treats sexually abused children; and a judge, who was a criminal prosecutor for 13 years involving crimes against children, primarily child sexual abuse.”

On the other hand, the Vatican's Congregation for the Doctrine of the Faith, or CDF, relies on the judgment of priests and bishop canon lawyers, and ultimately the pope. The Vatican for decades has been blasted by victims’ groups for giving bishops a pass when they have been accused of sexual abuse themselves or of covering it up.

A few exceptions have been made in recent years, most famously in the case of ex-Cardinal Theodore McCarrick, who was defrocked after the CDF determined he had abused minors as well as adults, including during confession — essentially the same allegations against Hart.

As a result, the sentence showed the arbitrary nature of Vatican’s canonical sex abuse judgments, which aren't public. Hart’s previous diocese of Kansas City-St. Joseph reached court settlements years ago with at least 10 victims. But Wyoming criminal prosecutors also decided last year not to proceed with charging Hart.

In its decree, the CDF rebuked Hart “for his flagrant lack of prudence as a priest and bishop for being alone with minors in his private residence and on various trips which could have been potential occasions endangering the ‘obligation to observe continence’ and that would ‘give rise to scandal among the faithful,'” the diocese said.

Hart was also rebuked for failing to observe previous Vatican restrictions prohibiting him from having contact with minors and seminarians and from participating in public engagements, the diocese said, adding that those restrictions remain in place.

“Today, I want the survivors to know that I support and believe you” Biegler said in a statement. “I understand that this announcement will not bring closure to the survivors, their family members, Bishop Hart and all those affected.”

Hart was a priest in Kansas City, Missouri, for 21 years before moving to Wyoming, where he served as auxiliary and then full bishop from 1976 until his retirement in 2001. The first known allegations against Hart dated to the early 1960s and were made in the late 1980s. At least six men came forward in the past few years to say Hart abused them in Wyoming.

Arguments in the Senate trial will begin the week of Feb. 8, and the case against Trump, the first former president to face impeachment trial, will test a political party still sorting itself out for the post-Trump era. Republican senators are balancing the demands of deep-pocketed donors who are distancing themselves from Trump and voters who demand loyalty to him. One Republican, Sen. Rob Portman of Ohio, announced Monday he would not seek reelection in 2022, citing the polarized political atmosphere.

For Democrats the tone, tenor and length of the upcoming trial, so early in Biden’s presidency, poses its own challenge, forcing them to strike a balance between their vow to hold Trump accountable and their eagerness to deliver on the new administration’s priorities following their sweep of control of the House, Senate and White House.

Biden himself told CNN late Monday that the impeachment trial “has to happen.” While acknowledging the effect it could have on his agenda, he said there would be “a worse effect if it didn’t happen.”

Biden said he didn’t think enough Republican senators would vote for impeachment to convict, though he also said the outcome might well have been different if Trump had six months left in his term.

In a Monday evening scene reminiscent of just a year ago — Trump is now the first president twice impeached — the lead prosecutor from the House, this time Rep. Jamie Raskin of Maryland, stood before the Senate to read the House resolution charging “high crimes and misdemeanors.”

Earlier, Senate Majority Leader Chuck Schumer said failing to conduct the trial would amount to a “get-out-jail-free card” for others accused of wrongdoing on their way out the door.

Republicans appear more eager to argue over trial process than the substance of the case, he said, perhaps to avoid casting judgment on Trump’s “role in fomenting the despicable attack” on the Capitol.

Schumer said there’s only one question “senators of both parties will have to answer before God and their own conscience: Is former President Trump guilty of inciting an insurrection against the United States?”

On Monday, it was learned that Chief Justice John Roberts is not expected to preside at the trial, as he did during Trump’s first impeachment, potentially affecting the gravitas of the proceedings. The shift is said to be in keeping with protocol because Trump is no longer in office.

Instead, Sen. Patrick Leahy, D- Vt., who serves in the largely ceremonial role of Senate president pro tempore, is set to preside.

Leaders in both parties agreed to a short delay in the proceedings that serves their political and practical interests, even as National Guard troops remain at the Capitol amid security threats on lawmakers ahead of the trial.

The start date gives Trump’s new legal team time to prepare its case, while also providing more than a month’s distance from the passions of the bloody riot. For the Democratic-led Senate, the intervening weeks provide prime time to confirm some of Biden’s key Cabinet nominees.

Sen. Chris Coons, D-Del., questioned how his colleagues who were in the Capitol that day could see the insurrection as anything other than a “stunning violation” of the nation’s history of peaceful transfers of power.

“It is a critical moment in American history,” Coons said Sunday in an interview.

An early vote to dismiss the trial probably would not succeed, given that Democrats now control the Senate. The House approved the charge against Trump on Jan. 13, with 10 Republicans joining the Democrats.

Still, the mounting Republican opposition to the proceedings indicates that many GOP senators will eventually vote to acquit Trump. Democrats would need the support of 17 Republicans — a high bar — to convict him.

One by one, Republican senators are explaining their objections to the unprecedented trial and scoffing at the idea of trying to convict Trump now that he’s no longer in office.

Rand Paul of Kentucky said that without the chief justice presiding the proceedings are a “sham.” Joni Ernst of Iowa said that while Trump “exhibited poor leadership,” it’s those who assaulted the Capitol who “bear the responsibility.” New Sen. Tommy Tuberville of Alabama said Trump is one of the reasons he is in the Senate, so “I’m proud to do everything I can for him.”

Sen. Tom Cotton, R-Ark., is among those who say the Senate does not have the constitutional authority to convict a former president.

Democrats reject that argument, pointing to an 1876 impeachment of a secretary of war who had already resigned and to opinions by many legal scholars. Democrats also say that a reckoning of the first invasion of the Capitol since the War of 1812, perpetrated by rioters egged on by a president as Electoral College votes were being tallied, is necessary.

A few GOP senators have agreed with Democrats, though not close to the number that will be needed to convict Trump.

Mitt Romney of Utah said he believes “what is being alleged and what we saw, which is incitement to insurrection, is an impeachable offense. ... If not, what is?” Romney was the only Republican senator to vote for conviction when the Senate acquitted Trump in his first impeachment trial.

Trump impeachment arrives in Senate ahead of historic trial

TOPEKA, Kan. (AP) — A Kansas teenager posted a video on social media showing the setting of a blaze that heavily damaged a Topeka mall in December, a court affidavit shows.

A tip to provided the next day to Crime Stoppers led investigators to the video posted on Snapchat, The Topeka Capital-Journal&nbsp;<a href="https://www.cjonline.com/story/news/2021/01/25/court-record-video-setting-white-lakes-fire-put-snapchat/6699433002/" target="_blank">reported</a>.

Joel Sink, 18, and two other youths face charges that include arson tied to the Dec. 29 fire that caused an estimated $100,000 in damage at the former White Lakes Mall in Topeka.

The charging affidavit included two images from the video taken of the fire soon after it was set. The video had been posted by a Snapchat user later identified as Sink, the affidavit said.

Snapchat is a a messaging service in which users send each other texts, photos or videos that are usually scheduled to disappear after a few seconds.

Straining to handle record numbers of COVID-19 patients, hundreds of the nation’s intensive care units are running out of space and supplies and competing to hire temporary traveling nurses at soaring rates. Many of the facilities are clustered in the South and West.

An Associated Press analysis of federal hospital data shows that since November, the share of U.S. hospitals nearing the breaking point has doubled. More than 40% of Americans now live in areas running out of ICU space, with only 15% of beds still available.

Intensive care units are the final defense for the sickest of the sick, patients who are nearly suffocating or facing organ failure. Nurses who work in the most stressed ICUs, changing IV bags and monitoring patients on breathing machines, are exhausted.

“You can’t push great people forever. Right? I mean, it just isn’t possible,” said Houston Methodist CEO Dr. Marc Boom, who is among many hospital leaders hoping that the numbers of critically ill COVID-19 patients have begun to plateau. Worryingly, there’s an average of 20,000 new cases a day in Texas, which has the third-highest death count in the country and more than 13,000 people hospitalized with COVID-19-related symptoms.

According to data through Thursday from the COVID Tracking Project, hospitalizations are still high in the West and the South, with over 80,000 current COVID-19 hospital patients in those regions. The number of cases reported in the U.S. since the pandemic’s start surpassed 25 million on Sunday, according to Johns Hopkins University.

Encouragingly, hospitalizations appear to have either plateaued or are trending downward across all regions. It’s unclear whether the easing will continue with more contagious versions of the virus arising and snags in the rollout of vaccines.

In New Mexico, one surging hospital system brought in 300 temporary nurses from outside the state, at a cost of millions of dollars, to deal with overflowing ICU patients, who were treated in converted procedure rooms and surgery suites.

“It’s been horrid,” said Dr. Jason Mitchell, chief medical officer for Presbyterian Healthcare Services in Albuquerque. He’s comforted that the hospital never activated its plan for rationing lifesaving care, which would have required a triage team to rank patients with numerical scores based on who was least likely to survive.

“It’s a relief that we never had to actually do it,” Mitchell said. “It sounds scary because it is scary.”

In Los Angeles, Cedars-Sinai Medical Center ran into shortages of take-home oxygen tanks, which meant some patients who could otherwise go home were kept longer, taking up needed beds. But the biggest problem is competing with other hospitals for traveling nurses.

“Initially, when the COVID surges were hitting one part of the country at a time, traveling nurses were able to go to areas more severely affected. Now with almost the entire country surging at the same time,” hospitals are paying twice and three times what they would normally pay for temporary, traveling nurses, said Dr. Jeff Smith, the hospital’s chief operating officer.

Houston Methodist Hospital recently paid $8,000 retention bonuses to keep staff nurses from signing up with agencies that would send them to other hot spots. Pay for traveling nurses can reach $6,000 per week, an enticement that can benefit a nurse but can seem like poaching to the hospital executives who watch nurses leave.

“There’s a lot of these agencies that are out there charging absolutely ridiculous sums of money to get ICU nurses in,” Boom said. “They go to California, which is in the midst of a surge, but they poach some ICU nurses there, send them to Texas, where they charge inordinate amounts to fill in gaps in Texas, many of which are created because nurses in Texas went to Florida or back to California.”

Space is another problem. Augusta University Medical Center in Augusta, Georgia, is treating adult ICU patients, under age 30, in the children’s hospital. Recovery rooms now have ICU patients, and, if things get worse, other areas — operating rooms and endoscopy centers — will be the next areas converted for critical care.

To prevent rural hospitals from sending more patients to Augusta, the hospital is using telemedicine to help manage those patients for as long as possible in their local hospitals.

“It is a model I believe will not only survive the pandemic but will flourish post pandemic,” said Dr. Phillip Coule, the Augusta hospital’s chief medical officer.

Hospitals are pleading with their communities to wear masks and limit gatherings.

“There just hasn’t been a lot of respect for the illness, which is disappointing,” said Dr. William Smith, chief medical officer for Cullman Regional Medical Center in Cullman, Alabama. He sees that changing now with more people personally knowing someone who has died.

“It has taken a lot of people,” he said of the virus, adding that the death toll — 144 people in six months in a county of 84,000 — “has opened their eyes to the randomness of this.”

The Alabama hospital’s ICU has been overflowing for six weeks, with 16 virus patients on ventilators in a hospital that a year ago had only 10 of the breathing machines. “You can see the stress in people’s faces and in their body language. It’s just a lot for people to carry around,” Smith said.

“Just the fatigue of our staff can affect quality of care. I’ve been encouraged we’ve been able to keep the quality of care high,” Smith said. “You feel like you are in a very precarious situation where errors could occur, but thankfully we’ve managed to stay on top of things.”

Hospitals say they are upholding high standards for patient care, but experts say surges compromise many normal medical practices. Overwhelmed hospitals might be forced to mobilize makeshift ICUs and staff them with personnel without any experience in critical care. They might run out of sedatives, antibiotics, IVs or other supplies they rely on to keep patients calm and comfortable while on ventilators.

“It’s really daunting and mentally taxing. You’re doing what you believe to be best practice,” said Kiersten Henry, a nurse at MedStar Montgomery Medical Center in Olney, Maryland, and a board director for the American Association of Critical-Care Nurses.

In Oklahoma City, OU Medicine Chief Medical Officer Dr. Cameron Mantor said while the vaccines hold promise, hope still seems dim as ICU cases keep mounting. The number of COVID-19 hospitalizations at OU Medicine has declined from more than 100 daily in recent weeks to 98 on Wednesday, Mantor said.

“What is stressing everybody out,” Mantor said, “is looking at week after week after week, the spigot is not being turned off, not knowing there is a break, not seeing the proverbial light at the end of the tunnel.”

He’s comforted that the hospital never activated its plan for rationing lifesaving care, which would have required a triage team to rank patients with numerical scores based on who was least likely to survive.“It’s a relief that we never had to actually do it,” Mitchell said. “It sounds scary because it is scary.”In Los Angeles, Cedars-Sinai Medical Center ran into shortages of take-home oxygen tanks, which meant some patients who could otherwise go home were kept longer, taking up needed beds. But the biggest problem is competing with other hospitals for traveling nurses.“Initially, when the COVID surges were hitting one part of the country at a time, traveling nurses were able to go to areas more severely affected. Now with almost the entire country surging at the same time,” hospitals are paying twice and three times what they would normally pay for temporary, traveling nurses, said Dr. Jeff Smith, the hospital’s chief operating officer.Houston Methodist Hospital recently paid $8,000 retention bonuses to keep staff nurses from signing up with agencies that would send them to other hot spots. Pay for traveling nurses can reach $6,000 per week, an enticement that can benefit a nurse but can seem like poaching to the hospital executives who watch nurses leave.“There’s a lot of these agencies that are out there charging absolutely ridiculous sums of money to get ICU nurses in,” Boom said. “They go to California, which is in the midst of a surge, but they poach some ICU nurses there, send them to Texas, where they charge inordinate amounts to fill in gaps in Texas, many of which are created because nurses in Texas went to Florida or back to California.”Space is another problem. Augusta University Medical Center in Augusta, Georgia, is treating adult ICU patients, under age 30, in the children’s hospital. Recovery rooms now have ICU patients, and, if things get worse, other areas — operating rooms and endoscopy centers — will be the next areas converted for critical care.To prevent rural hospitals from sending more patients to Augusta, the hospital is using telemedicine to help manage those patients for as long as possible in their local hospitals.“It is a model I believe will not only survive the pandemic but will flourish post pandemic,” said Dr. Phillip Coule, the Augusta hospital’s chief medical officer.Hospitals are pleading with their communities to wear masks and limit gatherings.“There just hasn’t been a lot of respect for the illness, which is disappointing,” said Dr. William Smith, chief medical officer for Cullman Regional Medical Center in Cullman, Alabama. He sees that changing now with more people personally knowing someone who has died.“It has taken a lot of people,” he said of the virus, adding that the death toll — 144 people in six months in a county of 84,000 — “has opened their eyes to the randomness of this.”The Alabama hospital’s ICU has been overflowing for six weeks, with 16 virus patients on ventilators in a hospital that a year ago had only 10 of the breathing machines. “You can see the stress in people’s faces and in their body language. It’s just a lot for people to carry around,” Smith said.“Just the fatigue of our staff can affect quality of care. I’ve been encouraged we’ve been able to keep the quality of care high,” Smith said. “You feel like you are in a very precarious situation where errors could occur, but thankfully we’ve managed to stay on top of things.”Hospitals say they are upholding high standards for patient care, but experts say surges compromise many normal medical practices. Overwhelmed hospitals might be forced to mobilize makeshift ICUs and staff them with personnel without any experience in critical care. LAWRENCE, Kan. (AP) — A man who officers believed was intending to fire a semi-automatic assault rifle around closing time in a popular Lawrence bar district has been sentenced to 16 months in prison.

The judge told 19-year-old Dayson G. Kelley of Topeka during his sentencing Thursday that he or police officers could have lost their lives, and “that is something that none of us can stomach thinking about."

Kelley was arrested after two Lawrence police officers saw him take a rifle out of the trunk of a vehicle in a parking lot. Police believed he had prepared the weapon for use and intended to fire it.

The officers drew their guns and shouted at Kelley to drop the weapon. He did not comply and instead dropped down behind a car, apparently seeking cover, according to an affidavit filed in the case.

Kelley pleaded no contest in December to two counts of attempted aggravated assault of a law enforcement officer,

“He’s very fortunate that he wasn’t killed or badly wounded by these officers given the circumstances of the case, and I’ve informed him of that and I think he knows that,” defense attorney Jerry Wells said.

Kan. teen who intended to fire assault rifle near bar sentenced

BARTON COUNTY —Law enforcement authorities are investigating a suspect for alleged crimes involving a child and a meeting for sex.

Just after 2:30 p.m., Saturday, members of the Great Bend Police Department met with members of MotorCity Justice in reference to tip that a Great Bend man was soliciting sex from a 15-year old girl. The Great Bend Police Detectives had been working on this investigation with MotorCity Justice for several weeks.

The suspect later identified as 37-year-old Peter Nail communicated through a chat log, planning to meet the 15-year-old girl at a location in Great Bend, according to the release. Members of the Great Bend Police Department staged in the area of 10th and McKinley until Nail arrived to pick up the girl.

When Nail arrived, police conducted a traffic stop and placed him under arrest on requested charges of sexual exploitation of a child, indecent solicitation of a child, and electronic solicitation, according to the release.&nbsp; Police also seized an electronic device as evidence.&nbsp;Nail is being held on a $1,000,000 bond.

The fire loss to the structure is estimated at $2.5 million dollars and the loss to the contents is estimated at $2.5 million dollars, according to&nbsp;Deputy Chief Ryan Almes. The fire cause is accidental due to construction workers cutting on the roof.

Upon arrival, crews found smoke and flames showing from the roof of a hotel.&nbsp; Crews immediately searched the building and helped one occupant from the structure.

During firefighting operations, a collapse occurred and a hotel room on the third floor crashed down to the ground level.&nbsp; 

The fire cause is accidental due to construction workers cutting on the roof. Riley County police asked the public to remain out of the area of East Poyntz and Frontage Road near the Hampton Inn as emergency crews worked the fire. There were no injuries reported.

Fire at Kansas hotel caused $2.5M damage

TOPEKA&nbsp;– Governor Laura Kelly signed Senate Bill 14 into law, extending the State of Disaster Emergency Declaration to March 31, 2021, and allowing for the continuation of certain resources, support, and regulations critical to Kansas’ COVID-19 response efforts, according to a media release from her offie.

“Extending the current disaster declaration is essential for our state’s COVID-19 mitigation efforts, allowing us to keep Kansans safe and healthy, keep our economy open, and get our kids back in school as quickly as possible,”&nbsp;Governor Laura Kelly said.

Among other resources and support, the disaster declaration allows Kansas to provide community-based COVID-19 testing, provide support to food banks and pantries, and provide hospitals and first responders with Personal Protective Equipment.

Though there are a number of COVID-19 response measures contained in SB 14, the key provision extends the current emergency declaration to March 31, 2021, providing a measure of stability and certainty for the state’s ongoing emergency response efforts.

The bill also contains the provisions of a number of executive orders that the Governor has issued during the pandemic, such as allowing establishments to continue the sale of alcoholic beverages for carryout consumption, expanding the ability of physicians to use telemedicine, and providing for temporary suspension of certain healthcare professional licensing and practice requirements.

Senate Bill 14 becomes effective upon publication in an emergency edition of the&nbsp;Kansas Register&nbsp;to be published Tuesday.

KANSAS CITY, Kan. (AP) — Police in Kansas City, Kansas, say they are investigating the death of a man whose body was found inside an apartment. Police say officers were sent to the apartment complex along Orville Street on Saturday morning to check on the welfare of a man. 

Arriving officers discovered the body of the man, believed to be in his 70s, inside the apartment. His name has not yet been released. 

Police say the department's Major Case Unit is investigating the death and have asked the public for any information to help in the investigation.

WASHINGTON (AP) — President Joe Biden signed an order Monday reversing a Trump-era Pentagon policy that largely barred transgender individuals from serving in the military.

The new order, which Biden signed in the Oval Office during a meeting with Defense Secretary Lloyd Austin, overturns a ban ordered by President Donald Trump in a tweet during his first year in office. It immediately prohibits any service member from being forced out of the military on the basis of gender identity.

This is the second order Biden signed that impacts the transgender community. Last week he signed an order that prohibits discrimination based on gender identity in school sports and elsewhere.&nbsp;<a href="https://www.whitehouse.gov/briefing-room/presidential-actions/2021/01/20/executive-order-preventing-and-combating-discrimination-on-basis-of-gender-identity-or-sexual-orientation/">Click here&nbsp;</a>to read last week's Executive Order.

The order that Biden signed Monday says that gender identity should not be a bar to military service.

“America is stronger, at home and around the world, when it is inclusive. The military is no exception,” the order says. “Allowing all qualified Americans to serve their country in uniform is better for the military and better for the country because an inclusive force is a more effective force. Simply put, it’s the right thing to do and is in our national interest.”

The order directs the departments of Defense and Homeland Security to take steps to implement the order for the military and the Coast Guard. And it says they must reexamine the records of service members who were discharged or denied reenlistment due to gender identity issues under the previous policy.

It requires the departments to submit a report to the president on their progress within 60 days.

Biden had been widely expected to quickly overturn the Trump policy. And the move also was backed by Biden’s newly confirmed defense secretary, retired Army Gen. Lloyd Austin, who spoke of the need to overturn it during his Senate confirmation hearing last week.

“I support the president’s plan or plan to overturn the ban,” Austin said. “If you’re fit and you’re qualified to serve and you can maintain the standards, you should be allowed to serve.”

Under Biden’s new policy, transgender servicemembers won’t be discharged based on gender identity, and they can serve in their preferred gender once their transition is complete and recorded in the defense reporting system.

The decision comes as Biden plans to turn his attention to equity issues that he believes continue to shadow nearly all aspects of American life. Ahead of his inauguration, Biden’s transition team circulated a memo from Ron Klain, now the White House chief of staff, that sketched out Biden’s plan to use his first full week as president “to advance equity and support communities of color and other underserved communities.”

The move to overturn the transgender ban is also the latest example of Biden using executive authority in his first days as president to dismantle Trump’s legacy. His early actions include orders to overturn a Trump administration ban on travelers from several predominantly Muslim countries, stop construction of the wall at the U.S.-Mexico border, and launch an initiative to advance racial equity.

Until a few years ago service members could be discharged from the military for being transgender, but that changed during the Obama administration. In 2016, Defense Secretary Ash Carter announced that transgender people already serving in the military would be allowed to serve openly. And the military set July 1, 2017, as the date when transgender individuals would be allowed to enlist.

After Trump took office, however, his administration delayed the enlistment date and called for additional study to determine if allowing transgender individuals to serve would affect military readiness or effectiveness.

A few weeks later, Trump caught military leaders by surprise, tweeting that the government wouldn’t accept or allow transgender individuals to serve “in any capacity” in the military. “Our military must be focused on decisive and overwhelming victory and cannot be burdened with the tremendous medical costs and disruption that transgender in the military would entail,” he wrote.

His early actions include orders to overturn a Trump administration ban on travelers from several predominantly Muslim countries, stop construction of the wall at the U.S.-Mexico border, and launch an initiative to advance racial equity.Until a few years ago service members could be discharged from the military for being transgender, but that changed during the Obama administration. In 2016, Defense Secretary Ash Carter announced that transgender people already serving in the military would be allowed to serve openly. And the military set July 1, 2017, as the date when transgender individuals would be allowed to enlist.After Trump took office, however, his administration delayed the enlistment date and called for additional study to determine if allowing transgender individuals to serve would affect military readiness or effectiveness.A few weeks later, Trump caught military leaders by surprise, tweeting that the government wouldn’t accept or allow transgender individuals to serve “in any capacity” in the military. “Our military must be focused on decisive and overwhelming victory and cannot be burdened with the tremendous medical costs and disruption that transgender in the military would entail,” he wrote.Full Coverage:&nbsp;<a href="https://apnews.com/tag/apf-politics">Politics</a>After a lengthy and complicated legal battle and additional reviews, the Defense Department in April 2019 approved the new policy that fell short of an all-out ban but barred transgender troops and military recruits from transitioning to another sex and required most individuals to serve in their birth gender.Under that policy, currently serving transgender troops and anyone who had signed an enlistment contract before the effective date could continue with plans for hormone treatments and gender transition if they had been diagnosed with gender dysphoria.But after that date, no one with gender dysphoria who was taking hormones or has transitioned to another gender was allowed to enlist. Troops that were already serving and were diagnosed with gender dysphoria were required to serve in their birth gender and were barred from taking hormones or getting transition surgery.As of 2019, an estimated 14,700 troops on active duty and in the Reserves identify as transgender, but not all seek treatment. Since July 2016, more than 1,500 service members were diagnosed with gender dysphoria; as of Feb. 1, 2019, there were 1,071 currently serving. According to the Pentagon, the department spent about $8 million on transgender care between 2016 and 2019. The military’s annual health care budget tops $50 billion.All four service chiefs told Congress in 2018 that they had seen no discipline, morale or unit readiness problems with transgender troops serving openly in the military. But they also acknowledged that some commanders were spending a lot of time with transgender individuals who were working through medical requirements and other transition issues.
