Nebraska’s bighorn sheep hunting season ended Dec. 6 when a hunter from the eastern end of the state punched his tag, one of the two permits issued for the season.

Todd Nordeen, the Nebraska Game and Parks Commission big game and disease research manager who supervises the hunting program, said each of the two rams harvested this year was a mature adult with full-curl horns. Both were harvested in the Wildcat Hills of the Panhandle.

Jerry Fischer of Denton bagged his ram on a 6-mile trek Dec. 6, his second day of hunting. He won his permit from a drawing 3,904 applicants.

The other hunter, Kevin Small, harvested his ram on his fourth day of pursuit, Dec. 2. He won his permit by auction in February during the annual banquet for the Iowa Chapter of the Foundation of North American Wild Sheep.

The sheep mark the 31st and 32nd harvested in Nebraska since the Game and Parks’ hunting program began in 1998.

The number of Nebraska bighorn sheep permits available each year is based on the state’s population of the species, especially mature rams, as determined during monitoring by Game and Parks staff. To date, permits have been limited to one or two hunters in most years, with several years not permitting any harvests.

Nebraska has developed a reputation for producing trophy-caliber rams for those fortunate to win a permit. Not only do the hunts provide a rare experience and uncommon table fare, they have been vital to bighorn sheep conservation in Nebraska. About $2 million has been raised through the lottery applications and auctions to fund research and reintroduction efforts of the species.

Permit winners are assisted by Game and Parks staff and treated to meals and lodging at Fort Robinson State Park.

Nebraska’s reintroduction efforts for bighorn sheep began in the 1980s, an attempt to remedy the unregulated hunting, habitat loss and disease that led to their extirpation from the state in the late 1800s. Nebraska’s population of bighorns stands at approximately more than 300 rams, ewes and lambs in both the Wildcat Hills and Pine Ridge.

PAWNEE COUNTY–Three people were injured in an accident just after 8p.m. Friday in Pawnee County.

The Kansas Highway Patrol reported a 2007 Chevy Tahoe driven by Marissa S. Doctor, 15, Larned, was westbound on U.S. 56 just west of County Road J.

The SUV crossed the center line and struck a 2009 Ford Escape driven by Erika S. Roman, 24, Great Bend, head-on in the eastbound lane.

EMS transported Doctor to the hospital in Great Bend, Roman to Wesley Medical Center and a passenger in the Ford 18-year-old Brittany&nbsp;Roman Velasquez of Great Bend to Hays Medical Center.&nbsp;

Erika Roman was not wearing a seat belt, according to the KHP.&nbsp; One juvenile passenger was in the SUV and&nbsp; two in the car; juvenile record is protected data.

Kan. teen hospitalized in Hays after head-on crash

It’s the Festival of Lights. Twinkly lights adorn five acres of trees, barns and buildings as excited families enjoy hot chocolate and homemade, spiced wine.&nbsp;

It’s an annual Christmas celebration hosted by a family-owned winery on the high plains of rural Kansas.&nbsp;&nbsp;&nbsp;

Kirk and Treva Johnston are the owners and founders of Shiloh Vineyard and Winery near WaKeeney. The vineyard hosts special events throughout the year, including the weeklong Festival of Lights during the week before Christmas.&nbsp;

Kirk Johnston grew up in Goodland. His wife Treva is originally from Damar. Kirk was always interested in farming. He grew up helping his uncle on the farm and earned a degree in agronomy from Kansas State University.&nbsp;

“I took lots of chemistry classes,” Kirk said. The two married and eventually ended up on his grandfather’s place near WaKeeney.&nbsp;

“My grandfather bought this place in 1921 because it had a horse barn on it,” Kirk said.&nbsp;&nbsp;“They built a chicken house and by 1925, had 300 layers in it.”&nbsp;

In 1929, they added the family home: “It was a house ordered out of the Montgomery Ward catalog,” Kirk said.&nbsp;

When Kirk and Treva got the property decades later, they considered their options. “We wanted to farm, but diversification seemed like a good idea, compared to spending millions of dollars for new farm equipment,” Kirk said.&nbsp;

Instead of big farm equipment, they put in a vineyard, installing a drip irrigation system. “We planted our first grapes in 2008,” Kirk said. Ultimately, this became a commercial winery.&nbsp;

“I read everything I could and went to a lot of conferences,” Kirk said. He learned from other commercial operators as well.&nbsp;

“We were assistant pastors at a local church in Hays and felt called to make an overseas trip,” Kirk said. Kirk and Treva went to a vineyard in Shiloh, Israel to help trim the vineyard and prune their vines. It was a powerful experience for them.&nbsp;

“If you let God direct your paths, his peace will come in,” Kirk said. “We want to provide top quality service so that people can experience that peace here in western Kansas.”&nbsp;

Today, Shiloh Vineyard and Winery offers a variety of premium wines made from the farm’s own fruit. This includes&nbsp;dry whites, dry reds, semi-sweet white, fruit and dessert wines.&nbsp;

“We started with 350 gallons in our first year,” Kirk said. “In 2021, we produced 1,000 cases at 2.5 gallons per case.”&nbsp;

They have upgraded their facilities and renovated the chicken house, barn, and a 100-year-old granary. In 2020, Treva’s niece, Kym, and her husband, Chris Heitke, relocated from California to WaKeeney to help with the business.&nbsp;

Shiloh Vineyard and Winery also hosts special events, lots of weddings, and visitors throughout the year. In addition to the nightly Festival of Lights during the week before Christmas, they offer a Sip of Summer Patio Party, Fall Festival dinner, and much more.&nbsp;&nbsp;Three times a year, they host five course meals paired with their wines.&nbsp;

The Johnstons also offer recreational vehicle dry camping sites at the vineyard. They connected with a national website called Harvest Hosts which promotes RV camping at farms, breweries, wineries and more across the country. The website has brought in lots of visitors.&nbsp;

“It’s been so wonderful,” Kirk said. “People say this is an oasis.”&nbsp;

They have had guests from every state in the U.S. plus Brazil, China, Peru, Germany, Australia and more.&nbsp;

Shiloh wines are available at a variety of retail outlets in western Kansas as well as at the vineyard itself. The vineyard is located in the country between WaKeeney and the rural community of Collyer, population 97 people. Now, that’s rural.&nbsp;

Now That’s Rural: Trego County's Shiloh Vineyard 

COLBY — Colby Community College received a $10,000 gift from the Thomas County Foundation to be used for the agricultural center on campus. Foundation Director Jada Tubbs made the presentation Wednesday night at halftime of the Trojans men's basketball game.

"On behalf of TCCF, I would like to express our excitement for the new Agricultural Center," Tubbs said. "Our board agrees this is a worthwhile&nbsp;cause to fund and looks forward to its completion."

Construction began in October on the 12,400-square-foot facility and is expected to open in time for the fall 2023 semester.

Three-day weather outlook

Twas&nbsp;the night before Christmas and all through the house, not a creature was stirring not even a mouse. Hold on just a minute!

The holidays can be a time of extra stress – more money flying out the door, too many places to be in too little time, schedules are upset, food that we don’t eat every day, and just general chaos!

Plan ahead now for some inexpensive fun ways to just be together. Drag out the books – share one that your child loved when they were small and read it together using your best character voices.&nbsp;Make a trip to the library to pick out a new book – every library has great librarians who would love to make reading recommendations for you!

When is the last time you played “crazy eights," “old maid," or had an energetic game of Uno?&nbsp;In addition to using skills of taking turns and being cooperative, youth practice counting and paying attention to details.

Have you put a jigsaw puzzle together as a family? Unless you do these often, don’t start with a 1,500-piece complicated one. Pick an easy one that everyone can participate in. Set up a card table in a corner and you may be surprised how often someone stops by it to add a couple of pieces.

My family&nbsp;has held&nbsp;a gingerbread house contest&nbsp;for many years. Now before you think these are huge, magical creations, let me tell you that they are made from graham crackers, frosting,&nbsp;and&nbsp;whatever odds and ends of candy and cereal&nbsp;that&nbsp;show up – Halloween candy is often used! The planning and giggles that go into these creations are so much fun to watch and my favorite part is seeing the big kids pair up with the little kids to help them learn about structure, creativity, and often gravity!

Be silly and dance – turn on some music and dance in the living room! It’s good exercise for the body and the brain. Show off those 90’s dance moves and learn a few from your kids. My kids and I still have “carcerts” – Yep, a concert in the car which means singing at the top of our lungs even when we don’t know all the words.&nbsp;We are OK with people thinking we look silly because we are having fun!

Go outside! Take a walk, play kickball, throw a disc or snowball. I grew up on one of the best sledding hills in my town. Even if we only had time for one or two runs, we were throwing ourselves on a sled and racing down the hill. My parents were regular participants in this craziness!

There is an old saying along the lines that people don’t care how much you know until they know how much you care. This applies to your family also – Unplug and&nbsp;Be There!

Just being there can be so&nbsp;hard to do but I remember one of the best/worst weeks quite a few years ago when we had a huge ice storm in 2007. We were out of power for 8 days and, while I could keep our home heated with the gas fireplace and cook on the gas stove, it could have been a really awful week just before Christmas! I couldn’t get to&nbsp;work&nbsp;and we had no internet with no power so we chose to make the best of the situation and had fun.&nbsp;We played games, read books, played outside, and chose to just Be There and enjoy the moment.

During the holiday break, make time to spend time with your kids! Be There because that is what they will remember!

BERAN: Play time

GREAT BEND — There is no 
statute of limitations in homicide cases. That's how, on Thursday, 
68-year-old Steven L. Hanks was arrested on second-degree murder charges
 from the death of Mary Robin Walter, stemming back nearly 43 years. 
Friday morning, Barton County Sheriff Brian Bellendir, Barton County 
Attorney Levi Morris, and various other law enforcement officers held a 
press conference at the Barton County Courthouse to discuss the case. 

"At
 42 years and 10 months, we believe this is the oldest homicide arrest 
in the state of Kansas," Bellendir said. "It may be one of the oldest 
homicide arrests in the United States. This also clears the last known 
homicide in a non-incorporated area under the jurisdiction of the Barton
 County Sheriff's Office."

Just before 7 p.m. on Thursday, Jan. 24, 1980, deputies responded to a
 possible homicide call in the Nelson Trailer Park, lot nine, near what 
is now Southwest 40th Avenue and Anchorway. 

"Upon arrival, 
deputies and investigators located the body of a female victim who had

 Mary Robin Walter, who lived at the residence. Walter was 23 years of 
age at the time, married with one child. She was a nursing student at 
Barton County Community College."

Bellendir said an extensive 
investigation was conducted at the time, and Hanks was developed as a 
person of interest in the case. However, law enforcement lacked the 
evidence needed to submit the case for prosecution.

In April 2022, Det. Sgt. Adam Hales was recovering from COVID-19 when
 he re-opened the case. "After taking a fresh look at the case, it 
became evident that some of the information had been initially 
overlooked, and some had been added at a later date," Bellendir said. 
"This was unknown to the original investigators."

Bellendir 
assigned additional detectives Alex Lomas and Bryan Volkel, as well as 
Patrol Sgt. Travis Doze to the case. Lt. David Paden supervised the 
operation as the deputies had time. The officers tracked down numerous 
individuals who had been involved in the case in the 1980s, reaching as 
far as the Pacific Northwest.

"In October of this year, new 
evidence was obtained that allowed the sheriff's office to submit the 
case to the Barton County Attorney, Mr. Levi Morris, for review," 
Bellendir said. "After approximately four weeks of review, Mr. Morris 
obtained an arrest for murder in the second degree, and the arrest of 
Steven L. Hanks, age 68, of Burden. Hanks was a neighbor to the victim 
at the time of the homicide."

Hanks was arrested by Kansas Bureau 
of Investigation agents Thursday evening in Oxford and turned over to 
the Barton County Sheriff's Office for transportation back to Great 
Bend. He is currently being held in lieu of a $500,000 bond. 

Morris
 said Hanks could make his first appearance in front of a district court
 judge as early as Friday afternoon or sometime Monday. The next step 
will be a preliminary hearing for the second-degree murder charge.

"The
 facts that we know, and believe they are, and believe we can prove in 
court fit that charge rather than any charges higher or lower," Morris 
said. "That can change either to be higher or lower at the preliminary 
hearing or at any time close to trial."

Bellendir was pleased to bring a level of closure to the case after 
42 years.&nbsp;

"Homicides are never closed," he said. "As long as you have a 
homicide case, it remains open until you get it closed one way or the 
other. This has case has been open ever since I've been a law 
enforcement officer. 

"I started with the sheriff's office in 
1982. This has been an irritation for the sheriff's office that we've 
never been able to close this case. A lot of investigators have tried to
 close this case, and we were unable, at that time, to get the 
information we needed."

Bellendir thanked the many agencies that 
assisted in the investigation, including the KBI, Great Bend Police 
Department, Oxford Police Department, Cowley County Sheriff's Office, 
Winfield Police, Burden Police Department, and Everett Police Department
 in Washington state. He also gave high praise to his own detectives.

"The
 credit in this case goes to my detective division, who were in the 
trenches doing the nuts and bolts work," he said. "These are long, 
complicated investigations, and tedious. The credit really goes to my 
people.

"This is such a complicated case with so many moving 
pieces," he continued. "The credit goes all the way back to the early 
1980s to the first cops that responded to the scene. The KBI has 
assisted us greatly in the case. Chief Haulmark is fairly new to the 
community, but he was personally out digging around in boxes trying to 
find records we needed from the 1980s. This was a joint effort."

Bellendir
 said Walter does still have family living in Kansas. At the time of her
 death, Mary was married to Doug Walter, who died in 2021, without 
closure in the case.   

"On the anniversary of her death, that was
 the day he would go in the basement," said one of Doug's stepdaughters,
 who was present at Friday's press conference. "All the lights would be 
off, and he didn't want anyone to bother him." 

Two stepdaughters 
moved in with Doug after he remarried, even though some considered him 
to be a suspect. Many originally thought Hanks committed the crime.

"I
 feel like a lot of people thought he did it," said the stepdaughter. 
"It was no big deal. We didn't think anything of it until now that we're
 older and we look back, and people always say they thought Doug did it.
 It's nice to have proof that he didn't."

statute of limitations in homicide cases. That's how, on Thursday, 
68-year-old Steven L. Hanks was arrested on second-degree murder charges
 from the death of Mary Robin Walter, stemming back nearly 43 years. 
Friday morning, Barton County Sheriff Brian Bellendir, Barton County 
Attorney Levi Morris, and various other law enforcement officers held a 
press conference at the Barton County Courthouse to discuss the case. "At
 42 years and 10 months, we believe this is the oldest homicide arrest 
in the state of Kansas," Bellendir said. "It may be one of the oldest 
homicide arrests in the United States. This also clears the last known 
homicide in a non-incorporated area under the jurisdiction of the Barton

&nbsp;TOPEKA — The Kansas Department of Health and Environment has rescinded a boil water advisory for&nbsp;the&nbsp;city of Smith Center&nbsp;public water supply system located in&nbsp;Smith&nbsp;County.&nbsp;The advisory was issued&nbsp;because of&nbsp;a loss of pressure in the system due to a&nbsp;line break.&nbsp; Failure to maintain adequate pressure may result in a loss of chlorine residuals and bacterial contamination.&nbsp;&nbsp;

Public water suppliers in Kansas take all measures necessary to notify customers quickly after a system failure or shutdown. Regardless of whether it’s the supplier or KDHE that announces a boil water advisory, KDHE will issue the rescind order following testing at a certified laboratory.&nbsp;

Laboratory testing samples collected from the city of Smith Center public water supply system indicate no evidence of bacteriological contamination and all other conditions that placed the system at risk of contamination are deemed by KDHE officials to be resolved.  &nbsp;&nbsp;

KDHE rescinds boil order for Smith Center

Options Domestic and Sexual Violence Services has seen an increase in requests for services during the last year and is seeking community assistance during its annual fundraising campaign to meet those increased needs.

"We were really predicting that our numbers this year would level off and go back to our pre-pandemic numbers," said Jennifer Hecker, Options executive director. "That has just not happened. They have continued to grow."

Options has seen significant increases in services during the last two years.

It provided 60 percent more services in 2021 than it did the previous years and has provided more than 60 percent more services in 2022 compared to 2021.

The average number of bed nights at the Options shelter is about 1,200 This year to date, the shelter has provided 4,800 bed nights. Hecker said she anticipates the shelter will hit 5,000 bed nights before the end of the year.

The shelter services women, children and men.

"It's anyone who needs a place to stay because they are experiencing domestic violence, sexual assault, stalking, human trafficking or family violence," Hecker said.

Options covers an 18-county area of northwest Kansas that includes Ellis County.

Hecker said she thought Options was seeing increases in its numbers both because of an increase in violent acts as well as a greater awareness of the services that are available.

The Kansas Bureau of Investigation recently released its 2021 domestic violent report, which showed a statewide increase in violent crime.

"We spent a lot of energy and time doing advertising and other community awareness during COVID because we saw those numbers increasing not just in Ellis County, but in other counties we serve and nationwide," Hecker said.

"I think COVID kind of pulled the Band-Aid off of America's dirty little secret — the harm that happens behind closed doors that we don't often hear about."

Options also provided new avenues to access its services. The agency added a mobile office that travels to all 18 counties in its service area. The agency also has a texting hotline and chat hotline in addition to its phone hotline. Text the word "Hope" to 847411.

The 24-Hour Helpline is 800-794-4624. The chat and other information can be accessed on the Options website at <a href="https://help4abuse.org/">https://help4abuse.org/</a> All of the helplines and chats are manned 24/7, 365 days a year.

Options also launched an app called "My Mobile Options," which is free for download for Apple or Android devices.

Difficult economic times can also be stressors that can result in domestic or family violence, Hecker said. Economic stress tends to grow during the holidays.

"Every family struggles to provide gifts and things like that for their family. If they are unemployed or underemployed that can compound that stress even more," Hecker said. 

In families in which violence has occurred coming together at Christmas can be triggering, she said.

Hecker said seeing signs of domestic abuse in friends and family members can be difficult. Unhealthy control can be one of those signs.

Individuals who seemed stressed about having to be home at a certain time or their partner is going to anger can be a sign of domestic abuse. Other signs can be someone who doesn't have control over their money, jealousy, a partner demanding to see a partner's phone or a partner expecting to listen in on phone conversations.

"Holidays are so stressful and a time when so many people tell victims to not leave now and to wait until the holiday is over. Don't ruin the holiday by leaving," Hecker said. "We tell people give yourself the gift of safety this holiday season.

"If you are fearful or you know someone who is, have them call Options, and we will get them the holiday help they need."

Options' Light of Hope annual fundraising campaign helps Options fill the funding gaps to provide services for victims of domestic violence, sexual assault, stalking and human trafficking.

The campaign goes through the end of the year. Donors have many options for giving. They can go to Options' website, donate by sending a check to or drop it off in person at the Options office at 2716 Plaza Ave., Hays, KS 67601

This year's campaign goal is $202,000. Options is about $15,000 away from reaching that goal.

"That money goes to help victims and survivors get the services they need and fills the gaps that our state and federal grants don't fill," Hecker said.

It helps pay for survivors to get hotel rooms if Options' shelter is full. It can be used to help survivors replace driver's licenses or other important documents they had to leave behind when they fled or were taken from them. It can also provide funds for the therapy dog, or child and youth services programs, among other programs.

 a fun time to get out," he said. "Not our typical time of year that 
people think about going outside to watch birds, but it can be a really 
fun time to get out and see what's here."

Hundreds of counts will 
take place across the nation during the three-week period, and Wolf 
estimates some 45 counts will take place in Kansas alone. The Cheyenne 
Bottoms count will take place on Monday, Dec. 19, from 8 a.m. to 4 p.m. 

"It's
 about a 15-mile area that is the same every year," Wolf said. "We 
divide that up into small groups of people that go out and basically try
 to monitor, identify, count, and document the birds they see during 
that day."

Regardless of how populations fare locally, Wolf said 
the Christmas Bird Count is one efficient way for scientists to collect 
massive amounts of data about birds.

"Scientists utilize this data
 frequently to monitor trends of birds," he said. "Here again, we would 
suspect our numbers are not going to be nearly what they were in 
previous years for the Cheyenne Bottoms count, but our count information
 gets put in with all the other counts across the U.S. and provides some
 incredible monitoring trend information for these birds."

Rookies
 or experienced birders are welcome for the count. Binoculars, bird 
books, and warm clothes are also preferred but not required, as much of 
the counting is done from vehicles. 

"This is a great way to 
learn," said Wolf. "We'll pair you up with people that are experienced 
bird watchers, and you can go out and see what you can learn on how to 
ID some of these winter birds."

The Christmas Bird Count is a free activity. To register, call the KWEC at (877) 243-9268.

The policies adopted will now become the organization’s road map for the 2023 legislative session. Topics of discussion included&nbsp;water, medical marijuana and energy production. Wilson County farmer Joe Newland was elected president. Others elected to the board of directors include:

• George Pretz, Miami County • Steve McCloud, Harvey County • Doug Zillinger, Phillips County • Joe Jury, Gray County • Craig Cooper, Sheridan County

Outgoing KFB President Rich Felts was honored at Sunday’s banquet, including remarks from Sen. Jerry Moran. Other activities included a host of agriculture-related workshops and speakers, including a keynote from Gregg Doud, former Chief Agricultural Negotiator with the Office of the U.S. Trade Representative. Sen. Roger Marshall and Rep. Tracey Mann spoke during a policy update, which also included briefings from Kansas Farm Bureau staff on issues important to agriculture. County Farm Bureaus and volunteers were recognized for their 2022 achievements. Nearly $5,600 was raised through a silent auction sponsored by the Women’s Leadership Committee for the End Hunger campaign. KFB Foundations’ Fundraiser “Let the Good Times Roll” raised more than $25,000, which also benefits the End Hunger campaign.

NW Kansans elected to Kansas Farm Bureau board of directors

SHERMAN COUNTY —One person was injured in an accident just before 7p.m. Thursday in Sherman County.

The Kansas Highway Patrol reported a 2008 Ford F250 driven by Brian&nbsp;Cardona ZaMarron, 20, Burlington, Colorado, was westbound on Interstate 70 three miles east of the state line.

The pickup left the roadway to the left and came back onto the roadway. The driver overcorrected and the vehicle rolled into the median.

EMS transported&nbsp;Cardona ZaMarron to the hospital in Goodland. He was not wearing a seat belt, according to the KHP.

The countdown has begun to the holiday season. &nbsp;Navigating the season and keeping&nbsp;up our healthy habits is always a challenge. &nbsp;So many temptations and busyness can de-rail anyone from good intentions. &nbsp;Donna Krug, Director and Family Consumer Science Extension Agent,&nbsp;and I recently presented about this topic in Great Bend. &nbsp;We found a great resource&nbsp;from Cleveland State University,&nbsp;entitled&nbsp;Healthy Holiday Survival Guide, that we included in our presentation. &nbsp;The tips&nbsp;below are meant to be simple and straight forward and not overwhelming. &nbsp;Keeping things simple during this season is key.&nbsp;So even if you only pick one or two items to be intentional about, that is a great approach to these suggestions.

1. Eat slowly-allow your brain to catch up and your body to feel satisfied by slowing down, putting your fork down, and visiting with those around you.

2. Drink water- sometimes our hunger cues are mistaken for being thirsty. &nbsp;Find a way to keep a water bottle near and drink water before attending events.

3. Don’t stress-easier said then done, I know! &nbsp;Prioritize what’s important and meaningful to you and your family and leave the rest. &nbsp;Find time for fun and relaxation. &nbsp;

4. Beware of liquid calories-alcohol, eggnog, soda, and lattes contain a lot of calories. &nbsp;Be aware of how many of these you drink because they go down easy and are often a forgotten source of calories.

5. Easy recipe substitutions-unsweetened applesauce for oil, lower fat milk for whole milk, whole wheat flour instead of white flour, extra virgin olive oil for butter, turkey instead of beef, low fat yogurt instead of sour cream, and herbs instead of salt are great substitutions that don’t sacrifice flavor.

6. Don’t forget to work out-find a way to be active even if you can’t get to the gym. &nbsp;Some examples include take the stairs, park farther away from doors, march in place or do squats during commercials when watching TV.

7. Wash your hands-because being sick during the holidays is no fun at all. &nbsp;Get rid of germs as often as possible by washing hands frequently.

8. Do something for others-it can be therapeutic to help others during the holiday season.

A 21-year-old Mexican citizen will serve a year in prison
for a drunk driving crash that killed a 56-year-old Schoenchen man in October 2021.

After pleading guilty to vehicular homicide in September,
Martin Efren Velazquez Cruz was sentenced Tuesday in Ellis County District
Court to one year in prison.

Cruz was initially charged with six different counts in
connection to the Oct. 3, 2021, crash south of Hays.

According to the Kansas Highway Patrol, Cruz was traveling
southbound on U.S. 183 and tried to pass another vehicle. He collided
head-on with a northbound passenger car driven by 56-year-old James Kohl of
Schoenchen. 

Cruz was charged with driving under the influence of
alcohol, “under the legal limit of .08 but to a degree that renders the person
incapable of safely driving the vehicle.”

He was also charged with vehicular homicide, reckless
driving, speeding, passing on left with insufficient clearance and display or
possess fictitious or fraudulent ID card.

As a result of Cruz pleading guilty to vehicular homicide and
entering into a diversion into the driving under the influence charge, the four
other charges were dismissed by the state.

In Kansas, vehicular homicide is a class A misdemeanor punishable
by up to a year in prison.

Cruz will also be required to pay restitution covering Kohl’s
funeral costs and the cost of his car.
