Kan. officer who was shot won't face charges for shooting at suspect

OLATHE, Kan. (AP) — A Kansas City, Kansas, police officer will not face charges for shooting at a suspect in December, Johnson County District Attorney Steve Howe said Tuesday.

Officer Daniel Vance, who was shot in the confrontation on Dec. 15, was justified in shooting at Jesse James Flaugher, Howe said.

The encounter began while Vance was watching a car that was believed to be involved in an earlier hit-and-run in Overland Park. Flaugher noticed Vance watching him and started shooting before the officer could draw his gun, Howe said.

One bullet struck Vaughn’s Taser gear and ballistic vest and another hit him in the arm. Howe said his investigation found that Vance fired once before his gun malfunctioned. He was treated and released from a hospital the same day.T

Flaugher drove away but was captured three days later in Edgerton. He is charged with attempted capital murder and possession of a firearm by a felon.
