TOPEKA -- Kansas Attorney General Derek Schmidt issued the following statement on Friday's Kansas Court of Appeals decision rejecting an attempt by a Wichita abortion provider to use the current COVID-19 crisis as a reason to lift restrictions on the delivery of abortion services through telemedicine:
āAround the country, several attempts to increase regulation of abortion providers during the current pandemic have drawn significant public attention, but here in Kansas just the opposite was happening with little notice. On March 31, a Kansas abortion provider invoked the COVID-19 crisis in quietly requesting the Court of Appeals to block enforcement of a state law that regulates the delivery of abortion services through telemedicine ā a law that remains the subject of years-long litigation unrelated to the pandemic. As we pointed out in opposition, their request was an āopportunistic abuse of the appellate process.ā The court did the right thing today in rejecting it.ā
