RUSH COUNTY&nbsp;–&nbsp;The Rush County Attorney reports that no charges will be filed against the Ness County sheriff’s deputy who shot and injured a suspect in a January officer involved shooting on Highway 96 in Rush County, according to a media release from the Kansas Bureau of Investigation.

After reviewing KBI investigative reports, Rush County Attorney Tony Rues determined the use of deadly force was justified, and he will not file charges against the sheriff’s deputy.

According to Rues, the officer involved shooting was reviewed pursuant to the statutory authority of K.S.A. 20-5222 use of force; defense of person; no duty to retreat and Kansas case law. Pursuant to K.S.A. 21-5222 (b) a person is justified in the use of deadly force if such person&nbsp;reasonably believes&nbsp;that&nbsp;such&nbsp;use of deadly force&nbsp;is&nbsp;necessary&nbsp;to&nbsp;prevent imminent death or&nbsp;great&nbsp;bodily harm to&nbsp;such&nbsp;person or a third&nbsp;person&nbsp;(emphasis added). The key words being reasonably believes. This is reinforced by case law in State v. McCullough, 293 Kan. 970, 975, 270 P. 3d 1142 (2012) and clarified in Graham v.&nbsp;Connor,&nbsp;490 U.S. 386 (1989).

Rues summarized his decision saying, “Considering the provided&nbsp;legal&nbsp;standard,&nbsp;the following facts are legally pertinent. The deputy&nbsp;was&nbsp;in pursuit of Timothy “Timmy” W. Kellebrew who was&nbsp;suspected&nbsp;of committing an aggravated robbery with a firearm of a Dollar General&nbsp;store.

&nbsp;Kellebrew's&nbsp;actions&nbsp;required law enforcement to engage in a dangerous&nbsp;high-speed&nbsp;pursuit of him. This&nbsp;not&nbsp;only&nbsp;endangered&nbsp;law&nbsp;enforcement but also other civilians&nbsp;using the&nbsp;highway.&nbsp;Kellebrew&nbsp;also&nbsp;wielded the firearm in attempting to gain access to the vehicle that he had forced off the&nbsp;highway. It is at that instance that the deputy fired his&nbsp;service&nbsp;weapon to prevent the same. The use of deadly force was justified. Therefore, no charges against the deputy will be filed.”

Kellebrew was charged in Lane County district court for his alleged involvement in the robbery at the Dollar General Store in Dighton. Charges are pending for suspected crimes that occurred in Rush County.

KBI: No charges against deputy in Rush Co. officer-involved shooting

PLAINVILLE — Rooks County Health Center reported Thursday an employee has tested positive for to the novel coronavirus, which can cause COVID-19.

On Tuesday, an RCH employee began feeling unwell during their shift even though the employee had no symptoms when they went through the screening protocol when they arrived for work.

The staff member reported symptoms as soon as they developed and was screened again with a second temperature check. Due to the symptoms and a change in their temperature, a culture was taken by a swab test and sent to a private lab for analysis. After the test was administered, the staffer went home per RCH protocol and proactively began self- quarantining.

The swab test sent to the diagnostic lab came back as positive. Fortunately, this specific test came back in a very short period of time, which allowed contact tracing to be initiated promptly.&nbsp;

Every RCH employee who had significant contact with the staffer has been notified and they are taking additional safety steps. Significant contact is defined as being closer than 6 feet for longer than 10 minutes.

“We knew that this day would come and we have been prepared for weeks on how to handle just such a situation," said AJ Thomas, CEO of Rooks County Health Center. "We have a great system in place and the hospital continues to operate in a safe manner for patients and staff."

Rooks Co. hospital staff member tests positive for coronavirus

Jim Mall was encouraged by his kids to join SouthWind
CrossFit six or seven years ago. When he did, he never thought he would be one
of the top competitors in the world at his age group — but that’s exactly what
happened.

The 62-year-old Mall recently finished 80th in the men’s 60
and older division of the CrossFit Games.

“Every day, we wanted to be around our children and grandchildren,
so we just went to the gym because that’s where they were at.” Mall said.

CrossFit has been a family affair for Mall and his wife, Sue. His kids, Tucker and Jill, were already coaches and later his youngest daughter
Maddy joined them.

CrossFit is a form of high-intensity interval training with strength
and conditioning workouts made up of functional movements performed at a high-intensity
level.

Once a year, CrossFit puts on a competition for its members
throughout the world, who range from ages 14 through 60-plus.

The games are broken down into three steps. The first is The
Open — a five-week competition that starts in October and has members completing
workouts sent out by the CrossFit corporation. Those who finish in the top 200
advance to the Online Qualifying round where competitors have five days to
complete six workouts. The top 10 of each age group then advance out of that to
the CrossFit Games which are scheduled for August in Madison, Wis. 

Mall was close to advancing out of the first round when he
first started competing in the 55-59 age group.

“I started competing in the open when I think (I was) 57 or 58. I
finished 224th and I’m thinking, 'I was so close, it can’t be that hard to move
up 24 spots,' ” Mall said.

After devoting more time and effort into his training for
the next year’s competition, he only moved up 12 spots. He joked that all
changed when he moved to the 60-and-older age group.

“Fortunately for me, there are not very many people in my
competition, I’m only competing against three or four thousand people, so it’s
easier to qualify for these things because there’s not that many people our age
that do CrossFit,” Mall said.

This is the third straight year Mall has advanced to the
second round in the older age division. He finished 86th in 2018 and 142nd in 2019.

Hays man finishes 80th in world CrossFit competition

MANHATTAN – Farmers across the country were already dealing with trade conflicts, weak commodity prices and ever-challenging weather and then the COVID-19 pandemic hit.

“Life has changed as we know it. We’re all trying to figure out what this is and how it will affect agriculture,” said Kansas State University agricultural economist Robin Reid during an April 8 webinar. The event was one of two offered for women in agriculture as a follow-up to a winter series “Farm Financial Skills for Kansas Women in Agriculture.”

“We were already in a challenging time for agriculture,” said LaVell Winsor, agricultural economist with the K-State Research and Extension Farm Analyst program.

Like families across the country, Winsor noted that school closures linked to the pandemic have farm families figuring out how to handle having children at home when they normally would be in school. In many cases, one parent is either working from home or has an off-farm job to go to while the other parent is getting spring crops planted and tending to livestock.

“In highly volatile times, no one is going to stop eating, but we are learning a lot about how the supply chain works and how it can be disrupted,” Winsor said.

Farm families are used to dealing with uncertainty – always-changing weather, shifting trade policy and competition from other countries. But in this case, Winsor said, the pandemic is a “black swan” event – one that could not be predicted or planned for but that could have catastrophic effects. The spread of COVID-19 and resulting stay-at-home orders, business closures and potential supply chain disruptions due to transportation or labor difficulties are presenting even more uncertainty and anxiety than farm families normally deal with.&nbsp;

Dairy, beef cattle, hogs and corn have been hit the hardest, Reid said, adding that the corn market received a double whammy – the oil trade war between Russia and Saudi Arabia which has driven oil and gasoline prices lower, plus less demand for ethanol because the pandemic-related stay-at-home orders means drivers are driving less.

About one-third of ethanol plants are predicted to close, Reid said, which reduces the need for corn.

Because of the predicted plant closures, an estimated 200 million to 500 million fewer bushels of corn will be needed this year compared with last. USDA has estimated a large corn crop this year if farmers are able to plant in a timely manner and input supply chains are not disrupted.&nbsp;

“USDA had projected a $3.60 Marketing Year Average for this year’s corn crop,” Reid said. “I don’t believe that estimate will last because of the factors that are bringing corn prices down.”

A bright spot is that U.S. grain sorghum prices are strengthening because China has been making recent purchases. In some areas, grain sorghum prices are higher than corn prices, which is unusual, Reid said.

Wheat prices also have been given a boost because countries such as Russia, Ukraine and Kazakhstan are stockpiling wheat for domestic consumption as fears of a prolonged quarantine grow, she added.

“As bread is flying off the shelves, we’ve seen more demand for wheat. That’s really the biggest boost,” Reid said.

Agricultural processors cannot always change quickly, which adds uncertainty to farmers deciding what crops to grow or how much milk or meat to produce. Reid gave the example of dairy processing-related businesses that provide individual packets of butter to now-closed restaurants and school districts. They don’t always have the equipment or ability to quickly pivot to a different product. Similarly, with restaurants closed, the demand for higher quality beef is curtailed. Grocery shoppers are still buying beef but tend to purchase lower-priced cuts, such as ground beef.

Compounding the uncertainty is that some farms and agricultural processing companies are dealing with labor difficulties, including several meat processing facilities closing temporarily. Some employees are not coming to work, either because they now have small children at home to care for, have become sick or are concerned about getting sick.

“The bottom line is, we have a lot of cattle and the bottleneck is at the packing plants and processors,” Reid said.

The economists summarized the $2.2 trillion Coronavirus Aid, Relief and Economic Security Act, also known as the CARES Act, the largest relief package in U.S. history. Among the provisions are $9.5 billion in direct relief to agricultural enterprises, including livestock, dairy and specialty crops, and $14 billion to the Commodity Credit Corporation for funds spent previously.

In her work as an economist with K-State’s Farm Analyst program, Winsor works one on one with farmers. She encourages farm families to consult with key advisors, including business partners, which in some cases are other family members, lenders, brokers or marketing advisors, agricultural retailers or others.

“We don’t have to bear the responsibility of decisions by ourselves,” said Winsor, who herself is a partner in her own family’s farm operation.

“When I sit down with farmers at the kitchen table, the ones who are willing to make decisions are usually the ones who come out ahead. When we’re uncomfortable, just making one decision is helpful,” Winsor said, noting that it may be shifting some acres you plant to one crop in favor of a different one.

“I can’t emphasize this enough -- continue to look at your farm financials,” Winsor said. “None of us feel very secure right now. Stay the course and follow your plan, but make adjustments if needed.”

The Democratic governor is keeping the shelter-in-place order in place until May 3, rather than Sunday and continuing to limit in-person worship services and other religious gatherings to 10 or fewer people. 

That restriction has resulted in criticism from the Republican-controlled Legislature. Kelly called a meeting of the Republican-dominated State Finance Council in hopes of helping hospitals. Kansas now has 1,494 confirmed coronavirus cases and 76 COVID-19-related deaths.&nbsp;

In addition she said she has called a teleconference meeting with top Kansas legislators Wednesday afternoon to consider aid for hospitals and funding to cover costs associated with the state’s response to the coronavirus pandemic.

She scheduled the session with lawmakers only four days after successfully thwarting attempts by top Republicans to revoke an order limiting in-person worship services and other religious gatherings to 10 or fewer people. She’s also faced GOP criticism as the state Department of Labor has struggled to handle a huge surge in unemployment claims from jobless workers.

Kelly called a meeting of the Republican-dominated State Finance Council in hopes of helping hospitals and releasing state funds to the Adjutant General’s Department, which oversees the state’s response to emergencies. The council is the governor and eight top lawmakers, six of them Republicans, and it makes some financial decisions when the GOP-controlled Legislature is not in session.

Statewide, the number of confirmed cases of COVID-19, the disease caused by the virus, grew Tuesday to 1,426 cases, up 50 from Monday. The number of deaths increased by seven to 69.

Nursing homes have been particularly hard, with the Clearwater Nursing and Rehabilitation Center in Sedgwick County joining those battling outbreaks. The facility has four cases and one death, The Wichita Eagle reports.

It has a one-out-of-five star rating on the Medicare website that ranks long-term care facilities based on past inspections, citations and complaints. Facility owner Willie Novotny said the concerns raised in the Medicare inspection had nothing to do with the outbreak.

Meanwhile, a variety retail store in western Kansas’ Garden City called Tienda Variedades Candy has been linked to multiple coronavirus cases, and now public health officials are warning shoppers that they may have been exposed there last month.

Projections conducted by the University of Washington have pushed the COVID-19 peak for Kansas out to April 29. Kelly’s order requiring people to stay home except for essential business, such as grocery store visits, had been set to expire Sunday, but she signaled last week that she would likely extend it. Some communities already are moving to tamp down further on public gatherings, with Manhattan announcing it was closing its pools for the summer.

Black Kansans have been disproportionately affected, with 109 cases per 100,000 residents, compared to 31 cases per 100,000 white residents as of Tuesday. The date is incomplete, though, with missing racial data for 24% of cases.

Kelly described the trend as “alarming” in a written statement and said that it “points to, among other things, inequalities in healthcare -- some of which could have been addressed had Kansas expanded Medicaid.”

Amid the outbreak, Kansas utility regulators Tuesday extended an emergency order barring utilities from shutting off service to customers who can’t pay their bills right now, The Wichita Eagle reported. The new order prohibits shutoffs of electric and natural gas utilities under state regulation due to nonpayment of bills through May 15.

The plant with the little purple flowers that have been showing up in home lawns is called henbit. If you are not sure this is what you have, check the stems. If they are square rather than round, you have henbit. A plant that also is low growing but has round stems and tiny white flowers is chickweed.&nbsp;

&nbsp;&nbsp; Both these plants are winter annuals and start to grow in the fall. They spend the winter as small plants and so most people do not pay much attention to them until they start to flower in the spring. Trying to kill either one at this late stage with a herbicide usually is a waste of time and money. Though plants may be burned back, they will rarely be killed. So what should you do? Remember, these are winter annuals that will die as soon as the weather turns hot. &nbsp; Keep the lawn mowed until nature takes its course.

However, you can do something next fall that will help next spring. Henbit and chickweed usually germinate about mid-October. Spraying with 2,4-D, Weed-B-Gon, Weed Free Zone, Weed Out, or Trimec in late October to early November can go a long way toward eliminating these plants as they are small and relatively easy to control. Choose a day that is at least 50 degrees F.&nbsp; These herbicides will work at temperatures below 50 degrees but the weeds are killed at a slower rate.&nbsp; You may also use a preemergent herbicide for lawns in late September as long as have not recently put down grass seed.&nbsp; Spraying with the postemergence herbicides mentioned earlier will also catch dandelions which the preemergent herbicides will miss.

&nbsp;&nbsp; Spot treating will probably be needed in the spring (March) whichever method of control you use but is more likely with the use of preemergent herbicides. Use Weed Free Zone, Speed Zone, Weed Out, Weed-B-Gon, Trimec, or one of the special henbit herbicides early in the spring before they have put on much growth.

FICK: Henbit and chickweed in lawns   

RUSH COUNTY –&nbsp;The Kansas Bureau of Investigation received notice from the Rush County Attorney that no charges will be filed against the Ness County sheriff’s deputy who <a href="https://hayspost.com/posts/5e2745b87d7daa72b30eb685">shot and injured a suspect in a January officer-involved shooting on Highway 96 in Rush County.</a>

According to Rues, the officer involved shooting was reviewed pursuant to the statutory authority of K.S.A. 20-5222 use of force; defense of person; no duty to retreat and Kansas case law. Pursuant to K.S.A. 21-5222 (b) a person is justified in the use of deadly force if such person&nbsp;reasonably believes&nbsp;that&nbsp;such&nbsp;use of deadly force&nbsp;is&nbsp;necessary&nbsp;to&nbsp;prevent imminent death or&nbsp;great&nbsp;bodily harm to&nbsp;such&nbsp;person or a third&nbsp;person. The key words being reasonably believes. This is reinforced by case law in State v. McCullough, 293 Kan. 970, 975, 270 P. 3d 1142 (2012) and clarified in Graham v.&nbsp;Connor,&nbsp;490 U.S. 386 (1989).&nbsp;

Rues summarized his decision saying, “Considering the provided&nbsp;legal&nbsp;standard,&nbsp;the following facts are legally pertinent. The deputy&nbsp;was&nbsp;in pursuit of Timothy 'Timmy' W. Kellebrew, who was&nbsp;suspected&nbsp;of committing an aggravated robbery with a firearm of a Dollar General&nbsp;store.&nbsp;Kellebrew's&nbsp;actions&nbsp;required law enforcement to engage in a dangerous&nbsp;high-speed&nbsp;pursuit of him. This&nbsp;not&nbsp;only&nbsp;endangered&nbsp;law&nbsp;enforcement but also other civilians&nbsp;using the&nbsp;highway.&nbsp;Kellebrew&nbsp;also&nbsp;wielded the firearm in attempting to gain access to the vehicle that he had forced off the&nbsp;highway. It is at that instance that the deputy fired his&nbsp;service&nbsp;weapon to prevent the same. The use of deadly force was justified. Therefore, no charges against the deputy will be filed.”

A suspect in a string of business burglaries in Hays was apprehended Tuesday in Russell after a tip from the community following a weeks-long search for information.

The HPD first asked for the public's assistance to identify the suspect on March 23, following a string of break-ins on March 19.

"We received multiple tips from the community," said HPD chief Don Schiebler. "And we are grateful for all of them."

By using information received, he said they eliminated a number of suspects, with one tip leading to an arrest.

After obtaining a search warrant Tuesday, the HPD, with the assistance of the Russell Police Department and the Russell County Sheriff's Office, conducted a search at a home in Russell.

Robin Robert Galyardt, 67, Russell, was arrested on suspicion of three counts of burglary and two counts of attempted burglary, Scheibler said.

All five alleged crimes occurred in Hays.

Galyardt has four previous convictions for burglary as well as one conviction for aggravated burglary and possession of burglary tools dating back to 1990, according to Kansas Department of Corrections records.

"Detective J.B. Burkholder took the lead on this and he and the entire investigation unit worked really hard to try to get this suspect identified," Scheibler said. "I appreciate their hard work and also appreciate the tips that came in from the community."

All suspects are presumed innocent until proven guilty in a court of law.
