DECATUR COUNTY —One person was injured in an accident just before 3p.m. Sunday in Decatur County.

The Kansas Highway Patrol reported a 2012 Chevy Traverse driven by Amber N. Carfield, 33, Oberlin, was northbound on U.S. 83 seven miles south of U.S. 36.

The driver lost control of the SUV. The vehicle entered the east ditch. traveled in the ditch along L Lane, and rolled onto its top.

EMS transported Carfield to the Decatur County Hospital. She was properly restrained, according to the KHP.

Engage, Inspire, and Celebrate: Inaugural Winner of the Russell Community Impact Award Announced

The first of two bridge projects along K-9 in Phillips County is expected to start the week of March 4.

The Kansas Department of Transportation project will replace the bridge over Wolf Creek, located approximately 3.5 miles east of Logan. A shoofly detour will be constructed first that will carry traffic around the work zone while the new structure is being built.

KDOT plans to shift traffic on to the detour in mid-April. Work is expected to be complete in November, conditions permitting.

The second project is located 0.4 mile east of Logan and is scheduled to begin in June.

The Kansas Highway Patrol reported a 2018 International semi driven by&nbsp; Kadyn R.&nbsp;Hernandez, 22, Kennesaw, Georgia was westbound in the 600 Block of West Willow Avenue in Colby.

The semi struck the back passenger side of a 2016 Lincoln Navigator driven by Lacy J Ralston, 39, Colby, who was exiting from Taco Johns onto Willow Avenue and did not yield to oncoming traffic.

&nbsp;EMS transported Ralston, who is pregnant, to Citizens Medical Center. Hernandez was not injured. Ralston was not wearing a seat belt, according to the KHP.

TOPEKA&nbsp;– The Kansas Office of Broadband Development (KOBD) has been awarded nearly $1 million from the U.S. Department of Agriculture’s Rural Utilities Service through its new Broadband Technical Assistance (BTA) grant program. The $997,000 grant will fund pre-engineering design studies in six rural Kansas counties to help reduce costs and identify avoidable barriers as broadband is deployed there.

“Access to broadband is crucial for the economic growth of our rural communities,”&nbsp;Governor Laura Kelly said. “This initiative demonstrates my administration’s commitment to expanding quality, affordable high-speed internet and creating opportunities for Kansans in every county of the state.”

The high cost of bringing broadband infrastructure to rural Kansas has long been a challenge to internet service providers. The distances, coupled with unique topographical challenges such as bedrock formations, have made broadband deployment economically unfeasible despite existing state and federal funding initiatives.

“KOBD’s plan aligns with our broader vision for economic development,”&nbsp;Lieutenant Governor and Secretary of Commerce David Toland said. “By identifying and removing barriers, we can continue to empower rural communities to utilize resources for sustainable solutions.”

The BTA grant will produce plans to address broadband deployment hurdles in six selected counties: Gove, Kearny, Kiowa, Linn, Rawlins and Wilson. These counties, situated far from urban centers, face significant challenges in achieving reliable and affordable broadband services. To develop a roadmap for future broadband deployment, the studies will analyze population density, topography, and various census data.

KOBD, along with Rural Utility Service staff, will then partner with local governments to understand and analyze the results of these studies, develop mitigation strategies, and identify next steps for effective broadband deployment, including use of federal and state funding sources.

“High-speed internet and reliable infrastructure will make it possible for rural Kansans to live and work in the communities they love,”&nbsp;USDA Kansas State Director for Rural Development Christy Davis said.

Kansas awarded nearly $1 million from USDA to assist with rural digital divide

A group of community members gathered in Hays Friday for a HaysMed health assessment.

As a nonprofit, HaysMed is required to conduct a community health assessment every three years. Although the assessment focuses on the overall community, not all the aspects addressed in the assessment are under the purview of HaysMed.

Almost two-thirds of 32 participants said mental health care is one of the top needs in the community. Mental health also topped the list for residents responding to a community health needs assessment survey.

Also among the top needs were medical care for the uninsured and underinsured, more medical specialists and a memory care unit.

Increasing awareness of community services and addressing domestic violence and sexual assault tied to round out the top six most important health needs for the community as identified by the group.

Other unmet needs making a list included social engagement for youth, affordable and available child care, dentist and periodontist, access to transportation, senior housing, and safe and affordable housing.

Data presented at the town hall indicated Hays has about the same rate of depression diagnosis as the rest of northwest Kansas — 19.9 percent of residents ever being diagnosed with depression.

The suicide rate was lower than the state average of 18.7 per 100,000 people and 21.6 per 100,000 people for northwest Kansas.

Twenty percent of the survey respondents indicated that Ellis County's community readiness to deal with mental health is poor or very poor. Similar percentages said they also thought the community readiness to deal with substance abuse and suicide prevention was also poor or very poor, which facilitator Vince Vandehaar said were concerning trends.

The survey respondents said they thought Ellis County had a similar lack of readiness to address violence and abuse prevention.

According to the data presented at the town hall, 12.3 percent of Ellis County residents lived in poverty as of 2022. That is a slight decline from 13.1 percent in 2021 when the last health assessment was completed. It is higher than the averages for the state and northwest Kansas, which are both 11 percent.

However, the number of uninsured residents in Ellis County has risen since 2021 with 8.8 percent of Ellis County residents uninsured in 2021 and 9.6 percent in 2024. However, this is still less than the state and northwest Kansas average of 10 percent.

HaysMed has continued to give back to the community through charity care and bad debt write-offs. In 2023, HaysMed had $5.8 million in charity care and wrote off almost $2.7 million in bad debt.

About 69 adults (20-64) per 1,000 (about 7 percent) in Ellis County   are receiving Kansas medical assistance. That is less than almost 100 per 1,000 residents (10 percent), which is the state average.

Although the group expressed a need for more specialists Friday, data presented indicated most Ellis County residents use HaysMed for their medical care. • 77.4 percent of inpatients used HaysMed • 86.4 percent of outpatients used HaysMed • 93.5 percent of emergency patients used HaysMed

Data indicated Ellis County residents have average to good access to preventive health measures. • Almost 90 percent had access to exercise opportunities • 52 percent received their annual mammography screening, which is 10 percent higher than the state average • 74 percent received their annual checkups, which was about the regional average • 67 percent had an annual checkup with their dentist, which is 4 percent higher than the state average

Overall, 61 percent of health assessment survey respondents said they rated health care delivery in their community as good or very good. Another 30 percent said it was average.

HaysMed town hall addresses what's working, what's not in Ellis County health care

Funding Will Bring High-Speed Internet, Clean Drinking Water and Modern Infrastructure to Rural Kansans

TOPEKA–U.S. Department of Agriculture (USDA) Kansas State Director for Rural Development Christy Davis today announced that USDA is funding nine Kansas infrastructure projects. This $22.4 million investment will provide reliable high-speed internet access, clean water, and sanitary wastewater systems for rural communities.

“High-speed internet and reliable infrastructure make it possible for rural Kansans to live and work in the communities they love,” Davis said.

High-Speed Internet Under the Broadband Technical Assistance Program, USDA is providing $997,000 to help Kansas Department of Commerce deliver technical assistance to expand high-speed internet access for people in rural and Tribal communities. This funding will also develop and expand broadband cooperatives in rural areas.

· A $997,000 grant will help promote the expansion of high-speed internet in Rawlins, Kiowa, Gove, Kearny, Wilson and Linn counties. Kansas Department of Commerce will use funding to provide technical assistance to some of the most rural and distressed energy communities in Kansas. Specifically, the Kansas Office of Broadband Development (KOBD) will facilitate pre-engineering design and cost studies to determine broadband buildout costs and current barriers to deployment. KOBD, with Rural Utility Service staff, will then partner with local governments to understand and analyze the results of these studies, develop mitigation strategies, and identify next steps for effective broadband deployment, including use of federal and state funding sources.

Rural Water and Wastewater Infrastructure

Through its Water and Waste Disposal Loan and Grant Program, Rural Development is also providing $21.4 million to help rural Kansas communities provide clean drinking water and sanitary wastewater systems.

· A $1,725,000 loan will help complete improvements to the sewer collection system for the City of Wakefield. The project will upgrade the wastewater treatment system and construct a non-discharging lagoon with irrigation.

· A $2,284,000 loan and a $921,000 grant will help complete rehabilitation work on the water and wastewater systems for the City of Burden. · A $1,205,000 loan and a $1,127,000 grant will help construct a new non-discharging lagoon facility for the City of Hanston. Rural Development previously awarded a $20,177 Special Evaluation Assistance for Rural Communities and Households Grant and the Kansas Department of Health and Environment provided $400,000 in Principle Forgiveness on this project.

· A $2,925,000 loan will help refurbish the wastewater collection system for the City of Valley Falls. The project will include pipe repairs, pipe replacement, heavy pipe cleaning and manhole repairs and replacement.

· A $35,000 loan and a $1,126,000 grant will help complete the rehabilitation of the City of Vermillion's water distribution system. The project will install approximately 6,500 feet of distribution piping, including new fire hydrants, valves and other equipment.

· A $5,819,000 loan will help construct a new 300,000-gallon elevated storage tank and a new ion exchange nitrate removal treatment plant for the City of Belle Plaine. The project will also replace the water distribution system, the telemetry systems and automated meter reading system.

· A $1,772,000 loan will help complete repairs to the Fall River dam, upgrade the Little Bear elevated storage tank, expand the distribution system and provide sewer extension to the hospital in Neodesha. The city received prior funding from Rural Development in the form of a grant and two loans as follows: a grant of $492,000 awarded in 2021, two loans of $998,000 and $7,000,000 awarded in 2018.

· A $795,000 loan and a $1,691,000 grant will help Little Blue Natural Resources District develop a new water source for the rural water system. The project will consist of developing two municipal wells, purchasing a generator, installing 16.2 miles of transmission main, a booster pump station, installing a 50,000-gallon ground level storage tank, installing 400 meters, software, and a control system.

This $22.4 million investment will provide reliable high-speed internet access, clean water, and sanitary wastewater systems for rural communities.“High-speed internet and reliable infrastructure make it possible for rural Kansans to live and work in the communities they love,” Davis said.High-Speed Internet Under the Broadband Technical Assistance Program, USDA is providing $997,000 to help Kansas Department of Commerce deliver technical assistance to expand high-speed internet access for people in rural and Tribal communities. This funding will also develop and expand broadband cooperatives in rural areas.The details of this project are:· A $997,000 grant will help promote the expansion of high-speed internet in Rawlins, Kiowa, Gove, Kearny, Wilson and Linn counties. Kansas Department of Commerce will use funding to provide technical assistance to some of the most rural and distressed energy communities in Kansas. Specifically, the Kansas Office of Broadband Development (KOBD) will facilitate pre-engineering design and cost studies to determine broadband buildout costs and current barriers to deployment. KOBD, with Rural Utility Service staff, will then partner with local governments to understand and analyze the results of these studies, develop mitigation strategies, and identify next steps for effective broadband deployment, including use of federal and state funding sources.Rural Water and Wastewater InfrastructureThrough its Water and Waste Disposal Loan and Grant Program, Rural Development is also providing $21.4 million to help rural Kansas communities provide clean drinking water and sanitary wastewater systems.The details of these projects are:· A $1,725,000 loan will help complete improvements to the sewer collection system for the City of Wakefield. Northwest Kansas residents earn spots on University of Kansas honor roll

What does the law actually say when it comes to a young person’s right to privately decide what gender they identify with, and to their parents’ right to engage in or even direct the decisions they make? As usual, the law is a lot more ambiguous and contentious than many might wish.

Recently Dion Lefler--arguably the best-known journalist in Wichita, Kansas’s largest city--&nbsp;<a href="https://www.kansas.com/opinion/opn-columns-blogs/dion-lefler/article285283457.html">picked a fight</a>&nbsp;with Kansas’s Attorney General Kris Kobach--arguably the best-known politician in the whole state--over essentially this issue, and Kobach&nbsp;<a href="https://www.kansas.com/opinion/guest-commentary/article285546377.html">picked back</a>. Let’s focus on the heart of their argument, and see what we can clarify.

Last December Kobach sent&nbsp;<a href="https://cdn.fbsbx.com/v/t59.2708-21/426996237_1373611433299120_8275965584595727633_n.pdf/letters-to-schools-and-kasb.pdf?_nc_cat=104&amp;ccb=1-7&amp;_nc_sid=2b0e22&amp;_nc_ohc=xrVs78-ryEoAX9NYUap&amp;_nc_ht=cdn.fbsbx.com&amp;oh=03_AdSQqmYjEBOX6sFDCfW8JVMCQVBKkFVaJmp7MiME4YuTxg&amp;oe=65D3CE38&amp;dl=1">a letter</a>&nbsp;to six Kansas school districts regarding policies which allegedly require teachers of students who identify as trans or non-binary to avoid revealing information about the students’ self-identification to their parents unless the students give consent. In his letter, Kobach cited multiple Supreme Court cases defending “parents' right to direct the care, upbringing, and education of their children,” and implied that he would treat these policies as a violation of those constitutional rights.

With the news of this letter became public, Lefler called Kobach a “bully,” and said that seeking to intimidate school districts into abandoning these policies was “endanger[ing] transgender kids without legal grounds.” His claim about the absence of any specific legal ground is correct: while a bill was proposed in the Kansas legislature last year that would have extended parental rights in this exact context, it died in committee, and so these policies do not violate any current state law.

But Kobach responded that his job was to “protect the constitutional rights of Kansans in court, regardless of whether the Kansas Legislature has passed any statute on the subject,” and this is also correct: Kansas officials swear to uphold the U.S. Constitution as well as our state one, after all. So the real question is: what is the merit to Kobach’s conviction that the U.S. Constitution, as presumably reflected in the multiple Supreme Court cases which he cites, is on his side?

It is true that federal cases&nbsp;<a href="https://supreme.justia.com/cases/federal/us/262/390/">stretching back a century</a>&nbsp;establish that parents have a fundamental right to make decisions about the education of their children. However, none of them are directly applicable to the present debate over names, pronouns, and privacy. Moreover,&nbsp;<a href="https://casetext.com/case/parker-v-hurley-2">other cases insist</a>&nbsp;that parents have to demonstrate a harm which “strike[s] at the heart of parental decision-making” before public schools, which are required by federal law to consider the needs of all students equally, can be forced to change policies which had been legally decided upon.

In his response to Lefler, Kobach did mention one Kansas case that was directly on point—<a href="https://casetext.com/case/ricard-v-usd-475-geary-cnty">a 2022 federal district court decision</a>&nbsp;which forbade Geary County’s USD 475 from enforcing a policy to not share private information regarding a student’s gender identification because it violated how the student’s teacher understood her religious faith. Why didn’t he mention that case in his original letter? Likely because he knows there are other federal district court decisions (like Massachusetts’s&nbsp;<a href="https://www.bloomberglaw.com/public/desktop/document/FooteetalvLudlowSchoolCommitteeetalDocketNo322cv30041DMassApr1220?doc_id=X3T38OEAVQ98HVAGVI971HP48HS">Foote v. Town of Ludlow</a>) which have taken up nearly identical cases and found for the school district instead. In the end, the Supreme Court will have to decide.

In short, what is being fought about is unsettled law. I think there’s a good chance the Supreme Court will end up agreeing with Kobach’s particular application of these constitutional precedents—but for now, his letter reflects cultural assumptions rather than controlling principles. Round one, therefore, goes to Lefler.

Let’s focus on the heart of their argument, and see what we can clarify.Last December Kobach sent&nbsp;<a href="https://cdn.fbsbx.com/v/t59.2708-21/426996237_1373611433299120_8275965584595727633_n.pdf/letters-to-schools-and-kasb.pdf?_nc_cat=104&amp;ccb=1-7&amp;_nc_sid=2b0e22&amp;_nc_ohc=xrVs78-ryEoAX9NYUap&amp;_nc_ht=cdn.fbsbx.com&amp;oh=03_AdSQqmYjEBOX6sFDCfW8JVMCQVBKkFVaJmp7MiME4YuTxg&amp;oe=65D3CE38&amp;dl=1">a letter</a>&nbsp;to six Kansas school districts regarding policies which allegedly require teachers of students who identify as trans or non-binary to avoid revealing information about the students’ self-identification to their parents unless the students give consent. In his letter, Kobach cited multiple Supreme Court cases defending “parents' right to direct the care, upbringing, and education of their children,” and implied that he would treat these policies as a violation of those constitutional rights.With the news of this letter became public, Lefler called Kobach a “bully,” and said that seeking to intimidate school districts into abandoning these policies was “endanger[ing] transgender kids without legal grounds.” His claim about the absence of any specific legal ground is correct: while a bill was proposed in the Kansas legislature last year that would have extended parental rights in this exact context, it died in committee, and so these policies do not violate any current state law.But Kobach responded that his job was to “protect the constitutional rights of Kansans in court, regardless of whether the Kansas Legislature has passed any statute on the subject,” and this is also correct: Kansas officials swear to uphold the U.S. Constitution as well as our state one, after all. So the real question is: what is the merit to Kobach’s conviction that the U.S. Constitution, as presumably reflected in the multiple Supreme Court cases which he cites, is on his side?It is true that federal cases&nbsp;<a href="https://supreme.justia.com/cases/federal/us/262/390/">stretching back a century</a>&nbsp;establish that parents have a fundamental right to make decisions about the education of their children. However, none of them are directly applicable to the present debate over names, pronouns, and privacy. Moreover,&nbsp;<a href="https://casetext.com/case/parker-v-hurley-2">other cases insist</a>&nbsp;that parents have to demonstrate a harm which “strike[s] at the heart of parental decision-making” before public schools, which are required by federal law to consider the needs of all students equally, can be forced to change policies which had been legally decided upon.In his response to Lefler, Kobach did mention one Kansas case that was directly on point—<a href="https://casetext.com/case/ricard-v-usd-475-geary-cnty">a 2022 federal district court decision</a>&nbsp;which forbade Geary County’s USD 475 from enforcing a policy to not share private information regarding a student’s gender identification because it violated how the student’s teacher understood her religious faith. Why didn’t he mention that case in his original letter? Likely because he knows there are other federal district court decisions (like Massachusetts’s&nbsp;<a href="https://www.bloomberglaw.com/public/desktop/document/FooteetalvLudlowSchoolCommitteeetalDocketNo322cv30041DMassApr1220?doc_id=X3T38OEAVQ98HVAGVI971HP48HS">Foote v. Town of Ludlow</a>) which have taken up nearly identical cases and found for the school district instead. In the end, the Supreme Court will have to decide.In short, what is being fought about is unsettled law. I think there’s a good chance the Supreme Court will end up agreeing with Kobach’s particular application of these constitutional precedents—but for now, his letter reflects cultural assumptions rather than controlling principles. Man faces multiple charges after hostages taken in NW Kansas

Three agreements that will enhance development efforts in Hays were approved by the Hays City Commission at its meeting Thursday night.

A public hearing for proposed expansion of the Neighborhood Revitalization Plan in Hays drew no public comments during Thursday's Hays City Commission meeting.&nbsp;

Commissioners approved a resolution to amend the district's area to include housing and commercial structures built in 1980 and earlier to incentivize improvements in older areas of town, including north Vine Street.&nbsp;

Guidelines call for a minimum residential property investment of $25,000 that is then eligible for property tax rebates of 65 percent for 10 years. Commercial properties require a minimum investment of $50,000, which is eligible for rebates of 95 percent for 10 years. Rebate amounts are based on the incremental increase in property values resulting from the project.

Also approved was an agreement with Werth Development Group, Hays, developer of WDG Addition, for the construction of public water and sewer mains along Hall Street to the WDG Addition north of Interstate 70.&nbsp;&nbsp;

The city, per its development policy, will pay $359,260 toward oversizing the water and sewer lines to 12 inches from 8 inches for future development.&nbsp;

The development policy also allows for a developer to recoup a proportionate share of the original construction costs from any future user connecting to or benefitting from the water and sewer improvements made by the developer for a period of 10 years after improvements are made. 

Commissioners agreed to the Werth Development Group's request for an extended period of 18 years.&nbsp; "We've all agreed that growth is what we want," said Commissioner Alaina Cunningham.

"If any development to the north or east of there is going to occur without this development, they're going to incur all of the cost.&nbsp; So, it's hard for me to think that the person that puts in the first cost should not have a chance to recoup some of that," she said. "I'm having a hard time finding the true con to 18 years."

The addition is subdivided into two lots. The north lot, comprised of 25 acres, is to be the location of the National Guard Readiness Center. There is no current development plan for the south lot.&nbsp;&nbsp;

An engineering services agreement for The Grove housing development north of HaysMed was also approved with Driggs Design Group, Hays, for $152,800.&nbsp;The project comprises 2,600 feet of water line, sanitary sewer and street improvements.

Grow Hays is developing the mixed housing and community center in The Grove Addition. Construction is expected to begin this summer. It will be built in one phase as a planned development.

Three proposals for Essential Air Service at the Hays Regional Airport were submitted to the U.S. Department of Transportation.

 "They basically subsidize the flights to the actual air carrier for smaller, rural communities like Hays that wouldn't necessarily have the service if the program didn't exist," said Jamie Salter, airport director.

The current contract with SkyWest expires July 31.&nbsp;

Salter recommended the city continue its relationship with the SkyWest, which has been in Hays since 2014. 

"They've provided safe, reliable jet service," she said.

The contract would be for another three years.&nbsp;

City commissioners signed a letter of support for the SkyWest bid&nbsp; for continued 14 roundtrip flights per week to Denver and Chicago.

Water Conservation Specialist Holly Dickman provided a review of the city's 2023 water conservation programs and incentives. Turf conversion rebates from water-intensive cool-season grasses to warm-season grasses, which use less water, increased considerably. The exchange of old inefficient showerheads for new low-flow showerheads and rebates for high-efficiency toilet installation also increased from last year.

City Manager Toby Dougherty said Friday in a Morning Blend interview that even as the R9 Ranch long-term water project progresses, water conservation will always be a priority in Hays.&nbsp;
